The ADU application is hereby approved pursuant to the findings presented by the department's Planning Division staff and the conclusions based on those findings. FINDINGS OF FACT The following findings are based on site, floor, and elevation plans received with the ADU application on November 27, 2013. 1. Proposal— The applicant proposes to construct an attached Accessory Dwelling Unit (ADU) within an existing single-family house located at 29415 100, Avenue SW, Federal Way, WA 98023. The ADU is located in the basement/crawl space of the house and no change in the footprint is proposed. 2. Zoning— The subject property is an 18,240 square -foot (0.42 acre) lot located within a single-family low density residential comprehensive plan and RS 15.0 zoning designation. 3. Floor Plan — The total square footage of the proposed ADU living area is approximately 781 square feet, including a living room, kitchen, master bedroom and bathroom, and a shared utility room. The principal dwelling unit building permit identifies the livable area as 4,286 square feet; therefore, the proposed ADU qualifies for a maximum of 800 square feet of livable area. The primary entrance for the ADU is via an entrance door on the north side of the house. 4. Parking— The site plan depicts an existing single -car garage, double -car garage, and existing concrete driveway. As such, there is sufficient amount of parking for the required one on -site parking for the ADU. 5. Required Yardf & Hei�ht — The proposed ADU structure is located in the basement of the existing house, which meets all the current setbacks and height requirements. 6. Lot Coveraue — There is no change in the lot coverage. Owner Occupancy — The p t has submitted a signed letter of application and deed restriction stating the owner shall occupy one o the two dwelling units as a permanent residence for six months or more of the calendar year. When the ADU is completed, city s taff will record the Letter qfApplicalion and Deed Restriction with King County. The ADU restriction will remain recorded against the property. CONCLUSIONS The following conclusions are based on the above findings of fact. 1. The proposal is consistent with policies of the .Federal Eqy Comprehensive Plan. 2. The proposal meets density, square footage, parking, occupancy, and dimensional requirements of the ADU Use Zone Chart within Federal Way Revised Code (FWRC) 19.200.180. 3. The ADU is subordinate and incidental in size, scale, and design to the primary dwelling unit. BUILDING PERMIT REQUIRED This ADU decision does not constitute building permit approval. Building permit #13-105313-00-SF for the ADU and house addition is under review by Public Works, Planning, Building, and Fire Department staff. Final inspections for the completed ADU and house addition will be conducted as part of a building permit process associated with this project. CLOSING This ADU decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. The proposed improvements include an attached ADU with utility room and bedroom proposed as an addition to the main house. According to city records, the total square footage of the primary dwelling unit is 4,286 square feet; therefore, the maximum allowable size of the proposed ADU is 800 square feet. T ECMIICAJ. COMMENTS In order to continue review of the proposed ADU, the following technical comments detailed below must be addressed: 1. Floor Plan —According to proposed plans, the expansion of the basement will include an ADU unit, a shared utility room, and a bedroom addition to the main house. As depicted, the ADU includes a living room, nook, kitchen, master bedroom, bathroom, and utility room, which exceed the maximum allowable size requirements for an ADU. In order to meet size requirements of the ADU, the area must be reduced to 800 square feet or less. One way to accomplish this is to replace the internal door to the utility room with a solid wall. Please revise the ADU plans as well as the building plan sets to meet this requirement. 2. Letter of Application — The department has not received the letter of application/deed restriction stating that the owner(s) shall occupy one of the dwelling units on the premises for six months or more of the calendar year. Prior to the final building inspection of the new ADU, please return the signed and notarized Letter of Application & Deed Restriction to my attention in accordance with note #11, FWRC 19.200.180, along with a cheek for recording fees payable to the City of Federal Way'. When the ADU is completed, City staff will record the Letter of Application and Deed Restriction with King County. The ADU restriction will remain recorded against the property. CLOSING When resubmitting the requested information, please submit four copies of plans accompanied by the enclosed Resubmittal Information form.
