All final determinations may be appealed within 14 days following the comment deadline. No licenses, permits, or approvals will be issued until completion of the appeal period. Our decision not to require an EIS does not mean that the license, permit, or approval you are seeking from the City has been granted. Approval or denial of the proposal will be made by the appropriate administrative or legislative body vested with that authority. The environmental record is considered by the decision maker(s) and conditions will be imposed to reduce identified environmental impacts, as long as the conditions are based on adopted and designated City policy. After a final decision has been made on your proposal (i.e., after a permit has been issued or City Council action taken, as applicable), you may, but are not required to, publish a Notice of Action as set forth in RCW 43.21 C.075. The Notice of Action sets forth a time period after which no legal challenges regarding the proposal's compliance with SEPA can be made. A copy of the Notice of Action form and copies of RCW 43.21C.080 and WAC 197-11-680 providing instructions for giving this notice are available from the Department of Community Development Services. Proponent: Zaremba Group LLC Location: 34001 Pacific Hwy South, Federal Way, WA Lead Agency: City of Federal Way City Contact: Isaac Conlen, Associate Planner, 253-835-2643 The Responsible Official of the City of Federal Way hereby makes the following Findings of Fact based upon impacts identified in the Environmental Checklist; the "Final Staff Evaluation for Environmental Checklist, Federal Way File No. 05-100448-00-SE"; Conclusions of Law based upon the 2003 Federal Way Comprehensive Plan; and other policies, plans, rules, and regulations designated as a basis for exercise of substantive authority under the Washington State Environmental Policy Act Rules pursuant to RCW 43.21 C.060. FINDINGS OF FACT 1. The subject property is located at 34001 Pacific Hwy South, Federal Way, Washington. 2. The subject property is zoned Business Park (BP). The comprehensive plan designation for the site is Business Park. An auto insurance claim center is a permitted use (by interpretation) in the BP zoning classification. 3. In accordance with code requirements, transportation impacts, pedestrian access, and improvements necessary for the proposed project were analyzed. A Transportation Impact Analysis (TIA) was prepared for the proposed project. The results of the analysis indicate that the potential exists for adverse impacts to the surrounding road network. In its Six Year Transportation Improvement Plan (TIP), the City of Federal Way has identified one TIP project in which the proposed development will exceed the net 10 PM peak hour threshold for requiring project mitigation. As a condition of approval, the applicant will construct the impacted TIP project or voluntarily contribute a pro-rata mitigation fee as calculated in the MDNS. 4. Street improvements for the project must comply with adopted City codes. The applicant must construct street front4ge improvements including street widening, sidewalk, Iandscaping, lighting, and storm drainage improvements along Pacific Highway South and a portion of 34& Street . adjacent to the site. 5. As required by code, all right-of-way dedication will be conveyed to the City through a Statutory Warranty Deed and have clear title prior to recording. 6. The "Final Staff Evaluation for Environmental Checklist, File No. 05-102389-00-SE," is hereby incorporated by reference as though set forth in full. CONCLUSIONS OF LAW The goals and policies of the Federal Way Comprehensive Plan serve as a basis for requiring SEPA conditions. TG1 Maintain mobility for residents and businesses through a balanced, integrated system of transportation alternatives that: a. Meet local and regional needs though inter jurisdictionally coordinated and integrated systems. b. Reduces auto dependency, especially SOV use. C. Supports the land use vision and plan. d. Protects and enhances the environment and quality of life. e. Provides acceptable levels of service for each transportation mode that is also commensurate with the planned levels of funding. TG2 Provide a safe, efficient, convenient, and financially sustainable transportation system with sufficient capacity to move people, goods, and services at an acceptable level of service. The City shall develop and adopt policies for the construction, reconstruction, maintenance, and preservation of new and existing facilities. TP 16 The City's LOS standard shall be E. This is defined herein as a volume/capacity ratio less than 1.00 in accordance with Highway Capacity Manual (2000) operational analysis procedures. At signalized intersections, the analysis shall be conducted using a 120-second cycle length and level of service E is defined as less than 80 seconds of delay per vehicle. Where transit or HOV facilities are provided, the LOS shall be measured by average delay and volume/capacity ratio per person rather than per vehicle. This standard shall be used to identify concurrency needs and mitigation of development impacts. For long-range transportation planning, a volume/capacity ratio of 0.90 or greater will be used to identify locations for the more detailed operational analysis. TP17 Expand arterial capacity by constructing channelization improvements at intersections when they are an alternative to creating new lanes along a roadway corridor. TP20 Take advantage of opportunities to open new road connections to create route alternatives, especially in areas with few access choices. The lead agency for this proposal has determined that the proposed action does not have probable significant adverse impact on the environment, and an Environmental Impact Statement (EIS) is not required under RCW 43.21C.032(2)(c), only if the following conditions are met. This decision was made after review of a completed environmental checklist and other information on file with the lead agency. This information is available to the public on request. CONDITIONS OF APPROVAUMITIGATION MEASURES Based on the above goals and policies, the following mitigation measures are required prior to occupancy to minimize identified potential significant adverse impacts. 