Thank you for participating in the preapplication conference with the City of Federal Way's Development
Review Committee (DRC) held September 5, 2019. We hope that the information discussed at that meeting
was helpful in understanding the general requirements for your project as submitted.
This letter summarizes comments given to you at the meeting by the members of the DRC. The members
who reviewed your project and provided comments include staff from the city's Planning and Building
Divisions, Public Works Department, and representatives from Lakehaven Water and Sewer District and
South King Fire and Rescue. Please be advised, this letter does not represent all applicable codes. In
preparing your formal application, please refer to the complete Federal Way Revised Code (FWRC) and other
relevant codes for all additional requirements that may apply to your project.

PROJECT DESCRIPTION
Proposal is a Binding Site Plan (BSP) to divide a developed commercial property into three separate parcels.
Note: Some of the comments in this preapplication letter will require sign(cant modifications to the overall project.
Additional comments may arise once the construction plans and supporting documentation to address these
comments are provided.
MAJOR ISSUES
Outlined below is a summary of the major issues of your project based on the plans and information
submitted for preapplication review. These issues can change due to modifications and revisions in the plans.
The major issues section is only provided as a means to highlight critical requirements or issues. Please be
sure to read the comments made by all departments in the following section of this letter.

• Planning Division
1. New Roadway— The new east -west road identified by the Public Works Traffic Division below is
required under the comprehensive plan. While Public Works modifications may be requested from
design requirements, removing the requirement for the road would require an amendment to the
comprehensive plan.
2. New Roadway Alignment— The new road will need to have its centerline aligned with the proposed
3181h Street to the east of the subject site. If you decide to move forward with this project and begin
drafting plans, contact Nathan Galer at (206) 903-7309 to coordinate the centerline alignment with
Sound Transit to the east (across 215t). Comments were provided at the preapplication meeting by the
traffic reviewer as -to the western centerline alignment, please contact the traffic reviewer with any
follow-up questions.
3. L andsrap'xg —City Center Core (CC-C) zone landscaping will need to be addressed as part of the site
improvements required due to the land division action. A modification to the landscaping
requirements can be requested and, with the exception of along the rights -of -way, may be practical
given the existing conditions of the property.
4. Easement— Regardless of whether the new lots are to remain under common ownership, an easement
must be recorded to address the shared parking, access, and landscaping. The city will review the
document insofar as it needs to make sure the properties remain in compliance with zoning and
other codes, but the applicant is responsible for drafting the easement to their satisfaction. Note that
shared parking facilities in the CC-C zone must comply with FWRC 19.130.120(2), which requires a
parking demand study.
0 Public Works Development Services Division
1. Stormavater Water.Quality and Flow Control (FWRC 18.30.280) —Prior to BSP approval and recording,
the site stormwater quality and flow control systems must be improved to meet the current King
County Surface Water Dqs x Manual (KCSWDM) standards. The 2016 manual with Federal Way
amendments is currently in effect.
■ Public Works Traffic Division
1, New Roadway —Map III-4 in the Federal Way Comprehensive Plan (FWCP) identifies an east -west road
within the subject property to a Type "Q" standard (discussed in the complete traffic comments
below). The street is expected to be constructed and dedicated prior to recordation of the BSP.
2. Frontage Improvements (FWRC 19.135.040) — Construct street frontage improvements and dedicate
right-of-way along the property frontage on both Pete von Reichbauer Way and 2PY Avenue. See the
traffic comments for details regarding these improvements that need to be constructed prior to
recordation.
3. Block Perimeter (T W C 18.55.010 & FWRC 19.135.251) —The development shall meet block
perimeter requirements of 1,320 feet for non -motorized access and 2,640 feet for streets. This
requirement is in conjunction with the new roadway and frontage improvements and may require
additional improvements to comply.

