Dear Mr. Khan:
The Community Development Department is in receipt of your Process I Master Land Use (MLU)
application for a site plan revision to Cedardale Apartments, submitted on October 6, 2017. The Process I
MLU application is hereby approved as it meets review criteria set forth in Federal Way Revised Code
(FWRC) 19.55.020. The director's conclusions are based on findings made by the department's Planning
Division.
CONCLUSIONS
Various sections of the zoning and development code indicate that certain developments, activities, or
uses are permitted only if approved using Process I — Director's Approval. Based on the findings below,
the proposed improvements to the developed site meet the following Process I approval criteria and land
use review thresholds of Federal Way Revised Code (FWRC) 19.15.030 and 19.55.020:
1. The proposed improvements are consistent with applicable chapters of FWRC Title 19 including, but
not limited to: Pen -nits and Review Processes; Process I — Director's Approval; Multifamily
Residential Use Guidelines; and Community Design Guidelines.
2. The health, safety, and welfare of the citizens of the city are preserved.
3. The proposal is a minor improvement, modification, or addition to a site that is exempt from SEPA
review.
FINDINGS OF FACT
Proposal — The applicant proposes adding several amenities to the 126-unit apartment complex.
Plans approved via File #16-103124-00-UP show a new 1,158 square -foot fitness center, outdoor
dog park, playground, covered barbecue and seating structure. Those improvements are not yet built.
File #17-104806-00-UP revises the aforementioned site changes to remove the fitness center,
relocate the dog park and relocate the basketball court. The leasing office interior will also be
renovated. No dwelling units will be added and no changes will be made to the existing parking.
2. Comprehensive Plan & Zoning Designation — The comprehensive plan and zoning designation for
the property is Multifamily Residential (RM2400). Per FWRC 19.205.010, attached dwelling units
are an allowed use in the RM2400 district at a density of 18 units per acre. The property was
developed at a density of 18.2 units per acre under the jurisdiction of King County, making it a
legally non -conforming development under FWRC.

Setbacks — The required setbacks for attached dwelling units are 20-foot front yard and 5-foot side
and rear yard, per FWRC 19.205.010. All of the proposed improvements meet the minimum setback
requirements.
4. Height— The maximum height allowed is 35 feet, per FWRC 19.205.010. All of the proposed
improvements meet the maximum height requirement.
Parking— For attached dwelling units, 2 parking spaces are required per dwelling unit by FWRC
19.205.010. The applicant proposes no change to the number of parking spaces or number of
dwelling units.
6. Environmental Review — The proposed improvements are exempt from environmental review.
7. Building Permit — Prior to building construction, the applicant must obtain building permit approval.
This Use Process I site plan approval decision does not grant building permit approval.
APPEALS
The effective date of this decision is November 10, 2017, or three days from the date of this letter.
Pursuant to FWRC 19.55.050, any person who commented on the application or requests a copy of this
administrative decision may appeal the decision to the Federal Way Hearing Examiner by November 24,
2017. Any appeal must be in the form of a letter delivered to the Community Development Department
with the established fee. The appeal letter must contain a clear reference to the matter being appealed and
a statement of the alleged errors in the Director's decision, including the identification of specific findings
and conclusions made by the Director disputed by the person filing. However, in that you are the only
party of record, your appeal period is waived (assuming you do not wish to appeal this decision). Waiver
of the right to appeal does not affect the effective date of this decision.
CLOSING
This decision shall not waive compliance with future City of Federal Way codes, policies, and standards
relating to this development. This Process I approval is valid for one year from the effective date of this
decision. If no further action is taken within one year, this decision will expire. Per FWRC 19.15.110, a
two-year extension may be granted if a written request is submitted to the City's Community
Development Department at least 30 days prior to the expiration of the decision.

Project Narrative
Cedardale Apartments is an existing 6.9 acre Multi -Family Residential property located
near 21 st Ave & 336t' Street in Federal Way. This property is zoned RM 2.4 and was
developed under the jurisdiction of King County in 1981. There are currently 126 dwelling
units, which makes the density legally non -confirming, according to the letter dated April
20t'', 2015 written by Kalon Thomas, Planning Intern at the City of Federal Way (copy
attached).
The current owners of this property are looking to renovate the interiors of the Leasing
Office by reconfiguring the interior space to create a more inviting leasing area and
incorporate a small fitness area for the residents. They are also adding additional amenities
to the existing site. Some of these site improvements include a covered outdoor seating
area with barbecue grills on the west side of the Leasing Office. Also proposed is a new
gathering area with a dog park at the old basketball court. All landscape & hadscape
materials will complement the existing landscape palette.
No dwelling units are being added to this property and none of the existing parking stalls
are being modified.
