The Department of Community Development Services hereby grants preliminary approval of the Phan Short Plat. This approval corresponds to the short plat map, date -stamped as received May 12, 2009. This Decision of the Director is based on the enclosed Statement of Facts (Exhibit A) and in accordance with decision criteria listed in Federal Way City Code (FWCC) Section 20-91. ENGINEERING REQUIREMENTS Preliminary approval of the short plat does not constitute approval for land clearing or grading, vegetation removal, or any other activities that otherwise require permits from the City. Prior to construction of any improvements, the applicant must receive engineering approval for all road improvements and storm drainage facilities. No permits or authorization to begin construction or site work will be granted until the final approval of all engineering plans, the payment of all fees, and the submittal of performance securities, as may be required. FINAL SHORT PLAT The City does not have a formal final short plat process. Upon completion and inspection of all required frontage improvements, stormwater facilities, and other infrastructure improvements, the applicant shall submit as -built plans to the Public Works Department for review. Following Department approval of as - built plans and payment of outstanding engineering, concurrency, and open space fees, the short subdivision mylar will be recorded by the City (at the expense of the applicant) with the King County Division of Elections and Records. Mr. Phan June 25, 2009 Page 2 APPEAL PROCESS Pursuant to FWCC § 20-94, any person who receives a copy of this decision may appeal the decision within 14 days of the date of issuance. The decision may be appealed in the form of a letter delivered to the Department of Community Development Services by 5:00 p.m, July 9, 2009, at the following address: City of Federal Way, 33325 8`h Avenue South, PO Box 9718, Federal Way, WA 98063. An appeal letter must contain a clear reference to the matter being appealed, along with a copy of the decision. A statement of the alleged errors in the decision and required appeal fee must be included. Any additional requirements of FWCC Section 20-94 must be followed. STATE ENVIRONMENTAL POLICY ACT THRESHOLD DETERMINATION Pursuant to Washington Administrative Code 197-11-355, the optional Determination of Nonsignificance (DNS) process was utilized. The final DNS was issued March 25, 2009. DURATION OF APPROVAL Short subdivision approval shall expire one year from the date of issuance of this decision. However, the applicant may submit a written request in the form of a letter with supporting documentation to the Department of Community Development Services requesting a one-time extension of this limit of up to one year, pursuant to FWCC § 20-107. OTHER AGENCY PERMITS The applicant is responsible for identifying and obtaining all required state, federal, or other agency permits, as may be required. These facts are in reference to King County tax parcel identification number 0537000-0595 located on 201h Avenue South near the intersection of South 310'h Street. 1. Proposal — The applicant proposes to subdivide one existing 32,690 square -foot single-family lot into three single-family residential lots, one access tract, and one open space tract. The following lot and tract measurements correspond to lot closure calculated by Dale Oakes of Sadler/Barnard & Associates and sealed February 12, 2009: a. Lot 1 — 7262 sq. ft. b. Lot 2 — 7262 sq. ft. C. Lot 3 — 10,344 sq. ft. d. Tract A (Vehicle Access) — 2,875 sq. ft. e. Tract B (Open Space) — 4,948 sq. ft. 2. Review Process — Pursuant to FWCC Chapter 20 `Short Subdivisions,' the proposed short plat is subject to administrative review and decision rendered by the Director of Community Development Services. The proposal has been reviewed by staff from the Department of Community Development Services, Public Works Department, Lakehaven Utility District, and South King Fire and Rescue. City staff has used the following FWCC development regulations when reviewing the short subdivision application: Chapter 19 `Planning & Development;' Chapter 20 `Subdivisions;' Chapter 21 `Surface & Stormwater Management;' and Chapter 22, `Zoning.' 3. Density & Zoning District Regulations — The subject property is located within a Single - Family Residential (RS 7.2) zone with a minimum lot size requirement of 7,200 square feet, or 6 dwelling units per acre. The proposal meets the density requirement as noted above. FWCC Section 22-631 "Detached Dwelling Unit" prescribes setback, height, and parking and lot coverage requirements. Future building permit applications will be reviewed for compliance with these provisions. 4. Comprehensive Plan — The subject property's comprehensive plan designation is Single - Family — High -Density Residential. The proposal provides an urban density consistent with the Federal Way Comprehensive Plan (FWCP) designation. The proposal meets relevant goals and policies of the FWCP including, but not limited to: a. LUG3 - Preserve and protect Federal Way's single-family neighborhoods; b. LUP 14 - Maintain and protect the character of existing and future single-family neighborhoods through strict enforcement of the City's land use regulations; C. LUP 17 - Encourage the development of transportation routes and facilities -to serve single- family neighborhoods. Special attention should be given to pedestrian circulation. The city's Responsible Official issued a Determination ofNonsignificance (DNS) using the Optional DNS process pursuant to WAC 197-11-355. No comments were submitted regarding the Notice of Application or environmental threshold determination. 