REQUESTED DECISION The applicant is requesting a Process IV "Hearing Examiner" decision pursuant to Chapter 19.70 of the Federal Way Revised Code (FWRC). Proposed improvements or land surface modifications within stream setback areas that are not essential public facilities, public utilities, public improvements or minor improvements shall be subject to Use Process IV review and criteria set forth in FWRC 19.165.070(3)(a)- (fl Pursuant to FWRC 19.70.150(2), the Hearing Examiner shall issue a decision within 10 working days following the close of the public hearing. The Use Process IV decision of the Hearing Examiner may be reviewed pursuant to Chapter 36.70C RCW in King County Superior Court per FWRC 19.70.260. III. PROJECT PROPOSAL The applicant proposes to pave and widen an existing gravel driveway to serve two single-family residential lots. The existing 5.53 acre lot contains one single-family dwelling currently under construction. There is a short plat under review to create an additional single-family lot. Both lots would use the existing driveway located off of 20`" Place SW. As another lot is going to be created, the driveway must be widened from its current 12' to 16' and its gravel surface paved within the first 40' per FWRC 19.130.210. There is an existing Major Stream located along the western property line120t' Pl. SW, which requires a 100' setback per FWRC 19.165.010.1.a. The stream passes under the existing driveway in an 18" culvert, which is 19' in length. The 4' of driveway widening to create a 16' wide paved driveway will not further encroach on the open stream channel beyond the existing culvert, as it is 19' in length. The analysis in the staff report and recommendation is based on: 1. Intrusions into stream setbacks — FWRC 19.165.070(3). 2. Use Process IV decision criteria — FWRC 19.70.150(3). IV. BACKGROUND The applicant submitted a short plat application in April 2013. Staff determined that due to proposed encroachments to the stream buffer (for driveway asphalt paving) a Use Process IV application was required. The Use Process IV application was submitted in October 2013. Process IV approval of the stream setback intrusion is required before the short plat application can be approved. Subsequent review and resubmittal of documents has included critical area reports submitted by the applicant (Attachments E & F). FWRC 19.05130 defines Minor and Major Streams as follows: "Major stream" means any stream, and the tributaries to any stream, which contains or supports, or under normal circumstances contains or supports, resident or migratory fish. If there exists a natural permanent blockage on the stream course which precludes the upstream movement of anadromous salmonid fish, then that portion of the stream which is downstream of the natural permanent blockage shall be regulated as a major stream. "Minor stream" means any stream that does not meet the definition of "major stream." Upon review of the submitted materials and the FWRC, the City has concluded the stream is Major due to no evidence that any natural downstream blockage has occurred. Regardless of the stream classification, whether it is a Minor or Major Stream, requiring either a 50' or 100' stream setback, the required driveway paving and widening will occupy the same 40' area within the stream setback. There is no place along 20'' Pl. SW to locate a driveway for this property and not have a stream setback intrusion. For additional background on the stream, in 2012, the City reviewed a request submitted by another property owner, Peter Shelley, for stream reclassification along 20t' Place SW. The Shelley property is located to the north and west of the Wall property, closer to Puget Sound. The department found there was insufficient evidence to reclassify the course to a Minor Stream and denied the request (Attachment G). V. ENVIRONMENTAL REVIEW The City's SEPA Responsible Official has determined the proposed improvements are exempt from State Environmental Policy Act (SEPA) review per FWRC 14.15.020 and SEPA Rules WAC 197-11-800(3). This section provides that the repair, remodeling, maintenance, or minor alteration of existing private or public structures, facilities or equipment, including utilities, recreation, and transportation facilities involving no material expansions or changes in use beyond that previously existing; except that, where undertaken wholly or in part on lands covered by water, only minor repair or replacement of structures may be exempt. VI. COMMENTS RECEIVED ON THE APPLICATION As of the date of this report, the Department has not received any written comments on the application. One citizen called in to report that the vicinity map used on the Notice of Public Hearing contains a mislabeled street. On the Notice of Public Hearing, the street in front of the subject property is labelled as 215t Ave SW, when it should be labelled as 20th Pl. SW. The subject property is correctly identified on the vicinity map; the street name was misapplied due to a mapping error. VII. CONSULTED DEPARTMENTS/AGENCIES & PUBLIC NOTICE The following departments, agencies, and individuals were advised of this application: 1. Development Review Committee (DRC), consisting of Community Development Department; Public Works Development Services and Traffic Divisions; Lakehaven Utility District; and South King Fire and Rescue District. DRC comments have been incorporated into this report where applicable. 2. Pursuant to Process IV notice and distribution requirements set forth in FWRC 19.70.060, all property owners within 300 feet of the site were mailed the Notice of Application (NOA) on November 21, 2013, and Notice of Public Hearing on March 20, 2015. The NOA and Notice of Public Hearing were posted and published in the Federal Way Mirror, in accordance with the City's public notice requirements in FWRC 19.70.060.2. VIII. GENERAL CHARACTERISTICS OF SITE AND VICINITY The subject property is currently one tax parcel identified by the King County Assessor as #012103-9013, approximately 5.53 acres in size, and located on the east side of 20`h Pl. SW. The lot contains one single- family dwelling currently under construction, which is a replacement of the older one that was demolished. There is a short plat under review to create an additional single-family lot. The remainder of the site is forested and contains a looped upper driveway area. There is a Major Stream along the western property line/20th Pl. SW. As shown on the Site Plan --Grading and Drainage Plan, Sheet 4 of 7 (Attachment H), the site's topography varies, with the steepest portions located adjacent to 20th Pl. SW in proposed Lot 1. The TIR states that site soils are Alderwood gravelly loam (Attachment 1). The property is surrounded on all sides by single-family residential RS 15.0 zoning which has a 15,000 square foot minimum lot size. Land use surrounding the site is single-family residential development on larger lots ranging from 10,000 sq. ft. to over 8 acres in size. IX. STREAM SETBACK INTRUSION DECISIONAL CRITERIA The City may approve any request to locate an improvement or engage in land surface modification within stream setback areas based on the criteria in FWRC 19.165.070(3)(a)-(f). Staff has provided the following analysis of the criteria: a) It will not adversely affect water quality. Staff Response —Given the existing developed nature of this area of the site, the 4' of clearing and grading associated with the driveway widening and pavement will not adversely affect water quality. The site is over 5 acres in size and is heavily forested, providing areas for stormwater infiltration. Site visits were conducted by staff in July 2014 and March 2015 and there was no water flowing in the stream in either instance. During construction related to the driveway the applicant will implement a temporary erosion and sediment control plan that includes silt fencing and straw wattles that will help protect the stream from turbidity. After construction, the applicant will be required to stabilize and replant any disturbed areas. b) It will not adversely affect the existing quality of wildlife habitat within the stream or setback area. Staff Response — Given the existing developed nature of this area of the site, the 4' of clearing and grading associated with the driveway widening and pavement will not adversely affect the existing quality of wildlife habitat within the stream or setback area. The site is over 5 acres in size and is heavily forested, providing additional wildlife habitat. During construction related to the driveway the applicant will implement a temporary erosion and sediment control plan that will help protect the stream. As information, in a previous Process IV approval of a stream setback intrusion for a driveway project, the Hearing Examiner required as a condition of approval that the applicant implement a proposed stream buffer enhancement plan prepared by a certified ecologist. The applicant, Mr. Wall, has indicated that they will largely be removing blackberry bushes and invasive weeds as part of the clearing activity. Any areas disturbed by construction are required to be stabilized and replanted. c) It will not adversely affect drainage or stormwater retention capabilities. Staff Response — Given the existing