This office and other City staff have reviewed the environmental. checklist you submitted. We have determined that
the proposal will not have a probable significant adverse impact on the environment. As a result, an environmental
impact statement (EIS) is not required to comply with the State Environmental Policy Act (SEPA).
A 14-day comment period is required by the SEPA rules (WAC 197-11-340). A notice inviting comments will be
published in the Federal Way Mirror on August 12, 2009. At the end of the comment period, the department will
determine if the DNS should be withdrawn, modified, or issued as proposed. All final determinations may be
appealed within 14 days following the comment deadline. No licenses, permits, or approvals will be issued until
completion of the appeal period.
Our decision not to require an EIS does not mean that the license, permit, or approval you are seeking from the City
has been granted. Approval or denial of the proposal will be made by the appropriate administrative or legislative
body vested with that authority. The environmental record is considered by the decision maker(s) and conditions
will be imposed to reduce identified environmental impacts, as long as the conditions are based on adopted and
designated City policy.
After a final decision has been made on your proposal (i.e., after approval has been issued or City Council action
taken, as applicable), you may, but are not required to, publish a Notice of Action as set forth in RCW 43.21C.075.
The Notice of Action sets forth a time period after which no legal challenges regarding the proposal's compliance
with SEPA can be made. A copy of the Notice of Action form and copies of RCW 43.21 C.080 and WAC 197-11-
680 providing instructions for giving this notice are available from the Department of Community Development
Services.
The City is not responsible for publishing the Notice of Action. However, the City is responsible for giving a notice
(to parties ofrecord to which there are none) stating the date for commencing a judicial appeal (including the SEPA
portion of that appeal) if your proposal is one for which the City's action on it has a specified time period within
which any court appeals must be made.

ENVIRONMENTAL CHECKLIST
PURPOSE OF CHECKLIST
The State Environmental Policy Act (SEPA), Revised Code of Washington (RCW) Chapter 43.21C,
requires all governmental agencies to consider the environmental impacts of a proposal before making
decisions. An environmental impact statement (EIS) must be prepared for all proposals with probable
significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide
information to help you and the agency identify impacts from your proposal (and to reduce or avoid
impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS
This environmental checklist asks you to describe some basic information about our proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of your proposal
are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise
information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you
should be able to answer the questions from your own observations or project plans without the need to
hire experts. If you do not know the answer, or if a question does not apply to your proposal, write "do not
know" or "does not apply." Complete answers to questions now may avoid unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark designations.
Answer these questions if you can. If you have problems, the governmental agencies can assist you.
The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of
time or on different parcels of land. Attach any additional information that will help describe your proposal
or its environmental effects. The agency to which you submit this checklist may ask you to explain your
answers or provide additional information reasonably related to determining if there may be significant
adverse impact.

11. Give brief, complete description of your proposal, including the proposed uses and the size of the
project and site. There are several questions later in this checklist that ask you to describe certain
aspects of your proposal. You do not need to repeat those answers on this page.
The project is subdividing 3.05 acres (after BLA is finalized with part of the property to the
north) into 14 single family residential lots, constructing about 500 feet of residential roadway
along with a cul-de-sac. Access will be off Norpoint Way within the City of Tacoma. A
pedestrian pathway will be built from the end of the new road to 25th Ave. SW. Sewer and
water will be installed to and though the site. There will be an on -site stormwater quality and
quantity facility discharging to the City of Tacoma.
12. Location of the proposal. Give sufficient information for a person to understand the precise location of
your proposed project, including a street address, if any, and section, township, and range, if known.
If a proposal would occur over a range of area, provide the range or boundaries of the site(s). Provide
a legal description, site plan, vicinity map, and topographic map, if reasonably available. While you
should submit any plans required by the agency, you are not required to duplicate maps or detailed
plans submitted with any permit applications related to this checklist.
This project is located just off the new Norpoint Way NE built in northeast Tacoma a
couple of years ago, at the curve to the west. It's in Sec. 25, T.21 N.,R3 E. WM.
There is no address this parcel, but the address next door is 35210 27th Ave. SW Federal Way,
98023. Parcel number is 252103-9048. This parcel is currently in a BLA land use process at
Federal Way with parcel 252103-9026.
B. ENVIRONMENTAL ELEMENTS
1. EARTH
a. General description of the site (circle one): flat, rolling, hilly, steep slopes, mountainous, other.
The site generally has between 0 and 14% grades over the site, sloping from east to west.
b. What is the steepest slope on the site (approximate percent slope)?
Approximetly 14% slope is the steepest on the site.
c. What general types of soils are found on the site (for example, clay, sand, gravel, peat, mulch)? If
you know the classification of agricultural soils, specify them and note any prime farmland.
The Pierce County Soils Map indicates the on -site soils are Alderwood gravelly sandy loam.
These soils are moderately well drained soils, classified as class "C" soils.

