Statement of Facts
Federal Way Revised Code (FWRC) Chapter 18.30 `Short Subdivision Plats'
Lourie (Freemantle) Short Plat File 09-104423-00-SU / King County Parcel 062104-9042
The Planning Division hereby presents the following analysis to the Director of Community and Economic
Development pursuant to content requirements of the Short Subdivision written decision as set forth in Federal Way
Revised Code (FWRC) 18.30.110(4).
Proposal — The applicant proposes to subdivide one existing 2.33-acre single-family residential lot into four
lots, one ingress/egress and utility tract, and one stormwater facility tract. As shown on the short plat, the
following are total square footage calculations for each lot/tract: Lot 1-15,006 square feet; Lot 2 — 27,625
square feet; Lot 3 — 28,313 square feet; Lot 4—16,553 square feet; Tract A—10,111 square feet; and Tract B —
3,768 square feet.
2. Review Process — Pursuant to FWRC 18.30 `Short Subdivision Plats,' the proposed short plat is subject to
administrative review and decision rendered by the Director of Community and Economic Development. The
proposal has been reviewed by city staff, Lakehaven Utility District, and South King Fire and Rescue. City staff
used the following FWRC development regulations when reviewing the short subdivision application: Title 14
`Environmental Policy;' Title 16 `Surface Water Management;' Title 18 `Subdivisions;' and Title 19, `Zoning
and Development Code.'
Comprehensive Plan & Zoning — The subject property is within the Single -Family Medium Density
Residential and RS 15.0 designation.
4. Site Profile — The subject property is located in the northern portion of the city at the southwest corner of 8,'
Avenue SW and SW 296h Street. The subject property is rectangular shaped, with 316 feet of right-of-way
street frontage on SW 290 Street and 271 feet of right-of-way frontage on a Avenue SW. The King County
Assessors office currently lists the subject property as vacant land.
The 1973 King County soils survey map lists the soils type as Alderwood gravelly sandy loam (AgC), 6-15
percent slopes. The Alderwood series consists of moderately well drained soils with an erosion hazard that is
medium.
The site topography contains a northeasterly downward slope with a high point of 396 feet at the southwest
corner of the property and a low point of 354 feet at the northeast corner. The average slope inclination
across the site is approximately 9 percent.
The tree retention and landscape plan identifies 104 existing tree units on the subject property. A mixture of
deciduous and evergreens are present with diameter at breast heights ranging from 6 inches to >24 inches.
Density 'and Dimensions — Minimum lot size for RS 15.0 zoning designations is 15,000 square feet or slightly
less than three single-family dwelling units per acre. The proposed 4-lot short subdivision meets minimum
dimensional standards of FWRC 19.200.010 `Detached dwelling unit.' The proposed site plan details required
yards meeting the 20-foot front, 5-foot side, and 5-foot rear. As Lot 4 is a corner lot, the 10-foot side yard
adjacent to SW 296`i' is accurately depicted. Individual single-family building permit plans will be required to
incorporate the recorded short plat's building setback lines.
State Environmental Policy Act (SEPA) — Short subdivisions are typically exempt from environmental
review, but infrastructure improvements, specifically the installation of 12" stormwater pipe near the
SW 296ffi Street frontage, exceed the exemption level specified in Washington Administrative Code
(WAC) 197-11-800(23). The city's Responsible Official issued a Determination of Nonsignificance
(DNS) using the Optional DNS process pursuant to WAC 197-11-355. No written comments were
submitted regarding the Notice of Application or environmental threshold determination.
7. Critical Areas — The city's Critical Areas inventory shows no environmentally sensitive areas.
8. Public Notice & Comment — A Notice of Land Use Application and anticipated DNS for the short subdivision
was published in the Federal Way Mirror, posted at the subject property and city designated notice boards, and
mailed to property owners within 300 feet on January 23, 2010. No written comments were received. Two
parties of record, Sue Wilson and Greg Sherles, have requested copies of the short subdivision decision.
