Background The applicant proposes to co -locate a Personal Wireless Service Facility (PWSF) microcell and microwave antennae at 65 feet above ground level on an existing monopole inside an existing, fenced compound; and install a 4.17-foot-tall equipment cabinet on a new, 16-square-foot slab. The subject property is zoned Single -Family Residential (RS9.6). Findings of Fact 1. The project does require a City electrical permit. pursuant to the National Electric Code (NEC), 2005 edition. 2. Lakehaven Utility District has no record of an access easement across its property (APN 072104- 9017) as shown on the applicant's proposal. The applicant should contact Lakehaven at his earliest convenience for more/any detail regarding easement acquisition. 3. The project is exempt from review under the State Environmental Policy Act (SEPA). 4. The project does not trigger the nonconformance requirements of Federal Way City Code (FWCC) Section 22-334. 5. There are no changes to use, lot size, lot coverage, setbacks, parking, building height, outdoor storage/use, pedestrian connections, critical areas, or landscaping resulting from this project. 6. The proposal was reviewed in accord with FWCC Chapter 22, Article IV.B, "Process I— Director's Approval," and for compliance with the standards of the FWCC contained in Chapter 22, Article XI, "District Regulations for the Single -Family Residential Zone (RS9.6)," and applicable sections of File NOS-106161-00-UP Doc. I.D. 34363 Mr. Kevin Foy Page 2 January 4, 2006 Chapter 22, Article IV, "Nonconformance"; Article XIII, "Supplementary District Regulations"; Article XIV, "Critical Areas"; Article XV, "Parking"; Article XVI, "Improvements"; Article XVII, "Landscaping"; and Article XIX, "Community Design Guidelines." Conclusion Based on our review, the proposal is found to be consistent with the Federal Way Comprehensive Plan, FWCC, and the public health, safety, and welfare. Approval of the project is recommended. Procedural Information The effective date of the decision is December 30, 2005. The decision may be appealed in the form of a letter delivered to the Department of Community Development Services (PO Box 9718, Federal Way, WA 98063-9718) on or before January 13, 2006, by any person who submitted comments or received a copy of this decision. No work on the proposal can commence until the end of the appeal period. Because you are the only party of record, you can waive your right to appeal this decision by submitting a written waiver request to the address above. Approval is effective once the waiver request is received, and work on the project can proceed immediately, provided you have obtained the necessary building permits. The City must receive this waiver request in writing. . Unless modified or appealed, this Process I approval is valid for one year from the effective date of this decision. If no further action is taken within one year, this decision will expire. A one-time six-month extension may be granted only if a written request is submitted to the City's Department of Community Development Services (address above) at least 30 days prior to the expiration of the decision. This decision does not constitute building plan approval and does not waive compliance with future FWCC regulations, policies, or standards relating to this development. The hourly Process I review fee is $59 per hour, plus a one-time automation fee of $5. Review and processing time for this project was one hour. The total review is $64.00. Prioritized locations for PWSFs: (1) Structures located in the BPA trail. FWCC 22-970 (a)(4) see propagation map. Bonneville Power Administration is not currently taking/processing applications for PWSF in any consistent time frame. Also the BPA trail would not full -fill the RF coverage needs this site will provide. (2) Existing broadcast, relay and transmission towers. Clearwire LLC's proposal calls for collocation on an existing Cingular Monopole. Antennas will be placed below existing antennas and radio cabinet will be placed inside the existing fenced compound. PWSF Specific Application Requirements An inventory of other PWSF sites operated by the applicant or other providers within a one mile radius of the proposed PWSF location. Clearwire LLC has contacted several providers (Cingular, Verizon, T-Mobile, Sprint, Nextel) and has decided to go with Cingular. The decision was based on coverage needs and the antenna height on the existing pole was chosen to best fit coverage goals. Clearwire LLC has contacted Riley Pittman, City of Federal Way, asking for help mapping all other carriers' location and height. PWSF Specific Application Requirements PWSF electronic equipment cabinet is proposed to be locate above ground ... an explanation of why it is impracticable to locate the cabinet underground or higher priority location. The proposal is not locating the cabinet (1) underground due the cost of vaulting, also difficult to expand the compound in future applications. Water sealing is also a concern due to the amount of rain in the region. (2) Place cabinets in an existing enclosed building, there are no existing buildings within distance. (3) Clearwire LLC is chosen this priority location. Clearwire LLC's fits the definition of a micro cell, we are smaller than 6' tall and a total of 16' square feet of floor space. PWSF Specific Application Requirements Clearwire LLC has tried to contact other carriers in an effort to promote collocation (and usually faster permitting times), and has chosen Cingular because of coverage objectives. PWSF Specific Application Requirements Clearwire LLC does not own the monopole. Clearwire LLC will allow any carrier that wants to collocate on the existing American Tower Monopole. Other than RF separation for antennas, Clearwire LLC promotes collocation when every possible. Kevin Fov Clearwire LLC applicant PWSF — Specific Application Requirements WA TAC 157 A System Description Clearwire LLC intends to construct and operate a wireless broadband service in the FCC licensed services known as the Broadband Radio Service `BRS" and Educational Broadband Service ("EBS'). These services operate in the 2500-2690 MHz band and Clearwire LLC will either own or lease a portion of this spectrum in the Federal Way area. In addition, Clearwire LLC will utilize at some base station sites point- to- point microwave to backhaul data to the central office or POP location. These point to point links will operate in both licensed and unlicensed bands allocated by the FCC for these services. All of the equipment utilized by Clearwire LLC has received FCC type acceptance approval and therefore meets all requirements for operation within the appropriate bands. Clearwire will install base station sites that will typically have omnidirectional coverage created by the use of 3 to 4 directional antennas on a tower or rooftop. These sites will typically be separated by 2 to 4 miles. This separation distance can vary significantly depending on terrain, ground clutter (foliage, buildings, etc.) and the available structure heights in the desired coverage area. The technology used by Clearwire to deliver the broadband service to consumers is manufactured by NextNet Wireless. This technology is a non -line -of -sight ("NLOS') technology and uses a multi -carrier OFDM modulation scheme. OFDM technology allows subscriber units to be placed inside the home or office. However, NLOS operation also requires the Clearwire system design incorporate sufficient margins in the RF link budget to accommodate the wide variation in path attenuation. Path attenuation in a NLOS application at 2500MHz is very dependent on the building material, thickness, orientation and other characteristics. In addition, another characteristic of the OFDM system is the need to use more frequencies in the cell layout.