d. Are there surface indications or history of unstable soils in the immediate vicinity? If so, describe.
No signs of unstable soils in this area.
e. Describe the purpose, type, and approximate quantities of any filling or grading proposed.
Indicate source of fill.
The preliminary estimated quantity of grading for the storm water pond and roadway
is 4600 c.y. of cut and about 50 c.y. of fill.
Most imported materials will be for the construction of the roadway. The materials will come
from local gravel pits and asphalt plants.
f. Could erosion occur as a result of clearing, construction, or use? If so, generally describe.
Erosion can occur with clearing and grading of the site.
Erosion control will be developed using the City of Federal and KCSWDM guidelines
during the final design phase of the project.
g. About what percent of the site will be covered with impervious surfaces after project construction
(for example, asphalt or buildings)?
The overall site has about 3.05 acres. Of this, about 0.63 acres will be covered with a
roadway, and about 1.29 ac. will be covered with buildings and driveways (4,000 sf x 14 lots)
for a total of about 1.91 acres or 63% of the site could be covered with impervious surface.
h. Proposed measures to reduce or control erosion, or other impacts to the earth, if any.
Follow the erosion control guidelines from Federal Way and KCSWDM.
2. AIR
a. What types of emissions to the air would result from the proposal (i.e., dust, automobile, odors,
industrial wood smoke) during construction and when the project is completed? If any, generally
describe and give approximate quantities if known.
During construction, some dust and equipment emissions would be produced. After
construction was finished, only automotive emissions would be produced.
b. Are there any off -site sources of emissions or odor that may affect your proposal? If so, generally
describe.

1) Is there any surface water body on or in the immediate vicinity of the site (including year-
round and seasonal streams, saltwater, lakes, ponds, wetlands)? If yes, describe type and
provide names. If appropriate, state what stream or river it flows into.
There is no water bodies on or around this site.
2) Will the project require any work over, in, or adjacent to (within 200 feet) the described
waters? If yes, please describe and attach available plans.
No
3) Estimate the amount of fill and dredge material that would be placed in or removed from
surface water or wetlands and indicate the area of the site that would be affected. Indicate the
source of fill material.
None are proposed.
4) Will the proposal require surface water withdrawals or diversions? Give general description,
purpose, and approximate quantities if known.
No surface water withdrawals or diversions are proposed.
5) Does the proposal lie within a 100-year floodplain? If so, note location on the site plan.
There is no 100-year flood plains on or near this site.

