The Process III Master Land Use (MLU) application submitted October 9, 2012, is hereby approved based on the enclosed findings of fact, incorporated into this decision in full, and the following conclusions based on those facts: 1. The proposal is consistent with the comprehensive plan; 2. The proposal is consistent with all applicable provisions of Federal Way Revised Code (FWRC); 3. The proposal is consistent with the public health, safety, and welfare; 4. The streets and utilities in the area of the subject property are adequate to serve the anticipated demand from the proposal; 5. The proposed access to the subject property is at the optimal location and configuration; and 6. Traffic safety impacts for all modes of transportation, both on and off site, are adequately mitigated. This land use decision does not authorize initiation of construction activities. REVIEW PEtOuSSES -. bUIRED Pursuant to FWRG.19.1 030(3), improvements and/or additions to an existing developed site that are not exempt from SEPA shal be processed under Use Process III. The Director of Community and Economic Development will -make -the initial land use decision based -on written- comments and information gathered during site plan review. Any appeals of the decision will be decided by the Hearing Examiner after a public hearing. SEPA PROCESS The City of Federal Way issued a Determination of Nonsignificance (DNS) on November 28, 2012, pursuant to Washington Administrative Code 197-11-350. Following review of the environmental checklist, the city determined the proposal would not have a probable significant adverse impact on the environment and an Environmental Impact Statement would not be required, and no SEPA based mitigation was necessary. REQUESTS FOR CHANGE OF VALUATION Any affected property owners may request a change in valuation for property tax purposes, not withstanding any program of revaluation. APPROVAL DURATION Unless modified or appealed, the Process III decision is valid for five years from the date of issuance of the decision. Time extensions to the decision may be requested prior to the lapse of approval following the provisions listed in FWRC 19.15.110. APPEALS The effective date of issuance is three calendar days following the date of this letter, December 16, 2012. Pursuant to FWRC 19.65.120, this land use decision may be appealed by any person who submitted written comments or any person who has specifically requested a copy of the decision. Any appeal must be in the form of a letter delivered to the Community and Economic Development Department with the established fee and within 14 days after the effective date of issuance of this decision, or December 31, 2012. The appeal letter must contain a clear reference to the matter being appealed and a statement of the factual findings and conclusion of the director disputed by the person filing the appeal. The Federal Way Hearing Examiner will hear any appeals of the Process III decision. Proposal — The applicant proposes to upgrade an existing Personal Wireless Service Facility (PWSF) by replacing the existing 95' light pole with a 103' light pole and adding three new LTE 4G Antennas. Associated upgrades to the radio equipment within the equipment shelter are included. 2. Site Conditions — The existing PWSF is located on a light standard pole on Federal Way parks property (Saghalie Park), at 33914 19'h Avenue SW, Federal Way. The ground equipment is located within an existing shelter; no changes are proposed to modify the equipment shelter location. Comprehensive Plan and Zoning — The city's comprehensive plan designation is Multi -Family, and the zoning is Multifamily Residential (RM 2400). PWSFs are permitted in the RM zone pursuant to Federal Way Revised Code (FWRC) 19.205.200. Review Process — The replacement and addition of antennas to the existing PWSF is not exempt from the State Environmental Policy Act (SEPA) review and is subject to Process III `Project Approval' review. State Environmental Policy Act (SEPA) — The proposal is not exempt from environmental review pursuant to Washington Administrative Code 197-11-800(25)(a)(iii). The city utilized the Optional Determination of Nonsignificance (DNS) process as allowed by SEPA Rules. A combined Notice of Application and Optional DNS was issued November 2, 2012. No comments were received during the integrated comment period. The city's Responsible Official issued a DNS on December 28, 2012. The threshold determination appeal period ended December 12, 2012, with no appeals submitted to the Federal Way City Clerk. 6. Public Notice — Pursuant to Process III and SEPA regulations, a Notice of Land Use Application and Optional DNS were published in the Federal Way Mirror, posted at two locations at the subject site, and displayed on the designated city notice boards on November 2, 2012. Notices were also mailed to property owners within 300 feet of the subject property. No comments were received on the land use application or SEPA DNS notice. Prioritized Locations — The applicant proposes to locate the PWSF on, "Existing broadcast, relay, and transmission towers...," which is the second priority location of the five prescribed in FWRC 19.255.010(4). Higher prioritized location, "Structures located in the BPA trail...," is not feasible as this proposal is an upgrade to an existing facility. There are no alternative BPA towers in the proposed vicinity. Staff finds the applicant has met the burden to utilize the second prioritized location. The antenna modifications should provide the full benefit of service to the area. 8. PWSF Development Standards — PWSFs located on existing structures shall meet development standards prescribed in FWRC 19.255.020(1). The following are staff responses to each criterion: a. The PWSF exceeds the minor facility thresholds for the number of antennas and