6. Open Space — Pursuant to FWCC 20-156(b), all residential subdivisions shall provide open space in the amount of 15 percent of gross land area of the site. The applicant has provided open space in the amount of 4,948 square feet, exceeding the 15 percent requirement. A 5-foot- wide walkway easement is provided for the benefit of lots 1 and 2. As conditioned on the short plat, all lot owners shall have a 1/3 undivided interest in the open space tract and it shall not be further subdivided, altered, or used for financial gain. 7. Homeowners' Association — Pursuant to FWCC 20-156(e), private on -site open space shall be owned in common undivided interest by all property owners within the subdivision as members of a homeowners' association or corporation as set out in a declaration of covenants and restrictions. Prior to recording of the short plat, the applicant will be responsible for drafting a document establishing such an association that contains applicable conditions, covenants, and restrictions that shall be approved by the city and recorded concurrently with the plat. The recording number of the conditions, covenants, and restrictions shall be referenced on the short plat mylar. 8. Concurrency — The Public Works Department's Traffic Division reviewed the applicant's concurrency application and concludes the proposed short subdivision will generate 5 new peak hour trips. Traffic Division staff have determined the 5 new trips generated by the short subdivision will impact the following two projects in the city's six -year Transportation Improvement Plan (TIP) as identified in the FWCP. Concurrency mitigation fees must be paid prior to recording the short subdivision with King County Division of Elections and Records. 9. Landscaping & Significant Tree Retention — As a component of the required street frontage improvements along 201h Avenue South, the applicant is required to plant street trees within the four -foot planter strip. The proposed Paperbark Maple planting has been approved by the Public Works Department. Each individual lot will retain 25 percent or more of identified significant trees and the open space tract will retain all 10 identified significant trees; therefore, no replacement planting is necessary. 11. Street Frontage Improvements — The project proponent is responsible for half -street frontage improvements using the FWCP cross section `S' along 20'h Avenue South abutting the subject property. Half -street cross section `S' consists of 10-foot driving lane, eight -foot parking lane, curb and gutter, four -foot planter strips with street trees, and five-foot sidewalks. No right-of- way dedication is necessary to accommodate frontage improvements. 12. Stormwater — Drainage improvements must meet standards established in the city's amended version of the 1998 King County Surface Water Design Manual. Applicant proposes to divert roof and driveway runoff to two below grade infiltration trenches located on Lot 1 and Tract A. Any overflow from the infiltration trenches will sheet flow into existing drainage ditches along 20`h Avenue South. 13. Ingress/Egress — Access for lots 1 through 3 will be via Tract A. Required ingress/egress improvements must be substantially completed prior to recording the short plat. 14. Fire Protection — South King Fire and Rescue will require an approved automatic fire sprinkler system for lot 3. This condition shall be included on the face of the short plat mylar. 15. Water & Sewer Services — Lakehaven Utility District issued water and sewer availability certificates October 30, 2008. The district will require a private water/sewer/utility easement across Tract "A" for the water & sewer service connection lines for Lots 2 and 3. Pavement Design & Analysis Pavement Design Recommendations On the basis of the results of laboratory tests and the assumed traffic counts of the proposed project, the pavement profile should consist of the following recommendations: GRAVEL BASE: 1) The gravel base should consists of at least 10.0 inches of compacted material. 2) Over -excavate any areas that exhibit pumping of the subgrade soils at least 6 inches (or as directed by a representative from our firm). Replace with crushed surfacing material compacted to 95% of max density per ASTM D1557. If subgrade is saturated or pumping excessively after over -excavating then it may be necessary to place quarry spalls on the subgrade prior to placement of any gravel base material. 3) Under certain site conditions the existing subgrade can be accepted by proof -trolling the subgrade using a fully loaded dump truck. This procedure (if used) should be witnessed and accepted by a representative of our firm. CRUSHED SURFACING: 1) The crushed surfacing consists of 6.0 inches of 5/8" crushed. The crushed surfacing should consist of 10.0 inches of 5/8" crushed compacted to 95% of the maximum dry density as determined by ASTM D- 1557 (Modified Proctor). 2) The crushed surfacing material should consist of WSDOT Section 9-03.9(3) Crushed Surfacing (Base Course Specs) that is placed and compacted to 95% of the maximum dry density as determined by ASTM D-1557 (Modified Proctor). 3) All of the crushed surfacing material could at the contractor's option consist of WSDOT Section 9- 03.9(3) Crushed Surfacing (Top Course Specs) that is placed and compacted to 95% of the maximum dry density as determined by ASTM D-1557 (Modified Proctor).
