The Process I MLU application is hereby approved pursuant to conclusions based on findings made by the department's Planning Division. FINDINGS The zoning for the subject property is Neighborhood Business (BN). The existing bank is an allowed use in the BN zone per FWRC 19.215.010, Office/retail. The applicant is proposing minor parking lot alterations to make the site fully -accessible, including re -paving the parking lot, new parking striping, wheelstops, and directional signage. Associated site work with the sidewalk and enhanced pedestrian connection are also included. The existing landscaping and amount of parking stalls will remain the same. CONCLUSIONS Various sections of the Zoning and Development Code indicate that certain developments, activities, or uses are permitted only if approved using Process I — Director's Approval. Based on the findings below, the proposed improvements to the developed site meet the following Process I approval criteria and land use review thresholds of Federal Way Revised Code (FWRC) 19.15.030 and 19.55.020: 1. The proposed improvements are consistent with applicable chapters of FWRC Title 19 including, but not limited to: Permits and Review Processes; Process I — Director's Approval; Community Design Guidelines; and Neighborhood Business (BN). 2. The health, safety, and welfare of the citizens of the city are preserved. 3. The proposal is a minor improvement, modification, or addition to a site that is exempt from SEPA review. CONDITIONS OF APPROVAL Pedestrian pathways should be delineated by separate paved routings using a variation in paved texture and color. The proposed striping does not meet this requirement. Prior to issuance of the building permit, an inspection is required to verify the pathway is constructed in an approved method of delineation, such as, brick or granite pavers, or stamped and colored concrete. Mr. Pizarro May 16, 2014 Page 2 BUILDING PERMIT ISSUANCE REQUIRED The cty's Building Division is currently reviewing the associated building permit (File #14-101898-00- CO). No site work may begin until the building permit has been issued. Please contact the permit center at 253-835-2607, or permitcenter@cityoffederalway.com, if you have any questions regarding the building permit. APPEALS The effective date of this decision is May 19, 2014, or three days from the date of this letter. Pursuant to FWRC 19.55.150, any person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner by June 2, 2014. Any appeal must be in the form of a letter delivered to the Department of Community Development with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision, including the identification of specific findings and conclusions made by the Director disputed by the person filing. In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal this decision). Waiver of the right to appeal does not affect the effective date of this decision. CLOSING This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. This Process I approval is valid for one year from the effective date of this decision. If no further action is taken within one year, this decision will expire. Per FWRC 19.15.110, a two-year extension may be granted if a written request is submitted to the City's Department of Community Development at least 30 days prior to the expiration of the decision. This Process I approval does not constitute approval of the building permit. The existing crosswalk (near the ADA parking) will remain, and not be paved over. Since proposed scope was only to stripe the existing path, you confirmed that it is okay to proceed, since we are not building new, or affecting the existing one. We will not stripe over the concrete crossing, and leave as -is. • The new crosswalk below was built by the Cily of Federal Way (Public Works), and does not meet the pedestrian pathway City standards. As you and I discussed, since it was the City of Federal Way that built this new pathway, you advised to write a letter/email which you can than take and review with your department. Can you please review with the applicable party, and see what you can to have this requirement waived based off this particular circumstance? K Also discussed, since we have a Building Permit review running concurrently, please communicate any/all correspondence for their reference. 3 Please let us know if you have any questions, or require anything further from us.
