The applicant proposes to subdivide one single-family residential lot into nine single-family residential lots, stormwater Tract "A", public road, and access easement Tract "B". The City received the application on October 13, 2016, and deemed it complete November 10, 2016. The City of Federal Way hereby grants conditional preliminary approval of the Daniel Lee Short Plat, subject to the conditions noted below. This preliminary approval corresponds to, but is not limited to, the following documents submitted by the applicant: 1. Three -page short plat drawing, prepared by ESM Consulting Engineers, LLC, date stamped resubmitted March 22, 2017 2. Engineering Plan sheets C1.0-C7.0, prepared by ESM Consulting Engineers, LLC, date stamped resubmitted March 22, 2017. 3. Preliminary Technical Information Report (TIR), prepared by ESM Consulting Engineers, LLC, date stamped resubmitted February 13, 2017. 4. School Access Analysis, prepared by ESM Consulting Engineers, LLC, date stamped resubmitted April 19, 2017. CONCLUSION This Decision of the Director is based on the enclosed Statement of Facts (Exhibit A) and is in accordance with the following criteria pursuant to Federal Way Revised Code (FWRC) 1830.1 10(2): 1. The proposed short subdivision is consistent with the comprehensive plan; 2. The proposed short subdivision is consistent with all applicable provisions of this title; 3. The proposed short subdivision is consistent with the public health, safety, and welfare; 4. The proposed short subdivision is consistent with the ten -item subdivision purpose statement listed in FWRC 18.05.020; and 5. It is consistent with applicable development standards listed in the subdivision code's desicln criteria, required improvements, other applicable ordinances or regulations of the city, and Revised Code of Washing -ton (RCW) 58.17.060 and 58.17.110. Mr. LaBrie April 25. 2017 Page 2 CONDITIONS OF APPROVAL The following conditions are reasonably necessary to eliminate or minimize any undesirable effects of granting the application. The following conditions are hereby incorporated as part of the short subdivision decision. Unless otherwise permitted in FWRC 18.30.280, all conditions shall be met prior to plat recording: 1) The applicant must obtain Engineering approval and authorization to proceed from the Public Works Department prior to construction of plat infrastructure. The engineering plans and technical information report must be revised per review comments provided on January 20, 2017, and submitted for Engineering Review. 2) A streetlight along 6`" Ave SW and internal road is required. Prior to the City's approval of engineering plans, the applicant shall submit a streetlight plan to the Public Works Department for approval. The streetlight plan must be prepared by a licensed engineer and shall meet the streetlight standards. 3) A revised Tree Preservation Plan is required to be submitted wish the EN drawings. The plan must depict where the tree units will be provided on -site and a revised tree unit calculation. 4) Lot 6 access will be determined during engineering review. 5) Prior to recording, a separate statutory warranty deed for public right-of-way dedication will be required. A legal description and exhibit map, stamped and signed by a PLS, must be provided. 6) Prior to recording, the applicant shall provide the City's Parks Department a fee -in -lieu payment for open space in the amount of 15 percent of the most recent assessed land value of the subject property and provide a voluntary letter authorizing the city to use the open space fee -in -lieu in any of the Parks Planning Areas the city wishes. 7) Prior to recording, the addresses identified in item #17 shall be depicted on the face of the short plat document. 8) Prior to recording, "Road A" should be labeled as SW 360"' Place on the short plat drawing. 9) Prior to recording, the existing single family house and accessory structures must be removed. 10) The applicant is required to pay a transportation impact fee (TIF) for each lot. The fee will be assessed and collected from the applicant when the building permit is issued, using the fee schedule then in effect. ENGINEERING REQUIREMENTS Preliminary approval of the short plat does not constitute approval for land clearing or grading, vegetation removal, or any other activities that otherwise require perm its from the City. Prior to construction of any improvements, the applicant must receive engineering approval for all road improvements and storm drainage facilities. No permits or authorization to begin construction or site work will be granted until final approval of all engineering plans, the payment of all fees, and the submittal of performance securities, as may be required. RECORDING Upon completion and inspection of all required frontage improvements, stormwater facilities, and other infi-astructure improvements, the applicant shall submit as -built plans to the Public Works Department for review. APPEAL PROCESS Pursuant to FWRC 18.30.140, any person who is mailed a copy of this decision may appeal the decision within 14 calendar days of the date of issuance. These facts are in reference to King County tax parcel number 302104-9051 located at 36027 6°i Avenue SW, Federal Way. 1. Proposal — The applicant proposes to subdivide one