The Process I MLU application is hereby approved as it meets review criteria set forth in Federal Way Revised Code (FWRC) 19.55.020. The director's conclusions are based on findings made by the department's Planning Division. CONCLUSIONS Various sections of the zoning and development code indicate that certain developments, activities, or uses are permitted only if approved using Process I — Director's Approval. Based on the findings below, the proposed improvements to the developed site meet the following Process I approval criteria and land use review thresholds of Federal YVay Revised Code (FWRC) 19.15.030 and 19.55.020: The proposed improvements are consistent with applicable chapters of FWRC Title 19 including, but not limited to: Permits and Review Processes; Process I — Director's Approval; Multifamily Residential Use Guidelines; and Community Design Guidelines. The health, safety, and welfare of the citizens of the city are preserved. The proposal is a minor improvement, modification, or addition to a site that is exempt from SEPA review. FINDINGS OF FACT 1. Proposal — The applicant proposes adding several amenities to the 126-unit apartment complex. Plans submitted with the application show a new 1,158 square foot fitness center, outdoor dog park, playground, covered barbecue and seating structure. The leasing office interior will also be renovated. No dwelling units will be added and no changes will be made to the existing parking. 2. Comprehensive Plan & Zoning Designation — The comprehensive plan and zoning designation for the property is Multifamily Residential (RM2400). Per FWRC 19.205.010, attached dwelling units are an allowed use in the RM2400 district at a density of 18 units per acre. The property was developed at a density of 18.2 units per acre under the jurisdiction of King County, making it a legally non -conforming development under FWRC. Mr. Khan February 2, 2017 Page 2 3. Setbacks — The required setbacks for attached dwelling units are 20-foot front yard and 5-foot side and rear yard, per FWRC 19.205.010. All the proposed improvements meet the minimum setback requirements. 4. Height— The maximum height allowed is 35 feet, per FWRC 19.205.010. All the proposed improvements meet the maximum height requirement. 5. Parking— For attached dwelling units, 2 parking spaces are required per dwelling unit by FWRC 19.205.010. The applicant proposes no change to the number of parking spaces or number of dwelling units. 6, C0177171u77ity Design Guidelines — Building fagade modulation and screening is required for building facades longer than 60 feet and visible from a right-of-way or residential use. The largest wall of the proposed fitness building is approximately 57 feet in length; therefore, it is exempt from fagade and screening requirements. 7. South King Fire & Rescue— A Certificate of Water Availability from Lakehaven Water & Sewer District was furnished by the applicant in their January 24, 2017 application resubmittal, thereby satisfying the water availability requirement. Environmental Reviely — The proposed improvements are exempt from environmental review. The combined floor areas of the new fitness center and renovated leasing office are below the 12,000 square foot threshold. Therefore, the improvements are consistent with the State Environn7ental Policy Act (SEPA) definition of "minor new construction" as adopted in the city's flexible threshold exemptions in FWRC 14.15.030(l)(c). 9. Building Per7nil — Prior to building construction, the applicant must obtain building permit approval. This Use Process 11 site plan approval decision does not grant building permit approval. APPEALS The effective date of this decision is February 5, 2017, or three days from the date of this letter. Pursuant to FWRC 19.55.050, any person who commented on the application or requests a copy of this administrative decision may appeal the decision to the Federal Way Hearing Examiner by February 21, 2017. Any appeal must be in the form of a letter delivered to the Community Development Department with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the Director's decision, including the identification of specific findings and conclusions made by the Director disputed by the person filing. However, in that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal this decision). Waiver of the right to appeal does not affect the effective date of this decision. CLOSING This decision shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. This Process I approval is valid for one year fi-orn the effective date of this decision. If no further action is taken within one year, this decision will expire. Per FWRC 19.15.110, a two-year extension may be granted if a written request is submitted to the City's Community Development Department at least 30 days prior to the expiration of the decision. This property is zoned RM 2.4 and was developed under the jurisdiction of King County in 1981. There are currently 126 dwelling units, which makes the density legally non -confirming, according to the letter dated April 20TM', 2015 written by Kalon Thomas, Planning Intern at the City of Federal Way (copy attached). The current owners of this property are looking to enhance the tenants' experience by adding additional amenities to the existing site. Some of these improvements include updating the interior of the existing Leasing Office and offering a more appealing community space for the tenants (Ref. Leasing Office Sheet A2.1). The exterior & roof of the building will remain as is, with the exception of fresh paint and a new canopy