The project includes bolting a pre -constructed steel frame into the top cement block of a 7.5 ft. tall ecology block enclosure and covering the frame with a weather resistant vinyl cover to protect the salt stored in the bin from exposure to inclement weather. The Process II land use application submitted on August 19, 2007, is hereby approved per the enclosed Exhibit A, Findings for Project Approval. Review Process Required The site is within a Single -Family Residential (RS7.2) zoning district. Government facilities are a permitted use in the RS7.2 zoning district. Adding an engineered, steel structure cover on an existing concrete block storage bin would be considered a "material change to the architectural design;" therefore, pursuant to Federal Way Revised Code (FWRC) 19.15.030, the proposed project was reviewed under the Process II `Site Plan Approval' review process. SEPA Process Pursuant to the State Environmental Policy Act, the proposed project does not exceed the exempt level thresholds; therefore, in accordance with FWRC Title 14, the project is exempt from SEPA review. Procedural Information Unless modified or appealed, the Process II decision is valid for a period of one year from the date of issuance of the decision. If a building permit is not submitted within one year of the date of issuance, the decision will expire. However, a two-year extension of the decision may be granted, only if a written request is submitted to the Department of Community Development Services (33325 8th Avenue South, PO Box 9718, Federal Way, WA 98063-9718) at least 30 days prior to the expiration of the decision and the request meets all the criteria as outlined in the code. This land use decision may be appealed, pursuant to FWRC 19.60.080, by the applicant or any person who received a copy of the decision. Any appeal must be in the form of a letter delivered to the Department of Community Development Services with the established fee within 14 calendar days after the effective date of issuance of this decision. The effective date of issuance is three calendar days following the date of this letter, or October 23, 2009. The appeal letter must contain a clear reference to the matter being appealed and a statement of the factual findings and conclusion of the Director of Mr Faster October 20, 2009 Page 2 Community Development Services disputed by the person filing the appeal. The Federal Way Hearing Examiner will hear any appeals of the Process II decision. No work on the proposal can commence until the end of the appeal period. However, in that you are the only party of record, you may waive your right to appeal this decision. If you wish to waive your right to appeal, you must do so in writing or via email to the attention of Senior Planner Joanne Long -Woods. This land use decision does not waive compliance with future City of Federal Way codes, policies, and standards relating to this development. The project site is adjacent to the Interstate 5 right-of-way. The 15 ft. tall, pre-engineered structure will be bolted into and mounted on top of an existing 7.5 ft. talc ecology block bin enclosure. The steel frame will be covered with a dark green weather resistant vinyl cover to help protect the salt storage area from inclement weather. FINDINGS 1) The subject property's Comprehensive Plan and zoning designation is Single -Family, High - Density Residential and RS 7.2, respectively. Federal Way Revised Code (FWRC) allows government facilities in RS zones. 2) The Steel Lake Maintenance Facility property was reviewed under a Use Process III approval with SEPA review in 2007 (File No. 07-145284-00-UP) to expand the existing yard to include two adjacent lots (31104 & 31114 28% Avenue South) that the City had purchased to be used for additional storage of equipment and materials. The expansion project and conditions of approval expanded the uses permitted on this parcel and are, therefore, applicable to this proposal. 3) Pursuant to FWRC 19.15.030, the placement of an engineered covering over an existing open salt storage bin would constitute a "material change to the approved architectural design;" therefore, a Use Process II, Site Plan approval is required for this project. And, because the project size and scope does not exceed exempt level thresholds under the State Environmental Policy Act, in accordance with FWRC Title 14, the project is not required to go through SEPA review. 4) The application was received by the City on August 19, 2009. Additional information was requested to address height restrictions in the RS 7.2 zone. The application was determined complete on August 29, 2009. 5) The maximum height of a structure in the RS zone is 30 ft. The frame for the cover of the salt bins is a pre-engineered steel structure that is about 15 ft. tall. It will be bolted into an existing concrete block enclosure that is constructed of three tiers of 2.5 ft. tall cement blocks, or 7.5 ft. tall. The existing concrete blocks are on an existing asphalt parking area, so the overall height of the proposed dark green, vinyl -covered, steel frame structure is approximately 22.5 ft. tall, which is well below the maximum height of 30 ft. 6) A landscape plan was submitted as a requirement of the previous Use Process III approval on January 14, 2008. As part of that approval, Type I perimeter landscaping 20 feet in width abutting 2S'h Avenue South and 10 feet in width abutting the north property line was required. The south A prop&ty line is developed with asphalt paved and striped parking area with a solid board fence along the south boundary. The existing vegetation between subject property and Interstate 5 frontage on the east property boundary was deemed sufficient buffering and no additional landscaping was required along the state right-of-way. However, a six -foot -high black chain link fence and Type I landscaping was approved to shield the maintenance yard expansion from public rights -of -way and adjacent properties. 7) The applicant was required to provide anew asphalt driveway to serve the subject property's ingress/egress requirements from 28t` Avenue South. The existing streets and utilities adequately serve the anticipated demand of the proposal. The proposed access to the subject property is at the optimal location. 8) The subject property is not located within any critical areas as defined by Chapter 19.145 FWRC `Critical Areas.' 9) Final construction drawings are subject to review for compliance with specific regulations, conditions of approval, and other applicable City requirements. This decision shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this development.
