We hope that the information discussed at that meeting was helpful in understanding the general requirements for your project as submitted. This letter summarizes comments given to you at the meeting by the members of the DRC. The members who reviewed your project and provided comments include staff from the City's Planning and Building Divisions, Public Works Department, and representatives from Lakehaven Utility and South King Fire and Rescue Districts. Some sections of the Federal Way City Code (FWCC) and relevant information handouts are enclosed with this letter. Please be advised, this letter does not represent all applicable codes. In preparing your formal application, please refer to the complete FWCC and other relevant codes for all additional requirements that may apply to your project. PROJECT DESCRIPTION The applicant proposes to subdivide an existing 32.482 square -foot lot into four single-family residential lots. MAJOR ISSUES Outlined below is a summary of the major issues of your project based on the plans and information submitted for preapplication review. These issues can change due to modifications and revisions in the plans. These major issues only represent comments that the DRC consider most significant to your project and do not include the majority of the comments provided. The major issues section is only provided as a means to highlight critical requirements or issues. Please be sure to read the entire department comments made in the next section of this letter. •r a Page 2 September 5, 2008 • Planning Division The flag pole portion of proposed lots 3 and 4 cannot be included in the total lot area calculation. A redesign of the lot configuration or lot reduction will be necessary. Public Works Traffic Division 1. A Transportation Concurrency permit is required. 2. Street frontage improvements and right-of-way dedication are required along 20"' Avenue South. The current proposal needs to meet access management standards. DEPARTMENT COMMENTS Outlined below are the comments made by the representatives of each department present at the preapplication conference. Each section should be read thoroughly. If you have questions, please contact the representative listed for that section. PLANNING DIVISION (Matthew Herrera, 253-835-2638, matt.herreraCcityoffederalway.com) Comprehensive Plan and Zoning Designation — The City's Comprehensive Plan designation for King County parcel 053700-0595 is Single -Family Residential — High -Density. The property is currently zoned RS 7.2. The minimum lot area for residential lots in RS 7.2 zones is 7,200 square feet. Vehicular access easements, private tracts, flag poles, and access panhandles shall not be credited in the calculation of minimum lot area. Due to this requirement, proposed lots 3 and 4 do not satisfy minimum lot size requirements. Procedurallnformation — Short subdivision review is administrative. Preliminary approval is granted by the City's Director of Community Development. A notice of application with an accompanied two -week comment period is required prior to preliminary approval. A two -week appeal period follows the Director of Community Development's short subdivision decision. Prior to construction of short plat improvements, engineering approval must be granted by the Public Works Department. Please see Ms. DoNver's comments for specific information regarding engineering requirements. 3. Short Plat Content Requirements — For an itemized list of required information to be included in the short plat, please refer to FWCC 20-83(b). Items 1-24 must be included on the plat. The City's Subdivision code (Chapter 20) and Zoning code (Chapter 22) can be accessed from the City's website at w-wvw.cityoffederalway.com. 4. Yard Requirements — Setbacks are: Front — 20 ft.; Rear — 5 ft.; Side — 5ft. (side yard setbacks for corner lots are 10 ft. for the portion of the lot not adjacent to the primary vehicular access). Setbacks as depicted appear to meet code requirements. Aliscelluneous Residential Regulations a) Maximum height of structures — 30 ft. above average building elevation. b) Maximum lot coverage — 60 percent_ c) Required parking spaces — two per dNvelline unit. d) Driveway and/or parking pad may not be closer than five feet to any side property line. Doc ] D 46472 Mr. Phan Page 3 September 5, 2008 6. Critical Areas — According to the City's database, no designated critical areas or buffers are located on the subject property. 7. State Environmental Policy Act (SEPA) — As proposed, the short subdivision is exempt from environmental review pursuant to SEPA. Open Space — All residential subdivisions are required to provide open space in the amount of 15 percent of the gross land area of the subdivision site. At the City's discretion, short subdivisions may satisfy this requirement with a fee in lieu payment calculated on 15 percent of the most recent assessed value of the property. If the fee in lieu option is chosen, a formal request must be made to the City's Parks Department. Open space fees must be paid prior to recording the short plat with the King County Division of Records and Elections. If on -site open space is proposed, it shall be provided in a separate tract. The City recognizes four types of open space: (1) Usable open space - Areas which have appropriate topography, soils, drainage, and size to be considered for development as active recreation areas. (2) Conservation opens ace - Areas containing special natural or physical amenities or environmentally sensitive features. (3) Buffer open space - Areas which are primarily intended to provide separation between properties or between properties and streets. Buffer open space may, but does not always, contain usable open space or conservation open space. (4) Severely constrained open_space - Areas not included in any of the above categories which, due to physical characteristics, are impractical or unsafe for development. Such areas may include, but are not limited to, steep rock escarpments or areas of unstable soils. Any combination of open space types may be used to accomplish the total area required to be reserved as follows: Open Space Category % of Gross Land Area Usable 10% minimum Conservation No maximum or minimun Buffer 2% maximum Constrained 2% maximum The applicant may also choose a combination of fee in lieu and on -site open space accommodations. 