impacts identified in the environmental checklist, Federal Way Comprehensive Plan, Federal Way
Revised Code, 2009 King County Surface Water Design Manual, and other municipal policies, plans,
rules, and regulations designated as a basis for exercise of substantive authority under the State
Environmental Policy Act Rule-$ pursuant to Revised Code of Washington (RCW) 43.31C.060.
The lead agency for this proposal has determined that it does not have probable significant adverse impact
on the environment and an Environmental Impact Statement (EIS) is not required under RCW
43.21C.032(2)(c). This decision was made after review of a completed environmental checklist and other
information on file with the lead agency. This information is available to the public on request.
This DNS is issued under Washington Administrative Code (WAC) 197-11-340(2); the lead agency will
not act on this proposal for 14 days from the date of issuance. Comments must be submitted or
postmarked no later than 5:00 p.m. on October 24, 2014.
Unless modified by the city, this determination will become final following the above comment deadline.
Any person aggrieved of the city's final determination may file an appeal with the city within 14 days of
the above comment deadline. You may appeal this determination to the Federal Way City Clerk at the
City of Federal Way (33325 8th Avenue South, 98003) no later than 5:00 p.m. on November 7, 2014, by a
written letter, accompanied with the associated fee, stating the reason for the appeal of the determination.

Proposal: The city proposes a retrofit to an existing stormwater swale into a bioretention facility. The
project includes replacing the existing topsoil with approximately 800 cubic yards of
engineered bioretention soil, and planting with native plants. The existing stormwater
conveyance system will also be improved as necessary.

The Responsible Official of the City of Federal Way hereby makes the following decision based upon
impacts identified in the environmental checklist, Federal Way Comprehensive Plan, Federal Wary
Revised Code, 2Do9 Ding County Surface Water Design Manual, and other municipal policies, plans,
rules, and regulations designated as a basis for exercise of substantive authority under the State
Environmental Policy Act Rulespursuant to Revised Code of Washington (RCW) 43.31 C.060.
The lead agency for this proposal has determined that it does not have probable significant adverse impact
on the environment and an Environmental Impact Statement (EIS) is not required under RCW
43.21 C.032(2)(c). This decision was made after review of a completed environmental checklist and other
information on file with the lead agency. This information is available to the public on request.
This DNS is issued under Washington Administrative Code (WAC) 197-11-340(2); the lead agency will
not act on this proposal for 14 days from the date of issuance. Comments must be submitted or
postmarked no later than 5:00 p.m. on October 24, 2014.
Unless modified by the city, this determination will become final following the above comment deadline.
Any person aggrieved of the city's final determination may file an appeal with the city within 14 days of
the above comment deadline. You may appeal this determination to the Federal Way City Clerk at the
City of Federal Way (33325 O Avenue South, 98003) no later than 5:00 p.m. on November 7, 2014, by a
written Ietter, accompanied with the associated fee, stating the reason for the appeal of the determination.
You should be prepared to make specific factual objections.

ENVIRONMENTAL CHECKLIST
Purpose of checklist:
The State Environmental Policy Act (SEPA), chapter 43.21C RCW, requires all governmental agencies to consider the
environmental impacts of a proposal before making decisions. An environmental impact statement (EIS) must be prepared for
all proposals with probable significant adverse impacts on the quality of the environment. The purpose of this checklist is to
provide information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts from the
proposal, if it can be dome) and to help the agency decide whether an EIS is required.
Instructions for applicants:
This environmental checklist asks you to describe some basic information about your proposal. Governmental
agencies use this checklist to determine whether the environmental impacts of your proposal are significant, requiring
preparation of an EIS. Answer the questions briefly, with the most precise information known, or give the best description you
can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you should be
able to answer the questions from your own observations or project plans without the need to hire experts. If you really do not
know the answer, or if a question does not apply to your proposal, write "do not know" or "does not apply." Complete answers

The project proposes to retrofit an existing stormwater swale into a bioretention facility. Specifically, the project will replace
topsoil of the existing swale with engineered bioretention soil media, and plant the area with native plants. Existing stormwater

Minimal to no erosion is anticipated due to the presence of stable soils. Construction will be staged
to be conducted during the historic driest time of year when no surface flows are anticipated, and
erosion control measures will be installed prior to all ground disturbing activities.
g. About what percent of the site will be covered with impervious surfaces after project
construction (for example, asphalt or buildings)?
The project will not cause any net increase in impervious area.
h. Proposed measures to reduce or control erosion, or other impacts to the earth, if any:
Besides the scheduling measures discussed in item "f." above, the project would require and enforce
temporary and permanent erosion control measures, including minimizing clearing/grading activities,
placement of slope stabilization materials (i.e.- Jute matting and landscape mulch) upon completion
of soil disturbing activities, and installation of native tree and shrub plantings within disturbed areas.

During construction, typical emissions are from construction equipment and dust. There will be no

of flow that will be infiltrated will depend on the soil conditions found on site. Prior to
infiltration, stormwater runoff will be filtered by the engineered soil media installed in the
bioretention facility to protect ground water.
