The City of Federal Way has completed the administrative review of the proposed installation of a 2,000
gallon above -ground fuel storage tank and associated improvements at the United Rentals site at 35100
Pacific Highway South. The Process III land use application submitted on October 17, 2006, and
additional information submitted on November 7, 2006, is hereby approved per the enclosed Exhibit A,
Findings for Project Approval. The remainder of this letter outlines future review processes required, gives
a brief summary of the process under the State Environmental Policy Act (SEPA), and outlines procedure
relating to appeals and approval periods for this decision. A building permit is not required for the fuel
tank installation; however, an electrical permit and a fire department permit are required.
REVIEW PROCESSES REQUIRED
The site is within the Community Business (BC) zoning district. This existing Rental Store use is permitted
within the BC zoning district. The fuel storage tank installation is not categorically exempt from the State
Environmental Policy Act; therefore, pursuant to Federal Way City Code Section 22-32.2(3), installation
of the proposed fuel tank on a developed site is reviewed under the Process III, Project Approval, review
process.
SEPA PROCESS
The responsible official of the City of Federal Way issued a Notice of Optional Determination of
Nonsignificance (DNS) on November 22, 2006, pursuant to the State Environmental Policy Act (file #06-
105312-00-SE). The comment period for this determination was completed on December 6, 2006, with no
comments submitted to the City. The responsible official of the City of Federal Way issued a Final
Determination of Nonsignificance (DNS) on December 12, 2006, pursuant to the State Environmental
Policy Act (file #06-105312-00-SE). The appeal period for this determination was completed on December
26, 2006, with no appeals received by the City.
PROCEDURAL INFORMATION
Unless modified or appealed, this project approval is valid for a period of one year from the effective date '
of the decision. If no further'action is taken within one year, the decision becomes void. An extension may
be granted, pursuant to FWCC Section 22-409, through a written request submitted to the City Department
of Community Development Services prior to the expiration of the decision.

This decision may be appealed by any person who received a copy of this decision. The appeal must be in
the form of a letter delivered to the Department of Community Development Services (33325 Eighth
Avenue South, PO Box 9718, Federal Way, WA, 98063-9718) and be accompanied by the established fee,
within 14 calendar days after the effective date of the decision (January 15, 2007). The effective date of
decision is January 1, 2007. The appeal letter must contain a clear reference to the matter being appealed
and a statement of the factual findings and conclusions of the Director of Community Development
disputed by the person filing the appeal.
This decision shall not waive compliance with future City of Federal Way codes, policies, and standards
relating to this development.

