Ord 04-477 , RDINANCE NO. 04-477 AN ORDIN CE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, AMENDING CHAPTER 2 OF THE FEDERAL WAY CITY COD BY AMENDING SECTION 2-95.2 TO ALLOW M RE THAN FIVE MEMBERS ON THE LODGING X ADVISORY COMMITTEE. WHEREAS, RCW 6 .28.180, authorizes local jurisdictions to levy and collect a special excise tax not to exce d two percent on the sale of or charge made for the furnishing of lodging by a h el, rooming house, tourist court, motel, trailer camp, and the granting of any similar li ense to use real property for the purposes of tourism promotion, and/or acquisitio or operation of tourism-related facilities; and WHEREAS, RCW 6 .28.1817 requires that a municipality with a population of . five thousand or more that i poses a lodging tax must establish a lodging tax advisory committee comprised of at I ast five members appointed by the legislative body of the municipality; and WHEREAS, RCW 6 .28.1817 requires that a lodging tax advisory committee include one member who is n elected official of the municipality, at least two members who are representatives ofb sinesses authorized to collect the lodging tax, and at least two members who are perso s involved in activities authorized to be funded by lodging tax revenues; and WHEREAS, Section 2-95.1 FWCC creates the City of Federal Way Lodging Tax Advisory Committee, in acc rd with Chapter 67.28, RCW; and WHEREAS, Section 2-95.2 FWCC limits the lodging tax advisory committee to five members only; and ORIGINAL ORD # 04-477 ,PAG 1 WHEREAS, the City of Federal Way Lodging Tax Advisory Committee at its September 10, 2004 meeting voted unanimously to allow for expansion of the committee's membership to p to seven members, by adding one member who is a representative of businesses uthorized to collect the lodging tax and one member who is a person involved in activiti authorized to be funded by the lodging tax revenues; and WHEREAS, the City Council wishes to expand the membership of the lodging tax advisory committee to e ourage greater community participation in committee activities and increase the nu ber of committee members able to work on committee projects and programs; NOW, THEREFORE, THE ITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES HE BY ORDAIN AS FOLLOWS: Section 1. Chapter 2, Article III, Division 7, Section 2-95,2 ofthe Federal Way City Code is a ended, as follows: 2-95.2 Membership The membership of the lodg' g tax advisory committee shall be appointed by the city council and shall consist of least five members: one member shall be an elected official of the city who shall serve a the chair; at least two members shall be representatives of businesses required to collec the tax, and at least two members shall be persons involved in activities authorized to be funded by revenue received from the tax. Section 3. R tification. Any act consistent with the authority and prior to the effective date of this 0 inance is hereby ratified and affirmed. Section 4. ffective Date. This ordinance shall take effect and be in force five (5) days from the t me of its final passage, as provided by law.
