Dear Mr. Jonas:
The City of Federal Way has completed an administrative review of the Boundary Line Adjustment
(BLA) application to alter the interior lot line between tax parcels 218820-1020, 218820-1030, and
218820-1060. The application was deemed complete on September 7, 2017.
The Department of Community Development hereby approves the BLA with conditions based on the
survey drawing prepared by Wessel, Jonas & Assoc., received on August 10, 2017, and resubmitted on
October 13, 2017 and November 6, 2017.
BACKGROUND
The applicant proposes to alter the interior lot lines between three parcels to create two parcels in the
Single -Family Residential (RS 15.0) zone. The minimum lot size in an RS 15.0 zone is 15,000 sq. ft. per
Federal Way Revised Code (FWRC) 19.200.010. Proposed Parcel A has a net area of 27,200 sq. ft. and
Proposed Parcel B has a net area of 25,500 sq. ft. There is a 25-foot ingress, egress, and utilities easement
along the east property line of both parcels. As proposed, the parcels meet the minimum lot size
requirements.
DECISIONAL CRITERIA
City staff has determined the BLA meets decisional criteria set forth in FWRC Chapter 18.10:
1. The BLA is a minor alteration in the location of lot boundaries on existing lots. The BLA will
not increase the number of lots, nor diminish the size of open space or other protected
environments.
2. The BLA will not diminish the size of any lot so as to result in a lot of less square footage
than prescribed in the RS 15.0 zoning district.
3. The BLA will not result in the reduction of setbacks or site coverage to less than prescribed in
the RS 15.0 zoning district.
4. All lots resulting from the BLA will be in conformance with the design standards of the city's
subdivision title.

CONDITIONS OF APPROVAL
The following comments must be revised on the final BLA drawing prior to recording.
1. The applicant is responsible for obtaining King County Health Department signature on the BLA
drawing.
2. The survey stamp is expired. The final BLA drawings will require a valid survey stamp.
3. The lot area for Parcel A differs from the lot closure calculations. Please revise accordingly.
RECORDING
Pursuant to FWRC 18.10.060, all BLAB shall be recorded with the King County Division of Elections and
Records. To finalize the BLA process, please use the enclosed Resubmittal Information form and submit
to the Permit Center one signed and notarized drawing (mylar or paper), two paper copies of the
signed/notarized drawing for city signatures.
Please note: Per state law, on the drawing all signatures and writing shall be made with
permanent black ink, including notary stamps.
After city signatures are obtained, the applicant must record the BLA with King County. Please return one
conformed copy to the city immediately after recording. No changes to the BLA document are allowed
following city signature. If the county recording process necessitates revisions to the BLA map, you must
request and receive approval of any change from city staff prior to recording.
CLOSING
This land use decision does not waive compliance with future City of Federal Way codes, policies, and

3. GRANTEES' PROPERTY. Grantees are individual owners of all lots in Blocks 8,
g, 10, 11, 21, and 22 in the Plat of East Tacoma, according to the Plat thereof recorded in
Volume 4 of Plats at page 50 in the records of King County, Washington.

