I've also prepared a redline drawing of the approved landscape plan to visually depict my observations. You can pick this up whenever. 1. Landscaping along the west end of south property line and south end of west property line is not yet installed. 2. Two existing trees shown on the approved plan (in the south portion of west property line) have been removed. Replacement landscaping (Type 1) must be installed here. Per note on approved landscape plan, the west buffer is to be Type I rather than Type III. It appears that Type III has been installed here. Type I requires additional staggered tree plantings similar to the type of plantings installed on the north perimeter of the phase I parking lot. 6. Groundcover is not installed in some portions of the landscape area. 7. In addition to other required landscaping, three repacement trees must be planted somewhere on the site to compensate for removed significant trees. You asked about deferring installation until after CO. Code provides for the possibility of a 90-day extension. The City of Federal Way, a Washington municipal corporation (hereinafter "City"), was granted permission under permit number 05-101067-00 to construct a 5,760-square foot Police Evidence Building (hereinafter "Building"), an S-1 occupancy at 600 South 333ra Street, Federal Way. B. The Building shell has been constructed, but the Building is not substantially complete, nor suitable for occupancy, and conditions for issuance of a Certificate of Occupancy set forth in the International Building Code cannot be met at this time. C. Due to the size of the Building, the City's Public Safety Department (hereinafter "Department") desires to obtain access to the Building interior's evidence storage and management area, approximately 4,800 square feet, to allow for prompt opening of the Building upon issuance of a Certificate of Occupancy. D. In consideration of being allowed temporary access to the Building interior prior to issuance of a Certificate of Occupancy, the Department hereby covenants and agrees as follows: AGREEMENT l . Permission for Access. Effective upon the signatures below, the Department may gain limited access to the Building interior; PROVIDED, however, that until such time as a Certificate of Occupancy is issued by the City, the Department shall limit any activities conducted within the Building to the following: 1.1 Completion of all work required by applicable law, including the Federal Way City Code; 1.2 Completion of all work permitted under permit number 05-101067-00; 1.3 Development of a construction or architectural punch list; 1.4 Construction or installation of storage racks, data and telecommunications equipment, and other equipment necessary for Building operation; and 1.5 Storage of evidence in a manner consistent with law and applicable standards. Until such time as a Certificate of Occupancy is issued by the City, the Department shall not occupy or utilize the public lobby, office space, and canine wash area; and shall not utilize 1 the interior of the Building to conduct hiring or training of employees, conduct any other business, or permit public access, other than as expressly permitted in Paragraphs 1.1 — 1.5 above. 2. Termination of Permission for Access. The City, through its Building Official or her designee, may terminate at any time, with or without notice, the permission for access granted in Paragraph 1 above, if the City determines in its reasonable discretion that: 2.1 Conditions within the building create any risk to life, health, or safety; 2.2 Reasonable progress towards completion of the project is not being made; or 2.3 The conditions set forth in Paragraph 1 above have been violated. 3. Indemnification. The Department acknowledges that the City is not required by any provision of law to permit access to the building interior prior to issuance of a Certificate of Occupancy, and that any access taken pursuant to this Agreement is at the Department's sole risk.
