The storage containers are located in the northeast corner of the parcel, as far as possible from the 28`h Avenue South right-of-way and behind the principal building. The containers are painted to match the existing office building. The City has completed a Land Use Process 1 Review and hereby approves the proposed storage containers. Pursuant to Federal Way Revised Code (FWRC) 19.125.180(h) the director may waive or modify the screening as necessary to accommodate the storage of materials related to public health, safety and welfare, when used in conjunction with an institutional use. After reviewing the site, the required 100 percent sight - obscuring screening around the storage containers is not necessary because the use is not visually obtrusive. Existing vegetation has been deemed a sufficient landscaping buffer between subject property and Interstate 5 frontage. The six -foot -high black chain link fence and proposed landscaping plan approved per the maintenance yard expansion project (file#07-105284-00-UP) is sufficient to screen the containers from the public right-of-way and adjacent property to the north. The Director of Community Development Services hereby waives the screening requirement and no additional screening will be needed. This decision shall not waive compliance with future City of Federal Way codes, policies, and standards relating to this project site. The effective date of decision is October 23, 2009. Pursuant to FWRC 19.55.050, any person who received notice of the administrative decision may appeal this decision to the Federal Way Hearing Examiner by November 6, 2009 (14 days from the effective date of decision). In that you are the only party of record, you may waive your right to appeal by submitting a letter to this effect to the City of Federal Way, Department of Community Development Services. Waiver of the right to appeal does not affect the effective date of this decision. As outlined in Federal Way City Code Section 19.125.180, the containers meet criteria for approval as follows: (1) Allowed uses and zones. The property is located within a residential zone (RS-7.2), however containers may be used as permanent accessory storage in this zone in conjunction with institutional or quasi -public uses. They are not the principal structure or use of a property. Project meets this criterion. (2) Review process. The containers are not part of a development project that requires a different review process; therefore Process 1 approval is required. (3) Design criteria. Permanent outdoor storage containers are subject to the following criteria: (a) Containers shall be placed to minimize visibility from surrounding streets, pedestrian areas, and properties; and shall not be located between the principal building and front property line. The containers are located in the northeast corner of the parcel, as far as possible from 28'h Ave Sand behind the principal building. Project meets this criteria. (b) Containers shall not be stacked. Project meets this criterion. (c) Containers shall not be refrigerated, or used or designed to be used for office, sales, or other habitable space. Containers are used as dry storage. Project meets this criterion. (d) Containers shall be painted to match adjacent building(s) or improvements. The cargo containers have been painted off-white to match the existing office building. (e) No loose material shall be stacked on or near a container unless approved under all applicable provisions of this chapter. Project meets this criterion. In reviewing proposed screening methods, the director will consider the zoning of the site and surrounding properties; location of the container and visibility from adjacent streets and properties; existing and proposed landscaping; and the physical condition of the container; provided, that containers located on or adjoining a residentially zoned property shall receive 100 percent sight -obscuring screening. See below. (g) The director may limit the number and/or size of containers on a site if necessary to minimize visual or operational impacts to the site or surrounding properties. See below. (h) The director may waive or modify the screening and/or placement criteria of this section as necessary to accommodate the storage of emergency preparedness supplies or other materials related to the public health, safety, and welfare, when used in conjunction with institutional and quasi -public uses. See below. Public Works Department requests that the director waive the requirement for 100% sight - obscuring screening, based on the following reasons. • The containers are currently heavily screened on the south and east sides, and partially screened on the west and north sides. ■ Proposed landscaping will provide additional screening on the west and north. • The containers are located such that they are minimally visible from 28`h Ave S and 1-5. • The adjacent property on the north is owned by the City and does not include a residential use. • The containers are used as storage for materials related to public safety and welfare. Additional Information There are. three 8'x40' and two 8' x 20' containers clustered together on the site at this time, for a total of 1,280 square feet. No additional containers are anticipated. You are being notified because the above referenced property contains outdoor storage container(s) that are subject to a compliance period under the new regulations. Please note that outdoor storage containers are prohibited as an accessory use to either a single-family or multi -family residential use and must be removed by November 15, 2010, the effective date of the ordinance, unless they are a legal nonconforming use, having previously been approved by the City of Federal Way or a prior jurisdiction. Unless previously approved by the City of Federal Way or a prior jurisdiction, other outdoor storage containers must comply with the new regulations or be removed by November 15, 2010. Prior to the compliance deadline, eligible outdoor storage container(s) must be reviewed and approved under "Process I, Director's Approval," or be removed from the property if not already designated as a legal nonconforming use. In order to have your outdoor storage containers be a permitted use in the City of Federal Way, please complete and submit the following items: (1) a Master Land Use Application (enclosed); (2) an informal site plan showing the "footprints" of the primary building and outdoor storage container(s) on the property; and (3) a fee of $79.50, automation fee plus Process I application fee, which is charged at the hourly rate of $73.50, with the first hour deposit required at the time of application. Following review of the application, the City will issue a Process I approval for the storage container(s) if it complies with City code, or we will notify you of any requirements that must be addressed for approval.