developed nature of this area of the site, the 4' of clearing and grading associated with the driveway widening and pavement will not adversely affect drainage or stormwater retention capabilities. The site is over 5 acres in size and is heavily forested, providing additional natural areas for drainage and stormwater retention capabilities. d) It will not lead to unstable earth conditions nor create erosion hazards. Staff Response — Given the existing developed nature of this area of the site, the 4' of clearing and grading associated with the driveway widening and pavement will not lead to unstable earth conditions nor create erosion hazards. During construction, temporary erosion and sedimentation controls will be implemented per City standards. The site's topography varies, with the steepest portions adjacent to 20`h Pl. SW in proposed Lot 1. The driveway work will occur on proposed Lot 2. Post developed conditions will provide soil coverage via paving and required revegetation/soil stabilization methods. e) It will not be materially detrimental to any other property in the area of the subject property nor to the City as a whole, including the loss of significant open space. Staff Response — Given the existing developed nature of this area of the site, the 4' of clearing and grading associated with the driveway widening and pavement will not be materially detrimental to any other property in the area of the subject property nor to the City as a whole, including the loss of significant open space. The site is over 5 acres in size and is heavily forested, providing adequate areas for open space. f) It is necessary for reasonable development of the subject property. Staff Response — The driveway widening and paving is required by City Code for development of the property. Utilizing the existing driveway's location is the least impactful to the subject property and stream while providing for reasonable development of the subject property. Given the existing developed nature of this area of the site, the 4' of clearing and grading associated with the driveway widening and pavement will have a minimal impact on the site. The property is over 5 acres in size, is heavily forested, and the short plat will only create one additional lot. The 4' of driveway widening to create a 16' wide paved driveway will not further encroach on the open stream channel beyond the existing culvert, as it is 19' in length. X. PROCESS IV DECISIONAL CRITERIA Process IV Decision Criteria - The applicant must also meet decisional criteria pursuant to FWRC 19.70.150(3)(A)-(F). Staff has provided the following analysis of Process IV criteria: a) It is consistent with the comprehensive plan. Staff Response - This criterion has been met. The comprehensive plan is used, among other documents, as a basis for implementing regulations such as zoning and critical areas requirements. The Process IV request was reviewed and determined to be consistent with the following policies contained in the Federal Way Comprehensive Plan: a) NEP1- Protect and restore environmental quality through land use plans, surface water management plans and programs, comprehensive park plans, and development review. Staff Response — The proposed stream setback intrusion has been reviewed under applicable regulations set forth in Title 19 Zoning and Development Code and Title 16 Surface Water Management. The applicant proposes stormwater infiltration and erosion/sedimentation control during construction. Final site stabilization methods, such as replanting, will be required. b) NEP 33 - The City will seek to retain native vegetation within riparian corridors. New planting of vegetation with the approval from the City may be required where such revegetation will enhance the corridor's function. Consideration should be given to the removal of non-native invasive species. Staff Response — The applicant has indicated that they will largely be removing blackberry bushes and invasive weeds as part of the clearing. It appears that a few trees will need to be removed to accommodate the expansion as well. Final site stabilization methods, such as replanting, will also be required. c) NEP37 - Erosion control measures shall be used for any work in or adjacent to stream buffers. Staff Response — The applicant will be required to implement Public Works Department approved temporary and long-term erosion and sedimentation control measures. The applicant will be required to detail the method that will be utilized on the construction drawings as part of the engineering review and will be checked onsite during construction by City inspectors. b) It is consistent with all applicable provisions of this title and all other applicable laws. Staff Response - This criterion has been met. The Process IV request has been reviewed under the FWCP; all applicable provisions of FWRC including Title 16, "Surface Water Management", and Title 19, "Zoning and Development Code;" and is consistent with all applicable provisions and laws. The construction permit plans for the driveway expansion and paving will be reviewed utilizing the 2009 King County Surface Water Design Manual and Public Works Department standards. Per FWRC 19.165.080 (Additional requirements for land 6 surface modification), for land surface modification within the stream setback area, the applicant shall comply with the following additional requirements: (1) All fill material used must be nondissolving and nondecomposing. The fill material must not contain organic or inorganic material that would be detrimental to water quality or the existing habitat. (2) The applicant may deposit dredge spoils on the subject property only if part of an approved development on the subject property. (3) The applicant shall stabilize all areas left exposed after land surface modification with native vegetation normally associated with the stream or setback area. A recommended condition of approval shall require compliance with FWRC 19.165.080. c) It is consistent with the public health, safety, and welfare. Staff Response - This criterion has been met. The proposed stream setback intrusion is consistent with the public health, safety, and welfare. The proposal will provide adequate and safe vehicular access for two single family residential parcels. No adverse impacts to the stream or buffer area are anticipated. Construction permit plans for the access easement will be reviewed utilizing the 2009 King County Surface Water Design Manual and Public Works Department standards. Note: Criteria (d)-69, below, are more appropriately resolved through the short plat review process, rather than addressing transportation and utilities functions as part of the stream setback intrusion review process. Nonetheless, responses are provided. d) The streets and utilities in the area of the subject property are adequate to serve the anticipated demand from the proposal. Staff Response - This criterion has been met. No significant adverse transportation impacts were identified by the Public Works Department Traffic Division. The applicant submitted an intersection site distance analysis (Attachment .) to address use of the existing driveway for the short plat. The analysis has been reviewed by staff. The analysis recommends the existing driveway be left in place and trimming of trees and vegetation be performed to keep sight triangles clear. The future building permit on Lot 2 will be subject to a transportation impact fee. The applicant applied for and received a street modification to not have to construct frontage improvements along 20`" Pl. SW. The applicant applied for and received a Capacity Reserve Certificate (concurrency) for the short plat. The two -lots will be served by septic systems, subject to review and approval by King County. Water service will be through Lakehaven Utility District, which has facilities in the area. e) The proposed access to the subject property is at the optimal location and configuration for access. Staff Response - This criterion has been met. The access easement meets Public Works width standards of 20-feet (16-feet paved) for serving two single-family residential lots. The applicant submitted an intersection site distance analysis to address use of the existing driveway for the short plat. The analysis has been reviewed by staff. The analysis recommends the existing driveway be left in place and trimming of trees and vegetation be performed to keep sight triangles clear. The applicant also applied for and received a street modification to not have to construct frontage improvements along 20ffi Pl. SW. f) Traffic safety impacts for all modes of transportation, both on and off site, are adequately mitigated. Staff Response - This criterion has been met. The access easement meets Public Works width standards of 20-feet (I6-feetpaved) for serving two single-family residential lots. The applicant submitted an intersection site distance analysis to address use of the existing driveway for the short plat. The analysis has been reviewed by staff. The analysis recommends the existing driveway be left in place and trimming of trees and vegetation be performed to keep sight triangles clear. The future building permit on Lot 2 will be subject to a transportation impact fee. The applicant applied for and received