After evaluating the existing conditions in the area, review of Federal Way City Code (FWCC) provisions (Sections 22-1474, 22·1496, 22-1497, 22-1477), and the direction provided by the City Council, the Public Works Department has determined the following requirements for street improvements to be applicable to the development of the property. FWCC Section 22-1477 Modification of Improvements Along Property Frontage: This code section allows the Public Works Director to grant a request to modify. defer, or waive the required street improvements only after consideration of the following four specific criteria. These criteria were reviewed to determine their application with respect to this request. The one tJ1.at best applies to this situation is: (I) "Improvement as required would not be hamzonious with existing street improvements" Required improvements for the vehicular access easement are a minimum of 20 foot wide pavement, 8 foot wide ditch, and 5 foot wide sidewalk The easement currently has a 12 foot wide gravel driving surface, one4foot wide grass shoulder and ditch, ex.tending in this condition for approximately 400 feet before it intersects with public right-of-way. Full improvements along the property frontage would not be hannonious with existing improvements. Extension of improvements beyond the property frontage is limited to 200 feet by City policy for single-family property owners. In this case~ a 200 foot extension would not substantially change the condition of the easement. ,r-'!" .. ~ .. ~ Based on this information, a modification of the standards is granted for this site, with the following conditions: l. The property owner shall provide verification of legal access from 43rd Ave SW. 2. Along the property frontage, the property owner must provide a minimum 20' wide crushed rock roadway surface which is smoothly graded and compacted.