existing 136,540 square -foot (3.13-acre) single- family lot into nine single-family residential lots and one stormwater tract. As shown on the short plat, the following are the net square footage for each lot/tract: Lot 1 10,230 sq. ft. Lot 7 9,710 sq. ft. Lot 2 9,910 sq. ft. Lot 8 9,655 sq. ft. Lot 3 9,680 sq. ft. Lot 9 9,670 sq. ft. Lot 9,625 sq. ft. 11,035 sq. ft. (net) Lot 5 9,605 sq. ft. Tract A 24,990 sq. ft. Lot 6 9,630 sq. ft. Tract B 4,035 sq. ft. 2. Review Process — Pursuant to FWRC Chapter 18.30 `Short Subdivision Plats,' the proposed short plat is subject to administrative review and decision rendered by the Director of Community Development. The proposal has been reviewed by staff from the Department of Community Development, Public Works, Lakehaven Water & Sewer, and South King Fire and Rescue. City staff used the following FWRC development regulations when reviewing the short subdivision application: Title 16 `Surface Water Management;' Title 18 `Subdivisions;' and Title 19, `Zoning and Development Code.' 3. Site Profile — The subject property is located on the east side of 6"' Avenue SW, between SW 36151 Street and SW 356"' Street. The 3.14-arce parcel is currently developed with a single- family residence and associated garage, outbuildings, paved driveways, and landscaped areas. The remainder of the site is vegetated with a few trees, shrubs, and tall grasses. The property slopes gently to the north at 4 to 6 percent and there is a slope of approximately 15 percent in the northwest corner of the site. 4. Comprehensive Plan — The subject property's comprehensive plan designation is Single- Family— High -Density Residential. The proposal provides an urban density consistent with the Federal Way Comprehensive Plcna (FWCP) designation. The proposal meets relevant goals and policies'ofthe FWCP. 5. Density and Dimensions — The subject property is located within a Single -Family Residential (RS 9.6) zone with a minimum lot size requirement of 9,600 square feet. The proposal meets the density requirement as noted above. FWRC 19.200.010 "Detached Dwelling Unit" prescribes setbacks, height, parking, and lot coverage requirements. The proposed site plan depicts meeting the 20-foot front, 5-foot side, and 5-foot rear setbacks required by code. Lot 1 is a corner lot; the 10-foot side yard setback adjacent to the right-of-way is accurately depicted. Future building permit applications will be reviewed for compliance with these provisions. 6. State Environmental Policy Act (SEPA) — The nine -lot short plat is exempt from environmental review pursuant to Washington Administrative Code (WAC) 197-11-800(6)(d). 7. Public Notice & Comment — A Notice of Land Use Application for the short subdivision was published in the Federal Way Mirror and posted at the subject property and city designated notice boards on November 23, 2016. One comment letter was received via email on December 8, 2016, pertaining to runoft%stormwater, property lines, and trees. A copy of the decision shall be mailed to all interested parties. 8. Critical Areas — The City's Critical Areas Map does not identify any wetlands, fish and wildlife habitat resource areas, geologically hazardous areas, or critical aquifer recharge areas within the boundaries of the subject property. 9. Open Space — As the City continues to grow with each new development and increase in residents, the need for additional recreation demand will follow. Providing open space with the new development is necessary to address the recreation needs of the growing community. As part of the City's Parks, Recreation, and Open Space Plan (2013) the City has adopted the following core values, goals, and policies regarding recreation and open space: Core Value #3: Retain and Improve Our Open Space. Open spaces and natural areas in the City provide an array of benefits to people and wildlife and can contribute to enhancing water quality in the community. Core Value 45: Provide a Balance of Services for a Diverse Population. Understanding the population being served and providing programs and opportunities that reflect residents' needs and interests is a major goal of the Plan. Federal Way's park systern should provide a variety of options for active and passive recreation opportunities. Goal B.1: Improve and maintain all neighborhood parks to 777aximize safety, visibility, usability, appeal, and identity. Policy B.2: Plan for improvements to neighborhood parks based on their unique potential and designated role in the City. -wide systern. Policy B.3: Explore ways to allow for informal play opportunities by incorporating unprogrammed spaces such as fields and forested areas. Goal C.1: Maintain City parks and open spaces so that they are inviting to users and offer facilities and activities based on the potential of each property and community need. Policy C.1: Develop a more recognizable and inviting park and open space system. Goal L. I. Manage environmentally sensitive lands for long-term7 ecosystem health and biodiversity of natural systems, while making them accessible to the community. Policy L.1: Maintain open spaces so that they are accessible to residents. Goal N.1: Preserve privately -owned open spaces with envir077777ental constraints through incentive -based programs to provide `breathing -room' open