9. Open Space — All residential land divisions are required to provide open space in the amount of 15 percent of
the gross land area of the subdivision site. The applicant will provide a fee -in -lieu as allowed by FWRC
18.55.060(2). Prior to plat recording, the applicant will be required to pay 15 percent of the most recent assessed
land value of the subject property or defer those costs pursuant to limitations set forth in FWRC
19.100.070(1)(b).
10. Tree and Vegetation Retention/Replacement — Single-family residential zones are required to maintain a
minimum of 25 tree units per acre. The total required tree units for the subject property are based on the gross
land area (2.32 acres) minus internal private street (.09 acre). The net area for retention/replacements equals
2.23 acres; therefore, the applicant will be required to retain, replace, or augment tree coverage to result in 56
tree units.' The applicant's Tree Retention and Landscape Plan provides a retention schedule of 16 tree units
and a planting schedule of 48 tree unit credits equaling 64 tree unit credits for the subject property. The
applicant has exceeded the minimum tree unit per acre requirement.
11. Clearing and Grading — The applicant's preliminary grading plans detail a projected grading area surrounding
the internal road and stormwater facility. Areas in and around the future building footprints are proposed to be
cleared of trees and vegetation and planted with an erosion control seed mix that will remain until the future
home improvements are constructed. Several trees on the lot perimeters are proposed to be retained. If future
home improvements are not constructed within 12 months of clearing the subject property, the site will be
subject to interim aesthetic treatment pursuant to FWRC 19.120.060(2)(c). Such treatment may include
installation of permanent vegetation shown on the tree plan and/or temporary revegetation that provides visual
screening of the site from neighboring properties and rights -of -way.
12. Traffic Mitigation — The city's Traffic Division reviewed the applicant's concurrency application and issued a
Capacity Reserve Certificate March 26, 2010. In order to mitigate the impacts of new vehicle trips resulting
from the proposed development, the applicant will be subject to a pro-rata share contribution in the amount of
$12,346 toward three identified capital improvements on the city's six -year Transportation Improvement Plan.
The fee will be due at the time of plat recording.
13. Access — Access to each of the four lots will be via 20-foot paved roadway within Tract B. Owners of the four
lots will share undivided interest in Tract B and will be required to maintain them to standards adopted by the
city. The new lots shall not have direct access on SW 296t" Street or 8'h Avenue SW.
1 FWRC 19.120.130(3) states if the calculation results in a fractional quantity, it shall be rounded up to the next higher whole number.
Statement of Facts Page 2
Lourie (Freemantle) Short Plat File 09-104423-00-SU/o.. I.D. 59258
14. Street Frontage Improvements —The applicant will be required to improve the subject property frontage per
planned roadway cross -sections shown in the Federal Way Comprehensive Plan along SW 296`h Street and 8"'
Avenue SW.
(1) SW 296"' Street is planned as a Type "T" street, consisting of a 28-foot street with 8-foot ditches, 5-
foot sidewalks, with street lights.
(2) 8`' Avenue SW is planned as a Type "S" street, consisting of a 36-foot street with curb and gutter,
four -foot planter strips with street trees, 5-foot sidewalks, and street lights.
15. Stormwater — The proposed development meets criteria requiring full drainage review. Development of the site
will create additional runoff from new impervious surfaces such as streets, driveways, and rooftops. The
applicant will be required to design a facility meeting the requirements of Level 2 Flow Controe and Basic
Water Quality. Stormwater facilities must be designed in accordance -with the 1998 King County Surface Water
Design Manual.
Existing stormwater generated from the subject property sheet flows in a northeasterly direction and then is
collected in a city system near the intersection of SW 296`h Street and 8`h Avenue SW. Following development
of the property, stormwater will be directed to a combination wetpond/detention facility prior to release into the
city system. It is likely that some stormwater generated on individual lots will be controlled via small -site
infiltration.
Following preliminary short subdivision approval, the applicant will be required to obtain engineering approval
from the Public Works Department prior to plat construction. Further analysis of the findings above and the
overall stormwater flow control/water quality system will be conducted.
16. Fire Protection — South King Fire and Rescue has accepted the internal road layout. As a condition of their
acceptance, sprinklers are required on Lots 2 and 3. The applicant has indicated on the preliminary short plat
document the Lot 2 and 3 sprinkler requirement.
