Upon receipt of the application, city staff reviewed the submittal packet for completeness based on the final plat submittal requirements For subdivisions tinder Fecleral TVay Revisecl Cade (FWRC) l 8.40.020 "Final Plat." INCOMPLETE APPLICATION On July, 6, 2016, the final plat application was deemed incomplete based on the two bullet items below. Substantial Completion of Construction — The plat infrastructure is not yet substantially complete. The project infrastructure must be substantially complete prior to moving the plat forward for City Council review. Contact Engineering Plans Reviewer Kevin Peterson at 253- 835-2734, or keyill- etersonae ciivoffederalway.corn regarding this comment. 0 Lakehaven Utility Districl Substatiticrl Completion — The applicant has not completed the necessary water and/or sewer facility construction; nor submitted to Lakehaven an application for substantial completion of such construction as necessary to be able to determine the applicant's requirements for subdivision acceptance. The applicant will need to either complete the necessary water and/or- sewer facility construction, or submit application for substantial completion of such facilities to Lakehaven. TECHNICAL COMMENTS The following comments represent the city's initial review of the final plat submittal. Please provide the following information as soon as possible in order to further process the final plat application. Please revise the final plat documents in accordance with the following comments and resubmit five sets of paper copies of the revised final plat drawings and four copies of any supporting documents along with the enclosed resubmittal form. l • Lots 8, 9 and 10; are all undersized and must be a minimum lot size of 7,200 square feet in order to meet the underlying zoning. The northern portion of the property is zoned RS 5.0 and the southern part of the site is zoned RS 7.2. The Director of Parks, Recreation, and C Tracts A, B and F will qualify as open space per FWRC 18.55.060 and represent approximately two percent of the required minimum 15 percent open space (2,705 square feet). The two percent figure is approximate, as I was unable to find the precise total parcel size oil the plat snap. A final precise lot size and open space calculation will need to be submitted. Therefore, the remaining balance of approximately 13 percent of the site must be paid as Fee - in -lieu of on -site open space. Provide the 2016 tax assessor staternent, and the fee -in -lieu amount will be approximately 13 percent of the assessed land value. This amount must be paid to the City prior to final plat approval. Per FWRC 19.100.070(1) (b), the applicant leas the option of deferring the open space fee -in -lieu payment. Open space 'fee -in -lieu inay be deferred, but shall be paid no later than the closing of sale of each individual house or five years from deferment of the fee, whichever is earlier. Covenants prepared by the city shall be recorded at the applicant's expense on each lot at the time of plat recording to enforce payment of deferred fees. The 'fee shall be calculated at the time of plat recording and divided equally among all newly created lots. Please inform the city if the open space fee deferment option is desired, as the city will need to prepare the covenants in this case. Pursuant to the concurrency permit file no. 08-10033 i -CN, $24,723.00 must be paid to the City prior to final plat approval. No deferral of this fee is allowed. The fee maybe slightly less than the $24,723.00 and we will let you know the final fee. 5. School impact fees are required to be paid at the time of individual building permit issuance. City staff anticipates that a fee deferral system for school impact fees will be adopted by the City Council in the next couple of weeks. If this fee deferral program is adopted, then upon developer request, deferral of these school impact fees may be available to the point of final building permit inspection or 180 days from the date of pen -nit issuance, whichever is sooner. 6. The Public Works Department will inspect the street trees and landscaping in and around the stormwater drainage pond. Contact Public Works Inspector to conduct this inspection. 8. Per FWRC 18.40.020(2) (d), identify the total site acreage and square footage on the face of the plat map. 9. If construction of a new house on the site is started before recording the plat, then the structure must be shown on the final plat map and identify actual setbacks from property lines. 10. The lot closure calculations need to be stamped and signed by a Licensed Land Surveyor. 11. Remove "Services" from CD Director Signature Block on the plat map. 12. Prior to forwarding the final plat to the City Council, please verify with King County recorder that the proposed name Norpoint Heights is available as the plat name. If this name has been previously used in King County, the County will not allow recording with this name. Upon substantial completion of the project infrastructure, and compliance with applicable FWRC requirements, the final plat application will be forwarded to the City Council's Land Use and Transportation Committee (LUTC). The LUTC will review the final plat and make a recommendation to the full City Council. The City Council will make the final decision on the plat application at a regular City Council meeting. Please be advised that staff reports to the City Council and council committees are required to be prepared approximately two weeks in advance of scheduled meetings. Therefore, once the project is determined to be substantially complete, processing and scheduling the final plat application will take a minimum of four to six weeks, in part due to the monthly LUTC meeting and bi-weekly City Council meetings.
