We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions and Public Works Department, and representatives from Lakehaven Utility District and South King Fire and Rescue. Some sections of the Federal Way Revised Code (FWRC) and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWRC and other relevant codes for all additional requirements that may apply to your project. PROJECT DESCRIPTION The applicant proposes to construct four single-family residences in the shoreline residential designation of the Shoreline Master Progam on approximately 54,646 sq. ft, zoned RS9.6. The proposal re- establishes two existing legal lots. Three lots are contiguous and one lot is located several parcels to the east. Future ownership to be determined. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review. These issues can change due to modifications and revisions in the plans. These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided. The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. Mr. Potter Page 2 March 24, 2015 Planning Division • Subject properties are within 200 feet of a state shoreline of significance (regulated lake). • Wetlands were identified on subject properties per the city's critical area inventory. A wetland delineation and investigation report is required for future development. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. If you have questions, please contact the representative listed for that section. PLANNING DIVISION Leila Willoughby -Oakes, Planning (253-835-2644, Leila.Willoughby-oalces(@cityoffederalway.com� 1. Zoning Designation and Use — The subject property is zoned RS-9.6 (one unit/9,600 square feet). Detached -dwelling units are permitted within RS zones per FWRC 19.200.010. Please consult the Use Zone Chart under FWRC 19.200.010 prior to submitting a building and land use application. 2. Single -Family Residential Regulations a. Setbacks — 5 ft. side yard, 20 ft. front yard, 5 ft. rear (please refer to shoreline regulations for further details). Please note property lines are those defined by a recorded vehicular easement or tract per FWRC 19.05.160, and accordingly, setbacks are measured from them. b. Maximum Height — 30 ft. above average building elevation (ABE), the RS9.6 requirements are lessor than the 35 ft. and would control the height requirements of the shoreline regulations. c. Parking — 2 per dwelling unit d. Lot Coverage — 60% e. Minimum Lot Size — 9,600 sq. ft., ingress and egress easements are not included in the minimum lot size calculation. f. Driveway Width — 20 ft. width limitation within required front yards and may not be closer than five feet from any side property line unless a shared access per FWRC 19.130.240(1)(b) is proposed. g. Shoreline accessory structures and appurtenances area subject to shoreline and building permit review. 3. King County Segregation/Merger — The subject properties are located within the Plat of Louise's North Lake Addition. Underlying Lots 7 and 6 are assessed as one tax parcel per the King County Assessor records; the applicant shall submit a segregation/merger application to the County and receive approval. Please provide segregation documentation with all future building and land use applications submitted. 4. Shoreline Management (Bulk Regulations) — The subject property is within 200 feet of the Ordinary High Water Mark of North Lake and therefore regulated under the city's Shoreline Master Program (SMP). The project shall comply with Shoreline Residential development standards set forth in FWRC 15.05.080. 15-100738-00-PC Doc ID: 68189 Mr. Potter Page 3 March 24, 2015 a. Shoreline Setbacks i. Single-family residential on lake shorelines shall maintain a minimum setback behind the stringline, 50 feet from the Ordinary High Water Mark (OHWM) or as required for the protection of critical areas/buffers, whichever is greater. ii. Single-family residential development is prohibited waterward of the OHWM. iii. Stringline Setback — Per FWRC Chapter 15.05.030 minimum setbacks from a regulated lake, the rear yards in this case under FWRC Chapter 19.170 for new structures will be landward of the stringline setback measured between the points on the primary structures having the greatest projection waterward on adjacent properties. On undeveloped parcels the stringline is measured 50 feet from the OHWM. b. Vegetation Conservation Area — The required setback area shall be considered a vegetation conservation area. Within the vegetation conservation area, no more than 30 percent of the area with existing native shoreline vegetation shall be cleared, and a minimum of 70 percent of existing native trees shall be retained. This shall be indicated on a landscaping and tree retention plan and submitted with shoreline and building permit applications. 