17. Water and Sewer — The applicant proposes to serve the short subdivision with a public water supply and
distribution system managed by the Lakehaven Utility District. The July 28, 2009, Certificate of Water
Availability indicates Lakehaven's capacity to serve the proposed development via an existing 6-inch diameter
water main located along the 8'h Ave SW frontage or an 8-inch diameter main along the SW 296h St. frontage.
The applicant proposes to serve the short subdivision by a public sewer system managed by Lakehaven Utility
District. A July 28, 2009, Certificate of Sewer Availability indicates the district's capacity to serve the proposed
development via temporary side sewer connection to an existing eight -inch diameter main located on the 8Lh
Avenue SW frontage or the applicant may extend the main along the subject property's 2961h Street frontage
and connect via side sewer.
18. Engineering Requirements — The applicant must obtain authorization to proceed from the Public Works
Department prior to construction of plat infrastructure.
These findings shall not waive compliance with future City of Federal Way codes, policies, and standards relating
to this development.
Prepared by: Matthew Herrera, Associate Planner
2 Level 2 flow control is required due to erosion problem located downstream of the subject property.

RE: FILE #09-104423-00-SU; TECHNICAL COMMENT LETTER
Lourie (Freemantle) Short Plat, 29601 8`h Avenue SW, Federal Way
Dear Mr. Duncanson:
The Community and Economic Development Department has reviewed your October 4, 2011, resubmittal
of documents related to the Lourie (Freemantle) Short Subdivision application. City departments and
jurisdictional agencies have provided the following comments that will need to be addressed prior to
preliminary approval of your application. Questions regarding the technical review comments should be
addressed to the referenced staff representative.
Matthew Herrera, Planning Division, 253-835-2638, matt.herrera@cityoffederalway.com
1. Required Yards —Federal Way Revised Code (FWRC) 19.200.010(3) requires a 10-foot side
yard setback for the portion of the corner lot that is not adjacent to the primary vehicle access.
Please increase the currently shown 5-foot building setback line to 10 feet along Lot 4's SW 296`h
Street frontage.
2. Tree Retention Plan — It appears trees were calculated for canopy density compliance in the
ROW along each street frontage. As the applicant is no longer seeking the city to vacate these
areas, please revise the plan to reflect the existing property lines. For clarity, please include notes
on the plan that show the following: (1) total tree units removed; (2) total number of replacement
tree units; and (3) total tree unit credits that will be provided at build out (existing + new).

■ Preliminary Engineering Plans
1. Because the storm drainage pond will now be a privately owned pond (due to the plat road now
being contemplated as a private road), the StormFilter water quality vault is no longer allowed
(refer to the City's March 1, 2010 conditional approval letter for StormFilter vault). City policy
on short plats with privately owned ponds requires the water quality (and flow control)
component(s) to be an `open' or above -ground system. As a reminder, stormwater quality
requirements for this plat are per the Basic Menu of the 1998 King County Surface Water Design
Manual.
2. The roadway improvements along the property frontage with 81h Avenue SW shall meet the City's
Type `S' standard, which requires a 4-foot planter strip (as measured from the face of curb to
edge of sidewalk). Revise the plan and street cross-section to show the planter strip.
• The following may be addressed at final engineering design:
1. Eliminate the curbing shown along the 296`' Street roadway, to a point just west of the curb ramp
at the NE corner. The city's section for this roadway does not include curbing.
2. Revise the Project Description note to indicate four lots, rather than six.
3. The two power poles along 8`b SW should be shown to be relocated to the `new' (vacated) right-
of-way line. This will help allow for clearances for the new street lights.
4. Street trees are required within the planter strip of 8"' Avenue SW. Street trees shall be selected
from the City's pre -approved tree list.
Sarady Long, Public Works — Traffic, 253-835-2734, sarady.long@cityoffederalway.com
1. The internal street (tract) should not exceed 150' in length from the approved fire access road to
the farthest point of building envelope unless approved by the Fire Department. Please see
standard DWG No. 3-2DD.