a street modification to not have to construct frontage improvements along 20th Pl. SW. The applicant applied for and received a Capacity Reserve Certificate (concurrency) for the short plat. XI. STAFF RECOMMENDATION Based on analysis in this report the department recommends approval of the stream setback intrusion subject to the following conditions: 1. The applicant shall demonstrate compliance with FWRC 19.165.080 (Additional requirements for land surface modification.) in all future permit documents and site construction associated with the driveway project. a. All fill material used must be nondissolving and nondecomposing. The fill material must not contain organic or inorganic material that would be detrimental to water quality or the existing habitat. b. The applicant may deposit dredge spoils on the subject property only if part of an approved development on the subject property. c. The applicant shall stabilize all areas left exposed after land surface modification with native vegetation normally associated with the stream or setback area. The applicant shall submit a planting plan for review and approval. XII. MISCELLANEOUS If this request is approved by the Hearing Examiner, it does not authorize the applicant to begin clearing, grading and paving. The applicant will be required to obtain Public Works Department engineering approval of the vehicle access easement pursuant to FWRC 19.135.130. If approved by the Hearing Examiner, the applicant must substantially complete construction within five years after the final decision of the City on the matter, or the decision becomes void pursuant to FWRC 19.15.100(2) XIII. Previous Community Development Department comments are listed below with an updated response shown in italics in response to the resubmitted materials. 1. Scale —Please provide correct scales on drawings. Scale does not correspond with the 1=40 as indicated on the engineering sheets. a. Comment satisfied. 2. Wetland Designations —The engineered plans detail a 100-foot wetland buffer and 150-foot wetland buffer. It appears these buffer widths are meant to apply to the stream. The city's stream setbacks are 100 feet for major streams and 50 feet for minor streams. Please clarify. a. Comment satisfied in part. The wetland labels have been removed. The revised drawing shows a 100' buffer as the total buffer area on both sides of the stream combined. For clarification, a buffer is applied to all sides of a critical area. For a major stream, that means the buffer is 100' on each side of the stream, rather than a cumulative total of buffer areas on both sides totaling 100'. For reference: 19.165.010 Setbacks. (1) No land surface modification or improvements may take place or be located in a stream or within the following setback areas except as allowed within this division: (a) The setback area for a major stream includes all areas within 100 feet outward from the ordinary high water mark of a major stream. On the plans, show the 100' buffer from each side of the stream. 3. Stream Designation — The stream analysis identifies the stream reach adjacent to the subject property as Minor due to downstream blockages consisting of a culvert and slope failure area. FWRC 19.05.130 states waters upstream of a natural permanent blockage on the stream course which precludes the upstream movement of anadromous salmonid fish are Minor. Please identify on the site plan where a natural permanent blockage occurs. The following thresholds developed by the Washington State Department of Fish and Wildlife are used to determine whether the blockages qualify as barriers: Mr. Wall July 23, 2014 Page 2 Feature Threshold Waterfall 3.7 vertical meters Stream Sustained gradient exceeding 20% for more than 160 continuous meters. Channel Sustained gradient exceeding 16% for a distance of 160 meters and having a width less than 0.6 meters measured at scour line. WDFW 2009 Fish Passage and Surface Water Diversion Screening Assessment and Prioritization Manual a. The comment response letter references a report by R. W. Thorpe and Associates, dated December 28, 2011, prepared for the Shelley property. The City did not approve the requested stream reclassification in regards to the Shelley property in 2011. The City considers the stream adjacent to the Wall property to be a Major stream, as no natural blockages have been demonstrated. The driveway, even as it would be improved, will be in the stream buffer whether the buffer is 50' or 100' in width. Therefore, we suggest in order to move forward to the hearing that you show the major stream buffer of 100'. We can always revisit the stream classification at any future time if you believe it should be classified as minor. At this time, the City proposes to move the Use Process IV application forward to hearing. 4. Driveway Width — The stream report and engineered drawing indicate only 12 feet of paved width within the 20-foot-wide ingress/egress and utilities easement. Public Works standards require a 16- foot paved easement to serve the two lots. This increase in paved width will require additional vegetation clearing within the stream buffer that will need to be mitigated. Please provide a buffer enhancement plan for the area between the paved easement and stream. Additionally, indicate how the proposed buffer encroachment and buffer enhancement meet decisional criteria set forth in FWRC 19.165.070(3). a. Not satisfied. Staff conducted a site visit on July 14, 2014, to verb existing conditions and observed the existing graveled driveway that is 12' in width. Public Works standards require a 16 foot paved easement to serve the two lots, necessitating a 4' wide driveway expansion. This increase in paved width will require additional vegetation clearing within the stream buffer that will need to be mitigated. Submitted documents prepared by H&S Consulting do not address buffer enhancement. As previously requested by the City, it is recommended that you prepare a buffer enhancement plan. 5. Water Connections — Will water meter improvements require trenching or any other work within the stream buffer? If so, this work will need to be shown on the engineering plans and mitigated via buffer enhancement. a. Not satisfied. A buffer enhancement plan is not the responsibility of Lakehaven (LUD); it is the responsibility of the property owner. In addition, please review the most recent comments from L UD, listed below. b. Comments from Lakehaven: The proposed water meter location is not at the ROW margin/property line as typically required. Please advise if the City of Federal Way would like us to use a 100' setback based on your interpretation of the FWRC or if you would like us to utilize the professional third party consultants' determination of the stream reach. Additionally, it appears that the city of Federal Way has diverted/or allowed diversion of additional flows into the major/minor stream that exists on the property in discussion. FWRC 16.05.190S defines a Stormwater drainage system as "constructed and natural features which function together as a system to collect, convey, channel, hold, inhibit, retain, detain, infiltrate, divert, treat or filter stormwater. Stormwater drainage system" includes both public and privately owned features". By this definition, a Stormwater Drainage system is located on this private property, and the city of Federal Way has allowed modification to the flows, thus imposing adverse effects on this property of a widened stream reach. Please advise as to the quickest and best way to rectify this situation. „ . WALL SHORT PLAT - FILE #13-104617-WUP 4. Driveway Width — The drawings have been changed to note a 16' paved driveway 40' in length. No additional vegetation clearing will be required to obtain this as the current driveway is 16' wide of gravel up to the point of access for the first lot (southern lot). Buffer enhancement is addressed in Mark Heckert's Stream Impact Evaluation (re -submitted within the TIR). As previously noted, existing vegetation and conditions will not be affected in any way and asphalt will be laid within the extents of the existing gravel driveway 5. Water Connections — No modifications will need to be made to the existing water service. A meter will be re -installed for the 2” service. If a buffer encroachment plan is required to simply re -install this meter, this will be the responsibility of Lakehaven. You'll probably remember that our critical areas ordinance uses a two tier major and minor stream designation. Minor being a stream that cannot sustain salmonids due to natural downstream blockage. Obviously the culvert is not a natural blockage but what about a slope failure? Would DFW consider a slope failure resulting in a blockage as a natural barrier? Any insight would be greatly appreciated. To develop access required by city of Federal Way, the drainage crossing at the southwest boundary must be improved. The improvement will maintain the presently -installed culvert and roadbed. The access will not be enlarged or change present configuration in any manner. An impermeable asphalt top will be installed over the present gravel roadbed. The off -site stream will buffered to standard City of Federal Way buffers and no new encroachment will occur to the stream or the buffer. Site Description