5. Review Process (Shoreline) Meeting follow-up — Requirements for individual permits versus a blanket Substantial Shoreline Development Permit Please see below. The proposal will require either individual Shoreline Exemptions, or two separate Shoreline Substantial Development Permits (SSDP) per FWRC 15.05.150. An SSDP is evaluated under Use Process III application criteria of FWRC 19.65 (SSDP),If required, an SSDP for Lots 5-7 may be processed under one application. A separate SSDP application shall be submitted for the development of Lot 2. Exemption from a Shoreline Substantial Development Permit will be determined at the time of application for consistency with the Washington Administrative Code (WAC) 173-27-040. The shoreline exemption per WAC 173-27-040(2)(g) shall not apply to the proposal if speculation homes are proposed by a developer. State rules clarify that a "single-family residence" means a detached dwelling designed for and occupied by one family. The construction must be by the owner, lessee or contract purchaser for their own use or for the use of their family (see Ecology v. Pacesetter case). If it is the intent of the applicant or owner at this time to sell these existing building lots to a builder for speculation a shoreline exemption shall not apply. Per WAC 173-27-040(1)(e), local governments may attach conditions to the approval of exempted developments and/or uses to ensure that the project is consistent with the Shoreline Management Act. 6. Public Notice — Process III applications require notice. Within 14 days of issuing the Letter of Complete Application, a Notice of Application for the Land Use Process III will be published in the Federal Way Mirror, posted on the subject property, posted on three City notice boards, and mailed to all property owners located within 300 feet of the site. A mailed notice is required for projects which are located 300 feet from property zoned SE (suburban estates), RS (single-family residential) or RM (multifamily). The subject property abuts other RS9.6 zoned lots. The applicant is required to 15-100738-00-PC Doc ID: 68189 Mr. Potter Page 4 March 24, 2015 submit one set of stamped mailing envelopes, a list of addresses and a map showing the subject property and the 300-foot buffer for the mailing. The G1S Division can provide this service for a nominal fee. Please see the enclosed handout for further information. Public notice is not rep iii red for Shoreline Exemption applications. 7. Rockeries and Retaining Walls — Review FWRC 19.120.120 for minimum standards for rockeries and retaining walls. The site design should minimize the need for rockeries and retaining walls and should not require any in excess of six feet. 8. State Environmental Policy Act (SEPA) Environmental Review —The proposed project is categorically exempt from SEPA review per the Washington Adminish-ative Code (WAC) 197-11- 800, and does not exceed the flexible thresholds identified in Chapter 14.15.030 of the FWRC. 9. Hazard Trees —Meeting follow-up: Mr. Potter requested additional information on the removal of hazardous trees. The removal of a hazard tree is regulated under FWRC 19.120. The development code defines hazard tree per FWRC 19.05.080 as: "... any tree which, in the opinion of the city or an expert approved by the city (such as, but not limited to, a professional forester, certified arborist, or landscape architect), poses an unreasonable risk of failure and poses a hazard to a permanent structure or high use outdoor area." 10. Tree Retention/Replacement — Per FWRC 19.120.130, development within the RS9.6 zoning district and the residential shoreline environment requires a minimum tree unit per acre standard of 25 tree units per acre. The applicant shall submit a tree unit per acre calculation, and landscape/tree retention plan depicting how the minimum tree unit standard is met with retained and planted trees for all lots. The minimum tree density shall be met through the conservation of existing trees, and trees located within critical area buffers shall be included as credits towards satisfying the tree units per acre requirements. The landscaping and tree retention plan must indicate tree removal and "no disturbance" areas during construction for tree protection. Where tree replacement is required in order to achieve the minimum tree units per acres the replacement trees shall consist of a mix of evergreen and deciduous trees, suitable to specific site conditions. Nothing in this section shall be interpreted to allow clearing, grading, and/or the removal of trees or other vegetation within sensitive areas or sensitive area buffers where prohibited under FWRC Chapter 19. . 11. Encroachments — Please note a fence encroachment along the east property line of Lot 2. During a site visit staff also noted equipment and debris and encroachments onto the vacant lot. An associated private easement agreement exists betweeVbutting property per King County Auditor's No. 201102231243; please find enclosed.�'- 12. Clearing and Grading — Prior to beginning clearing and grading activities all wetland buffers and trees/vegetation that are to be preserved within and adjacent to the construction area shall be clearly marked and protected. 