size, -but creates no more adverse impacts than a minor facility -.Based on site photos and? — -- -- - detailed drawings, the proposed addition will be installed in the same manner as the previously approved antennas and the visual impact will be minimal. b. The combined antennas will not exceed 15' above the existing structure. The proposal does increase the height by 8', which is the minimum necessary to support the new technology and prevent interference with existing PWSFs. The existing pole/structure cannot support the additional antenna, so a replacement light standard pole is necessary. c. This section does not apply as the proposed PWSF is not in a right-of-way. d. The proposed antennas will use "flush -mounting" techniques and match existing conditions. The impacts to surrounding uses will be no greater than the existing facility. e. The proposed size and number of the antennas are necessary to meet AT&T new 4G LTE coverage objectives as depicted in the project narrative and maps provided by the applicant. f. The existing ground equipment meets current regulations. The additional equipment is to be added to an existing shelter. The footprint of the facility will not be enlarged and will meet the setback requirements. Screening Standards — PWSFs are required to be screened using best available technology and design. The proposed antennas will use "flush -mounting" technologies and be painted to match the existing antennas. These measures appropriately mitigate visual impacts of the facility, cause no adverse cumulative effects, and meet aesthetic standards set forth in FWRC 19.255.020(1)(d). 10. Electronics Equipment Standards — No material expansions or changes to the architectural design of the enclosure are proposed. Therefore, these changes are exempt from PWSF standards set forth in FWRC Chapter 19.255 and are permitted outright with no further regulatory action required pursuant to FWRC 19.255.010(3)(g). 11. Security Screening — The PWSF includes existing structure and landscape screen; no new fencing or expansion of existing lease area is proposed. 12. Cumulative Effects — The city must consider the cumulative visual effects of the PWSF mounted on an existing structure in determining whether additional permits may be granted so as to not adversely affect the visual character of the city. I.D. 62687 modifications, the PWSF will not adversely affect the visual character of the city. The additional antennas will be camouflaged through best available technology and design and will have less of an impact than creating a new PWSF site. 13. Condition of Approval — The following condition of approval shall be a component of the Process III land use decision: d Prior to any site work, the applicant shall obtain an electrical permit from the city's Department of Community and Economic Development. 14. Process III Decision Criteria — Based on the above findings, staff has determined the proposal is consistent with applicable site plan approval criteria required for Process III `Project Approval' pursuanf�the following FWRC 19.65.100(2) items. Staff responses (italicized) follow each criterion: a. It is consistent with the comprehensive plan; The proposal is consistent with the following Federal Way Comprehensive Plan (FWCP) goals and policies: PUG] — Work with private utility companies to allow them to provide full and timely service that meets the needs of the city's residents and businesses, both present and future. PUG2 — Work with private utility companies to allow them to provide service in a way that balances cost-effectiveness with environmental protection, aesthetic impact, public safety, and public health. PUP17 — The city should require that site speck utility facilities such as antennas and substations be reasonably and appropriately sited and screened to mitigate adverse aesthetic impacts. b. It is consistent with all applicable provisions of this title; The site plan has been reviewed under FWRC Title 19, "Zoning and Development Code, " with speck attention to the following divisions and/or chapters: Division I, Administration; Chapter 19.65, Process III Project Approval; Chapter 19.205, Multifamily Residential (AM; and Chapter 19.255, Personal Wireless Service Facilities. c. It is consistent with the public health, safety, and welfare; No adverse impacts are anticipated as a result of the proposal. The PWSF has received approval from City of Federal Way Parks Department. The Process III MLU application has been reviewed under SEPA, FWCP, and applicable provisions of the FWRC. d. Traffic safety impacts for all modes of transportation, both on or offsite, are adequately mitigated. — As the facility is unmanned, this criterion is not applicable. (c) For PWSFs located in the right-of-way, the combined antennas may extend rip to the minimum necessary height to meet safety clearances required by the operator of the existing structure, but not exceed 1 S feet above the existing structure, plus the height of the proposed antennas as specified in subsection (1) (e) of this section. The maximum allowable height of the new structure with the PWSF antennas shall be determined by the director of community development services, depending upon the antenna type, design, location on the structure, and the proposed method of attachment. An existing structure can be increased in height only once per a 12-month period. Any structure, whether a new or replacement structure, located in a public right-of-way must be similar in terms of size (except height), shape, color, material, and location to the existing and surrounding structures, as determined by the director of community development services. The antenna extension may be permitted regardless of whether the existing structure is in conformance with the maximum height of the underlying zone as outlined in the use zone charts, FWRC