1. Construct impacted TIP project at the following locations: a. SR 18 @ SR 161: Add 3rd westbound left -turn lane, eastbound and westbound right -turn lanes, and add third southbound lane on SR 161 to South 352nd Street. Channelization and street improvement plans shall be prepared by a professional engineer registered in the State of Washington and submitted for City of Federal Way's review and approval in concurrence with building permit application and constructed prior to the issuance of Certificate of Occupancy. In lieu of constructing the above 2006 — 2011 TIP improvements project, prior to the issuance of building permits, the applicant may voluntarily pay the project's pro-rata share contribution calculated in the amount of $10,400 towards the TIP project. SEPA Determination This memorandum provides comments from the Traffic Division regarding the State Environmental Policy Act (SEPA) conditions pertaining to the proposal to construct 13,500 sq. ft. of insurance office building located on the west side of SR 99 just south of S 336th Street. Federal Way Comprehensive Plan references are provided in annotated form supporting the recommended conditions for the development. Policies and goals adopted by the City of Federal Way serve as the basis for the exercise of substantive SEPA authority to approve, condition, or deny proposed actions, which are applicable to potential adverse environmental impacts resulting from this project. State Environmental Policy Act SEPA Miti ation Based on the Traffic Impact Analysis (TIA), prepared by The Transpo Group, dated May 2004 and memorandum responding to the City's TIA comments, the development would generate 27 new weekday evening peak hour trips. The new trips generated by the development would have significant impact on the City's transportation network. The City of Federal Way has identified one (1) TIP project impacted by 10 or more trips. Additionally, the TIA also identified intersection improvements at SR 99 (Pacific Highway South)/S 340th Street intersection for safe access. These improvements would include but not limited to signal modifications, street improvements and adding a dedicated northbound left turn lane. The city concurs with the TIA recommendation. SEPA Conditions - In order to mitigate for the adverse transportation impacts of the new trips generated by the development on existing transportation network, prior to the issuance of Certificate of Occupancy, the applicant shall: 1. Construct impacted TIP project at the following locations: a. SR 18 @ SR 161: Add 3rd westbound left -turn lane, eastbound and westbound right -turn lanes, add third southbound lane on SR 161 to S 352nd Street. Channelization and street improvement plans shall be prepared by a professional engineer registered in the State of Washington and submitted for City of Federal Way's review and approval in concurrence with building permit application and constructed prior to the issuance of Certificate of Occupancy. In lieu of constructing the above 2006 — 2011 TIP improvements project, prior to the issuance of building permits, the applicant may voluntarily pay the project's pro-rata share contribution calculated in the amount of $10,400 towards the TIP project. General description of the site (circle one): flat, rolling, hilly, steep slo es, mountainous. b. What is the steepest slope on the site (approximate percent slope)? According to the topographic survey prepared by Triad Associates, the steepest slope on the site is approximately 20% located near the central portion of the property leading to the regional detention facility. The remainder of the site, the area proposed for development, is relatively flat at 1 %-5%. c. What general types of soils are found on the site (for example, clay, sand, gravel, peat, and muck)? If you know the classification of agricultural soils, specify them and note any prime farmland. According to the Preliminary Geotechnical Report prepared by Associated Earth Sciences, Inc. on June 13, 2001, the site is underlain by loose to medium dense fill overlying an alluvial deposit consisting of loose/medium stiff sand, clayey silt, and silty clay, overlying dense to very dense advance washout sand and gravel. d. Are there surface indications or history of unstable soils in the immediate vicinity? If so, describe. There are no apparent indications of unstable soils on -site or in the immediate vicinity. The wetland is defined as a Category II Wetland and the stream is defined as a Major Stream pursuant to the Federal Way City Code. The stream is a tributary of Hylebos Creek. 2) Will the project require any work over, in or adjacent to (within 200 feet) the described waters? If yes, please describe and attach available plans. Yes, the proposed development will discharge treated storm water directly to the regional detention facility in accordance with the requirement that the site discharge at its natural location and as anticipated during the design and construction of the regional detention facility. 3) Estimate the amount of fill and dredge material that would be placed in or removed from surface water or wetlands and indicate the area of the site that would be affected. Indicate the source of fill material. No filling or dredging will occur in the wetland. 4) Will the proposal require surface water withdrawals or diversions?