15-100738-00-PC Doc ID: 68189 Mr. 'Potter Page 5 March 24, 2015 A clearing and grading plan shall be submitted that meets FWRC 19.120.020. Please reference FWRC 19.120.040 for items required to be included on the plan. The plan must be submitted with the formal shoreline land use permit if required (Process III) and individual building permit applications, if clearing and grading work is proposed. 13. Archeological and Historic Resources — Per FWRC 15.05.040 under the Shoreline Management regulations, if any archaeological artifacts are uncovered during excavations in the shoreline jurisdiction, indicating a potential pre -contact site, work must cease and the City of Federal Way, State Department of Archaeology and Historic Preservation (DAHP), the Muckleshoot Indian Tribe, and Puyallup Tribe of Indians must be notified. An Archaeology — Survey may be required. Contact Gretchen Kaehler, Local Governments Archaeologist (DAHP) at 360-586-3088. 14. Critical Areas Wetlands— Category I Wetlands may exist on or within 200 feet of the subject properties in the plat of Louise's North Lake Addition per FWRC 15.10.240 (2). Further, based on the cty's Critical Area Inventory, assessor parcels 4420600010, 4420600025, and 4420600030 indicate the presence of regulated wetlands. The applicant must submit a wetland delineation report prepared by a qualified environmental professional with any shoreline development permit, construction permit or land use application, including the information set forth in subsections (2)(a) through (g) and (3) of FWRC 15.10.240. No critical area studies have been submitted on the subject properties within the last five years. Submitted critical area reports may receive a third -party review at the discretion of the Community Development Department and at the applicant's expense. If required, a contract and scope of work are established with the city's on -call wetland biologist requiring 2-3 weeks. Please find information enclosed on the Optional Direct Services Program available for this proposal, providing opportunities for concurrent critical area studies and third -party review. The conceptual site plan submitted does not depict wetland or associated buffers on Lots 5 and 6 identified in the City's critical area inventory. A preliminary wetland determination was conducted in October 2014. During formal applications the city may request additional site -specific data, sampling and/or analysis for parcels 4420600025 and 4420600030. 15. Residential Water Access —Meeting Follow -Up: Mr. Potter requested information on docks, water access, and accessory structures. Pursuant to FWRC 15.05.050 piers, docks, floats or mooring buoys are permitted accessory development to a single-family residence, or as common use facilities and permitted in the residential shoreline environment. Development regulations for such structures are regulated by the FWRC 15.05.070(6) Summary of uses, approval criteria, andprocess, "Standards Table." Boating facilities are only permitted as an accessory use to commercial or park development. Also note any filling activities waterward of the OHWM shall only be permitted with a shoreline conditional use permit. 15-100738-00-PC Doc ID: 68189 Mr- Potter Page 6 March 24, 2015 16. School Mitigation Fees — School mitigation fees are due at the time of building pen -nit application for new dwelling units ($5,429.55 in 2015). '.lhe fee amount is subject to change as determined annually by the Federal Way School District. 17. Traffic Impact Fees —Meeting follow-up: Mr. Potter requested further information on traffic impact fees. Please see Erik Preston's (Traffic Engineering) comments for more detail. 18. Application Fees —As development fees change annually, please contact the Permit Center at 253- 835-2607 or permitcenter@cityoffederalwaycom, for an updated fee list prior to submitting your application for Use Process III, Residential Building Permit, construction permit and 3rd party critical area review (determined at the time of submission). PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Kevin Peterson, 253-835-2734, kevin.Petersoniu?cityoffederalway.com} Building Permit Issues 1. Surface water runoff control Best Management Practices (BMP's) will be required as part of each individual building permit, per Appendix C, Small Site Drainage Requirements of the 2009 King County Surface Water Design Manual (KCSWDM). 2. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability. Right -of -Way Improvements 1. Construction of single-family residences on the vacant lots will meet the 25 percent threshold criteria for requiring street frontage improvements as identified in the Federal Way Revised Code (FWRC) 19.135.030. The applicant has chosen to request a waiver of the street improvements and will submit a written request as outlined in the Right -of -Way Modification Request handout. 