In your application you submitted a site plan, a Water Availability Certificate from Lakehaven Utility District, a septic repair and pumping receipt, a site application for an individual on -site sewage system, and a land use application. The following information is required in order to proceed with the review of your application. Required Setbacks Pursuant to Federal Way City Code (FWCC) Section 22-648 (enclosed), an ADU is an allowed use in a single-family residential zone subject to special regulations. As you are aware, the required setback for the proposed ADU is 20 feet from the right-of-way. You have proposed removing the attached carport in order to satisfy this code requirement. The demolition of the carport is required prior to approval of the ADU certificate. Please be advised that a demolition permit is required for this work. After removal of the carport from the subject property, please call me at 253-661-4120 for a site inspection and verification. Water A vailability Certificate In order to establish an ADU, it is necessary to provide certification of the availability of sufficient water by the appropriate utility providers. Furthermore, pursuant to FWCC Section 22- 648, an ADU shall conform to all applicable development standards, including the plumbing code. On January 17, 2001, Mr. Jensen submitted a King County Certificate of Water Availability, signed by Lakehaven Water Utility District. This certificate indicates that that while the water system has certificates of water right sufficient to provide service, the existing 0 0 Mr. Terry Jensen Mr. & Mrs. Peter & Andrea Shelley Page 2 January 22, 2001 meter does not meet plumbing code for the existing use. The existing water meter must be upgraded in accordance with the re uirements of Lakehaven Utility District for exclusive use of the proposed ADU. Please submit a sed ;ding County Water Availability Certificate indicating that this work has been completed, art tl7 `the ADU; has sufficient water to satisfy current plumbing code requirements. Sewer A vailability Certificate The proposed ADU appears to be on an unidentified septic system. Pursuant to code requirements, the septic system for the ADU must have King County Public Health Department Approval. The submitted site design application does not satisfy this requirement. Furthermore, it would appear that the submitted site design application is for a septic system designed to serve the proposed new construction, not the ADU. Please submit the appropriate certification for the ADU. Deed Restriction Please find enclosed a revised Letter of Application and Deed Restriction for the ADU. The wording on this document has been amended to reflect future occupancy of the principal residence. Please sign and have notarized this deed of restriction. The, City will record the document with the King County Office of Records and Elections. There is an $8 recording fee associated with this recording process. Please submit to the City a check in this amount made out to King County Office of Records and Elections Upon receipt or completion of the above referenced items, the City will issue approval on the ADU certificate. Please be advised that pursuant to zoning code regulations, occupancy of the new single-family residential structure will be contingent upon ADU approval.