The intersection sight distance analysis shall be conducted in accordance to the latest AASHTO
guideline (3.5 ft object height, 3.5 ft driver's eye height, and 14.5 ft back from the edge of the
traveled way). The intersection sight distance triangle shall be depicted on the plan set and shall
bear the seal of a licensed engineer in the state of Washington. The site plan with plan and profile
sheets should also be incorporated into the report to provide the site distance documentation.
Indicate if there are anv street trees, landscaping requirements, or any other objects existing or
proposed to be located within the sight distance triangle. State if the sight distance requirements
are met or not and provide any traffic safety mitigation measures. Please see enclosed intersection
sight distance report from other project.
Chris Ingham, South King Fire & Rescue, 253-941-7244, chris.ingbam@southkingfire.org
The fire district will accept the proposed access road on the condition that homes on lots 2 and 3 contain
fire sprinklers. Please add a note to the short plat document stating the fire sprinkler requirement.

RE: FILE #10-100198-00-SE; ENVIRONMENTAL THRESHOLD DETERMINATION
Lourie Short Plat, 296018h Avenue SW, Federal Way
Dear Mr. Duncanson:
The City and jurisdictional agencies have reviewed the environmental checklist submitted with the above -
referenced short subdivision. It has been determined that the proposal will not have a probable significant
adverse impact on the environment. As a result, an Environmental Impact Statement (EIS) is not required to
comply with the State Environmental Policy Act (SEPA). A copy of the Determination of Nonsignificance
(DNS) is enclosed.
The Optional DNS Process was used to review this proposal. The 14-day comment period required by SEPA
Rules ran concurrently with the public comment period associated with the notice of land use application,
which began on January 23, 2010, and ended on February 8, 2010. The City did not receive comments
regarding the short subdivision application or environmental checklist. Pursuant to Washington Administrative
Code (WAC) 197-11-355, a second comment period is not required upon issuance of the DNS.
The enclosed DNS was issued on October 19, 2011. The City will provide a copy of the DNS to the
Department of Ecology, agencies with jurisdiction, Puyallup and Muckleshoot tribes, and anyone requesting a
copy. All final determinations may be appealed within 14 days following the issuance of the DNS. No licenses,
permits, or approvals will be issued until completion of the appeal period, which ends November 2, 2011.
The decision not to require an EIS does not grant the license, permit, or approval you are seeking from the city.
The environmental record is considered by the decision maker(s) and conditions will be imposed to reduce
identified environmental impacts, as long as the conditions are based on adopted and designated city policy.
After a final decision has been made on your proposal (i.e., after a permit has been issued), you may, but are
not required to, publish a Notice of Action as set forth in RCW 43.21 C.075. The Notice of Action sets forth a
time period after which no legal challenges regarding the proposal's compliance with SEPA can be made. The
city is not responsible for publishing the Notice of Action.
Questions regarding the short subdivision's environmental review component should be directed to me at 253-
835-2638 or matt.herrera@cityoffederalway.com.

ENVIRONMENTAL CHECKLIST
PURPOSE OF CHECKLIST
The State Environmental Policy Act (SEPA), Revised Code of Washington (RCW) Chapter 43.21 C,
requires all governmental agencies to consider the environmental impacts of a proposal before making
decisions. An environmental impact statement (EIS) must be prepared for all proposals with probable
significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide
information to help you and the agency identify impacts from your proposal (and to reduce or avoid
impacts from the proposal, if it can be done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS
This environmental checklist asks you to describe some basic information about our proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of your proposal
are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise
information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you
should be able to answer the questions from your own observations or project plans without the need to
hire experts. If you do not know the answer, or if a question does not apply to your proposal, write "do not
know" or "does not apply." Complete answers to questions now may avoid unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark designations.
Answer these questions if you can. If you have problems, the governmental agencies can assist you.
The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of
time or on different parcels of land. Attach any additional information that will help describe your proposal
or its environmental effects. The agency to which you submit this checklist may ask you to explain your
answers or provide additional information reasonably related to determining if there may be significant
adverse impact.
USE OF CHECKLIST FOR NON -PROJECT PROPOSALS
Complete this checklist for non-proj ect proposals, even though questions may be answered "does not
apply." In addition, complete the Supplemental Sheet for Non -Project Actions.
