No specific decisional criteria are provided in the subdivision code! for review of proposed modifications to approved preliminary plats. However, Federal Way City Code (FWCC) §20-127(d)(1)-(4), provides "benchmarks" for considering such requests. In addition, the proposed changes must be consistent with all conditions of the Washington State Environmental Policy Act (SEPA) and preliminary plat approval, and other applicable City codes, regulations, and provisions. Your request has been reviewed according to these parameters. As background, preliminary plat approval for the eight lot plat was granted on June 28, 2005. To date, engineering plans have not been submitted. You have requested to modify the approved preliminary plat by reducing the size of the Tract C storm detention pond and by locating two lots south of the existing house on the west side of the plat. Based on the submitted documents,' access to the lots and pond is maintained. Responses to each request are provided in the following paragraphs. 1) Reduction in size of the Storm Detention Pond — This request is consistent with the above -noted code benchmarks for allowing minor modifications to preliminary plats, and can be approved administratively. As noted in Public Works technical comments following review of the October 18, 2006 Drainage Tract Analysis prepared by D.M.P, Inc.', vertical retaining walls may not exceed eight feet in height for ponds that will be dedicated to the City for future maintenance, and retaining walls will be reviewed by the City's structural engineering consultant at the expense of the applicant. 2) Relocation of Lots 1, 2, and 3 — This request is also consistent with the above -noted code benchmarks for allowing minor modifications to approved preliminary plats, and can be Federal Way Cily Code (FWCC) Chapter 20, "Subdivisions" "Resubmitted Preliminary plat sheet `revised' date April 10, 2007. This plan appears to be based on preliminary plat sheet prepared by DMP Engineers. However, final lot sizes and configuration must meet the applicable design and dimensional standards for lots in the RS 7.2 zoning district. In summary, the City can administratively approve the requested reduction of the size of the storm drainage pond, as well as the request to relocate lots 1, 2 and 3, provided that design and dimensional standards of the FWCC are met. Your plat notice was received late because our renter forgot to forward the notice to us. We just received it two days ago. We have several questions regarding the proposed Noyedlayout dated 10-01-03: A. We have been getting several inches of water in our crawl space under the house during the winter rainy season. Question: Who will be responsible for maintaining proper drainage out of the pond and wetland buffer zone? i.e. clearing pond outlet area and drainage piping to keep pond level at 288.7 ft elevation. (This elevation number was listed on Mirror Wood Formal Drainage Plans I reviewed in your office about a year ago. B. What tree removal/surface grading will be done in the wetland buffer areas? Several large trees are currently on the surveyed property lines. Our back fence is presently located several feet to the west of this line as was the neighbor's back fence. C. A 5 ft wide gravel trail, trail sign and picnic tables are shown. Several fence type lines are drawn around the wetland buffer areas and adjacent to the proposed cul-de-sac. Question: Will the general public use this trail and picnic tables? D. Tract "A" wetland to be dedicated to the public. Question: What use or retrictions will be enforced on the pond and wetland buffer areas? What liability, if any, will we be subjected to in case of accidents, drowning, etc.? I have retained my original consultant to reevaluate the modification request and to answer the City's comments. I believe the enclosed response has fully addressed all review comments. DMP Engineering apparently was unable to make the StormFilter design work, but has met my objective by optimizing the area of the storm detention and treatment facility by the use of limited vertical walls. I do not entirely understand why two professional engineering firms arrived at very different storm detention volumes. But the latest design has approximately three times the volume as the previous one. If the larger volume is an over -design, I would be most interested in knowing. Unlike the original modification request, I do not wish to make any changes to the east side of the street. To keep the total number of lots the same as the approved preliminary plat, lots 1 and 2 would be merged into one lot; and the smaller storm pond (tract C) would allow for two lots south of the existing house, consistent with the original modification request. By eliminating a separate lot to the north (lot 1) of my existing house, new construction to the north would be precluded, thus enhancing the transition between sensitive area buffer and future development. A change I would hope the City would view as an improvement. The required volume is now consistent with our previous finding. 2_ In the previously mentioned Preliminary Modified T.LR_, the correct assumption of 4,000 sq K per lot was used We have attached a copy of our analysis with the correct assumption. 3. We believe our previous assumptions in the Preliminary Modified T.I.R. were correct. The assumptions used by Baseline were replaced with our original assumptions. 4. We were originally proposing to use a stonnwater wetland (See page 21 of the Preliminary Modified T.LR_), which would have satisfied the requirements of the Resource Stream Protection Menu. We are again proposing the stormwater wetland 5. While it is true that in some cases a Stormfilter vault may .reduce the size of the water quality facility, in this case, a Stormfilter vault does not affect the required Tract size. Furthermore, a pre -settling device may even require a bigger Tract size. Baseline, in their analysis, did not consider the elevation of the existing drainage facilities where the Stormf lter will have to be connected, They merely lowered the bottom ofthe pond to show that additional volume can be provided, and that the Tract can be reduced in size. By lowering the bottom of the pond significantly, the proposed pond will have no way of draining without replacing an extremely long length of existing downstream facilities. The water quality portion of the facility does not determine the size of the tract It is the depth of the existing facilities and the required detention requirement that detenmines the size of the tract, therefore, the use of a stormwater wetland will be the ideal choice for this project. We are therefore eliminating the Stormfilter, which will require additional expense and maintenance costs for the City. 6. We are providing scaled details of the proposed detmuonlwater quality facility for your review and approval. The difference between our new proposal and our original proposal, is that walls will be provided around 75% of the pond perimeter. The depth of the pond was also slightly increased It is our experience that ponds are not always built exactly as planed, and that some volume may be lost during construction_ Additional volume in the proposed pond will therefore give some allowance during construction. In addition to the above response to your review items, please be informed that providing walls alone would not have allowed the creation of an extra lot between the existing house and the pond tract We were previously limited by our client's requirement for a 35-foot setback along the south side of the existing house, which even with walls around the pond �� would not have allowed the extra lot. Now, with the reduced setback requirement (See Baseline's proposal also), and the proposed pond walls, an extra lot may be provided. The pond, as shown on the preliminary clearing and grading plan, has available storage of 11,205 sq.fL In page 16, the stormwater wetland surface area required is equal to 594.75 sq.ft. in the first cell and 1,784.25 sqA in the second cell. The available surface area is 1,451 sq.ft. in the first cell and 3,078 sq.ft. in the second cell.
