Benzien, Moore, Vefik, and Swartz: The City of Federal Way's Community Dcvelopinenr Department has completed an administrative land use review of the proposed ES24 outdoor acti�,ity area and storage located at 3600 South 344`h Street (parcel 726120-0221). The Process II land use application submitted on July 12, 2019, with additional information provided on July 25, 2019 and August 6, 2019, is hereby approved based on the enclosed findings of fact, incorporated into this decision in full, and the following conclusions based on those facts: The proposal is consistent with the comprehensive plan; 2. The proposal is consistent with applicable zoning regulations in effect on August 23, 1994 (.Federal IFny City Code [FWCCJ), and procedural requirements of current code (Federal Way Revised Code [FWRCJ); 3. The proposal is consistent with the public health, safety, and welfare; 4. The streets and utilities in the area of the subject property are adequate to serve the anticipated demand from the proposal; 5. Traffic safety impacts for all anodes of transportation, both on and off site, are adequately mitigated. 7. It is consistent with those provisions of Chapter 19.115 FNX1RC, Community Design Guidelines, identified by the Director as being applicable. The remainder of this letter outlines the land use review process required for this particular site improvement; summarizes the State Environmental Policy Act (SEPA) process and provides other procedural information. This land use decision does not authorize initiation of construction activities. REQUIRED REVIEW PROCESS This proposal is subject to the provisions of the Weyerhaeuser Company Concomitant Pre - Annexation Development Agreement (CZA) and Office Park Zone (OP-1) zoning regulations, and the Chase Concomitant Pre -Annexation Zoning Agreement (CZA) and Office Park Zone (OP-3) zoning regulations, both in effect on August 23, 1994. Any procedural requirements must meet today's codes (Federal Wray Re�,ised Code [FWRC] Title 19). The zoning for the subject property is Office Park (OP-3) on the west side of the site and Office Park (OP-1) on the east side. The site recently received approval (19-100523-00-UP & 19-102812- 00-AD) for conversion to an elementary school, an allowed "school facilities" use in the OP-1 and OP-3 zones per the CZAs (OP-1 Exhibit D, Section III[A][10] and OP-3 Exhibit C, Section III[A][10]). The proposed improvements to the site are subject to Process II Site Plan Review pursuant to requirements set forth in FWRC 19.15.030(2). The Director of Community Development makes a written decision on the application based on the criteria listed under FWRC 19.60,050. SEPA PROCESS The storage sheds do not exceed the city -adopted flexible thresholds set forth in FWRC 14,15.030(1)(c), and therefore, are exempt from review under the SEPA. The conversion/remodeling of the parking garage upper level to an outdoor activity area is exempt from review under the SEPA per Washington Administrative Code (WAC) 197-11-800(3) and FWRC 14.15.020. These findings are based on review of City documents and items submitted by the applicant and received July 12, 2019, July 25, 2019, and August 6, 2019. Proposal — The applicant proposes to use the upper floor of the existing two-story parking garage as an outdoor activity area for the elementary school. The activity area will utilize non -stationary play equipment that can be stored away daily in storage sheds. The activity area will include striping for basketball courts, tether ball, four square, and hopscotch. No big toys will be used and there will be no permanently anchored poles or equipment, it will be moveable. A 12-foot tall fence or net will be placed at the perimeter. The column and shear wall pads that are above the parking surface approximately two inches will be painted yellow. The west and east exit locations will have ecology blocks added to control access. Additionally, the proposal includes placement of three (3) 12'x16' storage sheds, two (2) 12-foot x 16-foot emergency supply sheds, and two (2) approximately 15-foot x 36-foot fenced areas. The sheds will be placed at ground level and the fenced areas will be located on the lower floor of the parking garage. 