For non -prof ect actions, the references in the checklist to the words "project," "applicant," and "property
or site" should be read as "proposal," "proposer," and "affected geographic area," respectively.

Subject: Fremantle (Lourie) Short Plat (File #09-104423-00-SU)
Response to Incomplete Determination and Subsequent Comments
Dear Mr. Herrera:
In response to your December 3, 2009 Notice of Incomplete Application, please find
enclosed 6 sets of revised plans and 3 TIRs. The environmental checklist and notice
materials were previously submitted in January 2010.
As you know, the 6-lot short plat was based on successful vacation of a portion of the 81n
m Avenue Southwest right-of-way. While the Federal Way Council approved this right-of-
Z way vacation, the applicant has chosen to defer action on this vacation. This together
with additional land needed for a higher stormwater flow control standard and site
development costs and other factors has resulted in a reduction in the number of lots to 4
total. This will be a lower impact than the previously proposed 6 lots.
Following are responses to the Items contained in your December 3, 2009 letter.
Incomplete Items
1. SEPA. A SEPA checklist was previously submitted along with the mailing
materials.
2. Preliminary Clearing, Grading and Tree Retention Plans. These plans were
previously provided to attain a complete application. Six sets of revised plans are
included to reflect the reduction in lots and associated road and stormwater
changes.

Preliminary Technical Comments
Planning
1. Tree Density Standards. The individual that the applicant retained for the
tree/vegetation retention plan was not completely familiar with Federal Way's
newer standards and the plan version provided to us today, did not appear to meet
all requirements. We have discussed this with Alpine Pacific design and expect to
have a signed plan to you by October 6.
2. Pond Retaining Wall. Based on the revised configuration, a retaining wall is no
longer anticipated for the stormwater facility.
3. Required Procedural Information. Two foot existing contours, an internal road
section, acreage of tracts and the net plat area are included on the preliminary
short plat drawing. Note the applicant requests the 15% open space requirement
be met through fee -in -lieu provision.
Development Services
1. Short Plat Document. The requested information has been added to the extent
practical at this time. Additional coordination will be needed concerning
ownership of the pond Tract A. The pond will serve to detain and treat
stormwater from the right-of-way improvements as well as the private
improvements. It is our understanding that this would normally result in
ownership in Tract A going to the City.
2. Engineering Plans. The pond is designed as an open facility, entirely within Tract
A. Approval was granted for use of a StormFilter, which is located in Tract A.
The street modification request was denied. Appropriate street improvements are
shown in plan view and cross section. The right-of-way vacation was approved
by the council, but this short plat is no longer dependent on that occurring.
3. Other. As noted in subsequent correspondence, the detention facility is now sized
to provide the Level 2 Flow Control. Also, a hammerhead may be required for the
internal access road (Tract B) pending review by South King Fire. Impervious
area assumptions currently anticipate this possibility.

Traffic Division
1. Conceptual street lighting is shown on the plans per Federal Way standard detail
and spacing requirements. Detailed engineering will be included during
engineering review stage.
2. A sight distance profile is included in the plan set. The proposed access location
meets intersection sight distance (AASHTO Ex 9-55) and stopping sight distance
(AASHTO Ex 3-2) requirements including grade corrections.

RE: FILE #09-104423-00-SU; LETTER OF COMPLETE APPLICATION
Lourie Short Plat, 29601 8t' Avenue SW, Federal Way
Dear Mr. Duncanson:
The City of Federal Way's Department of Community Development Services is in receipt of your January
15, 2010, resubmittal of short subdivision materials. The city deemed the original application incomplete
December 3, 2009, due to the following missing items: (1) environmental checklist with notice materials;
and (2) clearing, grading, and tree preservation/retention plan. Pursuant to Federal Way Revised Code
(FWRC) 18.30.050(b), within 14 days after an applicant has submitted additional information identified
by the city as being necessary for a complete application, the department shall notify the applicant
whether the application is complete or whether additional information is necessary.