9. Landscaping and Significant Trees — A landscape plan prepared by a licensed landscape architect is required for all subdivisions. The plans shall identify existing t�q)ical landscape features and must include an inventory of all significant trees'. The plans shall also show all proposed buffers, open spaces; street trees, and replacement trees (if necessary). Significant tree retention and replacement ' Significant trees are defined as: (I)Twelve inches in diameter or 37 inches in circumference measured four and one-half feet above ground; and (2) In good health: and (3) Not detrimental to the community (e.g. is not diseased. dying, or likely of falling into public right-of-way, etc.) or obscuring safe site distance requirements. Significant trees removed for short plat infrastructure improvements are exempt from rep] acement/retention requirements. 10. Clearing & Grading — All natural vegetation including, but not limited to significant trees, shall be retained on the site to be subdivided except vegetation that will be removed for improvements (e.g. streets and utilities). Generally, the City does not allow mass grading methods for subdivision development. Clearing and grading of individual future lots is not permitted during construction of the plat infrastructure. 11. Notice Requirements — The City will prepare and post a notice board on the subject property. Copies of the Notice of Application will also be posted at the City's designated public notice areas and published in the Federal TY(ty Mirror. The applicant is not required to notify adjacent property owners. 12. Administrative FFc P.v — Current short subdivision review fees are ,52.278.50. Be advised, this fee is for review of preliminary short plat approval only and does not include fees with regard to coneurrency, engineering plan revieNy, open space, etc. 13. AP1_)roval Duration — Short plat preliminary approval expires one year from the date of approval. Engineering plans must be approved, improvements constructed. and the short plat must be recorded Nvithin the one year time period. No less than 30 days prior to the lapse of approval. the applicant may request a one-time extension. limited to one year. 14. Recording— The City will record the short plat with the King County Division of Records and Elections subsequent to Public Works Department approval of submitted as -built plans. Prior to recording the short plat, all surveying and monumentation must be complete. In addition, all other required improvements must be substantially completed as determined by the departments of Community Development and Public Works. All open space and traffic mitigation fees must be paid in full prior to recording. PUBLIC WORKS DEVELOPMENT SERVICES DIVISION (Ann Dower, 253-835-2732, ann.dower@cityoffederalway.com) Land Use Issues — Stormwater Surface water runoff control and water quality treatment will be required per the 1998 King County Su�face Water Design Manual (KCSWDM) and the City of Federal Way Addendum to the 1998 KCSWDM. The following comments are based on the 1998 KCSWDM. Staff anticipates adoption of a new storm',vater manual_ perhaps as early as the beginning of'2009. Applications are vested to the requirements that are in place at the time the application is deemed "Complete" by City staff. If an application has not been made, or the application is made but deemed "Incomplete" prior to adoption of the new manual, all regulations in the new manual shall apply. ` If the approved development will require the removal of more than 75 percent of the significant trees on a proposed lot_ significant trees shall be replaced in amount to 25 percent of the significant trees that existed on the subject property prior to development. For specific information regarding significant tree retention and replacements standards please refer to FV1'CC 22- 156S. 08-103577 I�,, I D 46472 FA .—1 Mr. Phan Page 5 September 5, 2008 This project meets the requirements for a Full Drainage Review. At the time of land use site plan preliminary short plat submittal, a preliminary Technical Information Report (TIR), addressing the relevance of the project to the eight core and five special requirements of the KCSWDM will be required. A Level 1 downstream analysis shall also be provided in the preliminary TIR. The City has 1 " = l 00', five-foot contour planimetric maps that may be used for basin analysis. The project lies within a Level 1 flow control area, thus the applicant must design the flow control facility to meet this performance criteria. The project also lies within a Basic Water Quality Area. Water Quality Treatment shall be designed to meet the treatment criteria of the Basic Water Quality Menu. 4. If infiltration is proposed, soil logs prepared by a licensed geotechnical engineer or septic designer must be provided to verify infiltration suitability. Detention and water quality facilities for short plats must be above ground (i.e. open pond). Underground facilities are allowed only with approval from the City of Federal Way Stormwater Management Division_ Small lot Best Management Practices (BMP's) may be used if all setback, slope; and design criteria can be met. 6. Show the proposed location and dimensions of the detention and water quality facilities on the preliminary plans. 