BACKGROUND
ATC Associates, Agent for United Rentals, has proposed installation of a 2,000 gallon above -ground fuel .
storage tank (AST) and associated improvements at the United Rentals site at 35100 Pacific Highway
South. The tank is proposed under an existing canopy at the site. The subject property is located within a
critical aquifer recharge area, wellhead capture zone 2 (five year time -of -travel).
•FINDINGS
1) The subject property is -zoned Community Business (BC). The site is developed with an existing
rental store, a permitted use in the BC zone. The fuel storage tank installation is not categorically
exempt from the State Environmental Policy Act; therefore, pursuant to Federal Way City Code
Section 22-32.2(3), installation of the proposed fuel tank on a developed site is reviewed under the
Process III, Project Approval, review process.
2) The application was received by the City on October 17, 2006. The application was determined
complete on November 14, 2006. The responsible official of the City of Federal Way issued a Notice
of Application and Notice of Optional Determination of Nonsignificance (DNS) on November 22,
2006, pursuant to the State Environmental Policy Act (file #06-105312-00-SE). The comment period
for this determination was completed on December 6, 2006, with no comments submitted to the City.
The responsible official of the City of Federal Way issued a Final Determination of Nonsignificance
(DNS) on December 12, 2006, pursuant to the State Environmental Policy Act (file #06-105312-00=
SE). The appeal period for this determination was completed on December 26, 2006, with no appeals
received by the City.
3) The fuel storage tank will be constructed under an existing canopy, and the area below the canopy is
connected to the Lakehaven Utility District sanitary sewer line, limiting runoff around the storage
tank.
4) The subject property is located within a critical area as defined by FWCC. Specifically, the site is
within a five-year wellhead capture zone. On November 7, 2006, the applicant provided a written
response to the City identifying how the proposed fuel storage tank meets the requirements of FWCC
Section 22-1375(b) (1-4) for storing, handling and using hazardous materials in a five=year wellhead
capture zone. The applicant's response shows the proposal meets the performance standards of
FWCC Section 22-1375(b)(1-4), as follows in summary: 1) The tank will be installed under a canopy
which limits stormwater runoff around the AST, the area under the canopy is connected to the
sanitary sewer; and a spill kit will be staged on -site near the safety shutoff switch for the ATC; 2) The
AST is double walled for secondary containment, and the area around the tank is connected to
sanitary sewer; 3) Fill material will not be imported with the installation; and 4) The proposed
development will implement Best Management Practices as discussed in 1 and 2 above.
5) The streets and utilities in the area of the subject property will not be affected by the proposal and the
applicant proposes no alteration in the ingress or egress of the facility. The site will use existing
infrastructure to facilitate the new proposal. The existing streets and utilities adequately serve the
anticipated demand of the proposal. The existing access to the subject property is at the optimal
location and configuration as reviewed previously for the original site development.
6) Final construction drawings are subject to review for compliance with specific regulations, conditions
of approval, and other applicable City requirements. This decision shall not waive compliance with
future City of Federal Way codes, policies, and standards relating to this development.
7) A building permit is not required for the project, as determined by the Building Official; however, an
electrical permit and Fire Department permit are required prior to installation.
CONCLUSIONS
The proposal has been reviewed for compliance with the Federal Way Comprehensive Plan, pertinent
zoning regulations, and other applicable City regulations.
Based on the findings and conclusions of this review, approval.of the project is recommended. This
decision shall not waive compliance with future City of Federal Way codes, policies, or standards relating
to this decision.

This office and other City staff have reviewed the environmental checklist you submitted. We have determined that
the proposal will not have a probable significant adverse impact on the environment. As a result, an Environmental
Impact Statement (EIS) is not required to comply with the State Environmental Policy Act (SEPA). A copy of the
Determination of Nonsignificance (DNS) is enclosed.
The 14-day comment period required by the SEPA Rules (WAC 197-11-355) ran concurrently with public comment
period associated with the notice of land use action. The comment period began on November 22, 2006, 2006, and
ended on December 6, 2006. The City did not receive any comments on the proposal. The enclosed Final DNS was
issued on December 12, 2006. The final SEPA determination may be appealed within 14 days of the date of issuance.
No licenses, permits, or approvals may be issued until completion of the appeal period, which will end December 26,
2006.
You may, but are not required to, publish a Notice of Action as set forth in RCW 43.21C.075. The Notice of Action
sets forth a time period after which no legal challenges regarding the proposal's compliance with SEPA can be made.
A copy of the Notice of Action form and copies of RCW 43.21C.080 and WAC 197-11-680 providing instructions
for giving this notice are available from the Department of Conununity Development Services.
The City is not responsible for publishing the Notice of Action. However, the City is responsible for giving a notice
(to parties of record) stating the date for commencing a judicial appeal (including the SEPA portion of that appeal) if
your proposal is one for which the City's action has a specified time period within which any court appeals must be
made.
We anticipate issuance of the related Process III decision required for the proposal, shortly after conclusion of the
SEPA appeal period.

