The Process I MLU application is hereby approved per the findings noted below. FINDINGS OF FACT 1. The zoning for the subject property is Neighborhood Business (BN). The existing bank is an allowed use in the BN zone per Federal Way Revised Code (FWRC) 19.215.010, "Office/retail." 2. The applicant proposes to modify the existing bank parking lot in order to comply with accessibility codes. Improvements will occur on the access aisle and the southwest entry -way, and include re- grading the access aisle and one ADA stall. A sidewalk with a new curb -ramp leading to the entrance will be installed. The proposal will not generate any new PM peak trips or traffic related issues impacting 21" Avenue SW or SW 336"' Street. 4. An existing fire lane is located beside the new cw-b ramp and sidewalk for the length of the building. 5. The proposed upgrades will not create new impervious area; do not reduce the amount of required landscaping, parking, buffering, or public areas; and do not change utilities or easements. The new sidewalk connection will both enhance pedestrian connections and accessibility. CONCLUSIONS OF LAW The proposed improvements are not exempt from Use Process review as they do not meet criteria set forth in FWRC 19.15.020, "Exceptions." 2. Process I "Director's Decision" is the appropriate Master Land Use application as the improvements are to a developed site and do not exceed thresholds set forth in FWRC 19.15.030(1). 16-105795-00-UP Due I D M92 Ms. Croasdell January 25, 2017 Page 2 of 2 3. The proposed improvements are exempt from Stale Environmental Policy Act review as the scope of work meets categorical exemption WAC 197-11-800(3), "repair, remodeling, and maintenance activities." 4. The Federal Way Comprehensive Plan and zoning designation for the subject property is Neighborhood Business (BN). Pursuant to FWRC 19.215.010, a bank is permitted in the BN zoning district. 5. The proposed improvements meet Process 1 purpose criteria set forth in FWRC 19.55.020, including compliance with applicable provisions of FWRC Title 19, "Zoning and Development," and health, safety, and welfare standards. CONDITION The applicant must re -stripe and label the fire lane if it is impacted by the new improvements. APPEALS The effective date of this decision is January 28, 2017, or three days fi-om the date of this letter. Pursuant to FWRC 19.55.050, any person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner within 14 calendar days after issuance, by February 11, 2017. Any appeal must be in the form of a letter delivered to the Community Development Department with the established fee. The appeal letter must contain a clear reference to the matter being appealed and a statement of the alleged errors in the director's decision, including the identification of specific findings and conclusions made by the director disputed by the person filing. In that you are the only party of record, your appeal period is waived (assuming you do not wish to appeal this decision). Waiver of the right to appeal does not affect the effective date of this decision. CLOSING This decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development.