2. FWRC 19.135.280 requires that driveways serving residential uses may not be located closer than 25 feet to each other (center -to -center). The driveway layouts will be reviewed under the Building Permit applications. PUBLIC WORKS TRAFFIC DIVISION (Erik Preston, PE, 253-835-2744, erik.Preston(a�,cityoffederaiNvay.com) Transportation Impact Fees (TIP) (FWRC 19.91) Based on the submitted materials for four single-family homes on four existing vacant lots, the estimated traffic impact fee is $12,821.19, including administrative fees. If building permit applications are submitted separately the current traffic impact fee is $3,111.94 plus 3% administration fee. The actual fee will be calculated and paid at the time of building permit issuance. The applicant may defer all or part of the impact fee payment amount to the closing of the sale of the single-family home. If this option is selected, a covenant prepared by the city to enforce payment of the deferred fees will be recorded at the applicant's expense on each lot at the time of plat recording for residential land divisions. 15-100738-00-PC Doc ID: 68189 Mr. Potter Page 7 March 24, 2015 Access Management (FWRC 19.135) Driveways that serve only residential use may not be located closer than 25 feet to any other driveway or street intersection. Separation distances shall be measured from centerline to centerline of roadways and driveways. Design Criteria (FWRC 18.55) All lots shall be accessed by a public street right-of-way (FWRC 18.55.020). In certain cases, lots may be accessed by an ingress/egress and utilities easement or alley subject to the requirements established in the City of Federal Way public works development standards. Residential lots should not have access onto arterial streets. Misc. Safety related Comments Driveways serving a single-family dwelling unit abutting two streets should be at least 25 feet from the beginning of the street radius. LAKEHAVEN UTILITY DISTRICT (Brian Asbury, 253-946-5407, BAsbua(@,Iakehaven.org) Water • A Certificate of Water Availability issued separately by Lakehaven may be required to be submitted with any land use and/or building permit applications (check with land use agency for requirement). Lakehaven issued a certificate for these properties on 1/8/15. Fire Apparatus Access Roadway Fire apparatus access roadways shall be required for every building when any portion of an exterior wall of the first story is located more than 150 ft. from fire apparatus vehicle access. Fire apparatus access roads: 1. Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. 2. Shall be designed and maintained to support the imposed load of a 75,000-pound fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities. 3. Shall be not less than a 32-foot inside turning radius and not less than a 40-foot outside turning radius. 4. Gradient shall not exceed 15 percent. EXCEPTION: When buildings are completely protected with an approved automatic fire sprinkler system, these provisions may be modified by the chief. Automatic Fire Sprinkler Systems An automatic fire sprinkler system shall be installed in Group R, Division 3 occupancies: 1. Anderson, Ecology NWRO Wetlands/401 Unit Supervisor Cc: David Pater, Ecology Date: 10/10/2016 Re: Wetland Determination at North Lake Background I understand that questions have been raised about the extent and category of wetlands along southern shore and within North Lake in the City of Federal Way (City). As the acting Washington State Department of Ecology (Ecology) Wetland Specialist for King County jurisdictions, I am happy to assist the City in answering wetland- and shoreline -related questions. Ecology is the state agency responsible for regulating wetlands and shorelines and, as such, has developed a number of guidance documents for protecting these valuable resources. To ensure that regulatory interpretations are consistent with that guidance and state law, Ecology staff routinely provide technical assistance to other agencies and local governments. At North Lake, the central question is whether wetlands below the ordinary high water mark (OHWM) of the lake should be regulated as wetlands or are they considered to be part of the lake itself and not subject to wetland regulation? Answering that question has important implications for future land use on several undeveloped parcels along the lake shore because it will determine the required buffers and regulatory setbacks. Regulatory Context In addition to other waters, water bodies greater than or equal to 20 acres in size are subject to regulation under the state Shoreline Management Act (SMA; RCW 90.58) and the City's Shoreline Master Program (SMP; Federal Way Revised Code (FWRC) Ch. 15.05). At approximately 56 acres in size, North Lake is a shoreline of the state regulated through the SMA and the City's SMP. Wetlands and other critical areas within shoreline jurisdiction are regulated by the City through the standards in SMP Appendix A. Wetlands are characterized by a dominance of plants adapted for life in saturated soils and by inundation or saturation (see RCW 90.58.030(2)(h)). Wetlands are frequently associated with water bodies or