The project area is generally rectangular, 5.5 acres in size, located in the Adelaide area of the City of Federal Way. The project area was bounded on the east, north, and south by residential development. To the west is 21 st Ave. SW. Critical Areas assessment by H&S Consulting (Wetland & Drainage Corridors Evaluation and Delineation and Stream Assessment Report — Wall Short Plat, January 2013) defined one area characteristic of a stream offsite, adjacent to the west boundary of the project site. Stream An unnamed stream, identified by City of Federal Way mapping as "All" to "A2" occurs offsite of the west boundary of the site, flowing north along the roadbed for 201" Place SW, down to Puget Sound. The drainage along the west boundary of the site originates on the upland area in the City of Federal Way, generally in the area of the intersection of SW 306tt' Place and 21 st Ave SW. This drainage is located in the Miller Creek sub -watershed of the Duwamish — Green watershed (WRIA 9). It is a small (200 acres +-), terminal drainage which is common to the Puget Sound riparian area. The drainage length is approximately 3,220 ft. to the confluence with Puget Sound. The upstream 1,800 ft. is confined to constructed roadside ditches which adjoin 21 st Ave SW. Flowing north, the next 900 ft. appears a natural stream channel, in location and configuration, as it separates from the roadside ditch. Within this reach, the 2 roadside channels confluence adjacent to the project site, and continue in a natural drainage. Approximately 1,580 ft. from the 12026 - Wall Stream Impact Asmt Rev1 1 P.O. Box 731695 • Puyallup WA 98373 (253) 732-6515 mheckert@Q.com confluence with Puget Sound, the stream passes through a culvert which is a private driveway. The culvert outlets on a steep fill slope (> 100% slope) and passes through a slope failure area. The slope failure and the culvert are each a complete blockage to upstream anadromous migration. The blocking mass continues for approximately 200 ft. downstream. From that point the stream gradient is reduced to less than what is defined as salmonid passage (<16%). The final 1,300 line feet of the stream appears as a natural watercourse. The stream passes through two culverts and confluences with Puget Sound. Reach 2 As designated in the H&S report, Reach 2 is where the access development will be enhanced. Reach 2 extends upstream of the mid -point of the west boundary of the project site. Above this point, the stream is confined to roadside ditches, but does express the characteristics of a "stream"; the drainage route is marginally naturally defined, and constrained by the roadside ditches, which coalesce through an under -road culvert at the downstream end, and surface waters flow naturally through the lowest point. Reach 2 does meet the City of Federal Way definition as a stream. It does not provide salmonid habitat due to downstream blockages. As such, Reach 2 meets the City of Federal Way definition as a "minor" stream. The City of Federal Way requires a 50-foot buffer around a Minor stream. FINDINGS AND CONCLUSIONS Stream Impacts The proposed enhancement of the present crossing access for the new development involves no impact to the stream or its buffer. The access will not involve any modification to the stream or the crossing. The only addition will be the addition of an impermeable asphalt cap on the presently -graveled crossing. This cap will reduce the sedimentation contribution to the stream from the roadbed. To obviate potential construction impacts, erosion BMP will be used. A silt fence will be installed on both sides of the crossing, out to the standard 50 ft. buffer boundary. With this in place, there will be no additional impacts to the stream from the enhancement of the crossing. City of Federal Way may approve minor improvements in stream corridors within the setback area if approved through process III, based on the following criteria: (a) It will not adversely affect water quality; There will be no impact on water quality or quantity. No new flow will enter stream (see TECHNICAL INFORMATION REPORT Wall Short Plat) (b) It will not adversely affect the existing quality of wildlife habitat within the stream or setback area; There will be no impact on wildlife habitat. No vegetation will be altered, and no alteration to stream bed or banks (c) It will not adversely affect drainage or stormwater retention capabilities; There will be no impact on drainage or stormwater retention. No drainage will be diverted, focused, or altered in any way. (see TECHNICAL INFORMATION REPORT Wall Short Plat) 12026 - Wall Stream Impact Asmt Rev1 2 (d) It will not lead to unstable earth conditions nor create erosion hazards; There will be no impact on streambank condition. The encroachment will only be located over a culvert in which the protected stream runs. The encroachment is approved with conditions. ORAL TESTIMONY Stacey Welsh, senior City of Federal Way planner, summarized the staff report. EXHIBITS At the hearing, the April 2, 2015 staff report in addition to its attachments A-K were admitted into the record as Ex. 1. A power point presented by Ms. Welsh was admitted as Ex. 2. FINDINGS OF FACT Procedural: 1. Applicant. The applicant is Kevin Wall. 2. Bearing. The Hearing Examiner conducted a hearing on the application at 1:00 p.m. at Federal Way City Hall on April 10, 2015. Substantive: 3. Site/Proposal Description. The applicant requests approval to encroach four feet into a 100-foot stream setback in order to widen a driveway that will serve two single-family homes from 16 to 20 feet. Stream Buffer Encroachment p. 1 Findings, Conclusions and Decision The existing 5.53 acre lot contains one single-family dwelling currently under construction. Thcrc is a short plat under review to create an additional single-family lot. Both lots would use the existing driveway located off of 20'' Place SW. As another lot is going to be created, the driveway must be widened from its current 12' to 16' and its gravel surface paved within the first 40' per FWRC 19.130.210. There is an existing Major Stream located along the western property linel20t' Pl. SW, which requires a 100' setback per FWRC 19.165.010.I.a. The stream passes under the existing driveway in an 18" culvert, which is 19' in length. The 4' of driveway widening to create a 16' wide paved driveway will not further encroach on the open stream channel beyond the existing culvert, as it is 19' in length. 4. Characteristics of the Area. The property is surrounded on all sides by single-family residential RS 15.0 zoning which has a 15,000 square foot minimum lot size. Land use surrounding the site is single-family residential development on larger lots ranging from 10,000 sq. ft. to over 8 acres in size. 5. Adverse Impacts. There are no adverse impacts associated with the proposal. Given the nominal encroachment that is limited to the culverted portion of the stream, no significant impacts could be reasonably anticipated. The applicant does not propose any alterations to streams, wetlands, or any other environmentally critical areas. Only the stream buffer will be encroached upon, and all adverse impacts have been thoroughly reviewed and addressed as determined below. A. Water Ouality. Water quality will not be adversely affected by the proposal. Given the existing developed nature of this area of the site, the 4' of clearing and grading associated with the driveway widening and pavement will not adversely affect water quality. The site is over 5 acres in size and is heavily forested, providing areas for stormwater infiltration. Site visits were conducted by staff in July 2014 and March 2015 and there was no water flowing in the stream in either instance. During construction related to the driveway the applicant will implement a temporary erosion and sediment control plan that includes silt fencing and straw wattles that will help protect the stream from turbidity. After construction, the applicant will be required to stabilize and replant any disturbed areas. B. Stream Habitat. Stream habitat will not be adversely affected by the proposal. The site is over 5 acres in size and is heavily forested, providing additional wildlife habitat. During construction related to the driveway the applicant will implement a temporary erosion and sediment control plan that will help protect the stream. The conditions of approval requires the replanting of any exposed soil with native vegetation pursuant to a planting plan approved by staff. C. Storm DraigLge. Storm drainage will not be adversely affected by the proposal. Given the existing developed nature of this area of the site, the 4' of clearing and grading associated with the driveway widening and pavement will not adversely affect drainage or stormwater retention capabilities. Given the existing developed nature of this area of the site, the 4' of clearing and grading associated with the driveway widening and pavement will have a minimal impact on the site. The 4' of driveway widening to create a 16' wide paved driveway will not further encroach on the open stream channel beyond the existing culvert, as it is 19' in length. CONCLUSIONS OF LAW Procedural: 1. Authori of Hearin Examiner: Chapter 19.70 FWRC provides the Examiner with the authority to conduct a hearing and issue a decision on Process IV Reviews, which includes stream buffer encroachments as dictated by FWRC 19.165.070(3). Substantive: 2. Zoning Design: The subject lots are zoned RS 15. 