This letter responds to your request to waive the required access improvements along S 333`d Street
and 24th Avenue S associated with your proposed development.
After evaluating the existing conditions along S 333`d Street and 24th Avenue S, review of Federal
Way City Code (FWCC) provisions (Sections 22-1496, 22-1477 and 22-1524), and the direction
provided by the City Council, the Public Works Department hereby modifies the requirements for
street improvements applicable to your land use application, as discussed below.
FWCC Section 22-1477 Modification of Improvements Along Property Frontage - This code section
allows the Public Works Director to grant a request to modify, defer, or waive the required street
improvements only after consideration of four specific reasons. The reason most applicable here is
contained in FWCC 22-1477 (1) "Improvements as required would not be harmonious with existing
street improvements."
S 333`d Street is classified as a minor collector corresponding to Federal Way Roadway Section "R".
This roadway section requires a 40-foot-wide paved street with curb, gutter, four -foot planter strip
with street trees, six-foot sidewalk, three-foot utility strip, and streetlights all within a 66-foot right of
way.
24th Avenue S is classified as a local access street corresponding to Roadway Section "W". This
roadway section requires a 28-foot wide paved street with curb, gutter, four -foot planter strip with
street trees, five-foot sidewalk, three-foot utility strip, and streetlights all within a 52-foot right of
way.
Application of the required street improvements would result in improved roadway sections that are
not harmonious with existing street improvements. S 333`d Street consists of a 22-foot paved
roadway and sidewalks to the west, within a 60-foot right of way. 24th Avenue S consists of a 20-
foot paved road with no sidewalk within a 24-foot easement.
As a result, the required street improvements are modified, to include constructing S 333`d Street
along your frontage to a 20-foot paved road from centerline to curb, curb and gutter, four -foot planter
strip with street trees, six-foot sidewalk, three-foot utility strip and streetlights. To accommodate
these improvements a three-foot right of way dedication is required. 20 Avenue S will need to be
constructed to include a 24-foot paved road, curb and five-foot sidewalk on the west side of the road.
To accommodate these improvements five feet must be added to the access easement. A professional
engineer registered in the State of Washington must design road improvements.
The conditions of this right of way modification will be applicable for one year from the date of this
letter. If a building permit is not issued within the one-year time limit, the right of way modification
will be void and a new request for modification must be submitted.
