Hi Sergey,
I reviewed your proposal with Isaac and we have come to the conclusion that a reasonable size house would be a building footprint up
to 1,600 sq. ft., including garage, limited to the 30-foot (above average building elevation) height maximum. As proposed, your current
design is larger especially with a three car garage, the overall house footprint will need to be reduced. The septic system would need to
be placed as far away from the wetland as possible with drain field size as required by Public Health Dept. The driveway or septic
system area would not be included in the building footprint.

wetlands in Federal Way. The city has a simplified rating system for wetlands, any wetland larger
than 1 acre is a Category II.

Planning staff has reviewed your single-family building permit for a proposed new house located at the
above -referenced address. A review of the material you submitted indicates the following issues that must
be addressed prior to building permit approval.
GEOTECHNICAL REPORT
The subject property is in an area identified as being geologically hazardous (landslide hazard area).
Please submit a geotechnical report that addresses the criteria established in Federal Way Revised Code
(FWRC) 19.160.010(2) and (3). The report should address what types of geologically hazardous areas
exist; impacts to the slope and adjacent properties that may result from the construction activity; and
measures to avoid or mitigate those impacts. Also, the report should evaluate the adequacy of the
proposed erosion/sedimentation control measures (silt fencing). The city may choose to utilize our third
party geotechnical engineering firm to review the report submitted by your geotechnical engineer. If so,
the cost of this review would be at the applicant's expense.
REGULATED WETLAND
■ As you have indicated on the site plan, a portion of a category III wetland is located on the south and
west part of the property. The associated 50-foot wetland buffer is also depicted and takes up a majority
of the site. However, no wetland report was submitted with the permit to verify these conditions.
• The city has a wetland report on file for the property, prepared by J.S. Jones and Associates, Inc.,
dated June 5, 2006. This report is outdated and a revised/updated report is necessary. Please submit a
current wetland report prepared by a qualified biologist that delineates the wetland and buffer area;
also, clearly indicate what work will be done in the wetland and wetland buffer. The city may choose
to utilize our third party biologist to review the submitted report at the applicant's expense.
■ The site plan depicts the southwest corner of the proposed house and patio intruding into the 50-foot
wetland buffer. Also, it is unclear what type of utility work will be intruding into the buffer along
Dash Point Road South. Please verify where water and sewer will be connected, from 28`' Avenue
South or Dash Point Road. If the utilities are being brought up through Dash Point Road, then it will
be intruding completely through the 50-foot buffer and wetland itself.

+ Per FWRC 19.175.040, and as part of the building permit, no land surface modification may take
place and no structure or improvement may be located within a regulated wetland buffer. If there are
intrusions into the wetland or wetland buffer (temporary or permanent), land use review will be
required prior to building permit approval. Based on the evaluation of the wetland report and the
extent of the intrusions, the city will determine what land use process will be required.
■ As depicted on the site plan, the step retaining wall is located on the edge of the 50-foot buffer. The
retaining wall must be located outside the buffer so when constructing the retaining wall, the buffer
will not be impacted. Please depict the wall setback from the buffer edge a distance adequate to
ensure that work, including excavation, does not intrude into the buffer. Also, please detail the height
and material composition of the retaining wall.
Please note: a separate building permit is required for retaining walls over four feet in
height. Per FWRC 19.120.120(1), retaining walls shall not exceed a maximum height of
six feet.
Be aware that construction staging and equipment cannot be located in the wetland buffer area. In
order to stay out of the buffer, the improvements may have to be reduced or moved to adequately
provide room for excavation, foundation, and/or general maneuvering around the building. A
construction fence/physical barrier is required during construction to prevent disturbance to the
wetland buffer. The construction fence must be located outside the buffer so when digging and setting
the silt fence, the buffer will not be impacted. Please depict the fence location on the site plan.
+ Prior to approval of the building permit, the city will prepare and record, with King County Recorder's
Office at the expense of the applicant, a restrictive covenant against the property. The covenant will
state that no land surface modification may take place and no structure or improvement may be located
in the wetland buffer. Only passive recreation activity can take place in a wetland buffer.
SITE PLAN
A redlined site plan is provided with the following comments:
+ The site plan notes, "proposed building footprint elevation to be 3' max." It is unclear what this is
referring to. Please clarify or remove from the site plan if not applicable.
+ There are a circled 1 and 2 on the site plan; however, no details that correlate to them. Please identify
what these noted numbers indicate.
■ The site plan depicts bold line segments along Dash Point Road's buffer impact area and near the
front of the house. Please identify what these lines represent.
BUILDING HEIGHT
More information is needed to confirm if the building height meets the 30-foot maximum height limit.