space. Policy N.3: To gain maximurn effect on overall parks and recreation systern, audit and revise City code requirements for on -site open space, and revise to require contribution to larger parks system rather than small, on -site parcels. As proposed, the added residents in the 9-lot short plat will increase the dernand for recreation activities and usable open space. Pursuant to FWRC 18.55.060, in order to reasonably mitigate the impact of development, the appl [cant is required to provide open space in the amount of 15 percent of the gross land area of the property. As proposed, there is limited space to provide on - site open space and the applicant has requested that a fee in lieu of open space be provided. Statement of Pacts Page 2 Daniel Lee Short Plat I6-105007/Doc. I.D. 75489 The Parks Department has agreed to allow the applicant to pay a fee in lieu of open space as allowed by FWRC 18.55.060(2). Prior to plat recording, the applicant will be required to pay 15 percent of the most recent assessed land value of the subject property pursuant to limitations set forth in FWRC 19.100.070(1). The applicant must also provide a voluntary letter authorizing the city to use the open space fee -in -lieu in any of the Parks Planning Areas the city wishes. 10. Tree and Vegetation Retention/Replacement— Per FWRC 19.120.130(2), single-family residential zones are required to maintain a minimum of 25 tree units per acre. The total amount of tree units required for the short subdivision is calculated by multiplying gross site acreage, minus any proposed public/private street by the required tree density per FWRC 19.120.130(3). Per the short plat drawing, the gross acreage of the site is 3.13 acres and the right-of-way dedication is 0.42 acres, for a net total of 2.71 acres. The subject property requires 68 tree units (2.71 acres multiplied by 25 tree units per acre). The applicant proposes to retain 22 tree units on site requiring replacement of 46 tree units. Per engineering drawing plan sheet TP-01, Tree Preservation Plan, the tree unit calculation appears to be incorrect. The calculation is based on a 3.14-acre site and 0.30 acres right-of-way dedication for a net total of 2.84 acres requiring 71 tree units for the site. As part of the Engineering (EN) review, a revised Tree Preservation Plan is required. Please note, street trees cannot be calculated as replacem( nt tree unit credits. The plan must depict where the tree units will be provided on site and a revised tree unit calculation. 11. Concurrency — The city's Traffic Division reviewed the applicant's conctirrency application and concludes the proposed short subdivision will generate 10 new PM peak hour trips. Traffic Division staff have determined that all intersections impacted by one or more weekday evening peak hour trips from the proposed development would meet the level of service (LOS) standards with programmed improvements; therefore, a Capacity Reserve Certificate was issued October 31, 2016. 12. Transportation Impact Fee — In order to mitigate the impacts of new development on the city's street infrastructure, the applicant will be subject to the transportation impact fee (TIF). The fee will be assessed and collected from the applicant when the building permits are issued, using the fee schedule then in effect. 13. Access — Lots 1-5 will access via a new Type "W" roadway including a cul-de-sac and 28-foot- wide paved roadway. Curb, gutter, four -foot -wide planter strip with streetlights, five-foot sidewalk, and three-foot utility strip is required on the north side of the road. Right-of-way width shall be 44 feet. The City issued a street modification on November 1, 2016, modifying the required road section south of the road. Per the modification decision, a four -foot -wide landscaped strip will separate the road from the south property line. Lot 6 access will be determined during engineering review. Access to Lots 7-9 will be via a new 20-foot paved private road within a 27-foot-wide access easement, Tract "B." 14. Street Frontage Improvements — The applicant is required to provide street frontage improvements along 6"' Avenue SW. 6"' Avenue SW is a Minor Collector planned as a Type "S" street, consisting of a 36-foot street with curb and gutter, four -foot planter strips with street trees, five-foot sidewalks, and street lights in a 60-foot right-of-way. Assuming a symmetrical cross section, half -street improvements are required as measured from the street centerline. 15. Stormwater — The project is required to meet flow control and water quality standards outlined in the 2016 King County Sznface Water Design Manual and the Federal Way Addendum. I.D. 75489 applicant has proposed a stormwater detention pond (Tract "A") and combined water quality facility to meet applicable flow control requirements. The engineering plans and technical information report must be revised per review comments provided on January 20, 2017, and submitted for Engineering Review. 