6) Does the proposal involve any discharges of waste materials to surface waters? If so, describe
the type of waste and anticipated volume of discharge.
No discharge of waste materials are proposed.
b. Ground.
1) Will ground water be withdrawn, or will water be discharged to groundwater? Give general
description, purpose, and approximate quantities if known.
The proposed stormwater facilities are a surface water detention/wetpond facility which is
not proposed to infiltrate.
2) Describe waste material that will be discharged into the ground from septic tanks or other
sources, if any (for example: domestic sewage; industrial, containing the following
chemicals...; agricultural; etc.). Describe the general size of the system, the number of such
systems, the number of houses to be served (if applicable), or the number of animals or
humans the system(s) are expected to serve.
No septic systems are proposed. Sewer will go to Lakehaven Utility District
treatment plant.
c. Water Runoff (including stormwater)
1) Describe the source of runoff (including stormwater) and method of collection and disposal,
if any (include quantities, if known). Where will this water flow? Will this water flow into
other waters? If so, describe.
The only runoff is from this site. Stormwater from this project, roads and homes will flow to
an on -site detention/water quality facility. After detention and treatment, it will flow into the
City of Tacoma conveyance system starting at the project. This system goes directly to an
outlet at Commencement Bay. It appears this conveyance system was sized for this
development.
2) Could waste materials enter ground or surface waters? If so, generally describe.

The project proposes to provide a level 1 detention facility and a basic water quality facility,
(wetpond) to mitigate any increase in runoff from the site.

A landscape buffer is required along Norpoint Way and around the stormwater facilties.
Street trees are required along the new street and each new home will have some
landscaping around it.

The proposed new homes are expected to use electric and natural gas for heating, lights.

No reduced in any solar energy by adjacent properties is expected from this project. This
project is generally lower than most surrounding properties.

Any project that proposes to develope raw land could create an environmental hazard
associated with heavy equipment, construction, or the development of residential
homes.

Traffic would be the only item, but it should not be a major impact.

There will be some short term construction type noise, land clearing, grading, utility
installation, etc. Long term there should be minor traffic noise.

No mitigation for noise is proposed except to follow the City of
Federal requirements.

Pierce County Transit has route # 61 (Northeast Tacoma) which comes up Norpoint
Way NE to 29th NE and turns either east or west. This is approximatly 1,000 feet
south of this project.

Using two parking spaces per lot, there would be 14 x 2 = 28 parking spaces.

The proposal is to build a local residentail street with a cul-de-sac near the end.
This road will connect to Norpoint Way NE within the City of Tacoma. Only minor
changes to this road is expected, remove curb/gutter/sidewalk and replace with the new
roadway. This new road will be a public road.

This development, similar to most residential housing developments, will require the
development of roads, utilities and new homes, which will require the use of power, gas for cars

The project will be design, built and managed using current city, state and federal standards and

The project will eventually remove most existing plants/vegetation from the site, which will be
replaced with normal landscaping around residential homes. Any wildlife animals currently
within the project area will be disturbed. Stormwater from the site will be directed to on -site
water quantity and quality facilities which will help treat the new surface water from this
development which discharges into Commencement Bay. This water treatment will help
improve the water quality before it is discharged into the marine environment.
Proposed measures to protect or conserve plants, animals, fish, or marine life:
There are no proposals to protect or conserve plants or animals on the site and the
proposed onsite stormwater facilities will help protect fish and marine environment.
3. How would the proposal be likely to deplete energy of natural resources?
The project will likely use energy from natural resources for heating of the homes, operating
vehicles, electrical usage and similar usages normally used in residential communities, all of
which are depleting natural energy resources. Only a national commitment towards the
development of renewable energy resources will change this depletion.
Proposed measures to protect or conserve energy and natural resources:
The homes will likely have all the new high efficiency appliances and built with regulated
insulation requirements and high affect furnaces and water heaters, which all help to conserve
energy.