4. EASEMENT GRANT. Grantors hereby warrant and dedicate to
Grantees, together with all after -acquired title of Grantors therein, a permanent, non-
exclusive easement for ingress, egress, and utilities and also the right to make
necessary cuts and fills upon the easement for reasonable grading over, across, and
under the real property described as follows:
THE EAST TWENTY-FIVE (25) FEET OF THAT PORTION OF VACATED ROADS
THAT ADJOIN LOTS 1 THROUGH 12, BLOCK 8, EAST TACOMA, PURSUANT TO
THE STIPULATION AND ORDER UNDER KING COUNTY SUPERIOR COURT
CAUSE NO. 09-2-29271-0, WHICH PLAT IS RECORDED IN VOLUME 4 OF PLATS,
PAGE 50, RECORDS OF KING COUNTY, WASHINGTON;
5. PURPOSE OF EASEMENT. Grantors intend to establish and convey a non-
exclusive easement for ingress, egress, and utility purposes and uses related to the installation,
construction, repair, and maintenano6 thereof. The purpose of any road constructed,
maintained, restored, repaired or Improved under this Agreement and any easement granted
under this Agreement is to provide rights of ingress, egress, and utilities installation for all
parcels in Blocks 8, 9, 10, 11, 21, and 22 in the Plat of East Tacoma, which are currently served
by First Avenue South and First Avenue Southwest.
6. RESTRICTIONS. This grant is subject to the following restrictions: (1) under no
circumstances shall the easement granted herein be used for public road purposes without the
express written consent of Grantors, their successors or assigns; and (2) under no
circumstances shall the easement granted under this Agreement ever be used as a "through"
roadway without the express written consent of Grantors, their successors or assigns.
7. DUTY OF IMPROVERS; RESERVATION,FOR FUTURE MAINTENANCE
COVENANTS. Subject to paragraph 6 above, a Grantee-chosing to improve the easement
shall bear the cost of the improvement and shall have the•affirinative duty not to cause damage
to the easement. In the event of damage to any improvements: installed in the easement, such
damage shall be repaired at the sole cost and expense of the party causing the damage.
Grantors, for their successors and assigns, hereby reserve the right to impose additional
maintenance obligations on Grantees in the future.
8. BENEFIT. This restrictive covenant shall run with the land and shall be binding
upon the heirs, successors and assigns of Grantor and Grantee and on anyone having or
acquiring any right, title, or interest in the real properties described herein or any part thereof.

Slisenko Boundary Line Adjustment application. City departments have provided the following
comments that will need to be addressed prior to approval of your application, or as otherwise noted_
1. Use the City's most cun-ent version of the BLA Title Block. Please contact Kevin Peterson at
253-835-2734 or kevin.peterson@cityoffederaIway. coin to obtain the most current CAD file.
2. Add the City file number (File #17-103859-00-SU) in the space provided in the Title Block.
3. Add Bearings and Distances for the overall exterior boundary lines and all proposed new lot lines.
4. Identify which Datum the vertical benchmark is based upon.
5. Eliminate the `O' from the heading 'Revised Legal Description' on Sheet 1.
6. Include the name of the BLA in the lower right corner of the drawing.
7. The 25-foot ingress, egress, and utilities easement should reference the recorded easement
document, King County Recording #20161118002279.
CLOSING
Once the revisions listed above are made, provide four paper copies of the BLA document with the
enclosed resubmittal form.
Pursuant to FWRC 18.05.080, if an applicant fails to provide additional information to the city within
180 days of being notified that such information is requested, the application shall be deemed null
and void and the city shall have no duty to process, review, or issue any decisions with respect to
such an application.

Dear,_Max:
A review of the above referenced parcels was conducted on September 28, 2016.
The desired intent of the three lots was to utilize a lot line adjustment with the City
of Federal Way to make two lots 170 x 150 with the purpose of constructing two 4
bedroom residences on each lot. This letter addresses the southerly most lot, and
its ability to have a drainfield, reserve area and a residence with a footprint of
approximately 2400 square feet. A total of four holes were dug on the proposed .5
acre lot. The soils were generally consistent, with an eight inch layer of topsoil,
underlain with thirty inches of sand and gravel, and eight inches of more compact
sandy gravel. The system that I would recommend be designed for the site would
be a gravity system as the soils are good to a 5 foot depth and there is no
indication of mottling or high winter water table. By making a rough layout of the lot
with a 40 x 60, 4 bedroom residence including all of the setbacks required by the
County, it appears that there is 5000 square feet available for the drainfield and its_
100 percent reserve area. This is an ideal layout and in the field when laying out
the system there will possibly require more area because of ground undulations
and working around tree roots and stumps. I'm not sure where the driveway would
be located, but it is my opinion that there is adequate room to accommodate the
driveway. A critical area review by King County will be required, and any wetlands
on the site will have to be identified, and the boundary line adjustment must be
complete before a design for a septic system can begin.

This soils review does not guarantee an approved system for the site, and a full
design will need to be submitted to the Seattle -King County Health Department for
their review and approval before a building permit may be obtained. The Health
Department has the authority to approve or disapprove designs for the site
depending on their review of a design.