7. if more than one acre will be disturbed during construction, a National Pollutant Discharge Elimination System (NPDES) permit may be required. Information regarding this permit can be obtained from the Washington State Department of Ecology at http://www.ecy.wa.go3L/pnggams/sep/ ac/index.html, or by calling 3 60-407-643 7. Right -of -Way Improvements 1. See the Traffic Division comments from Sarady Long_ Senior Transportation Planning Engineer. for traffic related items. 2. If dedication of additional right-of-way is required to install street frontage improvements; the dedication shall be conveyed to the City through a statutory warranty deed. The dedicated area must have clear title prior to recording. 3. All stormwater treatment and detention requirements outlined above will be applied to new impervious area within the public right-of-way. 4. FWCC Section 22-1543 requires that driveways serving residential uses may not be located closer than 25 feet to any street intersection_ Lots and intersections within new subdivisions or short plats must be designed to meet this standard_ Building (or EN) Permit Issues Engineered plans are required for clearing; grading, road construction. and utility work. Plans must be reviewed and approved by the City. Engineering review fees are $782.00 for the first 12 hours of review. and $65 per hour for additional review time. A final TIR shall be prepared for the project and submitted with the engineering plans. Both the TIR and the plans will require the signature/seal of a professional engineer registered/licensed in the state of Washington. (,8. 10? 577 Dh I D 40472 Mr. Phan Page 6 September 5, 2008 2. In addition to engineering approval, short plats and subdivisions are required to obtain a separate permit for grading. Details and fees may be obtained from the Federal Way Building Department. The Federal Way Development Standards Manual (including standard detail drawings, standard notes, and engineering checklists) is available on the City's website at www.ciiyoffederalway.com to assist the applicant's engineer in preparing the plans and T1R. 4. The applicant shall provide a geotecbmcal report that addresses design pavement thickness for the roadways. Bonding is required for all improvements associated with the project. The bond amount shall be 120 percent of the estimated costs of the improvements. An administrative fee deposit veil] need to accompany the bond to cover any possible legal fees in the event the bond must be called. Upon completion of the installation of the improvements, and final approval of the Public Works Inspector, the bond will be reduced to 30 percent of the original amount and held for a two-year maintenance period. 6. The developer will be responsible for the maintenance of all storm drainage facilities (including the detention and water quality facilities) and street systems during the two-year maintenance period_ During that time, the Public Works Inspector will make periodic visits to the site to ensure the developer's compliance with the maintenance requirements. Upon satisfactory completion of the two-year maintenance period, the remainder of the bond will be released. Maintenance for public roads and subdivision drainage facilities then become the responsibility of the City. Maintenance for private roads and drainage facilities, including short plats, remain the responsibility of the individual property owners. When topographic survey information is shown on the plans, the vertical datum block shall include the phrase "DATUM: N.G.V.D.-29" or "DATUM: K.C.A.S.." on all sheets where vertical elevations are called out. Drawings submitted for plan review shall be printed on 24" x 36" or 22" x 34" paper. All final approved drawings shall be drafted/plotted on 24" x 36" or 22" x 34" mylar sheet with permanent black ink. Site plans shall be drawn at a scale of l " = 20', or larger_ Architectural scales are not permitted on engineering plans. 9. Provide cut and fill quantities on the clearing and grading plan. Erosion control measures, per Appendix D, 1998 KCSWDM, must be shown on the engineering plans. 10. The site plan shall show the location of any existing and proposed utilities in the areas affected by construction. PUBLIC WORKS TRAFFIC DIVISION (Sarad}' Long, 253-835-2743, sarady.long@cityoffederalway.com) Transportation Impact Analysis Based on the Institute of Transportation Engineers Trip Generation 7`h Edition, land use code 210 (Single -Family Detached Housing), the project is expected to generate six (6) new weekday evening peak hour trips. nS-In9577 Do; I II •u-1" a Mr. Phan Page 7 September 5, 2008 2. Per FWCC Chapter 19, Article IV, a concurrency permit will be required for this development project. The concurrency analysis determines whether there is adequate roadway capacity to accommodate the proposed development project. It provides the applicant an analysis of evening peak hour project impacts and identifies traffic mitigation in the form of pro-rata share contributions towards transportation projects adopted in the Transportation Improvement Plan (TIP). Please note that supplemental transportation mitigation may be required if the proposed project creates an impact not anticipated in the six -year TIP. 3. The estimated fee for the concurrency permit application is $327.00. This