The ADU application is hereby approved pursuant to the findings presented by the department's Planning Division staff and the conclusions based on those findings. FINDINGS OF FACT The following findings are based on site, floor, and elevation plans received with the ADU application on February 20, 2014. 1. Proposal - The applicant proposes to construct an attached single housekeeping ADU above an existing attached 2-car garage, located at 31458 28th Place SW, Federal Way. Access to the ADU is provided by an exterior stairway and deck. 2. Zoning - The subject property is a 17,027 square -foot (0.39-acre) lot located within a single- family high -density residential comprehensive plan and RS 7.2 zoning designation. 3. Floor Plan - The total square footage of the proposed ADU living area is 600 square feet. The principal dwelling unit building permit identifies the livable area as 2,115 square feet; therefore, the proposed ADU qualifies for a maximum of 800 square feet of livable area. 4. Water & Sewer - Lakehaven Utility District issued Certificates of Water and Sewer Availability on February 19, 2014. The existing 5/8" meter may not be adequate and will need to be evaluated under the uniform plumbing code. Also, a sewer service connection permit will be required. 5. Required Yards & Height - The proposed ADU structure is located above the existing garage and all improvements including the stairway, meet the required 20-foot front yard, 5-foot side and rear yard setbacks. The proposed ADU structure is approximately 23 feet in height at its highest point, which meets the maximum 30-foot height limit. 6. Lot Coverage - The lot coverage of the principal dwelling, driveway, proposed ADU, and stair landing is 3,834 square feet or approximately 22.5 percent, which is below the lot coverage maximum. Owner Occupancy - The applicant must submit a signed letter of application and deed restriction stating the owner shall occupy one of the two dwelling units as permanent residence for six months or more of the calendar year. CONCLUSIONS The following conclusions are based on the above findings of fact. 1. The proposal is consistent with policies of the Federal Way Comprehensive Plan. 2. The proposal meets density, square footage, parking, occupancy, and dimensional requirements of the ADU Use Zone Chart within Federal Way Revised Code (FWRC) 19.200.180. 3. The ADU is subordinate and incidental in size, scale, and design to the primary dwelling unit. CONDITION OF APPROVAL • Prior to the final building inspection of the new ADU, please return the signed and notarized Letter of Application & Deed Restriction to my attention in accordance with note #9, FWRC 19.200.180, along with a check for recording fees payable to the City of Federal Way.' When the ADU is completed, City staff will record the Letter of Application and Deed Restriction with King County. The ADU restriction will remain recorded against the property. BUILDING PERMIT REQUIRED This ADU decision does not constitute building permit approval. Building permit #14-100792-00-SF for the new upper floor ADU over the existing garage, stairs, deck, and site improvements is under review by Public Works, Planning, Building, and Fire Department staff. Final inspections for the completed ADU will be conducted as part of a building permit process associated with this project. CLOSING This ADU decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. Violation: To date, the City has not received the required completed, signed, and notarized "Letter of Application & Deed Restriction" and required recording fee. As a result, the Accessory Dwelling Unit (ADU) is not approved, and is currently in violation of Federal Way Revised Code (FWRC) 19.265.020, Accessory dwelling units. In order to complete the approval process and resolve active violations on your property, the required notarized form and required recording fee ($73.00) is due now. Failure to comply with this request will result in progressive enforcement of FWRC Title 19 `Zoning and Development Code' and FWRC Title 13 `Buildings,' which may include forwarding this violation to the Building Official for revocation of the Certificate of Occupancy; including suspension of power and utilities which would render the structure unfit to occupy.