3. Review Criteria and Application. Applicable criteria for the requested stream encroachment are governed by FWRC 19.165.070(3). All Process IV decisions are also governed by the criteria of FWRC 19.70.150(3). All applicable criteria are quoted below in italics and applied through corresponding Conclusions of Law. Stream Buffer Encroachment Criteria FWRC 19.165.070(3)(a): Other than as specified in subsections (1) and (2) of this section, the city may approve any request to locate an improvement or engage in land surface modification within stream setback areas only through process IV, based on the following criteria: (a) It will not adversely affect water quality; 4. The proposed encroachment will not adversely affect water quality as determined in Finding of Fact ("FOF") No. 5(A). FWRC 19.165.070(3)(b): It will not adversely affect the existing quality of wildlife habitat within the stream or setback area; 5. The proposal will not create any erosion hazards or other unstable earth conditions. During construction, temporary erosion and sedimentation controls will be implemented per City standards. The site's topography varies, with the steepest portions adjacent to 20th Pl. SW in proposed Lot 1. The driveway work will occur on proposed Lot 2. Post developed conditions will provide soil coverage via paving and required revegetation/soil stabilization methods. E. Impacts to Area. The proposal will not create any other adverse impacts to neighboring properties. Given the existing developed nature of this area of the site, the 4' of clearing and grading associated with the driveway widening and pavement will not be materially detrimental to any other property in the area of the subject property nor to the City as a whole, including the loss of significant open space. The site is over 5 acres in size and is heavily forested, providing adequate areas for open space. F. Public Services. The proposal is adequately served by public services. No significant adverse transportation impacts were identified by the Public Works Department Traffic Division. The applicant submitted an intersection site distance analysis (Ex. 1, Attachment .0 to address use of the existing driveway for the short plat. The analysis has been reviewed by staff. The analysis recommends the existing driveway be left in place and trimming of trees and vegetation be performed to keep sight triangles clear. The future building permit on Lot 2 will be subject to a transportation impact fee. The applicant applied for and received a street modification to not have to construct frontage improvements along 20th Pl. SW. The applicant applied for and received a Capacity Reserve Certificate (concurrency) for the short plat. The two -lots will be served by septic systems, subject to review and approval by King County. Water service will be through Lakehaven Utility District, which has facilities in the area. G. Location. The proposed driveway is at the optimal location and configuration for access. The access easement meets Public Works width standards of 20-feet (16-feet paved) for serving two single-family residential lots. The applicant submitted an intersection site distance analysis to address use of the existing driveway for the short plat. The analysis has been reviewed by staff. The analysis recommends the existing driveway be left in place and trimming of trees and vegetation be performed to keep sight triangles clear. The applicant also applied for and received a street modification to not have to construct frontage improvements along 20" Pl. SW. 6. Necessity of Driveway. The proposed location of the driveway is necessary for the reasonable development of the property. There is no way to access the property except by crossing the stream buffer. The driveway widening and paving is required by City Code for development of the property. Utilizing the existing driveway's location is the least impactful to Stream Buffer Encroachment p. 3 Findings, Conclusions and Decision FWRC 19.165.070(3)(d): It will not lead to unstable earth conditions nor create erosion hazards; 7. The proposed encroachment will not lead to unstable earth conditions or hazards as determined in FOF No. 5(D). FWRC 19.165.070(3)(e): It will not be materially detrimental to any other property in the area of the subject property nor to the city as a whole, including the loss of significant open space; and 8. The proposed encroachment will not be materially detrimental to other properties or the city as a whole as determined in FOF No. 5(E). FWRC 19.165.070(3)(f): It is necessary for reasonable development of the subject property. 9. The proposed encroachment is necessary for the development of the subject lots as determined in FOF No. 6. Gencrally Applicable Process IV Criteria FWRC 19.70.150(3)(a): The hearing examiner shall use the criteria listed in the provisions of this title describing the requested decision in deciding upon the application. In addition, the hearing examiner may approve the application only if (a) It is consistent with the comprehensive plan; 10. As determined at p. 6 of the staff report in the analysis of this criterion, adopted incorporated by reference as if set forth in full, the proposal is consistent with the comprehensive plan. FWRC 19.70.150(3)(b): It is consistent with all applicable provisions of this title and all other applicable laws; 11. Staff have reviewed the proposal for compliance with the zoning regulations of the City and found it consistent if recommended conditions are adopted. The staff recommended conditions are incorporated into this decision and it is determined that the proposal is consistent with all development standards that apply at this stage of review. FWRC 19.70.150(3)(c): It is consistent with the public health, safety, and welfare. 13. As determined in FOF No. 5 and 6, the proposal provides necessary access necessary and creates no adverse impacts. For these reasons the proposal is consistent with the public health, safety and welfare. FWRC 19.70.150(3)(d): The streets and utilities in the area of the subject property are adequate to serve the anticipated demand from the proposal. Stream Buffer Encroachment p. 5 Findings, Conclusions and Decision 14. As determined in FOF No. 5(F), the proposal will be served by adequate streets and utilities. FWRC 19.70.150(3)(e): The proposed access to the subject property is at the optimal location and configuration for access. 15. The access location and configuration is optimal for the reasons identified in FOF No. 5(G). FWRC 19.70.150(3)(t): Traffic safety impacts for all modes of transportation, both on and off site, are adequately mitigated. 16. Traffic impacts are adequately mitigated for the reasons identified in FOF No. 5(G). DECISION The proposed stream buffer encroachment meets all applicable criteria as identified above and is approved subject to the following conditions: 1. The applicant shall demonstrate compliance with FWRC 19.165.080 (Additional requirements for land surface modification.) in all future permit documents and site construction associated with the driveway project. a. All fill material used must be nondissolving and nondecomposing. The fill material must not contain organic or inorganic material that would be detrimental to water quality or the existing habitat. b. The applicant may deposit dredge spoils on the subject property only if part of an approved development on the subject property. c. The applicant shall stabilize all areas left exposed after land surface modification with native vegetation normally associated with the stream or setback area. The Wall Project Site is located generally in the Adelaide area, City of Federal Way, Washington (Figure 1). The project site is dominated by a single-family house. The evaluation and delineation of onsite and adjacent wetlands and drainage corridors is a vital element in the planning and selection of a site development action. The goal of this approach is to assure that planned site development does not result in adverse environmental impacts to regulated wetlands, streams, and their associated protective buffer areas. Wetlands are generally defined as "those areas that are inundated or saturated by surface water or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions." (City of Federal Way Title 15). STUDY PURPOSE The purpose of this document is to present the results of an onsite assessment and evaluation of wetland areas within the Wall Project Site following the methods and procedures outlined in the Washington State Wetlands Identification and Delineation Manual (Wash. Manual), Revised Washington State Wetland Rating System(WSWRS), and the Corps of Engineers Wetland Delineation Manual (1987 Manual). Onsite assessment noted that there were no differences in the identified wetland boundaries as a result to using either the Wash. Manual or the 1987 Manual. Drainage corridors were also assessed in accordance with the criteria established by City of Federal Way and the State of Washington Department of Natural Resources (WDNR) Forest Practice Rules (WAC 222-16-030). This study was