The Short Plat Alteration is proposed in order to revise a 1983 short plat declaration of covenant for non -building lot as recorded against the property. The 0.37-acre lot is a buildable lot under City codes. The City received the application November 30, 2015, and deemed it complete December 17, 2015. The City of Federal Way hereby grants conditional approval of the Evans Short Plat Alteration, subject to the condition noted below. This approval corresponds to the Short Plat Alteration drawing prepared by Edward Barnard P.L.S. date -stamped as resubmitted January 26, 2016. CONCLUSION This Decision of the Director is based on the enclosed Statement of Facts (Exhibit A) and is in accordance with the following criteria pursuant to Federal Way Revised Code (FWRC) 18.30.110(2): 1. STATE ENVIRONMENTAL POLICY ACT The proposal is exempt from a SEPA threshold determination pursuant to Washington Administrative Code (WAC) 197-11-800(6)(d). DURATION OF APPROVAL Short subdivision approval shall expire five years from the date of this decision if the final short plat is not recorded. Opportunities for time extensions are available pursuant to criteria listed in FWRC 18.05.090. REQUESTS FOR CHANGE OF VALUATION Any affected property owners may request a change in valuation for property tax purposes, not withstanding any program of revaluation. I.D. 72035 L CITY OF Federal Way Exhibit A Statement of Facts Evans Short Plat Alteration, File No. 15-106023-00-SU The Planning Division hereby makes the following Findings of Facts pursuant to content requirements of the Short Subdivision decision as set forth in Federal Way Revised Code (FWRC) 18.30.110. These facts are in reference to King County tax parcel number 072104-9246 located at 843 SW 312t' Street, Federal Way. Proposal — The applicant proposes to alter an approved short plat. The original 2-lot short plat was approved under King County's authority in 1983. The recorded short plat contained a declaration of covenant for non -building lot for the property in question, Lot 2. Per the Declaration of Covenant, no improvements are to be made on Lot 2 unless or until the lot is approved in accordance with short plat regulations. In order to become a legal building site an alteration of the approved Short Plat is required. Review Process — Pursuant to FWRC 18.30.190, Alteration and vacation of short plats, alterations of an approved short plat shall follow the same review process used to create a short plat as set forth in FWRC 18.30.010. The proposed short plat alteration is subject to administrative review and decision rendered by the Director of Community Development. The proposal has been reviewed by staff from the Department of Community Development, Public Works, Lakehaven Utility District, and South King Fire and Rescue. City staff used the following FWRC development regulations when reviewing the short subdivision application: Title 16 `Surface Water Management;' Title 18 `Subdivisions;' and Title 19, `Zoning and Development Code.' Public Notice & Comment — A Notice of Land Use Application for the short subdivision was published in the Federal Way Mirror and posted at the subject property and city designated notice boards on December 18, 2015. No comments were received regarding the short subdivision application. 4. Density & Zoning District Regulations — The subject property is located within a Single - Family Residential (RS 7.2) zone with a minimum lot size requirement of 7,200 square feet. The proposal meets the density requirement as noted above. FWRC 19.200.010 "Detached Dwelling Unit" prescribes setback, height, and parking and lot coverage requirements. The associated building permit application (File #15-103179-00-SF) will be reviewed for compliance with these provisions. 5. Comprehensive Plan — The subject property's comprehensive plan designation is Single - Family — High -Density Residential. The proposal provides an urban density consistent with the Federal Way Comprehensive Plan (FWCP) designation. The proposal meets relevant goals and policies of the FWCP. 6. State Environmental Policy Act (SEPA) — The short plat alteration is exempt from environmental review pursuant to Washington Administrative Code (WAC) 197-11-800(6)(d), 7. Open Space — This project did not create any new lots; therefore, open space is not required. Critical Areas —The city- s critical areas map has identified that a portion of the subject property -is located within a designated 10-year wellhead capture zone. No other critical area exists within the subject property vicinity. 9. Tree and Vegetation Retention/Replacement — Single-family residential zones are required to maintain a minimum of 25 tree units per acre. The total required tree units for the subject property are based on the gross land area (0.37 acres). The applicant will be required to retain, replace, or augment 10 tree units as part of the building permit approval for the lot. 10. Access —The site is accessed off of SW 312`h Street. Lot 2 is a flag lot; the driveway width is 15 feet with 8 feet of asphalt. Total length of the driveway is 161.05 feet. 11. Street Frontage Improvements — No frontage improvements are required. 12. Stormwater —As part of the associated building permit File #15-103179-00-SF, the applicant has proposed to utilize an infiltration trench meeting the requirements of the 2009 King County Surface Water Design Manual. 13. Fire Protection — South King Fire and Rescue reviewed the application materials. An approved automatic fire sprinkler system is required or the access road must be increased to twenty feet with an approved Fire Department turnaround. Since the proposed access road is depicted as 15 feet and does not meet Fire Department fire apparatus access road standards, an automatic fire sprinkler system is required. A note must be provided on the face of the short plat that states an automatic fire sprinkler system is required for any new residence built on this lot. 14. Water and On -Site Septic System — The applicant proposes to serve the one lot with a public water supply and distribution system managed by the Lakehaven Utility District. The January 28, 2015, Certificate of Water Availability indicates Lakehaven's capacity to serve the proposed development via an existing 12-inch diameter water main that is 43+/- feet from the site. A water service connection application will be required. The applicant proposes to serve the site with on -site septic systems. King County Department of Public Health approved the on -site sewage system design plan on May 14, 2015. A note has been placed on the face of the plat which states verification of on -site sewage system approval will be conducted as part of the associated building permit application review for Lot 2. 