• Lakehaven Water & Sewer
1. If the required new roadway or frontage improvements require existing water system facilities to be
relocated, a Lakehaven Developer Extension Agreement will be required to construct new
distribution facilities necessary for the proposed development.
2. Water and Sewer Certificates of Availability may be required. If required, please allow one to two
working days for these to be issued.
DEPARTMENT COMMENTS
Outlined below are the comments made by the representatives of each department present at the preapplication
conference. Each section should be read thoroughly. If you have questions, please contact the representative
listed for that section.
COMMUNITY DEVELOPMENT — PLANNING DIVISION

1. Exi ting Site Conditions — The subject property is zoned City Center Core (CC-C) and contains three
separate shopping center buildings and associated parking and landscaping improvements. The existing
site access is from both Pete Von Reichbauer Way and 211Y Avenue. Street improvements exist on both
frontages; however, additional improvements are required as noted in the Public Works — Traffic
Division comments.
2. Critical Areas — The subject site is partially located in the 10-year groundwater capture zone. The
application will need to provide adequate information to demonstrate compliance with Article V of
FWRC 19.145.
3. Existing Drive -Through — The binding site plan cannot create a development nonconformance of the bank
drive -through facility. FWRC 19.115.050(7)(b) requires the drive -through to not be audible off -site, which
may be infeasible with the proposed property line location.
4. Landscaping FWRC 19.125 — The application is subject to the landscaping requirements of FWRC
19.125. The frontage improvements and new roadway dedication that will be required will mean that the
site is modified to the point the development is expected to meet parking lot (FWRC 19.125.070) and
zone -specific landscaping requirements of five feet width Type III landscaping along all perimeter lot
lines and between the parking and the final right-of-way line (FWRC 19.125.060[7]). The internal
property line perimeter landscaping may be appropriate for consideration of a modification application
under FWRC 19.125.100.
5. Parking FWRC 19.130 — A shared parking agreement will need to be recorded with the BSP (may be in
the same document as required easements) and comply with the requirements of FWRC 19.130.120(2).
The application will need to provide a parking demand study as per the identified code section.
6. Building Code— The BSP should identify the distance from the existing buildings to the proposed property
lines. Improvements to the structures will be required prior to recordation if necessary to maintain
compliance with the building and fire code with regards to separation requirements.

Procedural Information — Pursuant to FWRC 18.20, BSP applications are administratively reviewed by the
Department of Community Development pursuant to the short subdivision regulations of FWRC 18.30.
The administrative review process requires that the Community Development Director to issue a decision
on the binding site plan request and determine compliance with the decisional criteria of FWRC
18.30.110(2). After the Permit Center accepts an application, Planning Division staff will conduct a review
and issue a letter of completeness or incompleteness requesting additional information within 28 days of
receipt. A master land use application and binding site plan submittal checklist are enclosed; relevant code
sections are available at the city's website at www.cirvoffederal-,vay.com under Title 18 "Subdivision."
8. Public Notice —Public notice of a BSP proposal is required per FWRC 18.30.080, and a 15-day public
comment period is provided. The city will prepare and post a notice board on the subject property.
Copies of the Notice of Application will also be posted at the city's designated public notice boards and
published in the Federal Way Mirror.
9. Binding Site Plan Approval Duration — BSP approvals expire five years from the date of the Community
Development Director's decision per FWRC 18.30.260(1). The BSP must be recorded within the five-
year time period. No less than 60 days prior to the lapse of approval, the applicant may request a two-
year time extension for the BSP approval pursuant to FWRC 18.05.090(1)-(6).
10. State Environmental Policy Act (SEPA) —The three -lot BSP proposal is exempt from the requirements of
SEPA review per Washington Administrative Code (WAC) 197-11-800(6)(d).
11. Lot Si.Zel Coverage — Pursuant to FWRC 19.225, there is no minimum lot size or lot coverage in the CC-C
zoning district. Instead of a maximum lot coverage, the buildable• area will be determined by other site
development requirements (i.e., required buffers, parking lot landscaping, surface water facilities, etc.).
12. Other General CC-C Zoning Requirements (Future Development) — Please refer to the use zone charts within
FWRC 19.225. They contain lists of permitted uses and their corresponding bulk zoning requirements
(i.e., height, parking, setbacks, and special notes). Different uses in the CC-C zone have different zoning
requirements. The dedication of a new road cannot create a nonconforming development (existing
buildings to remain must comply with setback requirements).
13. Recording — The city will require the applicant to record the BSP with the King County Division of Recordg
and Elections, subsequent to an administrative land use decision by the Community Development
Director. The applicant is responsible for meeting King County Auditor recording requirements and
ensuring all drawings and location maps are legible.