II. SUMMARY OF PROPOSAL
ESM Consulting Engineers has proposed a modification to the Norpoint Heights preliminary plat
project which received City Council approval on April 6, 2010 (Exhibit A). Their request is to modify
plat clearing and grading limits so that most of the site can be cleared and all residential building lots
graded in conjunction with installation of the roadway and storm pond improvements, and in advance
of building permits issued for new homes. This is a change to the clearing and grading limits that
were approved with the preliminary plat as shown on sheet PP-04, which is the "Preliminary
Clearing, Grading & Utility Plan" prepared by ESM Consulting Engineers dated August 24, 2009
(Exhibit B). That plan depicts clearing and grading next to the road and storm pond while building
Iots are generally left un-disturbed and vegetation is retained.
III. BACKGROUND
Approved sheet #PP-04 depicts site clearing with grading limits approximately twenty-five feet
behind the sidewalks, with areas of retained significant trees on future building lots.' According to
these plans, individual building lots were to retrain generally undisturbed until building permits were
issued and individual home construction begins, and there would be vegetation retained on individual
building lots following clearing and grading activities.
Following preliminary plat approval and City Council adoption of Resolution #10-580 (Exhibit Q,
the applicant submitted engineering plans for review under file #10-105147-00-EN. Sheet GR-01
"Clearing, Grading & T.E.S.C." (Exhibit D) prepared by ESM Consulting Engineers and dated
10/21/11, depicts a grading proposal that significantly exceeds the grading limits shown on sheet

#PP-04 as approved by the City Council. Sheet GR-01 shows that eight significant trees would be
retained at the rear of lots 5, 9, 10 and 11, and one significant tree retained in the buffer tract between
the plat and Norpoint Way NE. The rest of the subdivision site would be entirely cleared, and all
building lots graded along with installation of toads and storm pond_ Staff notified the applicant that
the grading proposal was not consistent with the approved preliminary plat grading plan, and advised
the applicant to revise the grading plans so as to be consistent with the approved plans, or
alternatively, request a modification to the approved preliminary plat from the City Council. In a
November 8, 2011 letter (Exhibit E), the applicant requested a codification to the approved clearing
and grading plans to allow for clearing and grading as proposed.
The proposed modification consists of replacing sheet PP-04 "Preliminary Clearing, Grading &
Utility Plan" in Exhibit A with sheet GR-01 "Clearing, Grading & T.E.S.C."
IV. ANALYSIS OF THE REQUEST
Pursuant to FWCC 20-127(d), the City Council may approve a minor modification to a preliminary
plat if (1) the change will not have the effect of increasing the residential density of the plan; (2) the
change will not result in the relocation of any access point to an exterior street from the plat; (3) the
change will not result in any loss of open space or buffering provided in the plat; and (4) the city
determines that the change will not increase any adverse impacts or undesirable effects on the project
and that the change does not significantly alter the project. Following is an analysis of the requested
modification relative to these criteria.
(1) The change will not have the effect of increasing the residential density of the plan. The
proposed modification deals only with clearing and grading limits and does not impact or change
the density approved with this plat. This criterion is met.
(2) The change will not result in the relocation of any access point to an exterior street from
tine plat. The proposed modification deals only with clearing and grading limits and will not
impact or change the access point to Norpoint Way from this plat. This criterion is met.
(3) The change will not result in any loss of open space or buffering provided in the plat. The
proposed modification does not impact the open space or buffering provided in this plat. The
original open space requirements are satisfied via a fee in lieu of payment prior to final plat
approval, and vegetative buffering that will be planted along Norpoint Way is not impacted by
the proposed modification. This criterion is met.
(4) The change will not increase any adverse impacts or undesirable effects on the project and
that the change does not significantly alter the project. The proposed modification seeks to
amend the grading plan required by FWCC 20-179(a). That provision states "All natural
vegetation shall be retained on the site to be subdivided except that which will be removed for
improvements or grading as shown on the approved engineering plans... If development is to be
phased, clearing and grading shall also be phased. A preliminary clearing and grading plan shall
be submitted as part of the preliminary plat application."
At the time the applicant submitted the approved grading plan, the expanded grading plan now
being proposed by the applicant was considered inconsistent with Staff s interpretation of a
Comprehensive Plan policy. Staff relied on the interpretation to prohibit mass clearing and
grading. However, in a subsequent preliminary plat recommendation for a different subdivision
project, the City's Hearing Examiner rejected Staffs interpretation of the Comprehensive Plan