Integrated Comment Period: Consistent with the provisions of WAC 197-11-355, a single integrated
comment period will be utilized to obtain comments on the Notice of Land Use Application and Notice of
Optional Determination of Nonsignificance. This may be the only opportunity to comment on the
environmental impacts of the proposal.
Any person may submit written comments on the land use application or the environmental impacts of the
proposal to the Director of Community Development Services by 5.-00 p.m. on December 6, 2006. Persons
who submit written comments to the Director, or specifically request a copy of the decision, may appeal the
Process III decision. However, any interested party may appeal the environmental threshold determination.
Details of appeal procedures for the requested land use decision will be included with the written decision.
Issuance of Final Environmental Determination: The final Determination of Nonsignificance may be
issued without a second comment period, unless timely comments identify probable significant adverse
impacts that were not considered by the Notice of Optional Determination of Nonsignificance. A copy of
the Determination of Nonsignificance may be obtained upon request.
Consistency with Applicable City Plans and Regulations: Development of the site is subject to all
applicable City codes and regulations, including FWCC Zoning, Environmental Protection, Landscaping,
Community Design Guidelines, Environmental Protection, and Planning and Development Chapters.

Optional Environmental Determination: Based upon review of a completed environmental checklist and
other information on file with the City, it is likely that the City of Federal Way will determine that the
project will not have a probable significant adverse impact on the environment. It is likely that an
Environmental Impact Statement (EIS) will not be required under RCW 43.21 C.030(2)(c). The City
anticipates that a Determination of Nonsignificance (DNS) will be issued for the proposed project. The
optional DNS process in WAC 197-11-355 is being used. The proposal may include mitigation measures
under applicable codes, and the review process may incorporate or require mitigation measures regardless
of whether an EIS is prepared. A copy of the subsequent threshold determination for the specific proposal
may be obtained upon request. (In addition, the lead agency may choose to maintain a general mailing list
for threshold determination distribution.)
Integrated Comment Period.-. Consistent with the provisions of WAC 197-11-355, a single integrated
comment period will be utilized to obtain comments on the Notice of Land Use Application and Notice of
Optional Determination of Nonsignificance. This may be the only opportunity to comment on the
environmental impacts of the proposal.
Any person may submit written comments on the land use application or the environmental impacts of the
proposal to the Director of Community Development Services by 5:00 p.m. on December 6, 2006. Persons
who submit written comments to the Director, or specifically request a copy of the decision, may appeal the
Process Ill decision. However, any interested party may appeal the environmental threshold determination.
Details of appeal procedures for the requested land use decision will be included with the written decision.
Issuance of Final Environmental Determination: The final Determination of Nonsignificance may be
issued without a second comment period, unless timely comments identify probable significant adverse
impacts that were not considered by the Notice .of Optional Determination of Nonsignificance. A copy of
the Determination of Nonsignificance may be obtained upon request.
Consistency with Applicable City Plans and Regulations: Development of the site is subject to all
applicable City codes and regulations, including FWCC Zoning, Environmental Protection, Landscaping,
Community Design Guidelines, Environmental Protection, and Planning and Development Chapters.

The 14-day comment period required by the SEPA Rules (WAC 197-11-355) is running concurrently
with public comment period associated with the notice of land use action. The comment period began on
November 22, 2006, and ends on December 6, 2006.
If no comments are received on the notice of application and optional DNS, I anticipate issuing the Final
DNS shortly following December 6, 2006. The final DNS, when issued, requires a 14-day appeal period.
Following the close of the SEPA appeal period, the decision on the Process III land use decision will be
issued by the City, and the Process III land decision requires its own 14-day appeal period. If no
comments are received on the application, this appeal period may be waived upon request by the

PURPOSE OF CHECKLISTt
The State Environmental Policy Act (SEPA), Revised Code of Washington (RCW) Chapter 43.21 C, < of

significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide
information to help you and the agency identify impacts from your proposal (and to reduce or avoid
impacts firorn the proposal, if it can be done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS
This environmental checklist asks you to describe some basic information about our proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of your proposal
are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise
information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you
should be able to answer the questions from your own observations or project plans without the need to
hire experts. If you do not know the answer, or if a question does not apply to your proposal, write "do not