15. Checklists — Notwithstanding anything else in this letter, the application must include or address all items

PUBLIC WORKS DEVELOPMENT SERVICES DIVISION

Land Use Issues — Stormwater
10. Surface water runoff control and water quality treatment will be required per the 2016 Kind County Surface
Water Design Manual (KCSWDM) and the City of Federal Way Addendum to the manual. This project
meets the requirements for a full drainage review. At the time of land use site plan BSP submittal, a
preliminary Technical Information Report (TIR), addressing the relevance of the project to the nine core
and five special requirements of the KCSWDM will be required. A Level 1 downstream analysis shall also
be provided in the preliminary TIR. The city Addendum can be found at the following website:

11. The project lies within a conservation flow control area; thus, the applicant must design the flow control
facility to meet this performance criteria. In addition to flow control facilities, Best Management Practices
(BMP's) are required as outlined in the KCSWDM. The project also lies within an enhanced basic water
quality area. Water quality treatment shall be designed to meet the treatment criteria of the Enhanced
Basic Water Quality Menu. The city will accept treatment systems which are listed on the Department of
Ecology's General Use Level Designation (GULD) for the required level of water quality treatment.
12. In addition to the KCSWDM, our initial review suggests that FWRC 19.30.120, "Nonconforming Water
Quality Improvements" applies to this site. Specifically, the following item is applicable:
Ld. Redevelopment which involves the collection and/or concentration of surface and/or
stormwater runoff from a drainage area of 5,000 square feet or more;
Therefore, water quality treatment will be required for the entire site, including new and existing pollution
generating impervious surfaces. Treatment options must be selected from the EnhancedBasic WaterQuality
Menu provided in the KCSWDM.
13. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must
be provided to verify infiltration suitability.
14. Detention and water quality facilities for private commercial developments within the City Center Core
may be placed underground.
15. Show the proposed location and dimensions of the detention and water quality facilities on the
preliminary plans.
16. If more than one acre will be disturbed during construction, a National Pollutant Discharge Elimination
System (NPDES) construction storm water permit may be required. Information regarding this permit
can be obtained from the Washington State Department of Ecology at 360-407-6048, or

17. If work is to be done below the ordinary high-water mark, a Hydraulic Project Approval (HPA) permit
may be required. Information regarding this permit can be obtained from the Washington Department of
Fish and Wildlife.

Right -of -Way Improvements
See the Traffic Division comments from Senior Transportation Planning Engineer Sarady Long for
traffic related items.
2. If dedication of additional right-of-way is required to install street frontage improvements, the dedication
shall be conveyed to the city through a statutory warranty deed. The dedicated area must have clear title
prior to recording.
All stormwater treatment and detention requirements outlined above may apply to any improvements
within the public right-of-way.
EN Permit Issues
1. Engineered plans are required for clearing, grading, road construction, and utility work. Plans must be
reviewed and approved by the city. Engineering review fees are $3,004 for the first 18 hours of review for
commercial building permits, BSPs, and full subdivision EN permits. Additional review time is charged at
$167 per hour. A final TIR shall be prepared for the project and submitted with the engineering plans.
Both the TIR and the plans will require the signature/seal of a professional engineer registered/licensed
in the State of Washington.
2. In addition to engineering approval, short plats and subdivisions are required to obtain a separate permit
for grading. Details and fees may be obtained from the Building Division.
3. To assist the applicant's engineer in preparing the plans and TO, the Federal Way Public Works Development
Standards Manual (including standard detail drawings, standard notes, and engineering checklists) is
available on the city's website at: www.citgvffederalway.eom/node/1467.
4. Bonding is required for all street improvements and temporary erosion and sediment control measures
associated with the project. The bond amount shall be 120 percent of the estimated costs of the
improvements. An administrative fee deposit will need to accompany the bond to cover any possible
legal fees in the event the bond must be called. Upon completion of the installation of the improvements,
and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original
amount and held for a two-year maintenance period.
The developer will be responsible for the maintenance of all storm drainage facilities (including the
detention and water quality facilities) and street systems during the two-year maintenance period. During
that time, the Public Works Inspector will make periodic visits to the site to ensure the developer's
compliance with the maintenance requirements. Upon satisfactory completion of the two-year
maintenance period, the remainder of the bond will be released. Maintenance for public roads and
subdivision drainage facilities then become the responsibility of the city. Maintenance for private roads
and drainage facilities, including short plats, remain the responsibility of the individual property owners.
6. When topographic survey information is shown on the plans, the vertical datum block shall include the
phrase "DATUM: N.G.V.D.-29" or "DATUM: K.C.A.S.," on all sheets where vertical elevations are
called out.
7. Drawings submitted for plan review shall be printed on 24" x 36" or 22" x 34" paper. Site plans shall be
drawn at a scale of 1" = 20', or larger. Architectural scales are not permitted on engineering plans.

