The Department of Community Development has completed review of the Accessory Dwelling Unit (ADU)
Land use application submitted to the city on November 6, 2019, with the addition of information discussed at
a meeting on January 2, 2020. The ADU application is hereby approved pursuant to the following findings of
fact and conclusions based on those findings.
FINDINGS OF FACT
The following findings are based on site and floor plans received with the ADU land use application.
1. Proposal— The applicant proposes to establish a 791 square foot attached ADU within an existing single-
family dwelling, which was previously remodeled into a duplex without all required permits at 32830 38th
Court SW.
2. Zoning— The subject property is a 12,150 square -foot (0.28-acre) lot with a Single -Family Residential (RS
7.2) zoning designation. The proposal meets the minimum lot size requirement pursuant to Federal Way
Revised Code (FWRC) 19.200.180, Note 1.
3. Lot Coverage —The lot coverage of the single-family dwelling, attached ADU, and other existing site
improvements do not exceed the maximum lot coverage of 60 percent in the RS 7.2 zone pursuant to
FWRC 19.200.180, Note 2.
4. Setbacks —The front, side, and rear structural setbacks for the single-family dwelling and attached ADU
comply with required setbacks in the RS 7.2 zone pursuant to FWRC 19.200.180.
5. Height — The single-family dwelling and attached ADU comply with the 30-foot height limitation in the
RS 7.2 zone pursuant to FWRC 19.200.010 and FWRC 19.200.180.
6. Floor Plan —The square footage of the proposed ADU is 791 square feet, including a living room, dining
room, kitchen, bathroom, bedroom, laundry room, and powder room. The principal dwelling unit
contains more than 2,000 square feet. The ADU will not exceed the 40 percent maximum accessory
dwelling unit size of 800 square feet pursuant to FWRC 19.200.180, Note 9. A wall will be constructed to

separate the ADU from the other primary dwelling unit living space on the first floor. The ADU will be
accessed through an entrance at the rear of the residence pursuant to FWRC 19.200.180, Note 7, which
allows only one entrance gt the front of the residence.
7. Parking — The proposal will include removal of the attached garage's doors. The attached garage has
already been converted to liv`iiig space. The site plan shows the existing concrete driveway with
dimensions that can accommodate three parking spaces. As such, there is sufficient amount of parking
for the required one on -site parking space for the ADU pursuant to FWRC 19.200.180 and the required
two on -site parking spaces for the single-family home pursuant to FWRC 19.200.010.
The owner has established a second driveway and parking area at the southwest corner of the site.
Pursuant to FWRC 19.135.280(3), there may be no more than one driveway for each 330 feet of lot
frontage. The lot contains two street frontages, neither of which is 330 feet in length. Therefore, more
than one driveway is not permitted on the lot. Additionally, the second driveway/parking pad exceeds the
allowable width and extends to the property line; not maintaining a five-foot side yard setback required
pursuant to FWRC 19.130.240(1)(a):
"Vehicles may not be parked in a required sideyard, but may be parked in the requiredfront and rearyards
only ifparked on a driveway and/orparkingpad. A driveway and/orparkingpad, in a required front
yard, may not exceed 20 feet in width except as specified in subsection (1)(b) of this section and may not be
closer than five feet to any side propery line... "
The property does not have a three -car garage and thus does not meet the exception contain in FWRC
19.130.240(1)(b). The second driveway/parking area must be removed.
8. Water & Sewer— The applicant proposes to serve the ADU with public water and sewer. The sewer
purveyor is Lakehaven Water and Sewer District, who issued a Certificate of Sewer Availability on
October 24, 2019. The water purveyor is Tacoma Water, who issued a Certificate of Water Availability on
November 4, 2019. The applicant will need to work directly with those agencies for any service changes.
9. Owner Occupancy — On the application, the owner marked that the owner -occupied unit is the primary
dwelling unit. As a condition of land use approval, the applicant will be required to record the Letter of
Application and Deed Restriction with King County, and provide a copy of the recorded document to the
city. The document will state that the owner shall occupy one of the two dwelling units as a permanent
residence for six months or more per calendar year, pursuant to FWRC 19.200.180, Notes 8 & 11.
CONCLUSIONS
The following conclusions are based on the above findings of fact.
1. The proposal is consistent with policies of the Federal Way Comprehensive Plan.
2. As conditioned, the proposal meets the requirements of the ADU Use Zone Chart within Federal Way
Revised Code (FWRC) 19.200.180.
3. The ADU is subordinate and incidental in size, scale, and design of the primary dwelling unit, and the
appearance remains that of a single-family dwelling.