designed to accommodate site planning and potential regulatory actions and is suitable for submittal to federal, state, and local authorities for wetland and stream boundary verification and permitting actions. SITE DESCRIPTION The overall project area was generally rectangular, 5.5 acres in size, located in the Adelaide area of the City of Federal Way. The project area was bounded on the east, north, and south by residential development. To the west is 21 st Ave. SW. 1 12006 — Wall Graham WL & FWL Rept BACKGROUND INFORMATION NATIONAL WETLAND INVENTORY The National Wetland Inventory (NWI) mapping completed by the U.S. Fish and Wildlife Service was reviewed as a part of this assessment (figure 2). This mapping resource identified wetlands at the southwest and south boundaries of the project site. STATE OF WASHINGTON PRIORITY HABITATS AND SPECIES The State of Washington Priority Habitats and Species (PHS) Mapping was reviewed as a part of this assessment. This mapping identified No priority habitats or species on, or adjacent to, the project site. CITY OF FEDERAL WAY WETLAND INVENTORY and DNR WATER TYPE The City of Federal Way Wetland Inventory Mapping and WA DNR Water Type mapping was reviewed as part of this assessment. This mapping resource identified no wetlands on, or adjacent to, the project site. This mapping resource identified a City of Federal Way "Major" stream flowing from the northwest property corner to confluence with Puget sound approximately 1,500 ft. to the north. This stream is designated Al at the confluence and A2 at the upstream termination. WaDNR Water Type map depicts the stream as a Type F [fish -bearing] from Puget sound upstream to approximately 450 ft. north of the northwest project boundary. The stream is designated Type N [non -fish bearing] to it's terminus approximately at the southwest corner of the project site. (Figure 3). State of Washington Department of Fisheries Stream Catalog The State of Washington Department of Fisheries Stream Catalog was reviewed as a part of this assessment. This mapping resource identified one stream adjacent to the project site. This stream was identified as LLID 1223579473368 providing documented presence of Coho salmon proximal to the project site. SOILS MAPPING Soils mapping of the overall project area completed by the Natural Resource Conservation Service identified the soils located generally through the overall project area as Alderwood gravelly loam. Alderwood gravelly loam: This soil series formed in glacial till and is moderately well drained. This soil is NOT listed as "hydric." 2 12026 — Wall FedWay WL&Stream Rept ONSITE ANALYSIS CRITERIA FOR WETLAND AND STREAM IDENTIFICATION Wetlands are transitional areas between aquatic and upland habitats. In general terms, wetlands are lands where the extent and duration of saturation with water is the primary factor determining the nature of soil development and the types of plant and animal communities living in the soil and on its surface (Cowardin et al., 1979). Wetlands are generally defined within land use regulations as "areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions" (1987 Manual). Wetlands exhibit three (3) essential characteristics, all of which must be present for an area to meet the established criteria within the Wash. Manual and the 1987 Manual. These essential characteristics are: 1. Hydrophytic Vegetation: A predominance of plants that are typically adapted for life in saturated soils. 2. Hydric Soil: A soil that is saturated, flooded, or ponded long enough during the growing season to develop anaerobic conditions in the upper horizons. 3. Wetland Hydrology: Permanent or periodic inundation, or soil saturation to the surface, at least seasonally. A stream is generally defined as a location where surface waters produce a defined channel or bed. A defined channel or bed is typically an area which demonstrates clear evidence of the passage of water and includes, but not limited to, bedrock channels, gravel beds, sand and silt beds, and defined channel swales. A stream need not contain water year-round. A stream typically does not include irrigation ditches, canals, storm or surface water run-off devices, or other artificial watercourses unless the constructed watercourse conveys a stream which naturally occurred prior to the construction of such watercourse. STUDY METHODS H & S completed a specific onsite evaluation of the project site on December 21, 2012. The objective of this evaluation was to define and delineate potential wetland and drainage corridor areas which may be present within and adjacent to the project area as defined by the three - parameter criteria test noted within the Wash. Manual and 1987 Manual, and the water -typing criteria noted within the WDNR Forest Practice Rules (WAC 222-16-030). Boundaries between wetland and non -wetland areas were established by examining the transitional gradient between wetland and non -wetland characteristics criteria along transects through the site. Delineation was performed using the routine methodology for areas greater 3 12026 — Wall FedWay WL&Stream Rept than five acres as detailed in the 1987 Manual. City of Federal Way Wetland category was derived utilizing the Revised Washington State Wetland Rating System (WSWRS) rating form. FIELD OBSERVATION 6 Soils The project site was generally comprised of loam, and gravelly sandy loam soils that appeared to drain moderately well. These areas did not exhibit redoximorphic features such as gleying, oxidized root channels, or mottles. This area did not meet the hydric soil criteria. Hydrology Hydrology within the overall project area appeared to be the result of seasonal stormwater runoff from onsite and adjacent properties; short-term seasonal ponding within depressional areas and soil characteristics. Stormwater surface runoff through the overall project area was directed by topography generally to the stream and then to the north. O Vegetation An upland deciduous forest dominated the project site. The forest canopy was dominated by sapling red -alder (Alnus rubra) and big -leaf maple. This plant community was identified as non-hydrophytic in character (i.e. typical of uplands). WETLAND AND STREAM DETERMINATION Wetland determination was based on sample plots which contained hydrophytic vegetation, hydric soils, and wetland hydrology in accordance with the 1987 Manual (with Supplement) and the Wash. Manual. Based on these methods NO wetlands were identified within, or adjacent to, the project site. One area characteristic of a stream was defined offsite, adjacent to the west boundary of the project site. Stream: An unnamed stream, identified by City of Federal Way mapping as "Al" to "A2" occurs offsite of the west boundary of the site, flowing north along the roadbed for 20th Place SW, down to Puget sound. This stream is unnamed. 4 12026 — Wall FedWay WL&Stream Rept STREAM DETERMINATION This assessment identified that one area of the site exhibited characteristics applicable for designation as a "stream,,. This assessment identified that this area of the site exhibited the established criteria for designation as a "stream". This stream apparently meets the criteria for designation as a City of Federal Way Minor stream. City of Federal Way requires a 50-foot buffer around a Minor stream. SITE ANALYSIS Evaluation Methodologies Onsite assessment was completed on December 21, 2012. This assessment covered the entire project site and followed general methodologies and procedures for the definition of stream. City of Federal Way-19.05.130 definitions. "Stream" means a course or route, formed by nature, including those which have been modified by humans, and generally consisting of a channel with a bed, banks or sides throughout substantially all its length, along which surface waters naturally and normally flow in draining from higher to lower elevations. A stream need not contain water year-round. In a development, streams may run in culverts or may be channeled in a concrete, rock or other artificial conveyance system. This definition does not include irrigation ditches, stormwater facilities or other artificial watercourses unless they are used by resident or anadromous salmonid fish, or the feature was constructed to convey a natural stream which existed prior to construction of the watercourse. Those topographic features that resemble streams but have no defined channels shall be considered streams when hydrologic and hydraulic analyses done pursuant to a development proposal predict formation of a defined channel after development. "Major stream" means any stream, and the tributaries to any stream, which contains or supports, or under normal circumstances contains or supports, resident or migratory fish. If there exists a natural permanent blockage on the stream course which precludes the upstream movement of anadromous salmonid fish, then that portion of the stream which is downstream of the natural permanent blockage shall be regulated as a major stream. "Minor stream" means any stream that does not meet the definition of a major stream. * Site Characteristics The drainage along the west boundary of the site originates on the upland area in the City of Federal Way, generally in the area of the intersection of SW 306t' Place and 21$t Ave SW_ This drainage is located in the Miller Creek sub -watershed of the Duamish -- Green watershed (WRIA 9). It is a small (200 acres +-), terminal drainage which is common to the Puget sound 12026 — Wall FedWay WL&Stream Rept riparian area. The drainage length is approximately 3,220 ft. to the confluence with Puget sound. The upstream 1,800 ft. is confined to constructed roadside ditches which adjoin 215t Ave SW. Flowing north, the next 900 ft. appears a natural stream channel, in location and configuration, as it separates from the roadside ditch. Within this reach, the 2 roadside channels confluence adjacent to the project site, and continue in a natural drainage. Approximately 1,580 ft. from the confluence with Puget sound, the stream passes through a culvert which is a private driveway. The culvert outlets on a steep fill slope i' 100% slope) and passes through a slope failure area. The slope failure and the culvert are each a complete blockage to upstream anadromous migration. The blocking mass continues for approximate) 200 ft. downstream. From that point the stream gradient is reduced to less than what is defined as salmonid passage (<16%). The final 1,300 line feet of the stream appears as natural watercourse. The stream passes through two culverts and confluences with Puget sound. Re Reach 1 extends upstream of the southwest corner of the project site. Above this point, the stream is confined to roadside ditches until losing definition at the top of the bluff. In this reach, the stream does not express the characteristics of a "stream"; the drainage route is not naturally defined, and constrained by the roadside ditches, and surface waters flow unnaturally. Reach 1 does not meet the City of Federal Way definition as a stream. Reach 2 Reach 2 extends upstream of the mid -point of the west boundary of the project site. Above this point, the stream is confined to roadside ditches, but does express the characteristics of a "stream"; the drainage route is marginally naturally defined, and constrained by the roadside ditches, which coalesce through a under -road culvert at the downstream end, and surface waters flow naturally through the lowest point. Reach 2 does meet the City of Federal Way definition as a stream. It does not provide salmonid habitat due to downstream blockages. As such, Reach 2 meets the City of Federal Way definition as a "minor" stream. Reach 3 Reach 3 extends upstream of the blocking driveway culvert and slope failure to the outlet of the under -road culvert which coalesces the road ditches. Within this reach, the stream is not confined to roadside ditches, and does express the characteristics of a "stream". The drainage route is naturally defined, and surface waters flow naturally through the lowest point. Reach 3 does meet the City of Federal Way definition as a stream. It does not provide salmonid habitat due to downstream blockages. As such, Reach 3 meets the City of Federal Way definition as a "minor" stream. Re Reach 4 extends upstream of the confluence with Puget sound to the blocking driveway culvert and slope failure. Within this reach, the stream is not confined to roadside ditches, and does express the characteristics of a "stream". The drainage route is naturally defined, and surface waters flow naturally through the lowest point. Reach 4 does meet the City of Federal Way definition as a stream. it does provide salmonid habitat and under normal circumstances 12026 — Wall FedWay WL&Stream Rept contains or supports, resident or migratory fish. There is no natural permanent blockage on the stream course which precludes the upstream movement of anadromous salmonid fishes. FINDINGS AND CONCLUSIONS Wetlands: No area on the site, or adjacent to the site, exhibits- characteristics for definition as wetland. Stream: Stream assessment was based the presence of stream morphology and hydrology suitable to support the production and maintenance of resident or anadromous fish species. Based on these criteria, the unnamed stream which passes offsite to the west of the project site meets the criteria for definition as a minor stream along the west site boundary. At the northwest corner of the site, the stream meets the criteria for definition as a major stream. REGULATORY CONSIDERATION The proposed alteration of lands defined by various federal, state, and local authority rules and regulations as "wetlands" raises environmental concerns that are generally addressed in the development review process. These concerns center on the development's potential adverse impacts to the structure, function, value, and size of these "wetland" areas. Such adverse impacts may include a reduction in wildlife habitats, reduced surface water quality, reduced water retention, a reduced ground water recharge rate, reduced plant species diversity, and the reduction in the function and value of other associated wetland and non -wetland characteristics. U.S. ARMY CORPS OF ENGINEERS - Section 404 Section 404 of the Clean Water Act (33 U.S.C. 1344) prohibits the discharge of dredged or fill material into "Waters of the United States" without a permit from the Corps of Engineers (Corps). The Corps has jurisdiction over freshwater systems waterward from the ordinary high water line of a water body or waterward from the upland boundary of the adjacent wetland. The definition of fill materials includes the replacement of aquatic areas with dry land, grading which changes the surface contour of a wetland, and mechanized land clearing in wetlands. For the purposes of Section 404 permitting the Corps makes the final determination as to whether an area meets the wetland definition and would be subject to regulation under the Corps program. Currently the Corps has two specific types of permits which apply to wetland fill proposals. These two types are a series of specific Nationwide Permits and the Individual Permit. The Nationwide Permit process identifies specific categories of work that can be undertaken following a set of specific conditions applicable to each Nationwide Permit number. 12026 —Wall FedWay WL&Stream Rept The Corps requires an Individual Permit where a proposed activity within an identified jurisdictional wetland area can not be authorized under one of the Nationwide Permits. Within the Individual Permit process the Corps undertakes a much more in-depth review of the proposed project and the proposed impacts. The Corps must evaluate whether the benefits derived from the project outweigh the foreseeable environmental impacts of the project's completion. All projects that proceed forward using either one of the Nationwide Permits or the Individual Permit process must also comply with the provisions of the Endangered Species Act. As defined by a recent U.S. Supreme Court decisions the Corps of Engineers does not typically regulated "isolated" wetlands pursuant to Section 404 of the Clean Water Act. Under this decision "isolated" wetlands do not exhibit a continuous surface water connection to other, downstream aquatic systems. STATE OF WASHINGTON DEPARTMENT OF ECOLOGY Proposed action undertaken through either of the Corps of Engineers processes (Nationwide or Individual) are also subject to the provisions of the Washington State Department of Ecology Section 401 Water Quality Certification Process. Projects that may be exempt from Corps of Engineers Section 404 jurisdiction may still require review by the Washington State Department of Ecology to ensure consistency with State water quality protection provisions. CITY OF FEDERAL WAY ® Protective Buffers City of Federal Way requires that an undisturbed native vegetation buffer be placed along the upland side of the identified stream. All construction shall be in accordance with the Federal Way Revised Code (FWRC), applicable ordinances, and the City Council conditions of project approval. These documents are supplemented by the Standard Specifications for Road, Bridge, and Municipal Construction (WSDOT/APWA), the King County Road Standards (KCRS), and the King County Surface Water Design Manual (KCSWDM). It shall be the sole responsibility of the applicant and the Professional Engineer to correct any error, omission, or variation from the above requirements found in these plans. All corrections shall be at no additional cost or liability to the City of Federal Way. 2. The design elements within these plans have been reviewed according to the Federal Way Engineering Review Checklist. Some elements may have been overlooked or missed by the City Engineering Plan Reviewer. Any variance from adopted standards is not allowed unless specifically approved by the City of Federal Way, prior to construction. 3. Approval of this road, grading, and drainage plan does not constitute an approval of any other construction (i.e. domestic water conveyance, sewer conveyance, gas, electricity, etc.) 4. Before any construction or development activity, a Preconstmction Meeting must be held between the City of Federal Way, the applicant, and the applicant's construction representative. 5. A signed copy of these approved plans must be on the job site whenever construction is in progress. 6. Construction noise and activity (on private property) shall be limited as per FWRC (Section 19.105.040); normally this is 7:00 am. to 8:00 p.m., Monday through Friday, and 9:00 am. to 8:00 p.m. on Saturdays. 