8. Provide cut and fill quantities on the clearing and grading plan.
9. Temporary Erosion and Sediment -Control (TESC) measures, per Appendix D of the 2016 KCSWDM,
just be shown on the engineering plans.
10. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction.
PUBLIC WORKS — TRAFFIC DIVISION

Transportation Concurrency Analysis (FWRC 19.90)
1. The submitted application does not have adequate information for staff to determine trip generation for
the proposed development using the Institute of Transportation Engineers ITE's Trip Generation. A
concurrency permit and appropriate application fee will be required if the development project generates
new weekday PM peak hour trips. The PW Traffic Division will perform a concurrency analysis to
determine if adequate roadway capacity exists during the weekday PM peak period to accommodate the
proposed development. Please note that supplemental transportation analysis and concurrency mitigation
may be required if the proposed project creates an impact not anticipated in the six -year Transportation
Improvement Plan (TIP). The applicant has the option of having an independent traffic engineer prepare
the concurrency analysis consistent with city procedures; however, the fee remains the same.
Transportation Impact Fees (FWRC 19.91)
1. Traffic impact fees will be calculated at the time a completed building permit application is filed and must
be paid prior to permit issuance.
Transportation Impact Analysis (FWRC 19.135)
1. A Transportation Impact Analyses (TIA) to identify transportation impacts of development projects and
provide appropriate mitigation measures is required. The TIA shall assess additional project impacts
beyond those that were identified under the concurrency permit process conducted by the city. Mitigation
improvements necessary beyond those identified in the TIP to meet the city's adopted level -of -service
standards shall be provided by the applicant.
2. A Traffic Impact Analysis (TIA) prepared by engineer licensed in the state of Washington may be
required for this development project. The TIA will be limited to queuing analysis and other peaks LOS
analysis. The TIA should include the following analysis:
■ A specialized land use trip generation study;
■ Analysis of intersections impacted by 100 trips in the weekday morning and Saturday peak hours;
• Signal warrant analysis;
■ Left -turn lane warrant analysis;
■ Intersection Sight distance analysis per AASHTO;
■ Queuing analysis of access points for morning, evening, and Saturday peak hours.

Street Frontage Improvements (FWRC 19.135)
1. Under a BSP application, the development will be expected to construct street improvements consistent
with the planned roadway cross -sections as shown in Map III-4 in Chapter III of the Federal allay
Comprehensive Plan (FWCP) and Capital Improvement Program (CIP) shown as Table III-10 (FWRC
19.135.040). The applicant will be expected to construct improvements on the following streets to the
city's planned roadway cross -sections:
■ Twenty -First Avenue South is a Minor Collector planned as a Type "Q" street, consisting of a 40-
foot street with curb and gutter, 12-foot sidewalks with street trees, and decorative streetlights in a
70-foot right-of-way. Assuming a symmetrical cross section, additional right-of-way dedication and
half street improvements are required as measured from the street centerline.
■ Pete Von Reichbauer Way South is a Principal Collector planned as a Type "L" street, consisting of a
44-foot street with curb and gutter, 12-foot sidewalks with street trees, and decorative streetlights in a
74-foot right-of-way. Assuming a symmetrical cross section, a seven -foot right-of-way dedication and
half street improvements are required as measured from the street centerline.
Map III-4 in the FWCP depicted an east -west grid road within the subject property. The planned grid
road would be constructed to a Type "Q," consisting of a 40-foot street with curb and gutter, 12-foot
sidewalks with street trees, and decorative streetlights in a 70-foot right-of-way. The applicant will be
expected to construct this east -west grid road to city standards, and dedicate the necessary right-of-
way to accommodate the improvement. The grid road would extend from 2Pi Avenue South, south
of the Federal Way Transit Center to Pete Von Reichbauer Way South and South 318th Place. Please
coordinate with Sound Transit on the conceptual grid road alignment.
2. Tapers and transitions beyond the project frontage may be required as deemed necessary for safety
purposes. The taper rate shall be WS2/60, or as directed by the Public Works Director.
3. The applicant may make a written request to the Public Works Director to modify, defer, or waive the required
street improvements (FWRC 19.135.070). These modification requests currently have a nominal review fee.
4. Block perimeters shall be no longer than 1,320 feet for non -motorized trips, and 2,640 feet for streets
(FWRC 18.55.010 and FWCP Policy TP4.2).
Access Management (FWRC 19.135)
1. Access management standards are based on roadway safety and capacity requirements. FWRC 19.135.280
provides access standards for streets based on planned roadway cross -sections. Access may be further
restricted if such access would interfere with the 95th percentile queue lengths from any existing traffic
control device.
2. Driveways must be located no closer than 150 feet to any street intersection, or to any other driveway,
whether "on or off the subject property. The Public Works Director may grant a modification
administratively to reduce spacing standards by up to 20 percent of the tabular values with supporting
documentation (FWRC 19.135.290). Please note that these modification requests have a nominal review fee.