streams and may be found below the OHWM of those waters (Hruby 2014). For wetland delineation purposes, only five percent cover is required to consider an area vegetated (U.S. Army Corps of Engineers 2010). Page 2 of 9 October 10, 2016 The shorelands (landward 200 feet of the OHWM and any associated wetlands') at North Lake are apparently designated Urban Conservancy in the SMP and require a minimum 50-foot setback from the OHWM (FWRC '§ 15.G5.070(6) Standards table). Wetlands under 2,500 square feet (sf) are exempt from regulation under the SMP; whereas, Category I wetlands require a 200-foot buffer, Category II wetlands require a 100-foot buffer, Category III wetlands greater than 10,000 sf have a 50- foot buffer and Category III wetland between 2,500 and 10,000 sf have a 25-foot buffer (SMP Appendix A § 6.B). Additional regulatory guidance on wetlands, including lake fringe wetlands below OHWM, is found in the Washington State Wetland Rating System for Western Washington, 2014 Update (Hruby 2014). Of particular relevance to the wetlands waterward of the OHWM at North Lake is the following guidance from § 4.4 (p. 23): "Sometimes a strip of open water is found between the wetland plants farther from shore and those closer to shore. In this situation, the open water is considered a part of one unit that encompasses both the rooted submerged plants offshore and the shore -side plants. The absence of plants in the area of open water may only be temporary, or the submerged plants are present but not visible because they do not grow to the surface. The plants may also be absent due to wave action or physical removal." Office Assessment A number of resources were reviewed in considering whether the lake fringe wetlands at North Lake should be regulated as wetlands, including the City's SMP, Ecology's current wetland rating system (Hruby 2014), Classification of Wetlands and Deepwater Habitats of the United States (Federal Geographic Data Committee (FGDC) 2013), aerial photographs, the National Wetlands Inventory (NWI; available at: https://www.fws.gov/wetiands/Data/Mapner-htinl and a boundary and topographic survey (Barghausen Consulting Engineers, Inc., dated 9-23-14) for parcels along the southern shore of the lake. The survey shows three adjoining parcels, identified on the survey as Lots 5, 6 and 7 and Lot 2 to the east. The survey also shows the flagged OHWM on all of the subject parcels as well as 5 flags (labelled W-1 — W-5) on Lot 2 that apparently show a delineated wetland edge. Figure 1, below, shows the general location of North Lake and Figure 2 shows the parcels of interest at the south end of the lake. Aerial photographs for 2013, 2012, 2009, 2007 and 1936, available at the King County Parcel Viewer Website (available at: htt :II isms skin count ov! arcelviewer2/), show patches of aquatic bed vegetation along the southern shore of North Lake. The patches of vegetation most visible in the photographs are those where plants, such as water lily, extends to or above the water's surface. More extensive areas that appear to include submerged aquatic bed vegetation are also visible in the photographs. The distribution of aquatic bed vegetation in the aerial photographs varies from year to year due, in part, to the time of year the photograph was taken and also, apparently, due to vegetation management within the lake. ' The SMA implementing rules (WAC 173-22-030(1)) define "Associated wetlands" as those wetlands in proximity to and that either influence or are influenced by a shoreline water. Wetlands below the OHWM would be within the shoreline water and only those portions of the wetland that extend landward from the OHWM would be considered to be associated under the SMA. Page 3 of 9 October 10, 2016 The North Lake Management District was formed to address ongoing concerns about water quality and the City has been implementing a management program to reduce the extent of aquatic vegetation, including fragrant water lily (Nymphaea odorata) within'North Lake. The primary means of aquatic weed control at North Lake has been through herbicide application and weed rakes (City of Federal Way 2015). Where management activities may have altered the plant community, wetland delineation standards allow for consideration of other approaches in determining if wetland vegetation is present (Ch. 5, § 4.e. Managed plant communities, pp. 104 —105; U.S. Army Corps of Engineers 2010). Also, the federal definition of aquatic bed vegetation acknowledges that the distribution of plants varies within a year (growing season) and between years: "AQUATIC BED: Includes wetlands and deepwater habitats dominated by plants that grow principally on or below the surface of the water for most of the growing season in most years." Floating aquatic bed vegetation is visible immediately offshore of Lots 5, 6 and 7. The NWI map shows a lacustrine aquatic bed wetland contiguous with the southern and western shorelines of North Lake (Figure 3). This wetland, extending from the upland to a water depth of approximately 2.5 meters (8.2 feet)2, is mapped at 12.21 acres in size. The waterward margin of the aquatic bed wetland polygon appears to be consistent with the mapped 5- and 10-foot bathymetric contours for North Lake (Figure 4; Washington State Water Program 1973). 