above the expanded outdoor seating area in the back of the building (Ref. Sheet SA1.2). The existing playground will be demolished to allow for a new covered barbecue & seating structure. This structure will be constructed of wood composite material and the ground surface will be permeable pavers. This new seating area will connect to a children's playground through an accessible & permeable paver path. The playground will have a new play equipment with a ground surface of Engineered Wood Fiber (EWF) playground chips. Per the grading plan, the surrounding grading & drainage of these two areas will be modified to accommodate these new amenities. Lastly, the owners are adding a new Fitness Center (Ref. Fitness Center Sheet A2.1) along the entry drive where an unused basketball court currently exists. This new 1,158 SF structure reflects a similar design as the existing apartment buildings by the use of similar materials, colors, varying angled rooflines and movement within the building footprint. Next to the Fitness Center, a new dog park (853 SF) will be added. This park will have synthetic turf and will be enclosed by a decorative metal fence (Ref. Sheet SA1.3). The surrounding grading & drainage of this area will also be modified to accommodate these new amenities. The proposed project consists of replacing a children's playground area, adding a barbeque deck in an existing lawn area, replacing a sport court with a fitness building, expanding a covered patio at the leasing office and adding a small dog park in an existing lawn area. The Site is 301,775 SF (6.9 acres) with 50,647 SF of building coverage and 75,627 SF of pavement and walkways, for a total lot coverage of 126,274 SF. The remainder of the site is predominantly landscaped with lawn and shrubs with mature evergreen trees around the perimeter and in several small groves. Runoff is directed into a large retention/detention pond located in the northeast corner of the Site. The site was developed in the early 1980s. The proposed project will result in approximately 2,100 SF of New Impervious Surface and 1,700 SF of Replaced Impervious Surface for a total of New plus Replaced Impervious Surface of 3,800 SF. Replaced Impervious Surfaces existed prior to January 8, 2001 and are mitigated with an existing facility. Therefore only the New Impervious Surfaces are Target Surfaces requiring mitigation. No new or replaced PGIS is proposed. Total disturbed area will be approximately 11,000 SF. A more detailed breakdown of impervious areas is shown on Cl. Site soils are mapped as Alderwood gravely, sandy loam. Limited Infiltration Drywells are proposed to mitigate runoff from the new roof areas. The drywells have been preliminarily sized using the Sandy Loam sizing factor of 380 CF/1,000 SF, per Appendix C, 2009 KCSWDM. Conceptual locations are shown on Cl. Most patio and walkway areas are currently proposed to be permeable pavers. . The barbeque deck will be permeable concrete pavers. The dog park area will be surfaced with synthetic turf, with a clean crushed rock base material and no underdrain, so this surface is also considered permeable. The value of the proposed improvements are on the order of $150,000, whereas the existing improvements are assessed at $9,900,000. Based on the above described scope, it is our understanding that this project falls below the thresholds for Redevelopment in terms of the Federal Way Addendum to the KCSWDM with respect to water quality. This property is zoned RM 2.4 and was developed under the jurisdiction of King County in 1981. There are currently 126 dwelling units, which makes the density legally non -confirming, according to the letter dated April 20,11, 2015 written by Kalon Thomas, Planning Intern at the City of Federal Way (copy attached). The current owners of this property are looking to enhance the tenants' experience by adding additional amenities to the existing site. Some of these improvements include updating the interior of the existing Leasing Office and offering a more appealing community space for the tenants (Ref. Leasing Office Sheet A2.1). The exterior & roof of the building will remain as is, with the exception of fresh paint and a new canopy above the expanded outdoor seating area in the back of the building (Ref. Sheet SA1.2). The existing playground will be demolished to allow for a new covered barbecue & seating structure. This structure will be constructed of wood composite material and the ground surface will be permeable pavers. This new seating area will connect to a children's playground through an accessible & permeable paver path. The playground will have a new play equipment with a ground surface of Engineered Wood Fiber (EWF) playground chips. Per the grading plan, the surrounding grading & drainage of these two areas will be modified to accommodate these new amenities. Lastly, the owners are adding a new Fitness Center (Ref. Fitness Center Sheet A2.1) along the entry drive where an unused basketball court currently exists. This new 1,158 SF structure reflects a similar design as the existing apartment buildings by the use of similar materials, colors, varying angled rooflines and movement within the building footprint. Next to the Fitness Center, a new dog park (853 SF) will be added. This park will have synthetic turf and will be enclosed by a decorative metal fence (Ref. Sheet SA1.3). The surrounding grading & drainage of this area will also be modified to accommodate these new amenities. No dwelling units are being added to this property and none of the existing parking stalls are being modified.