15. Conditions of Approval — Staff recommends the Director of Community Development include the following conditions of approval to the short subdivision decision. The following condition must be met prior to plat recording. Please revise the cross section street on Sheet 2 to be depicted as 8ch AVE SW. 16. Decisional Criteria — The proposal is consistent with all items listed in FWRC 18.30.110(2), which include the following: (1) FWCP; (2) Applicable provisions of FWRC Tile 18 `Subdivisions"; (3) The public health, safety, and welfare; (4) Design criteria; (5) Development standards, Chapter 58.17 of the Revised Code of Washington, and other applicable ordinances or regulations of the City. These findings shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. There are two issues that came up in review of your building permit application: 1. Designation as a non -building lot: When this lot was originally short platted, under King County jurisdiction, lot 2 (the Dawson lot) was designated as a non -building lot. A covenant establishing the fact that it is not buildable is recorded on the face of the short plat. This is the first time Grace or I had encountered this particular situation. We checked in with staff from King County. County staff confirmed that the intent of the covenant was to restrict building on the lot until the underlying issue is resolved and the covenant is removed. In this case, we understand that the underlying issue at time of subdivision was the inability to provide sewer/septic facilities. The method of removing the covenant utilized by King County is to approve a 'one -lot short subdivision'. The only change that would be made is that the covenant describing the lot as a non -building lot would be removed. A short subdivision process like this is necessary to eliminate the covenant, which is depicted on the face of the short plat. Based on this guidance from the County we would require you to apply for a one -lot short subdivision to remove the covenant. Upon completion of this process the lot would be considered buildable. The second issue we had identified is that code requires that driveways be setback 5-feet from side property lines in certain circumstances. This would be problematic given the substandard dimension of the pipe -stem portion of your lot at 15-feet (leaving only 5-feet for the driveway dimension once the setbacks are applied). After looking into this question we have made a determination that the 5-foot setbacks do not apply within the pipe -stem area of your lot. Therefore this issue is resolved and you may locate a driveway within the pipe -stem part of the lot (we should discuss exact location to avoid any problems). Also, you may want to coordinate with your neighbor to the west with regard to some type of shared access easement as the existing driveway appears to cross the property line, but we'll leave that to your discretion. The next step would be to apply for the short subdivision. I will follow up with a detailed description of the items that need to be submitted. I wanted to get the main questions answered before doing so. The short subdivision fee is $ 2,416.50. Processing time is between 3 and 4 months. Let me know if you have any questions. After reading through your message, I identified two issues: First, a request that you be allowed to submit an older title report; and second, a request that the City Attorney represent your interests in terms of recovering compensation from those parties involved in the sale transaction when you purchased the lot. Title deport What is the date of the title report in your possession? Legal Advocacy The City's legal resources cannot be used to help you settle a civil dispute because the City Attorney's office is prohibited from providing legal advice to citizens. This is clearly a civil matter to be resolved between you, your title company, and the party that sold you the property. If you recall, I recommended that you consult an attorney on these matters. For information on obtaining legal advice, please contact the King County Bar Association Lawyer Referral Service at ( 206) 267-7010. The King County Bar Association also offers a neighborhood legal clinic that provides individuals a free half- hour consultation with an attorney on any civil legal issue. Also, I disagree with your conclusion that the City is somehow responsible for this problem. I understand you did make some inquiries to City staff prior to purchasing the property and we informed you of all of the issues we were aware of. We did not have any information at our disposal that identified the unique limitation associated with this property. In fact, we were not even aware that non -building lots (of this type) existed until you provided us with the short plat, so the City could not have identified that as an issue in our initial discussions. Likewise, after City review began, it's not clear how the amount of time it took for the City to identify this issue harmed you (you had already purchased the property so the damage was done), or that it took an unreasonable amount of time to identify the issue. The main point here is that your complaint is with the other parties involved in the sales transaction, not the City. The City is prohibited from contributing public funds to this issue and the City Attorney's office is likewise prohibited from providing legal advice to private parties. I have a question about our short Plat changes that Isaac sent us an Email what needs to be done. 3 of those documents surveyor will do for us, but it will cost 2000$. The change itself over 2400$ to make that short plot subdivision or whatever it's called. Then another document to get the updated title report will cost 390$ from Stewart title, which should be no older than 90 days. Can we provide the one they originally give us, its more than 90 days old but we have it and it will save us some money and time? It became very expansive and long project. We were wondering if You and Issac could help us to get through it faster and get the city attorney to go after title/insurance or the listing agent/seller, to create smart and helpful compliant -and or do whatever we can to make them pay, whoever is responsible, for those expanses or later reimburse us at least. Because, like Issac told us and what we personally strongly believe, it was not our fault and nobody told us it was non building lot. I think that this is a very important thing that should of being verbally disclosed to us and showed in the paperwork too by listing agent and title insurance, but we had no idea, they sold it to us as permanent residency, paperwork was not explained to us, short plot we didn't even have until Grace requested it, listing agent was telling us that it perks, that we will be able to build a house there with sewer or septic, etc., title insurance never explained or verbally told anything, nobody didn't even mention that this property has so many problems, like non -binding or non buildable lot, lack of sewer, very narrow drive way, with the neighbors fence built on our property's driveway, which will make it expansive to put the mobile home through, no survey done, etc. We are paying taxes on it, king county got a septic approval, so why would we need to be responsible for all these changes and expanses? We already waited all this extra time and spent thousands of dollars on this property and more to go, which could be all avoided if somebody told us everything about that property at the first place. Even you guys did not tell us about non building lot or drivaway right away. All these is extreme hardship and inconvenience for us. We need help from you guys and city attorney to help us, we do not have enough money for everything. Somebody needs to pay for all of it or to help us to pay for it! These are not last expanses and waisted precious time, the neighbors fence on our driveway is another thing we will need help with too. So, please, provide the free survice of the city attorney for us.