4. Minimum throat length for non -single-family driveways shall be 40 feet minimum, 50 feet desirable. Throat
length is measured from the face of curb (or edge of traveled way if no curb exists) on the public street to
the first conflicting drive aisle or parking movements that would conflict with entering and exiting traffic.
Design Criteria (FWRC 18.55)
1. Block perimeters shall be no longer than 1,320 feet for non -motorized trips, and 2,640 feet for streets
(FWRC 18.55.010 and FWCP Policy TP4.2). Additional connections are required to address this
requirement. Improvements must be completed prior to recordation of the binding site plan.
2. All lots shall be accessed by a public street right-of-way (FWRC 18.55.020). In certain cases, lots may be
accessed by an ingress/egress and utilities easement or alley subject to the requirements established in the
City of Federal Way Public Works Development Standards.

valid for one year from the date of issuance. If a certificate is needed, allow one to two working days to issue
for typical processing. The 2019 cost for a Water Certificate of Availability is $70.00.
■ If required right-of-way improvements off/along the west side of the property affect existing Lakehaven
water system facilities, and/or if any existing water distribution facilities are required to be relocated, a
Lakehaven Developer Extension (DE) Agreement will be required to construct new water distribution
facilities necessary for the proposed development. Additional detail and/or design requirements can be
obtained from Lakehaven by completing, completing, and submitting a separate application to Lakehaven for
either a Developer Pre -Design Meeting or a Developer Extension Agreement. Lakehaven encourages the
owners/developers/applicants to apply for Lakehaven processes separately to Lakehaven, and sufficiently
early in the pre-design/planning phase to avoid delays in overall project development.
Sewer
0 A Sewer Certificate of Availability issued separately by Lakehaven may be required to be submitted with any
land use and/or building permit applications (check with land use agency for requirement). The certificate is
valid for one year from the date of issuance. If a certificate is needed, allow one to two working days to issue
for typical processing. The 2019 cost for a Sewer Certificate of Availability is $70.00.

Please accept this letter and accompanying materials as our request to schedule a Pre -
Application Conference with the City to discuss a proposed commercial subdivision of the
Center Plaza Shopping Center. The subject property is located south of Town Square Park and
includes King County tax parcel 0921049297.
The property owners of this parcel are seeking approval to subdivide it into three commercial
lots as illustrated on the enclosed conceptual site plan. No changes to building footprint are
anticipated for proposed lots 1 and 2. As you are aware, the building located on proposed lot 3
was demolished.
No modifications to site access are requested as each of the proposed lots will have an existing
access point on the property. If required, a blanket access easement can be created to
accommodate parking and vehicle circulation. It is ESM's understanding that Pete von
Reichbauer Way S (PVR) is classified as a principle collector with a cross section Type 1". A
cursory review of available data shows that the proposed project street frontage on PVR will
require additional dedication of approximately 7 feet to accommodate the required street type.
Furthermore, it is ESM's understanding that 21 st Avenue S is classified as a minor collector with
a cross section Type "Q". It appears that the City made right-of-way improvements to 21 st
Avenue S between 2015 and 2017 as illustrated on King County's iMap. Improvements included
installation of a 12-foot wide sidewalk, street trees, and lighting.
Questions:
• Is ROW dedication required on each street frontage?
• Are street frontage improvements required?
• If street frontage is required, can they be deferred until building permit
application?
• Does the proposed BSP trigger any site improvements?