Title 19 Division VI, Zoning Regulations. Applicant Response: This modification proposal is not located within the right- of-way. (d) The antennas are mounted on the building or structure such that they are located and designed to minimize visual and aesthetic impacts to surrounding land uses and structures and shall, to the greatest extent practical, blend into the existing environment pursuant to subsection (3) of this section. Applicant Response: As approved by the property owner, the replacement structure will be located within 10' of the existing structure but all setback minimum standards will be retained. The existing minimum setback from any property line is currently 188'. (2) New freestanding PWSFs. All requirements of the associated land use zoning charts must be met. Additionally, these structures shall conform to the following site development standards: (a) Placement of a freestanding PWSF shall be denied if placement of the antennas on an existing structure can meet the applicant's technical and network location requirements. Applicant Response: This modification proposal requires replacement of the existing freestanding PWSF due to engineering limitations of the existing structure. No other structures are available which would meet the same technical and network requirements and would also require the Applicant to site a new PWSF rather than modifying their existing location as proposed within. (b) Monopoles shall be the only freestanding structures allowed in the city; except that a lattice tower may be used to accommodate the collocation of four or more providers as part of a joint permit application. Applicant Response: The proposed replacement freestanding structure will be a monopole style ball field light pole. This will mimic the existing, approved structure except for the additional 8' of height as requested within. (c) In no case shall a freestanding PWSF be located closer than 500 feet to an existing freestanding PWSF whether it is owned or utilized by the applicant or another provider. Applicant Response: This modification proposal requires replacement of the existing freestanding PWSF due to engineering limitations of the existing structure. The Applicant does not request the siting of a new freestanding PWSF. (d) A freestanding PWSF, including the support structure and associated electronic equipment, shall comply with all required setbacks of the zoning district in which it is located. (� In reviewing the proposed placement of a facility on the site and any associated landscaping, the city may condition the application to supplement existing trees and mature vegetation to more effectively screen the facility. (g) Support structures, antennas, and any associated hardware shall be camouflaged to blend in harmoniously within the existing site through the use of faux -structural designs, or when not technologically or aesthetically feasible, painted in a nonrejlective color scheme appropriate to the background against which the PWSF would be viewed from a majority of points within its viewshed. The proposed color or color scheme shall be approved by the hearing examiner or director of community development services. PWSFs shall be screened or camouflaged through employing the best available technology and design, as determined by the city. This may be accomplished by use of compatible materials, location, landscaping, color, stealth techniques such as, but not limited to, artificial trees and hollow flag poles, and/or other methods or techniques to achieve minimum visibility of the facility as viewed from public streets or residential properties. In addition, the provisions for landscaping as outlined in the use zone charts, FWRC Title 19 Division VI, Zoning Regulations, shall apply. AT&T is committed to maintain same 2G services to the existing customers who may own 2G only phones. Many of the existing 3G antennas are better left intact to minimize service outages to the public on the 3G network. The steps taken in this analysis follow below: 1. LDC obtained elevation data from King County for use in ArcGIS. The data set used in the analysis was the Digital Surface Model of King County. This model was derived from LiDAR and used it's first -return pulse, which measures the top -most layer of the terrain (such as the top of vegetation or buildings). 2. Using the Digital Surface Model data we used ArcGIS and it's Viewshed tool to calculate the area of visibility. The proposed height of the tower was set at 103' . 3. The area calculated by the Viewshed tool can be seen in Figure 2. 4. For Figure 1, we refined the area of visibility by removing areas that were clearly the tops of trees or buildings. In doing so, we were trying to show which areas in the vicinity of the site would have visibility to the tower from the ground level. The subject parcel is listed as the Saghalie Park, but is zoned Residential (RM-2400), and it's primary use is for two ball fields. Access to the subject parcel is through the adjacent middle school property as addressed above. B. ENVIRONMENTAL ELEMENTS l O wy VV4 1. EARTH a. General description of the site (circle one) flat rolling, hilly, steep slopes, mountainous, other. b. What is the steepest slope on the site (approximate percent slope)? The entire parcel is generally flat minus the very northern end which slopes towards SW 336th St. This slope is likely man-made to build up the surface for the ball fields. 15-20% c. What general types of soils are found on the site (for example, clay, sand, gravel, peat, mulch)? If you know the classification of agricultural soils, specify them and note any prime farmland. A recent boring log described the first 15' of soil as sand with grass/loam on top. The boring report described some gravel mix towards the 15' level and the auger was unable to continue due to soil conditions.