7. Construction activity within City Rights -of -Way shall be limited to the hours of 8:30 AM to 3:00 PM, 8. It shall be the applicant's/contractor's responsibility to obtain all construction easements necessary before initiating off -site work within the road right-of-way. 9. Franchised utilities of other installations that are not shown on these approved plans shall not be constructed unless an approved set of plans that meet all City requirements and the requirements of KCRS Chapter 8 are submitted to the City of Federal Way at least three days prior to construction. 10. Vertical datum shall be KCAS orNGVD-29. 11. Groundwater system construction shall be within a right-of-way or appropriate drainage easements, but not underneath the roadway section. All groundwater systems must be constructed in accordance with the WSDOT/APWA Standard Specifications. 12. All utility trenches in the right-of-way shall be backfilled 5/8" crushed rock and compacted to 95% density. When trench width is 18 inches or less, and is within the traveled way, trench will be backfilled with control density fill (self -compacted flowable fill) as defined by Washington Aggregates and Concrete Association. The aggregate will be 3/8-inch minus. 13. All roadway subgrade shall be backfilled and compacted to 95% density in accordance with WSDOT 2-06.3. 14. Open cutting of existing roadways is not allowed unless specifically approved by the Public Wodcc Director and noted on 1hese sppovad plans. Any open cut shall be restored in accordance with KCRS 8.03(b) 3. 15. The contractor shall be responsible for providing adequate safeguards, safety devices, protective equipment, flaggers, and any other needed actions to protect life, health, and safety of the public, and to protect property in connection with the performance of work covered by the contractor. Any work within the traveled right-of-way that may interrupt normal traffic flow shall require at least one flagger for each lane of traffic affected. All sections of the WSDOT Standard Specifications 1-07.23 - Traffic Control, shall apply. 16. Contractor shall provide and install all regulatory and warning signs per the latest edition of Manual on Uniform. Traffic Control Devices (MUTCD). 17. All utilities shall be adjusted to final grade after paving asphalt wearing course. 18. Rockeries are considered to be a method of bank stabilization and erosion only. Rockeries shall not be constructed to serve as retaining walls. All rockeries shall be constructed in accordance with CFW Drawing Numbers 3-22, 3- 23. Rockeries may not exceed six feet in height for cut sections or four feet in height for fill sections unless designed by a geotechnical or structural engineer licensed in the state of Washington. REV I DESCRIPTION I BY I DATE ICHK'DIAPPRI DRAINAGE NOTES: 1. Proof of liability insurance shall be submitted to the City prior to, or at, the Preconstruction Meeting. 2. All pipe and appurtenances shall be laid on a properly prepared foundation in accordance with WSDOT Specifications. This shall include leveling and compacting the trench bottom, the top of foundation material, and required pipe bedding, to a uniform grade so that the entire pipe is supported by a uniformly dense unyielding base. 3. All pipe in the ROW that is in excess of 18" in diameter must be plain or reinforced concrete. Additionally, if more than I of non -concrete pipe is installed, the pipe must be videoed to verify the integrity of the completed system. The contractor shall provide a copy of the video to the City. 4. Storm pipe within the public right of way shall have a minimum diameter of IT' (8" diameter ductile iron pipe may be permitted on cross sheet laterals less than 66 feet long, only to avoid utility conflict or meet shallow gradient as approved by the Public Works Department). 5. Steel pipe shall be galvanized and have Asphalt Treatment #1 or better inside and outside. 6. All drainage structures, such as catch basins and manholes, not located within a traveled roadway or sidewalk shall have solid locking lids. All drainage structures associated with a permanent retention/deteution facility shall have solid locking lids. 7. All driveway culverts located within the right-of-way shall be of sufficient length to provide a minimum 3:1 slope from the edge of the driveway to the bottom of the ditch. Culverts shall have beveled end sections to match the side slopes. 8. Rock for erosion protection of ditches, channels and swales, where required, must be of sound quarry rock, placed to a depth of one foot and must meet the following specifications: 4"-8" rock/40% 700% passing; 2"A" rock/30% 40% passing; and -2" rock/I0%-20% passing. Installation shall be in accordance with KCRS, or as amended by the approved plans. Recycled asphalt or concrete rubble shall not be used 9. Lots not approved for infiltration shall be provided with drainage outlets (stub -outs). Stub -outs shall conform to the following: A. Each outlet shall be suitably located at the lowest elevation on the lot, so as to service all future roof downspouts and footing drains, driveways, yard drains, and any other surface or sub -surface drains necessary to render the lots suitable for their intended use. Each outlet shall have flee -flowing, positive drainage to an approved stormwater conveyance system or to an approved outfall location. B. Outlets on each lot shall be located with a five-foot high, 2 x 4 stake marked "Storm". The stub -out shall extend above surface level, be visible and be secured to the stake. C. Pipe material shall conform to underdrain specifications described in the KCRS and, if non-metallic, the pipe sbsn min wire or other acceptable detection. D. Approval of this Erosion/Sedimentation Control (ESC) Plan does not constitute an approval of permanent road or drainage design (i.e. size and location of roads, pipes, restrictors, channels, retention facilities, utilities, etc.). 2. The implementation of these ESC plans and the construction, maintenance, replacement, and upgrading of these ESC facilities is the responsibility of the applicant/contractor until all construction is approved 3. The boundaries of the clearing limits shown on this plan shall be clearly flagged in the field prior to construction. During the construction period, no disturbance beyond the flagged clearing limits shall be permitted. The flagging shall be maintained by the applicant/contractor for the duration of construction. 4. Stabilized construction entrances and wash pads shall be installed at the beginning of construction and maintained for the duration of the project. Additional measures may be required to ensure that all paved areas are kept clean and tracking in the roadway does not occur for the duration of the project. 5. The ESC facilities shown on this plan must be constructed prior to or in conjunction with all clearing and grading activities, and in such a manner as to ensure that sediment laden water does not enter the drainage system, adjacent properties, or violate applicable water standards. 6. The ESC facilities shown on this plan are the minimum requirements for anticipated site conditions. During the construction period, these ESC facilities shall be upgraded and/or revised as needed for unexpected storm events, and modified to account for changing site conditions (e.g. additional cover measures, relocation of ditches and silt fences, perimeter protection, etc.). 7. The ESC facilities shall be inspected daily by the applicant/contractor and maintained as necessary to ensure their continued proper functioning. 8. Any areas of exposed soils, including roadway embankments, that will not be disturbed for seven (7) days during the dry season or two (2) days during the wet season, shall be immediately stabilized with the approved ESC methods (i.e. seeding, mulching, netting, erosion blankets, etc.). 9. Any area needing ESC measures, not requiring immediate attention, shall be addressed within seven (7) days. 10. The ESC facilities on inactive sites shall be inspected and maintained a minimum of once a month or within 24 hours following a storm event. 11. At no time shall more than one (1) foot of sediment be allowed to accumulate within a catch basin. All catch basins and conveyance lines shall be cleaned prior to paving. The cleaning operation shall not flush sediment -laden water into the downstream system. 12. Any permanent retention/detention facility used as a temporary settling basin shall be modified with the necessary erosion control measures and shall provide adequate storage capacity. If the permanent facility is to function ultimately as an infiltration system, the facility shall not be used as a temporary settling basin. No underground detention tanks or vaults shall be used as a temporary settling basin. 13. Cover measures will be applied in conformance with Appendix D of the KCSWDM. 14. Management practices providing significant tree protection (per FWRC) shall be provided on the ESC plans. 15. Wet Season Special Provisions, as described in Section D.5.2 of Appendix D, KCSWDM are in effect October 1 through April 30. Prior to the beginning of the wet season, all disturbed areas shall be reviewed to identify which ones can be seeded in preparation for winter rains.