fee is based on estimated new PM peak hour trips of the current proposal. The applicant will be notified with the actual fees that will be calculated and must be paid prior to staff releasing the completed concurrency analysis. The applicant has the option of having an independent traffic engineer prepare the concurrency analysis consistent with City procedures; however, staff review time requires that the application fee remain the same. Street Frontage Improvements 4. Based on the materials submitted, staff conducted a limited analysis to determine the required frontage improvements in meeting FWCC Section 22-1474. Based on the analysis and FWCC, the applicant/o,,vner is expected to construct half -street improvements on the east side of 20`h Avenue South to a Type S street., which include a 28 pavement, 4' planter strip with street trees; 5' sidewalk. and streetlights all within 527 right-of-way. It seems the existing right-of-way is adequate to accommodate a Type S street. 5. Per FWCC Section 22-1477, the applicant may make a written request to the Public Works Director to modify, defer, or waive the required street improvements. Access and Traffic Circulation The proposed 30' access tract does not meet access management standards. To meet this requirement the applicant shall construct half -street improvements along the northerly property to a Type W street and set aside as Tract "X" for future South 310`h Street extension. At a minimum, the improvement shall include a 24' paved surface -, ith vertical curb, 4' planter with street trees, 5' sidewalk. and streetlights. Alternatively_ the applicant could construct half -street improvements along the southern property line to the same standard (type "W" street) for access. A temporary turn around is required for emergency vehicles at the easterly property as required by the Fire Marshal. FWCC Section 22-1543 indicates a procedure and allows the public works director to modify access requirements. Once preliminary traffic queuing analysis has been completed, the applicant's traffic engineer may submit a written request for modification if desired. Private easement area(s) shall cover off -site property along the route of the affected portion of the building supply line from the edge of public ROW to the lot or tract receiving such service. Sewer • A Certificate of Sewer Availability (application form enclosed) may be required to be submitted with any land use and/or building permit applications. If Certificate is needed, allow- 30 days to issue. A separate sewer service connection permit (application form attached) is required for each new connection to the sanitary sewer system, in accordance with standards defined in Lakehaven's current `Fees and Charges Resolution'. Minimum slope for gravity sewer service connections is 2%. If the short plat is configured so that one or more lots does not abut 20th Ave. S ROW, private, sewer easement(s) will be required across new short plat lot(s) &/or tract(s). for the benefit of the portion of the private building sewer lines across these areas for new lots not abutting ROW. Private easement area(s) shall cover off -site property along the route of the affected portion of the building sewer line from the edge of public ROW to the lot or tract receiving such service. General Lakehaven's Capital Facilities Charges are calculated on the basis of Equivalent Residential Units (ERU). Residential equivalency for Single-family use is calculated as 1.0 ERU per unit. Lakehaven's 2008 Capital Facilities Charges are $3,000/ERU for water and $2,891/ERU for sewer. Property has credit for three (3) ERU for sewer, from previous ULID assessment. Property does not have any ERU credit for water. All comments herein are valid for one (1) year and are based on the proposal(s) submitted and Lakehaven's current regulations and policies. Any change to either the development proposals) or Lakehaven's regulations and policies may affect the above comments accordingly SOUTH KING FIRE AND RESCUE (Chris Ingham, 253-946-7244, ehris.ingham@southkingfire.org) Water Supplies for Fire Protection A Certificate of Water Availability shall be provided at the time of application indicating the fire flow available at the site. A hydraulic fire flow model shall be requested from the water district. 2. Fire Apparatus Access Roadway Fire apparatus access roadways shall be required for every building when any portion of an exterior wall of the first story is located more than 150 ft. from fire apparatus vehicle access. Fire apparatus access roads. - a) Shall have an unobstructed width of not less than 20 feet and an unobstructed vertical clearance of not less than 13 feet 6 inches. b) Shall be designed and maintained to support the imposed load of a 25-ton fire apparatus and shall be provided with a surface so as to provide all-weather driving capabilities. c) Shall be not less than a 20-foot inside turning radius and not less than a 40-foot outside turnin21 radius. W Mr. Phan Page 9 September 5, 2008 d) With a dead-end in excess of 150 feet in length shall be provided with a cul-de-sac at the dead end. All such cul-de-sacs shall be not less than 80 feet in diameter. EXCEPTION: When buildings are completely protected with an approved automatic fire sprinkler system, these provisions may be modified by the chief. 3. Automatic Fire Sprinkler Systems An automatic fire sprinkler system is required for lots 3 and 4. An automatic fire sprinkler system shall be installed in Group R, Division 3 occupancies a) When the occupancy exceeds 2,500 square feet (]including attached garages) without adequate fire flow. b) Without approved fire department access.
