The short answer is that we believe all three of the concerns you expressed in your letter are resolved by discontinuing the proposal to remove the septic tank. Your geotechnical engineer agreed with the proposal for pin piling foundation (see quoted language under #2 below). The request from your geotechnical engineer that your residence be surveyed, was in response to the proposal for septic removal. Since that is no longer proposed we do not believe imposing that condition to be justified. Further, the concern about removal of living root system was also related to the septic tank removal. As the tank is no longer proposed to be removed, the root system will be left in place. Matt Herrera, the planner who worked on this one provides some additional detail below. Foundation excavation and pin piling activity downslope of our property." The applicant's geotechnical engineer and Mr. Dupree geotechnical engineer expressed no concern in documents regarding this issue. On page 2 of E3RA Geotechnical Report Review Letter (Mr. Dupree's consultant) it states "(b]ased on our observations of the surface and subsurface conditions, as well as our review of the Geotechnical Report provided by other, we are in general agreement with the recommendations for foundation support provided by the installation of pin piles. " On August 26, 2011, David Fall (applicant's consultant) responded to David Rupert (Mr. Dupree's consultant) to notify him of the change in scope from septic removal to filling. it states "[o]ur proposed foundation system of grade beams supported on pin piles, as you know, is a typical foundation support system in sensitive soils and steep slope situations. Similarly, this foundation system is compatible with abandonment of the existing septic system." Mr. Dupree's consultant's concern is regarding the removal of the septic system and backfill activities. The consultant recommended surveying the Dupree residence during and after completion of the septic removal and backfill operations. As the applicant is no longer pursuing septic removal, there appears no need to condition it as such. "3. Removal of living root systems located on the subject property requiring backfilling and compaction." This was a component of the septic system removal and is now moot. My wife and I are the owners for 22 years of the residence at 3120 SW 302na Place immediately upslope of the proposed project. As noted in our comment letter of 814/2011, we have evaluated the geotechnical findings submitted with this application along with the engineer's reports and we are most concerned with potential instability of the slope which could be induced by: 1. The removal of the existing septic tank and down slope drain field which will be replaced with fill and compacted. 2. Foundational excavation and pin piling activity downslope of our property. 3. Removal of living root systems located on the subject property requiring back filling and compaction. A letter sent by Mr. Fall on 8/26/2011to our geotechnical consultant, David Rupert, addressed item 1 above by leaving the septic system in place and filling it with CDF concrete mix but did not adequately address out concerns surrounding numbers 2 and 3. We are requesting that any building permit issuance by the City of Federal Way be conditional on following the recommendation of Mr. Rupert in his report of 8/4/2011 that the Dupree residence be surveyed at Bradshaw expense by a licensed professional surveyor before, during, and after completion of downslope activity noted above. In the event of any upslope movement, these operations should be suspended until such time that the Dupree residence has been shored and properly supported.