2 With the 2013 update to the federal wetland classification system, the boundary between wetland and deepwater habitat was changed from 2 meters depth to 2.5 meters (8.2 feet) (FGDC 2013). Mapped bathymetric contours (feet) for North Lake (Washington State Water Program 1973). Field Investigation Thank you for taking time to join me for the North Lake site visit on September 7, 2016. Your familiarity with the permitting history on the parcels we visited was a big help in understanding the setting. During our site visit, we looked for wetland and OHWM indicators along the lakeshore. We were also able to see wetland vegetation, including scrub -shrub, emergent and aquatic bed communities at and below OHWM on the parcels of interest. Aquatic bed vegetation was visible approximately 12 feet waterward of the OHWM along the western parcels (Lots 5 — 7; Photo 1). On Lot 2 and to the east, emergent vegetation was found below OHWM and aquatic bed was seen just offshore (Photos 2 and 3). Observed OHWM indicators included a distinct topographic break along the upland edge that was demarcated by a small rockery, water marks on the rockery, a change in the dominant plant community (from wetland to upland) and substrate changes. On Lot 2, the OHWM extended to the landward edge of the wetland, encompassing a small island. The topographic survey (Barghausen Consulting Engineers, 9-23-14) incorrectly shows the North Lake OHWM on the waterward side of the island and wetland on Lot 2. Page 7 of 9 October 10, 2016 'Conclusion Ecology concurs with the flagged OHWM boundary on Lots 5 — 7. We do not concur with the OHWM boundary shown on Lot 2 nor do we concur with the determination that the aquatic bed wetland in North Lake does not extend onto the parcels of interest. The OHWM on Lot 2 is coincident with the landward wetland edge. Based on my review of available background information and our site visit on September 7th, Ecology has determined that the wetland below OHWM on all of the subject parcels is greater than 2,500 sf and therefore, subject to regulation under SMP Appendix A. This conclusion is based on the following factors: ■ Aquatic bed vegetation was visible immediately offshore along all of the parcels we visited on September 7th; • The NWI has mapped a contiguous lacustrine aquatic bed wetland (12.21 acres) along the southern and western shores of North Lake; • Aquatic bed vegetation is visible along the shoreline of interest in several aerial photographs dating back to 2007; • Active management for aquatic weeds has very likely impacted the distribution of aquatic bed vegetation in North Lake; • Only five percent cover is required to consider an area vegetated and in areas subject to vegetation management, delineation standards allow for other approaches to making a wetland determination (U.S. Army Corps of Engineers 2010); and • the Washington State Wetland Rating System for Western Washington, 2014 Update (Hruby 2014) provides specific guidance for situations where there may be an unvegetated gap within lake fringe wetlands (see § 4.4, p. 23). Based on the wetland categories described in SMP Appendix A3, I believe the lake fringe wetland on the subject parcels would be rated as a Category II wetland as it is greater than 2,500 sf in area, is contiguous with a water body that supports a fish population and is greater than one acre in size (SMP Appendix A § 6.B.(a)(2)). Standard buffers for Category II wetlands shall be 100 feet (SMP Appendix A § 6.B.(b)(2)), which in this case would be measured from the OHWM/wetland edge. References City of Federal Way. 2015. Dear Mr. Barghausen: RECEIVED FEB 17 2015 CITY OF FEDERAL WAY CDS A wetland determination was conducted for the North Lake Properties located along S. 3371h Street at the intersection with 331d Place S. in the city of Federal Way (Assessor Parcel #s 4420600010, 4420600025, 4420600030). The Properties are vacant, waterfront land on North Lake just north of Weyerhaeuser Way S. The total area of these Properties above Ordinary High Water is approximately 1.25 acres. One wetland area was observed on -site. North Lake is designated as a State Shoreline. Recent communication with city staff indicated the subject Properties are identified in the city's Shoreline Master Program as "Residential" with a 50-foot Shoreline setback. This wetland report includes a wetland delineation and characterization of the on -site wetland. The wetland field data forms are attached. A professional survey map showing existing topography and the delineated wetland boundary will be submitted with this letter report as a full-sized drawing (Boundary and Topographic Survey for Washington Federal, Barghausen Consulting Engineers 9/23/14). Site Description