It has been determined that the proposal will not have a probable significant adverse impact on the environment. As a result, an Environmental Impact Statement (EIS) is not required to comply with the Slate Enyimnmewa!Pohi yzid (SEPA). A copy of the Determination of Nonsignificance (DNS) is enclosed. The Optional DNS Process was used to review this proposal. The 14-day comment period required by the SEPA rules ran concurrently with the public comment period associated with the notice of land use application, which began on June 19, 2015, and ended July 6, 2015. The city received no comment letters regarding notice of application for land use approvals or environmental review. Pursuant to Washington Administrative Code (WAC) 197-11-355, a second comment period is not required upon issuance of the DNS. The enclosed DNS was issued on August 21, 2015. The city will provide copies of the signed DNS to the Department of Ecology, state and local agencies with jurisdiction, Puyallup and Muckleshoot tribes, and anyone requesting a copy. All final determinations may be appealed within 21 days following the issuance of the DNS. No licenses, permits, or approvals will be issued until completion of the appeal period, which ends September 11, 2015. Our decision not to require an EIS does not mean that the license, permit, or approval you are seeking from the city has been granted. Approval or denial of the proposal will be made by the appropriate administrative or legislative body vested with that authority. After a final decision has been made on your proposal (i.e., after a permit has been issued), you may, but are not required to, publish a Notice of Action as set forth in RCW 43.21C.075. The Notice of Action sets forth a time period after which no legal challenges regarding the proposal's compliance with SEPA can be made. SEPA still has an active appeal period as the DNS was issued last Friday for I believe 14 days, but the comment period does not exist due to the optional DNS. The applicant starts other permits at their own risk, if there is an appeal. Any contamination related to the removal of the tanks is monitored by the Dept. of Ecology and the volume of the tanks is what triggered SEPA in addition to grading, building site and number of parking spaces; a qualified professional engineer must be on site during their removal. In speaking with the Department of Ecology fuel tank leaks are likely due to the age of the existing gas station. Specifically this area is in a wellhead protection zone and critical area regulations apply. Kevin is out until the 315t I believe. I request any demo/grading submittals in the development services realm be held until Kevin gets back and we can all talk. A Process III approval via planning has not been issued. They also risk the Process III decision being appealed, if they do not wait for the land use decision. Thanks, L.
