In summary, the permit application is to construct a 1,024 square foot addition atop an existing single -story detached garage. Based on records for the property and in the application'materials, the building addition as proposed would result in the detached garage being larger than the existing primary residential structure. This permit application cannot be approved as proposed, due to the size of the detached garage being larger than the single-family residence (principal structure) on the property. Ding County records indicate the existing single-family residence is 1,200 square feet in size. The permit application site plan indicates the roof area at the main house is 1,732 square feet. The site plan references the 1,732 square footage (reference permit 16-105189-SF). However, it appears the house addition proposed under permit 16-105189-SF was not constructed. You will need to clarify square footage of the existing residence (principal building). King County records and the permit application plans indicate the existing detached garage structure has an existing square foot of 1,024. Therefore; with the proposed 1,024 square foot addition to the detached accessory structure, the detached accessory structure would be larger (2,048 square feet) in size than the existing principal building (house) (2,048 > 1,200 or 1,732). Pursuant to FWRC 19.265.010(3), an accessory building total gross floor area and footprint must be less than the total gross floor area and footprint of the principal building on the subject property respectively- City records and the permit application indicate the proposed addition would result in an accessory structure larger than the principal building (house) on the subject property. FWRC 19.265.010 Accessory uses, buildings, and structures. (1) Generally. In order to meet the zoning code requirements, the accessory structure must be smaller than the principal structure as identified above. ADU — Please note, ,in addition to the comment above regarding the building size, the second story of the proposed detached structure appears to resemble a dwelling unit, or accessory dwelling unit (ADU) as the notes on page A-0 reference sleeping rooms and the floor plan includes bathroom facilities, rooms with closets, etc. Either the structure will need to be designed, constructed, and permitted as an ADU pursuant to FWRC 19.200.180 and FWRC 19.265.020, or alternatively, you can record a private covenant documenting that this structure will not be used as an ADU. Please note that the city through this letter is not reviewing the addition as an ADU, and the structure as proposed may not meet ADU zoning standards and may exceed size limits and other zoning requirements for an ADU. An ADU covenant template draft is enclosed for your information and potential use, and would need to be completed and recorded prior to the issuance of the building permit. If you opt to proceed with the covenant, then sign and notarize the covenant (black ink only) and insert the legal description of the property in two places. The covenant document must be single sided. Submit the notarized and completed covenant and city staff will sign it as required and return it to you to record at King County Records and Elections. HOME OCCUPATION — It also appears the addition may be intended for a home business as the floor plan references a main studio, work rooms, and break room. If the detached garage is proposed for use as a home business then a home occupation business registration is required pursuant to FWRC 19.270. This visit was scheduled in light of issues detailed in a July 9, 2019, letter sent by Jim Harris regarding the failure to meet Federal Way Iteursed Cade (F%RC) 19.265.010(3). Namely, the proposal to construct an additional 1,024 square Coot detached accessory structure (permit 19-102302-00-SF) atop an existing 1,024 square foot detached garage structure would be larger (2,048 square feet) in size than the existing principal building (house) that is documented as 1,200 square feet per King County Department of Assessments records. City findings are documented below. On the August 14, 2019 visit, city staff accompanied Mr. Gorski through his home to view the property first-hand to determine if the size of the principal building was larger than the 1,200 square feet listed by King County records. Staff verified dint the basement meets the definition of habitable space per the 2015 Edition of the International Residewial Gode (1RC) as adopted in FVVRC 13.22.020, by measuring to ensure ceiling heights in the basement were greater than seven feet tall, that the space was heated, and possessed safe access into and out of the house. Photos of the basement provided by Brian Gorski's August 14, 2019, entails nre silso on 5ie in city records verifying staff on -site observations. Following the site visit, staff determined that the principal building (home) is in fact 2,400 square feet, as the first floor (1,200 square feet) and the basement (1,200 square feet) add up to this total. On December 18, 2019, the city received a recorded restrictive covenant (recording 201912040014491 filed by Brian Gorski. The covenant states, "The second floor of the detached accessory building is not an Accessory Dwelling Unit (ADU) [...] and the second floor of the accessory structure shall not be converted into an ADU without city approval." In conclusion, following the site visit and reception of the restrictive covenant, the city finds that the construction proposal for the accessory structure meets FVVRC 19265.010(3).
