The request was formally submitted on April 8, 2009. The zoning designation of the site is Office Park (OP-1) and the proposed use is allowed in this zone pursuant to the zoning regulations in place in 1994 as stated in a previous letter. The location of the proposed meeting place is Building A of Lot 1 of the Binding Site Plan for the East Campus Terrace business park In order to determine what land use process may be required to allow you to continue the prayer meetings in the office space you are leasing, we had to determine whether this request would be considered a "change of use." The primary area of concern had to do with the traffic generation and required parking you needed, based on the days and hours of meetings and the number of attendees during peak hours of use. It was identified that you would need approximately 75 parking spaces for the days of highest attendance_ Building A had been allocated 51 spaces; however, the business park approval stated that the building owners could share parking through a mutual consent agreement. We asked you to obtain such an agreement to provide the additional parking spaces needed. You submitted the additional information on June 3, 2009, in the form of a signed agreement between the building owners of Building A and Building B to allow you use of their parking areas for your meetings, a total of 93 spaces. The owner of Building A stated they would need 10 spaces for their use and that left 83 spaces available for you to use. We have, therefore, determined that you can meet minimum parking requirements and will not trigger a "change of use," to hold periodic prayer meetings in a room within East Campus Terrace business park. Your request for an administrative decision is, therefore, approved. You must, however, obtain a business license from the city to continue the services and get building permit approval for the tenant improvements you are required to make for this facility. The submittal consists of an agreement by the property owners of Buildings A & B that the applicant can utilize the parking areas designated for the property at 32008 32nd Ave., South to provide parking for the proposed IHOP meetings. It was identified by the Traffic Division that the 7-10 PM peak hour usage for this facility would require approximately 75 spaces. As shown on the attached site plan, the two buildings provide 93 parking spaces. The owner of Building A, Korean American TV Broadcasting, identifies that only 10 spaces would be needed by their business during this time line and the owner of Building B, Genesis Real Estate and Property Management, did not identify usage of their parking area during this time frame. If there is no usage during this time by the owners of Building B, then there are 83 spaces available for use by the IHOP facility. Please respond with your comments as soon as possible. If the proposed use by IHOP does not trigger a "change of use", then they can proceed with their meetings as proposed. As part of our review, we must determine whether your proposal would be considered a "change of use" from what was previously approved for this site. By definition in the Federal Way Revised Code (FWRC), a "change of use" means the general character of a use has been modified and we are required to review: 1) hours of operation; 2) required parking; 3) traffic generation; 4) general appearance; 5) type, extent, or amount of indoor or outdoor storage; and, 6) constituents of surface water discharge or runoff. We have determined that criteria 1), 3), 4), 5), and 6) would not trigger a change of use. We need more information to evaluate criteria 2) for the required parking. This property is located within an Office Professional (OP-1) zone and has a Comprehensive Plan designation of Office Professional. This property is vested to the zoning regulations in effect in 1994 and is also subject to the conditions of a 1994 concomitant agreement between the City and Weyerhaeuser Corporation as part of an annexation process. Since then, a Binding Site Plan approval was issued in 2007 for the construction of four office buildings. As part of that project approval, a traffic impact analysis and parking study was required that identified how many parking spaces would be needed for each lot as part of the binding site plan. It was determined that, based on square footage of the "office use" in the buildings, 151 parking spaces would be required. Your group is located in Building A of Lot 1 and 51 parking spaces were required for this building. We consulted with the Traffic Division and have determined that we need more information from you to determine whether there is adequate parking on this property. Since the binding site plan allocated a certain number of spaces per lot, we need to know if there is an agreement within the building owners' association to allow "sharing" of parking spaces from building to building. If there is no parking agreement in place, you do not have enough parking spaces on this lot for your services. A preliminary calculation by the Traffic Division shows that based on the information you have given us on the attendance at prayer meetings, training and services on some days, you need about 75 parking spaces. As such, the new use would be considered a "change of use" and a Use Process II application would be required. In order to permit the use, you would need to establish that adequate parking exists, either thru establishment of a shared parking agreement with the other lot owners or by demonstrating through a parking study that adequate parking does exist on the subject property. May 5, 2009 Page 2 If there is a shared parking agreement, then the Traffic Division has asked that you identify: how many parking spaces are used within the complex during your primary hours of use, i.e. after 7PM (include the number of spaces you need and the number of spaces used by other offices during this time). If your analysis shows there are adequate parking spaces for existing and proposed uses, you would not trigger a "change of use." If there is no change of use, then you would not be required to submit and receive approval on a use process application for the establishment of church meetings within this building. This complex was approved through a Binding Site Plan Approval in 2007. This group is leasing space at Office Building A, Lot 1 to conduct prayer and worship services under the name "International House of Prayer'. They were tagged by PW because of the need to provide another access and to meet fire requirements for the meetings they are conducting. According to the application, they will meet four days per week, with meetings held several times during the day and night with attendance ranging from 40-110 people per day, depending on which session they are conducting. This complex was approved with a Binding Site Plan for proposed office buildings. This particular building also houses the Korean Broadcasting Company and provides 51 parking spaces. According to the traffic analysis done for this project, 151 spaces were required for the four buildings within the complex. It was reviewed as office buildings, which require 1 space/300 sq. ft. of building space. Parking requirements for churches are reviewed on a case by case basis after a TMP/Parking study has been completed. Soma and I have talked about this a couple times, briefly. She suggested I have the applicant find out how many of the parking spaces will be used by the Korean Broadcasting and other businesses in the complex to determine whether they are exceeding the parking limit that was approved for the original complex. We are reviewing this as an administrative application to verify whether they can conduct these meetings in this building. The main issue which would prevent them from continuing is that they would be considered a "change of use", which may require a Use Process II or III permit. The two things that could trigger the change of use determination is: 1) increase in traffic; 2) required parking; and, 3) hours of operation. Although they have not specified in their request what their future plans are, we should be asking whether they intend to expand, grow, or increase their attendance. Please let us know what additional information and/or studies you may need to determine whether this proposed facility should be allowed at this site and whether you consider it a "change of use". The purpose of the International House of Prayer Northwest Missions Base is to establish a night and day prayer and worship ministry in the spirit of the Tabernacle of David utilizing young adult musicians and singers. The goal is to build a missions base which will set a context for night and day prayer and worship in the Pacific Northwest and the Pacific Rim. Creating an atmosphere of prayer and worship will accelerate the physical return of Jesus to the earth. Jesus' return is dependent upon the prayers of this generation according to Matthew 23:37-39 and Revelation 22:17. Our focus is on the replication and amplification of the simple promise of scripture to encourage the seeking of God in humility, prayer and worship via a global network of houses of prayer. Should be fun - looking for some starter plants to do patio flowers and herbs. Now, I need your help also. There was a binding site plan done in 2006-2007 for the East Campus Terrace development off of 32nd Ave., So. As part of that review, they were required to do a traffic study based on construction of 4 office buildings, total of 45,000 sq. ft. of office space which required 151 parking spaces. My question: we have a private religious group that is leasing part of one of those buildings to be used for daily prayer for up to 25 people and then 1-2 weekly meetings where there could be as many as 75-100 people attending. Would they have to do a revised traffic study to determine whether they have enough parking for this use? Your help is appreciated. Joanne