policy. The Hearing Examiner found that the Comprehensive Plan policy was vague and Staffs
interpretation was in conflict with recent case law. Furthermore, the Hearing Examiner found
that the Comprehensive Plan policy was not mandatory; rather it only stated what a developer
"should" do, not what a developer was "required" to do. Therefore, the Hearing Examiner ruled
that the grading plans could only be restricted based on clear violations of the code. Based on
this ruling, Staff changed its interpretation of the Comprehensive Plan policy.2 This change was
in effect prior to the City's preliminary plat approval for Norpoint Heights.
The applicant notes in the request for modification that grading the site based on the proposed
modification reduces the overall impact to the public roadways by relocating and importing soil
material at one time rather than multiple times in conjunction with development of each lot. The
applicant further stated that clearing and grading the entire site will have minimal impact to the
public as the majority of the site sits above the major access roadway and only a small portion of
the site will be visible from the roadway. Grading the lots during construction of the roadway is
an effective way to control erosion. Moreover, the proposed modification will not result in any
changes to approved road layout, to lot layout, to open space, or to the location of the stonnwater
facility, and it balances cut and fill quantities with roadway installation.
The proposed modification is also compliant with the City's significant tree retention
requirement that the subdivision application is vested to.3 The subdivision code required that
preservation of significant trees pursuant to FWCC 22-1568 shall apply solely to the
development of each single-family lot. The 3.06-acre site is partially wooded with thick
shrubbery, and a mixture of conifer and deciduous trees. According to an "Existing Conditions
Survey" there are a total of twenty-seven trees on the subject property that meet the FWCC
definition of a significant tree. Under the approved grading plan, seventeen of these trees are to
be retained on future building lots and in a landscape buffer based on sheet PP-04 —
"Preliminary Clearing, Grading & Utility Plan". The seventeen retained trees exceed the 25%
minimum of significant trees that were required to be retained or replaced with a subdivision
proposal. As a result, tree replacement was not required with the preliminary plat approval.
The proposed grading plan would retain a total of eight significant trees at the rear of lots 5, 9,
10 and 11, and retain one significant tree in the required landscape buffer between the plat and
Norpoint Way NE. These nine trees are more than 25% of the existing twenty-seven trees on the
subject property. Therefore, the modification request maintains compliance with the significant
tree retention requirements of FWCC Section 22-1568.
V. FINDINGS OF FACT AND CONCLUSIONS
Based on an analysis of the approved preliminary plat, the requested modification, and related
decisional criteria, the Community and Economic Development Department concludes as follows:
The proposed modification will not increase the residential density of the plat, will not result in
the relocation of any access points to an exterior street from the plat, and will not result in any
loss of open space or buffering provided in the plat.

2. The proposed modification will not increase any adverse impacts or undesirable effects of the
project, and does not significantly alter the project by: 1) adequately addressing erosion and
sedimentation control; 2) reducing construction impacts on surrounding properties and the
public roadway; 3) complying with the significant tree retention code; and 4) complying with all
other code provisions the preliminary plat is vested to.
3. The proposed modification is limited to replace in sheet PP-04 "Preliminary Clearing, Grading
& Utility Plan" in Exhibit A with sheet GR-01 "Clearing, Grading & T.E.S.C." No other part of
the preliminary plat approval authorized by Resolution 10-580 is to be altered by the
modification request.
4. The proposed modification to the preliminary plat complies with the criteria for a modification
as stated in FWCC 20-127(d).
VI. RECOMMENDATION
Based on Staff s review of this modification request with the preliminary plat application, related
code, and pertinent decisional criteria, Staff recommends that the City Council: 1) affirm that the
modification request meets the criteria for a modification pursuant to FWCC 20-127(d); and 2)
approve the Norpoint Heights preliminary plat modification to replace sheet PP-04 "Preliminary
Clearing, Grading and Utility Plan" in Exhibit A with sheet GR-01 "Clearing, Grading & T.E.S.C."
