The current BLA proposal would not be necessary if an upcoming code amendment passes for Chapter FWRC 19.30 Nonconformance Provisions and Chapter FWRC 19.105.010 General Development Regulations. The proposed regulations state an owner of contiguous lots, which are less than the required lot size or substandard are now buildable. One condition of this provision is that the lot size shall be least 50% of the underlying zoning (7,200 = at least 3,600). For example your properties are zoned RS7.2, but are less than 7,200 sq. ft. before the BLA. Under the new regulations they may be built on if less than 7,200 sq. ft. PROPOSED DEVELOPMENT LANGUAGE: "19.105.010 Buildable Lot. (2) Exception, detached dwelling units. Subject to all other requirements of this title, an applicant may build one detached dwelling unit on a lot or parcel regardless of the size of the lot or parcel, if: c Lots less than 50 percent of the minimum lot size required by this title are combined with one or more contiguous lots under the same ownership until the resulting lot equals at least 50 percent of the minimum lot size required. If that is not possible, all lots under contiguous ownership are combined into one lot which ma then be developed „ The item was heard at Planning Commission. A public hearing was held with no comments on September 2"d. The Land Use and Transportation Committee will hear the Item at the next meeting (Oct 5), barring any revisions from the managers and the committee. The LUTC's possible options are to recommend (recommended for 15t and 2"d reading and adoption), recommended with revisions, or not recommend the code revisions for council adoption. I will still forward a letter of complete application to you. Please confirm Norm at Crosspointe Survey Consultants if aware of the next steps. Please respond that you would like to lace the 3-lot BLA on hold until further notification of the re elation updates. I will update you on the legislative process. If approved by council please also send me a second email requesting to void the BLA application.