The subject properties are vacant lakefront lots that have been partially cleared or disturbed from past use. The Properties have tree cover comprised of native and non- native species. The easternmost lot (Parcel 2 — APN 4420600010) has been mostly cleared and maintained as lawn. The western parcels (APN 4420600025 & 4420600030) have Douglas fir (pseudotsuga rnenziesii), red alder (Alnus rubra), Western red cedar (Thuja plicata), and big leaf maple (Ater macrophyllum) trees covering most of the area adjacent to the Lake. The dominant tree cover on the south side of these parcels is planted sugar maple (Ater saccharum) trees and laurel Mr. Tom Barghausen, North Lake Properties October 25, 2014 Page 2 The western parcels have shrub cover that includes Western hazelnut, salmonberry, Himalayan blackberry, and scattered salal groundcover. The highly disturbed areas from past clearing are dominated by English ivy (Hedera helix) groundcover. All of these Properties are relatively flat. Purpose / Methodology The primary purpose of this report is to identify the extent of wetland and wetland buffer area present on the Property. Identification of wetland and buffer areas will allow for site planning. This report is purposely brief due to the related size of the property and limited site features. Wetlands are determined where vegetation, soils, and hydrology all reflect that hydric conditions are present on a site. In accordance with current State requirements, the 1987 US Army Corps of Engineers Wetlands Delineation Manual (FTCWD 1987) was used for wetland determination. The methodology is based on the presence of dominant hydrophytic vegetation (i.e. plant species adapted to, or tolerant of, growing in saturated soil conditions), hydric soils, and observed wetland hydrology as described in the Manual and consistent with the Regional Supplemental to the Corps of Engineers Wetland Delineation Manual (US Army Corps of Engineers 2010). Data for wetland determination was collected on the Properties during the site investigation. The observed site conditions warranted installing data plots in lowland and potential wetland areas. A total of four wetland data plots were installed to document wetland boundaries. The wetland data plot forms are attached to this letter. In addition, the professional survey map depicting wetland area, data plot locations, and wetland buffer is attached as an 11 x 17 inch drawing (Wetland Delineation Map - Boundary and Topographic Survey Barghausen Consulting Engineers 9/23/14). Wetland Determination The Properties were investigated in October 2014. Based on the investigation of observed soils, hydrology, and dominant vegetation, one small area of wetland was delineated on the easternmost lot. Wetland W's boundary crosses the eastern lot (Parcel 2 — APN 4420600010) along the edge of North Lake. Mr. Tom Barghausen, North Lake Properties October 25, 2014 Page 3 Soil According to the King County Area Soil Survey (US Soil Conservation Service 1973), the property is mapped as having Alderwood gravelly sandy loam, 0 to 6 percent slopes (AgB). The Alderwood soil series is associated with upland habitats and is moderately well drained and formed in glacial deposits. This series includes the poorly drained and hydric Norma, Bellingham, Seattle, Tukwila, and Shalcar soils that occur in depressions and drainageways. Disturbed soil conditions were observed on the Properties related to past clearing and grading activities. Hydrology Wetland W appears to be a seasonally ponded area depending on the water level of North Lake. Streams or drainage channels were not observed on the Properties. Based on local topography seasonal surface water runoff drains to the Lake. Wetland W Wetland W is a narrow, lake -fringe wetland that extends off -site on both sides of the eastern lot (Parcel 2 — APN 4420600010). The on -site area is comprised of emergent vegetation cover. Dominant vegetative cover in the wetland includes speedwell (Veronica sp.) marsh willow -herb (Epilobium palustre), silverweed (Potentilla anserina), and hard -stem bulrush (Scirpus acutus). Based on the City's Critical Areas code listed below, Wetland W is rated as Category It because it is a wetland contiguous with a water body that supports fish and appears to be greater than 2,500 square feet in size. Category H wetlands have a standard buffer of 100 feet (FWRC 15.10.250 (2)). Federal Way Revised Code - Chapter 15.10.250 1 (b) Category Il wetlands are greater than 2,500 square feet in area, do not exhibit the characteristics of Category I wetlands, and meet one of the following criteria: (i) Are contiguous with water bodies or tributaries to water bodies which under normal circumstances contain or support a fish population, including streams where flow is intermittent; or (ii) Are greater than one acre in size in their entirety; or (iii) Are less than or equal to one acre in size in their entirety and have two or more wetland classes, with neither class dominated by nonnative invasive species.