NOTICE OF COMPLETE APPLICATION
Please consider this correspondence as a Notice of Complete Application. Pursuant to FWRC 18.30.050,
the application is deemed complete as of January 20, 2010, based on a review of your submittal relative
to those requirements as set out in FWRC 18.30.030 and the State Environmental Policy Act (SEPA). The
submittal requirements are not intended to determine if an application conforms to the City of Federal
Way codes; they are used only to determine if all required materials have been submitted. A technical
review of the short plat application will now begin. You will be notified if any additional information or
corrections will be required prior to preliminary approval.
Having met the submittal requirements, a Notice of Application will be posted on site, published in the
Federal Way Mirror, posted on the city's official notice boards, and distributed to agencies/individuals
per guidelines established by development and SEPA regulations within 14 days of this letter.
If you have any questions regarding this letter or your development project, please feel free to contact me
at 253-835-2638 or matt.hrrera@cityoffederalway.com.
Sincerely,
Matthew Herrera

3. Required Procedural Information — Please add the following items on the plat document pursuant to
content and formrequirements of FWRC 18.30.030:
• Item (g) — Existing topography of the land indicated by contours of two -foot intervals for slopes
less than 15 percent and five-foot intervals for slopes of 15 percent or greater.
• Item (t) — Internal roadway section.
■ Item (x) — Acreage of tracts dedicated for open space; or request that 15 percent open space
requirement may be met via fee -in -lieu of the property's assessed value.
• Item (y) — Net plat area, which is gross plat area minus critical areas, rights -of -way, and public
purpose lands.
Kevin Peterson, Development Services, 253-835-2734, kevin.peterson@cityoffederalway.com
Prior to preliminary short plat approval, the Public Works Development Services Division requires the
following technical issues be addressed:
1. Short Plat Document — The following technical issues shall be addressed prior to preliminary short
plat approval:
• Add the City file number (09-104423-00-SU) in the space provided on the Title Block.
• If sanitary sewer service is provided to all lots, then the King County Health Department
approval block may be removed from the Title Block.
• Provide letter designations (A, B) for the street and storm drainage tracts.
• Add notation that the street tract will be owned and maintained by all lot owners.
• The note that indicates the drainage tract to be "undivided 1/8 ownership..." should be revised
to 1/6 ownership to lots 1 through 6.
• A note should be added that maintenance of the storm drainage facilities will be the
responsibility of the owners of lots 1-6.
2. Engineering Plans — The following technical issues shall be addressed prior to preliminary short plat
approval:
■ City policy requires above ground detention and water quality facilities for short plats. The
water quality vault does not meet the criterion. The engineer shall revise the drawing. The
engineer may make a written request to utilize the vault or other enclosed structure; however,
the final decision rests with the Deputy Public Works Director and Surface Water Manager.
• If the water quality vault is allowed, it cannot be located within City right-of-way as currently
designed
• The pond wall cannot be constructed within the City right-of-way as currently shown.
• Street improvements along 8th Avenue SW do not meet the City's standard for a street Section
`S', as required. However, it is understood that the applicant has applied for a right-of-way
modification request. The final determination on the required street improvements will be made
under cover of the City's modification response letter.
• As noted in the preapplication summary letter, the "Street vacation process on 81h Avenue SW
takes 6-9 months to complete."
19_104423 Doc- ID.52241
Mr. Duncanson
December 3, 2009
Page 4
NOTE: Because the lots are at the minimum size allowed under code, revisions to the water quality and/or
detention facility may necessitate an increase in the size of the drainage tract, and therefore reduce the
number of lots proposed for the subdivision in order to maintain the minimum lot sizes. This would also
apply if the street vacation is not approved.
Sarady Long, Traffic Division, 253-835-2743, sarady.long@cityoffederalway.com
Prior to preliminary short plat approval, the Public Works Traffic Division requires the following
technical issues be addressed:
Lighting Standards — Street lighting is required along the frontages (8n` Avenue SW and SW 296tn
Street) and within the plat. Submit street lighting plans to the Traffic Division for review.
2. Sight Distance — Provide sight distance verification that meets American Association of State
Highway and Transportation Officials (AASHTO) standards at the proposed access.