lowest. Please identify both the existing grade and proposed finished grades around the building.
TREE AND VEGETATION RETENTION
Identify the number of tree units retained per FWRC 19.120.130. The minimum requirement is 25 tree
units per acre. The number of tree units is calculated by multiplying the gross site acreage, minus any
regulated critical areas (excluding buffers), by the required tree density. It is unknown how much of the
site area is covered by wetlands. Please provide the tree unit density for the site excluding the regulated
wetland area. If that number will not be retained, planting will be required per FWRC 19.120.130(4).
Please depict the tree unit calculation on the site plan. Show tree retention fencing around retained trees in
close proximity to construction activity pursuant to FWRC 19.120.160. Also, show which trees are to be
removed. Trees located within the wetland buffer can be credited towards satisfying the tree unit per acre
requirement.

On January 16, 2015, the City of Federal Way received your request for third party review of the Wetland
Assessment of the Adzhigery property (dated May 28, 2014) prepared by J.S. Jones and Associates. Per
the report, the wetland was delineated and classified as a Category II wetland with a 100-foot buffer. As
depicted on the Wetland Map Survey (dated May 7, 2014) prepared by Encompass Engineering &
Surveying, a majority of the site is encumbered by the wetland and/or wetland buffer.
WETLAND REPORT
The City forwarded your request to our wetland consultant, Grette Associates, for their review. Grette
Associates completed a site visit to the subject site and reviewed relevant documents. Biologist Chad
Wallin prepared a technical memorandum (dated February 12, 2015) in which he stated that the J.S. Jones
and Associate report appears to have characterized the wetland and associated buffer accurately. The
wetland is a Pahtstrine Scrub/shrub Forested wetland, Category II with 100-foot buffer. Based on the
plans submitted for the associated single-family building permit under review (File # 14-100487-00-SF)
the entire house footprint would be located in the wetland buffer.
REVIEW PROCESS
Based on the findings of the wetland report, the following review processes are required to construct a
single family house within the buffer area of the above -mentioned property.
Intrusions into a regulated wetland bufer — As mentioned in the wetland report, all relevant portions of
the property are impacted by the wetland and wetland buffer. The constriction of a single family house
would intrude into the buffer. Ordinarily, your next step would be to request a reduction of the wetland
buffer in accordance with Federal Way Revised Code (F)VRC) 19.175.040(5). However, the maximum
reduction allowed under that section is 50% and it appears the house improvements would intrude more
than that; the exact amount of intrusion is unknown at this time. Therefore, pursuant to FWRC
19.150.040, Reasonable use of the subject property, you may request a modification or waiver of the
buffer requirements to allow "reasonable use" of the property based on the following criteria:
a) The application of the provisions of this division eliminates all reasonable use of the subject
property.
b) It is solely the implementation of this division, and not other factors, which precludes all
reasonable use of the subject property.