2. The proposal, exempt from SEPA, is procedurally reviewed under Use Process II Site Plan Review. The Director of Community Development makes a written decision on the application based on the criteria listed under FWRC 19.60.050. Environmental Review — The storage sheds do not exceed the city -adopted flexible thresholds set forth in FWRC 14.15.030(1)(c), and therefore, are exempt from review under the State Environmental Policy Act (SEPA). The conversion/remodeling of the parking garage upper level to an outdoor activity area is exempt from review under the SEPA per Washington Administrative Code (WAC) 197-11-800(3) and FWRC 14.15.020. 5, Review Criteria — In accordance with OP-1 Exhibit D, Section III(D) and OP-3 Exliibit C, Section III(D), the use zone chart Federal Way City Code (FWCC) 22-729 (Schools) for the BN zone applies as there is no chart for "schools" in the OP or MP zones. According to the CZAs, "If the provisions relating to the OP-1 'Lone conflict with other provisions of City codes, the OP-1 Zone provisions shall prevail" (OP-1 Exhibit D, Section II). Additionally, "If the provisions relating to the OP-3 Zone conflict with other provisions of City codes, the OP-3 Zone provisions shall prevail' (OP-3 Exhibit C, Section II). The CZAs also state that, "Provisions of the FWC[C] relating to lot coverage, facade measurement, modulation, and parking between structures and streets other than those specified herein, shall not apply for non-residential uses. Building height increases greater than 35 feet shall apply whether or not the OP-1 designated property adjoins a low -density zone." (OP-1 Exhibit D, Section III(D)). Additionally, "Provisions of the FWC[C] relating to lot coverage, facade measurement, modulation, and parking between structures and streets other than those specified herein, shall not apply for non-residential uses. Building height increases greater than 35 feet shall apply whether or not the OP-3 designated property adjoins a low -density zone." (OP-3 Exhibit C, Section III(D)). Height — There is adjacent low density zoned property located to the east, zoned R-4 and within unincorporated King County boundaries. Therefore, the maximum building height is 30 feet per FWCC 22-729. See Finding #5, above, the CZA provisions prevail and as a result, height in excess of 30 feet is permitted. The parking garage is approximately 20-feet 6 inches tall. The proposed net/fence will be affixed to the existing perimeter concrete wall surrounding the proposed outdoor activity area. The sheds are 12 feet tall at the ridge of the roof. 7. Setbacks — Per FWCC 22-729, the required yards arc 50 feet on all sides. The existing garage is setback more than 50 feet from all property lines. The five sheds are proposed to be located in three different areas that are all more than 50 feet from all property lines. Lot Coverage — See Finding #5, above, the CZA provisions prevail and as a result, no lot coverage applies. 9. Parking — Per FWCC 22-729, the required parking for school use is determined on a case -by -case basis. There are approximately 901 parking spaces on -site between the surface lot and the parking garage. The proposal for establishment of the outdoor activity area and storage will remove 235 spaces (8 spaces from the first floor of the parking garage for the fenced storage enclosures; 221 spaces which is all spaces from the second floor of the garage; and 6 spaces from the surface lot for placement of two (2) storage sheds). Even with the proposed removal of stalls, the remaining amount is adequate for the use. 19-103364-00-UP Exhibit A Pap 2 of 5 Doe ID 79501 10. Landscaping— The only modification to existing site landscaping is where two (2) sheds are being placed within an area landscaped with shrubs and groundcover near the stormwater pond. This area of landscaping is not required by the zoning code or C'LA. 11. Additional Requirements — An outdoor play area is required per FWCC Section 22-729, Special Regulation and Note #3. The play area must have at least 75 square feet (sq. ft.) for each child using the area at any one time. For example, if 500 children were to use the area at one time then 37,500 sq. ft. of area is required (75 x 500=37,500). The second floor of the garage is over 68,000 sq. ft. in size. The area must be fenced and.play equipment must be setback 20 feet from each property line. A fence is proposed and the existing garage is setback more than 50 feet from all property lines. FWCC Section 22-729, Special Regulation and Note #9 states that, "This use must comply with the requirements of the state department of social and health services and/or the state superintendent of public instruction." FWPS is already subject to such requirements, which are enforced by other agencies. 12. Tree Density — No trees are proposed to be removed as part of this project. 