Your letter states that the property known as King County tax lot #0121039126 constitutes two legal lots as established by a series of Permanent Record Cards (PRC) from 1962 to 1967. Based on the information provided in your November 16, 2008, letter and exhibits, and follow up re - submittal of information received January 5, 2009, it appears that the subject property does in fact constitute two legal lots that complied with the applicable state and local land segregation statutes or codes in effect at the time the lots were created. This determination is based on the following conclusions: 1. A series of PRCs exist, which depict the southernmost lot with dimensions of 140.feet by 140 feet (19,600 square feet). These documents are considered proof of legal lot status. 2. There is no evidence that this legal lot has ever been combined or eliminated (for anything other than tax purposes). 3. Based on the dimensions of the overall property as depicted by current assessor's mapping, the 2nd lot having dimensions of 90 feet by 140 feet (12,600 square feet) is acknowledged to be a remainder of an adjacent lot and therefore must exist. The record is silent with regard to how this lot was created, although you speculate it was likely related to a deed release for home construction purposes. Therefore, the city recognizes the existence of two legal lots for the property identified by parcel number 0121039126. Recognition of the property as two separate lots by the City of Federal Way is not to be regarded as a commitment of any sort that the lots may become building sites (except as noted below); or are suitable for development under applicable City of Federal Way ordinances. Any application for development on the southern lot, which is currently unimproved, will be reviewed under the ordinances and laws in effect at that time. Specifically, Federal Way City Code 22-953 Building Site states a lot is a legal building site if (1) it was created pursuant to laws then in effect, (2) it meets minimum lot size of the zone, and (3) it is adjacent to a _. street;-praviding_-access to±that-lour--•pareel;=•that-rneets-the-minimum2requirements•-established-by-this------ chapter. Criteria (2): The subject lot is located in the RS 15.0 zoning district, which has a minimum lot size of 15,000 square feet The lot is approximately 19,600 square feet, which is larger than the minimum required lot size and therefore satisfies criteria (2). Criteria (3): The subject lot is adjacent to 304ti, street, which is a public street meeting the requirements of this chapter and thus satisfies criteria (3). The southern lot is therefore considered a legal building site. This letter, however, is not intended to identify or address other constraints to development such as critical areas, access issues, etc. This determination of separate lot status is not intended to provide legal advice. Attached is a sewer facility map showing the location of existing gravity sewer (green) and what you would need to extend (red) to serve the subject parcels. The sewer to be extended measures approximately 1,050 feet. It would be a low pressure sewer (LPS) line, HDPE pipe, most likely 2" or 3" in diameter. Low pressure sewer main is typically installed along the shoulder of the road, out of pavement. It is also not as deep as gravity main. The City of Federal Way requires it be at least 5 feet deep. Connection to it would require each house to have a private Environment One (E/One, www.eone.com) pump station. You would enter into a Developer Extension (DE) Agreement with Lakehaven (LUD). An initial deposit of $1500 is collected (plus a $500 non-refundable application charge) and a project is created. All time expended on the project for plan review, correspondence, inspection, etc. by our Engineering Technicians, Engineer, Inspector, Field staff, is charged to the project. Once the $1500 is depleted, you begin to receive monthly invoices for the amount currently owing. You would hire a civil engineer registered in the State of Washington to design it to our standards. You would hire a contractor to construct/install it. Once construction is complete and LUD has accepted the system, you provide a Bill of Sale to LUD for ownership, operation, and maintenance of the sewer main. Overall cost (engineering, material, construction) averages $100 - $150/lineal foot for LPS main. I've attached the informational pages from both our Pre - Design and DE Applications, which explain the process. The Pre -Design is not required, but provides information as to what LUD is going to require. Formal comments should provide direction to your engineer for plans to be prepared and submitted with the DE Application. Per Federal Way City Code (FWRC)19.60.070, Sewage Disposal, wherever feasible, all lots in land divisions shall be connected to a sanitary sewer system designed and constructed to the specifications of the Lakehaven utility district. Where connection to the sanitary sewer system is not feasible, on -site sewage disposal systems may be utilized. The design and construction of such systems shall be approved by the Seattle -King County department of public health. When submitting the BLA, you must provide a sewer availability letter from Lakehaven for the new lots and a letter from King County Health Department approving the septic system on the existing house with the adjusted property boundaries. The city is fine with the existing house staying on septic. A note will have to be placed on the face of the plat stating which lots will be served by the public sewer system. Also, when the BLA is done being reviewed and is approved by the City, King County Public Health will have to sign the final mylar before the BLA is recorded. I have delineated a conforming reserve area on the attached drawings. Currently the house is on Lots A & B and the drainfield is on Lot C. This proposed BLA puts the house and everything septic on Lot A. Parcel's B & C will be served by Lakehaven Sewers (letter attached). All Lots are served by Lakehaven for water.
