AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
FEDERAL WAY, ASIDNGTON, ESTABLISIDNG AN EFFECTIVE
DATE OF JA ARY 1, 2005 FOR THE REDONDO EAST
ANNEXATION
WHEREAS, the City Coun il of the City of Federal Way, Washington, has determined that it
would be in the best interest and eneral welfare of the City of Federal Way and the annexing area to
annex certain property, east and so th of existing City of Des Moines City Limits, west of existing City of
Federal Way City limits, and nort of S. 284th St. and legally described in Exhibit "A" and graphically
depicted in Exhibit "B" attached he eto and incorporated by reference as if fully set forth; and
WHEREAS, financial analy is of revenues and costs for the Redondo East territory indicate a net

on December 23, 1998, September 4,2000, November 1,2001, March 27, 2003, and July 20,2004; and
(P AA) Subarea Plan, which repla ed Chapter 8, "Potential Annexation Areas," of the Federal Way
Comprehensive Plan, and; and
WHEREAS, Chapter 8, "Po ential Annexation Areas," of the Federal Way Comprehensive Plan
establishes Comprehensive Plan de ignations and zoning classifications for property within the Potential
Annexation Area; and
WHEREAS, the Redondo Ea t area is within the City of Federal Way's Potential Annexation Area;
and
WHEREAS, the Growth M nagement Act and the King County Countywide Planning Policies
encourage transition of unincorpo ted urban and urbanizing areas within Potential Annexation Areas

from county governance to city go ernance; and
WHEREAS, annexations ar exempt from the requirements of the state Environmental Policy Act;
and
WHEREAS, on May 18, 2 04 City Council passed Resolution 04-414 calling for annexation by
election of the Redondo East area; nd
WHEREAS, on July 23, 2 04 the King County Boundary Review Board notified the City the
Redondo East annexation was cons dered approved by the Board; and
WHEREAS, on August 24, 004 City Council passed Resolution 04-423, setting an election date of
November 2, 2004 for the Redond East annexation; and
WHEREAS, on September 7 and October 27, 2004 the City held informational open houses for
the Redondo East annexation; and
WHEREAS, the City provi ed public notice of the Redondo East annexation pursuant to RCW
Chapter 35A.14.070; and
WHEREAS, on November, 2004 voters within the Redondo East area voted on the question of
annexation to the City of Federal
ay and a majority of voters residing within the area voted in favor of
annexation; and
WHEREAS, on November 1 , 2004 the King County Director of Elections certified the results of
the Redondo East annexation; and
WHEREAS, the City Coun il desires to establish an effective date of January 1, 2005 for the
Redondo East annexation.
Now, THEREFORE, the City Council of the City of Federal Way, Washington, does hereby ordain
as follows:
Section 1. Findings.
A.
The best interests a d general welfare of the City of Federal Way and the annexing area
would be served by the annexation of certain contiguous unincorporated territory lying in the area east

and south of existing City of Des
oines City Limits, west of existing City of Federal Way City limits,
and north of S. 284th St., legall described in Exhibit "A" and graphically depicted in Exhibit "B"
attached hereto and incorporated b reference as if fully set forth.
B.
Annexation of th Redondo East area would benefit the citizens of Federal Way by
transferring permitting and land us authority ftom King County to the City, thereby establishing a future
land use pattern and transportation etwork in the area more consistent with that of the entire City.
C.
City Departments are ready to begin providing services within the Redondo East
annexation area.
D.
The City, in conju ction with the County is developing a Memorandum of Understanding
to address annexation operational i sues including permit processing and police transitional issues.
E.
The City has take and is in the process of taking the steps necessary to receive tax
revenues generated within the Red ndo East area, including notification of State and County offices and
completion of an annexation certifi ate.
F.
Financial analysis f revenues and costs for the Redondo East territory indicate a net
annual surplus to the City of Feder Way in the amount of $6,990.
Section 2. Zoning. All p operty located within the territory to be annexed shall, simultaneous
with the annexation, have imposed he City of Federal Way Comprehensive Plan designations and zoning
classifications, prepared under RC
35A.14.330, and depicted in the Potential Annexation Area Chapter
of the Federal Way Comprehensive Plan, as adopted by ordinance number 04-460.
Section 3. Annexation E fective Date. The Redondo East annexation shall be effective on
January 1, 2005, subject to success ul completion of a Memorandum of Understanding related to police
and permitting operational issues p or to January 1,2005.
Section 4. Severability.
he provisions of this ordinance are declared separate and severable.
The invalidity of any clause, senten e, paragraph, subdivision, section, or portion of this ordinance, or the
invalidity of the application thereo to any person or circumstance, shall not affect the validity of the

remainder of the ordinance, or the alidity of its application to other persons or circumstances.
Section 5. Ratification.