13. Community Design Guidelines — The project is not subject to the City's Community Design Guidelines because the guidelines were not part of the 1994 code. 14. Public Comments — Notice of Application and public comment are not required for Use Process II applications per FWRC 19.15.010.3 (b) and FWRC 19.60.070.2. 15. Transportation — According to information previously provided by FWPS, site users are not anticipated to cross S. 344`h Street as all activity will occur on -site. This proposal does not affect that, as the play area is located in the northern portion of the property away from S. 344" Street. 16. Stormwater — Public Works Development Services reviewed the application and had no comment. 17. Water/Sewer — Lakehaven Water & Sewer District (LWSD) is the water and sewer seance purveyor for the site. They have no comment regarding the proposed outdoor activity area & storage sheds project. If there is plumbing to/for these areas, a LWSD Sewer Service Connection Permit would be required and applicant would either extend the water supply from an existing water service connection/meter or have a new service/meter installed. 18. Fire — South King Fire & Rescue reviewed the proposal and has the following comments, which are applicable at time of building/occupancy: a. Upgrade fire alarm to a voice evacuation system. b. Knox locking caps on all standpipe connections. c. Maintain all exits. d. Mark all exits with visible paint on the ground in front of the exits. 19-103364-00-UP Exhibit A Page 3 of 5 Doc ID 79501 19. Director's Decision Criteria — The Director of Community Development makes a written decision on the application based on the criteria listed under FWRC 19.60.050(2)(a-f) & (3)(c): a. The proposal is consistent with the comprehensive plan; i. The Federal Way Comj�rehensive Plan (FWCP) designation for the subject property is Office Park. The FWCP (revised 2015) contains the following goals and policies: o LUG 8: Create office and corporate park development that is known regionally, nationally, and internationally for its design and function. This is a developed site and this proposal is to use the upper floor of the existing two-story parking garage as an outdoor activity area for the elementary school and placement of five storage sheds on site, some of which will be used for emergency supplies. o LUG 9: Work collaboratively to evaluate and realize the potential of the (former) Weyerhaeuser properties in East Campus. The former Weyerhaeuser properties in East Campus are privately owned. The former DeVry building was acquired by Federal Way Public Schools. The site recently received approval (19-100523-00-UP & 19- 102812-00-AD) for conversion of an existing office building and developed site into an elementary school, an allowed "school facilities" use. o LUP 49: In the East Campus Corporate Park area, encourage quality development that will complement existing uses and take advantage of good access to I-5, Highway 18, and future light rail as well as proximity to the City Center. The site recently received approval (19-100523-00-UP & 19-102812-00- AD) for conversion of an existing office building and developed site into an elementary school, an allowed "school facilities" use. b. The proposal is consistent with all applicable provisions of Federal Way Revised Code; i., The proposal is consistent with applicable zoning regulations in effect on August 23, 1994 (FWCC), and procedural requirements of current code (FWRC), as detailed in this report. c. The proposal is consistent with the public health, safety, and welfare; i. The Community Development and Public Works Departments, along with Lakehaven Water & Sewer District and South King Fire & Rescue, have reviewed the project for conformance with codes designed to protect the public health, safety, and welfare. The project is not subject to the City's Community Design Guidelines because the guidelines were not part of the 1994 code. Also see Findings #5 and #13, above. Conclusion The proposed site plan application has been determined to be consistent with the FWCP; with all applicable provisions of the FWCC and FWRC; and with the public health, safety, and welfare. The proposed development is consistent with Process II Site Plan Review, decisional criteria required under FWRC Chapter 19.60. Final construction drawings will be reviewed for compliance with specific regulations and other applicable City requirements. This decision shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this development.