11. Give brief, complete description of your proposal, including the proposed uses and the size of the
project and site. There are several questions later in this checklist that ask you to describe certain
aspects of your proposal. You do not need to repeat those answers on this page.
The proposed work will include the following:
• A 2,000-gallon, double -walled, compartmentalized above -ground storage tank (AST) will be procured
and installed to meet state and local building and fire code requirements.
• Form and pour a 6-inch thick concrete pad for AST base: The pad will be 24' x 14' and will be
composed of 4,000 psi concrete reinforced with No. 4 rebar.
• Twelve bollards will be installed around the tank pad to protect the AST from accidental collision.
The bollards will be constructed of 7-feet long, 6-inch diameter steel pipes filled with concrete,
painted safety yellow, and will be set 3-feet into the ground with 4-feet above ground stick up.
• Electrical service and emergency shutoff switch will be installed to the AST.
■ Stand-alone dispensers will be installed adjacent to the tank. Dispensers will have break -away hoses
and will be Weights and Measures certifiable.
• Safety and warning labels will be installed as required by local codes and NFPA 30 and UFC 79-3.
12. Location of the proposal. Give sufficient information for a person to understand the precise location of
your proposed project, including a street address, if any, and section, township, and range, if known.
If a proposal would occur over a range of area, provide the range or boundaries of the site(s). Provide
a legal description, site plan, vicinity map, and topographic map, if reasonably available. While you
should submit any plans required by the agency, you are not required to duplicate maps or detailed
plans submitted with any permit applications related to this checklist.

The proposed development is the installation of a 3-compartment 2,000-gallon AST. The AST will hoJ 1

with a monitoring port to check for releases. As with any AST, there is a potential for operator error wFW
could result in a spill. The United Rental staff operating the AST system will be fully trained on the\\

anticipates that a Determination of Nonsignificance (DNS) will be issued for the proposed project. The
optional DNS process in WAC 197-11-355 is being used. The proposal may include mitigation measures
under applicable codes, and the review process may incorporate or require mitigation measures regardless
of whether an EIS is prepared. A copy of the subsequent threshold determination for the specific proposal
may be obtained upon request. (In addition, the lead agency may choose to maintain a general mailing list
for threshold determination distribution.)
Integrated Comment Period:. Consistent with the provisions of WAC 197-11-355, a single integrated
comment period will be utilized to obtain comments on the Notice of Land Use Application and Notice of
Optional Determination of Nonsignificance. This may be the only opportunity to comment on the
environmental impacts of the proposal.
Any person may submit written comments on the land use application or the environmental impacts of the
proposal to the Director of Community Development Services by 5:00 p.m. on December 6, 2006. Persons
who submit written comments to the Director, or specifically request a copy of the decision, may appeal the
Process III decision. However, any interested party may appeal the environmental threshold determination.
Details of appeal procedures for the requested land use decision will be included with the written decision.
Issuance of Final Environmental Determination: The final Determination of Nonsignificance may be
issued without a second comment period, unless timely comments identify probable significant adverse
impacts that were not considered by the Notice of Optional Determination of Nonsignificance. A copy of
the Determination of Nonsignificance may be obtained upon request.
Consistency with Applicable City Plans and Regulations: Development of the site is subject to all
applicable City codes and regulations, including FWCC Zoning, Environmental Protection, Landscaping,
Community Design Guidelines, Environmental Protection, and Planning and Development Chapters.

The proposed work will include the following:
• A 2,000-gallon, double -walled, compartmentalized above -ground storage tank
(AST) will be procured and installed to meet state and local building and fire code
requirements.
• Form and pour a 6-inch thick concrete pad for AST base. The pad will be 24' x
14' and will be composed of 4,000 psi concrete reinforced with No. 4 rebar.
• Twelve bollards will be installed around the tank pad to protect the AST from
accidental collision. The bollards will be constructed of 7-feet long, 6-inch
diameter steel pipes filled with concrete, painted safety yellow, and will be set 3-
feet into the ground with 4-feet above ground stick up.
• Electrical service and emergency shutoff switch will be installed to the AST.
• Stand-alone dispensers will be installed adjacent to the tank. Dispensers will have
break -away hoses and will be Weights and Measures certifiable.
• Safety and warning labels will be installed as required by local codes and NFPA
30 and UFC 79-3.