c) The applicant has in no way created or exacerbated the condition that forms the limitation on the
use of the subject property, nor in any way contributed to such limitation.
d) The knowledge of the applicant of limitations on the subject property when he or she acquired the
subject property.
e) The waiver or modification will not lead to, create, nor significantly increase the risk of injury or
death to any person or damage to improvements on or off the subject property.
For projects on single-family residential lots, a reasonable use modification or waiver requires Process III
land use review. Process III is an administrative review conducted by city staff with a final decision
issued by the Director of Community Development.
It is the applicant's responsibility to show how the proposed wetland intrusions meet the criteria of
FWRC 19.150.040. The intrusion must be the minimum necessary to provide the applicant with some
reasonable use of the subject property. The city may impose any limitations, conditions, and restrictions
as appropriate to reduce or eliminate any undesirable effects or adverse impacts of granting a reasonable
use request.'
CLOSING
The formal application must be prepared in accordance with the City's Development Requirements
checklist (enclosed) and must be accompanied by the appropriate fees. As fees change annually, please
contact Development Specialist staff at the time of submittal for the current Process III application fees

Finally, the City is preparing amendments to update the Critical Areas Chapter of the FWRC, which
should be effective June 2015. At this time staff does not have draft codes for regulated wetlands, but
more information will be available soon. Although your development proposal has not been evaluated
against this update, you may discuss with staff the impact, if any, the amendments would have on your
proposal in the next 3 to 4 weeks.

WETLAND AND STREAM REVIEW
BASIC SERVICE
The City of Federal Way's consulting wetland and stream scientists can provide a flat fee service to review limited
wetland and stream site conditions. A nonrefundable flat fee of $1,050.00 generally provides the following services:
• Two hours of wetland or stream study review
• Equivalent of a two hour site visit by two scientists
• Preparation of a brief memorandum
• Coverage of various reimbursables
This service is designed to review existing wetland and stream reports and field verify flagged delineations and
ratings on smaller properties. This service is generally limited to properties less than one acre in size with only

Task 100 — Site Assessment and Wetland Assessment Review
The City of Federal Way has requested Grette Associates complete a third party wetland assessment
review for consistency with the requirements of chapter 19.175 of the Federal Way Revised Code
(FW RC). Grette Associates will visit the site (King County Tax Parcel 416660-0600) located at 30523 8th
Avenue SW, in Federal Way, WA, and perform a visual assessment of the conditions described in the
application documents. The submittal documents will be reviewed for completeness, accuracy, and
compliance with the standards of the current version of the FWRC. Specifically, the wetland(s) discussed
in the report will be verified and a categorization will be applied based on FWRC 19.175.200.
Per the existing Professional Services Agreement between the City of Federal Way and Grette Associates,
the wetland assessment review services shall be performed for a flat fee of $1,050.
Fixed Review Fee Amount: $1,050.00
The fixed fee amount includes the review of documents in possession of Grette Associates at the time of
contract scoping. Review of additional or revised documents may require an amendment to this contract.
Grette Associates will seek authorization from the City prior to providing any additional review services
that will exceed the review fee.
It is the responsibility of the applicant to ensure Grette Associates has permission to access the portions of
the property pertinent to the review of the critical area documents.
This scope of work will be conducted pursuant to the terms and conditions of the Professional Services
Agreement executed between the City of Federal Way and Grette Associates, LLC on August 1, 2013.

CLIENT AUTHORIZATION:
The undersigned authorizes the above requested services and agrees to pay for these services within 30
days of receiving the invoice. Failure of payment within the specified 30-day period will result in a late
payment penalty of a $70.00 processing fee and an interest charge of 2% of the past due amount levied at
each subsequent invoice cycle.
In consideration of Consultant's agreement to perform the services set forth above, Client and Consultant
agree to limit the liability of Consultant to Client, and to all other persons or entities, arising from
professional acts, errors, or omissions of Consultant, and for liability arising out of or relating to this
contract, such that the total aggregate liability of Consultant, including attorney's fees awarded pursuant
to this Agreement, that all those named shall not exceed $50,000 or the total fee of Consultant for the
services rendered under this agreement, whichever is greater.
This contract will expire if it remains unexecuted for 60 days after the above listed date. If client wishes
to pursue this work after 60 days' time, Grette Associates staff may issue a new contract based current
workload availability and rate status.
This agreement may be terminated at any time by the Client upon written notice to the Consultant, or by
the Consultant upon written notice to the Client. In the event of such termination by the Client, the Client
shall pay to the Consultant all costs of work performed to the date of termination.