CLOSING
Please submit six copies of required plans and six copies of the environmental checklist with mailing
envelopes for SEPA requirements. The city will notify you within 14 days of the application status
following receipt of the two completeness items: (1) environmental checklist with mailing envelopes; and
(2) clearing, grading, and tree retention/preservation plans. It is important to note that the city cannot
begin processing your formal application until completeness items are submitted. Above -referenced code
sections maybe accessed at www.codepublisbing.com/WA/FederalWay.
Pursuant to FWRC 18.05.080, if an applicant fails to provide additional information to the city within 180
days of being notified that such information is requested, the application shall be deemed null and void
and the city shall have no duty to process, review, or issue any decisions with respect to such an
application.
Please note that additional technical comments may be provided subsequent to receipt of the requested
information. If you have any questions regarding this letter or your development project, please contact
me at 253-835-2638 or matt.herrera@cityoffederalway.com.

1. Project Overview
The Fremantle Short Plat is located in the southwest quadrant of the intersection of 8`h
Avenue SW and SW 296'h Street. The 4 short plat lots will access SW 290h Street with a
new private road, which will align with the existing 9'h Avenue SW intersection on the
north side of SW 296`h Street.
This report presents the findings of our sight distance investigation for the proposed 9th
Avenue SW connection to SW 2961h Street.
2. Sight Distance Requirements
Sight distance requirements were determined using A Policy on Geometric Design of
Hi hwa s and Streets, American Association of State Highway and Transportation
Officials (AASHTO). A design speed of 25 MPH was used. A plan and profile figure is
attached, which show the horizontal and vertical sight lines. The applicable AASHTO
Exhibits are also included.
Stopping Sight Distance
SW 296`h Street has an approximate 3% upgrade across the site frontage from east to
west. Stopping sight distance requirements were derived from AASHTO Exhibit 3-2.
Driver eye height of 3.5 feet and object height of 2.0 feet were used, also per AASHTO.
SSD Required
Eastbound: 158 FT (3% downgrade)
Westbound: 147 FT (3% upgrade)
SSD Provided
The available eastbound and westbound stopping sight distance easily exceed the
standard minimums.
Intersection Si ht Distance
The private 9'h Avenue SW (minor road) will be stop controlled at the intersection with
SW 296'h Street (major road). This minor road will approach at a downgrade; therefore,
no grade adjustment was applied. The northbound to westbound turn represents Case
B 1—Left Turn from Stop. The northbound to eastbound turn represents Case B2—Right
Turn from Stop.
ISD R uired
Northbound to westbound: 280 FT —Case B1 AASHTO Exhibit 9-55
Northbound to eastbound: 240 FT —Case B2 AASHTO Exhibit 9-58
ISD Provided
Northbound to westbound ISD is approximately 262 feet or18 feet less than
AASHTO requirements. The limitation is a result of a crest in the road where the
main travel way transitions from SW 296h Street to 8'h Avenue SW near the
extreme end of the sight triangle. There is no horizontal limitation.
Northbound to eastbound ISD is well over the 240 foot minimum.
Fremantle Short Plat DCI 08158
3. Conclusions and Recommendations
All Stopping Sight Distance standards are met at the proposed development. Northbound
to eastbound Intersection Sight Distance standards are met. The northbound to
westbound Intersection Sight Distance is 18 feet less than AASHTO recommendations.
A profile showing
To mitigate the very minor deficiency of northbound to eastbound ISD we note the
following:
1. Westbound traffic on SW 296th Street is constrained by a sharp 90 degree
curve followed by a steep uphill grade approaching 8t' Avenue SW.
2. Due to curves and grades, advisory speeds of 15 MPH are posted throughout
the area. The ISD required for 15 MPH is 170 feet.
3. Most traffic on SW 296"' Street turns south down 8 h Avenue SW. There is
little reason for traffic westbound on SW 296`h Street to continue past 8a`
Avenue SW or even reach 9t' Avenue SW.
4. Northbound to eastbound ISD could be achieved by moving the proposed 9'
Avenue SW intersection to the west; however, that would create and
intersection offset with the existing north leg of 9t' Avenue SW. The City has
requested that we align with this existing intersection, which is reasonable to
minimize left turn conflicts.