16. Schools — As part of the City's initial review of the proposal, the short plat application was rooted to the Federal Way School District for comments. Comments from the school district indicate Enterprise Elementary, Illahee Middle School, and Todd Beamer High School will serve the proposed subdivision. There is school bus transportation to Enterprise Elementary and Todd Beamer High School. The closest bus stop for both schools is at 6"' Avenue SW & SW 363' Place. Students would walk to Illahee Middle School. The school district requested that the applicant prepare a "School Access Analysis" to the elementary, middle school, and high school to assure safe walking conditions for students. The applicant provided a School Access Analysis on March 22, 2017, and resubmitted a revised plan on April 19, 2017. The school access analysis identifies a safe path of travel for students walking to and from school and to the bus stop. Final location and design of the school access route shall be approved by the Federal Way School District prior to issuance of construction permits for infrastructure improvements. A school impact fee is required to mitigate the additional new students this subdivision may add. The school impact fee is due at the time of building permit application for new dwelling units. This fee amount is subject to change as determined annually by the Federal Way School District. 17. Water and Sewer — The applicant proposes to serve the short subdivision with a public water supply and distribution system managed by Lakehaven Water & Sewer. The August 1, 2016, Certificate of Water Availability indicates Lakehaven's capacity to serve the proposed development via a Developer Extension Agreement. Water services require an improvement to the water system of 15 +/- feet of water main to reach the site. The applicant proposes to serve the short subdivision by a public sewer system managed by Lakehaven Water & Sewer. An August 1, 2016, Certificate of Sewer Availability indicates the district's capacity to serve the proposed development will require a Developers Extension Agreement. Sewer service requires improvements to the sewer system of 5 +/- feet of sewer main or trunk to reach the site. 18. Fire Requirements — South King Fire and Rescue has indicated an additional fire hydrant is required at lot 3. An automatic sprinkler system may be required for lot 9 due to fire access. Automatic sprinkler system requirements will be determined at the time of building permit application review. 19. Lot Addresses — The city's Building Department has assigned the following addresses to the proposed lots. Based on the letter, the City is requiring a cul-de-sac and full 20- foot-wide paved roadway with curb and gutter. A minimum four -foot -wide landscape strip is required to separate the road from the south property line. Total right-of-way width is 44 feet (larger than what has been proposed). This will need to be depicted on the revised plat drawings including revised lot square footage. Revisions to the layout may necessitate the elimination of a lot to meet code requirements. School service areas are reviewed each year and necessary boundary changes may be made to accommodate enrollment increases. Students living in this area receive transportation to Enterprise Elementary and Todd Beamer High School. The closest stop for Enterprise Elementary and Todd Beamer High School is at 6th Ave SW & SW 363rd PI. Bus stops are reviewed annually at student transportation needs change. Students would walk to Illahee Middle School. Student safety must be considered for all students who would walk to the schools and to school bus stops from this development. A question came up as to whether this is a short subdivision or a full subdivision. In 2007 the code changed and short subdivisions are nine or fewer lots. Based on past practice (when up to four lots was a short subdivision) tracts for stormwater/roads/open space have not been counted as lots for division purposes. You could have four residential lots, an open space, road, and stormwater tract and it is still a short subdivision. This is the first nine lot short subdivision since the code has been updated. Does the stormwater tract change the project to a full subdivision? Per FWRC 18.05.010, Definitions: "Short subdivision" means the division or redivision of land into nine or fewer lots, tracts, parcels, sites, or divisions for the purpose of sale, lease, or transfer, including the division of land into lots or tracts which are one -one -hundred -twentieth of a section of land or larger, or five acres or larger if the land is not capable of description as a fraction of a section of land. For purposes of computing the size of a lot, which is one -one -hundred -twentieth of a section of land or larger, or five acres or larger, and which borders on a street or road, the lot size shall be expanded to include the area which would be bounded by the centerline of the road or street and the side lot lines of the lot running perpendicular to such center lot line. I've attached the King County Short Subdivision FAQs which states 'A short subdivision may include any number of tracts (land reserved for special uses such as open space, surface water retention/detention utilities, or access). Tracts are not counted as lots, and they cannot be used as residential building sites.' This seems like a logical interpretation, the stormwater tract is not buildable and would not be further subdivided. Before proceeding with review we would like some clarification whether this is a short subdivision (nine or fewer) or full subdivision (ten or more).