5. No accident data was identified with the existing 9t' Avenue SW/SW 296'
Street intersection.
6. Most anticipated traffic from the short plat will turn east out of the
development —northbound to westbound traffic will be negligible.
7. This segment of SW 29e Street functions as a local access road with no
restriction or operational problems to existing driveway access.
It is our opinion that the above factors adequately mitigate the minor deficiency in
Intersection Sight Distance for the northbound to westbound traffic.

Exhibit 3-2. Stopping Sight Distance on Grades
Decision Sight Distance
Stopping sight distances are usually sufficient to allow reasonably competent and alert
drivers to come to a hurried stop under ordinary circumstances. However, these distances are
often inadequate when drivers must make complex or instantaneous decisions, when information
is difficult to perceive, or when unexpected or unusual maneuvers are required. Limiting sight
distances to those needed for stopping may preclude drivers from performing evasive maneuvers,
which often involve less risk and are otherwise preferable to stopping. Even with an appropriate
complement of standard traffic control devices in accordance with the MUTCD (6), stopping
sight distances may not provide sufficient visibility distances for drivers to corroborate advance
warning and to perform the appropriate maneuvers. It is evident that there are many locations
where it would be prudent to provide longer sight distances. In these circumstances, decision
sight distance provides the greater visibility distance that drivers need.
Decision sight distance is the distance needed for a driver to detect an unexpected or
otherwise difficult -to -perceive in source or condition in a roadway environment that
may be visually cluttered, recognize the condition or its potential threat, select an appropriate
speed and path, and initiate and complete the maneuver safely and efficiently (7). Because
decision sight distance offers drivers additional margin for error and affords them sufficient
length to maneuver their vehicles at the same or reduced speed, rather than to just stop, its values
are substantially greater than stopping sight distance.
Drivers need decision sight distances whenever there is a likelihood for error in either
information reception, decision making, or control actions (8). Examples of critical locations
where these kinds of errors are likely to occur, and where it is desirable to provide decision sight
distance include interchange and intersection locations where unusual or unexpected maneuvers
are required, changes in cross section such as toll plazas and lane drops, and areas of concentrated

I
Exhibit 9-55. Design Intersection Sight Distance Case Bl—Left Turn from Stop j
n
Sight distance design for left turns at divided -highway intersections should consider multiple
design vehicles and median width. If the design vehicle used to determine sight distance for a
divided -highway intersection is larger than a passenger car, then sight distance for left turns will
need to be checked for that selected design vehicle and for smaller design vehicles as well. If the
divided -highway median is wide enough to store the design vehicle with a clearance to the
through lanes of approximately 1 in [3 ft] at both ends of the vehicle, no separate analysis for the
departure sight triangle for left turns is needed on the minor -road approach for the near roadway
to the left. In most cases, the departure sight triangle for right turns (Case B2) will provide
sufficient sight distance for a passenger car to cross the near roadway to reach the median.
Possible exceptions are addressed in the discussion of Case B3.
If the design vehicle can be stored in the median with adequate clearance to the through
lanes, a departure sight triangle to the right for left turns should be provided for that design
vehicle turning left from the median roadway. Where the median is not wide enough to store the
design vehicle, a departure sight triangle should be provided for that design vehicle to turn left
from the minor -road approach.
The median width should be considered in determining the number of lanes to be crossed.
The median width should be converted to equivalent lanes. For example, a 7.2-m [24-ft] median
should be considered as two additional lanes to be crossed in applying the multilane highway
adjustment for time gaps in Exhibit 9-54. Furthermore, a departure sight triangle for left turns

Note: Time gaps are for a stopped vehicle to turn right onto or cross a
two-lane highway with no median and grades 3 percent or less.
The table values require adjustment as follows:
For multilane highways:
For crossing a major road with more than two lanes, add
0.5 seconds for passenger cars and 0.7 seconds for trucks
for each additional lane to be crossed and for narrow
medians that cannot store the design vehicle.
For minor road approach grades:
If the approach grade is an upgrade.that exceeds
3 percent, add 0.1 seconds for each percent grade.
