Background Information: In accordance with the requirements of Chapters 35.77 and 47.26 of the Revised Code of Washington, the City of Federal Way adopted its original Transportation Improvement Program (TIP) on July 23, 1991. The City is also required to adopt a revised TIP on an annual basis to reflect the City's current and future street and arterial needs. The City is required to hold a minimum of one public hearing on the revised plans. Staff proposes that this occur at the June 18, 2024 City Council meeting. Once the revised plans have been adopted by Resolution, a copy of the respective plans must be filed with the Washington State Secretary of Transportation and the Washington State Transportation Improvement Board. The proposed resolution sets the public hearing date for the June 18, 2024 City Council meeting. The TIP will also be presented to the Land Use and Transportation Committee on June 3, 2024. This project is intended to utilize the above budget for 2024. No additional funding is proposed. Background Information: The SWM Capital Improvement Program includes an annual project budget of $150,000 to be utilized for unidentified significant contracted maintenance tasks, minor contracted construction projects, and purchase of equipment to support maintenance activities. In staffs reviewing of the current status of the surface water system the most significant emergent need is to repair several failing stormwater structures within roadways. These include both catch basins and manholes. The top sections of the structures are typically concrete with a metal casting bolted or cast into the concrete. Over time, the repeated impact of vehicles, most significantly large trucks, results in the failure and breakdown of the concrete. Maintenance staff routinely patches and reinforces structures within highly traveled corridors, however eventually the structures reach the end of their useful life and need to be replaced. The maintenance staff typically replaces several structures annually, and has already replaced several this year. The need however exceeds staff s availability to complete the work. For this year's SWM Small CIP, staff has proposed to repair up to the small CIP project Rev. 7/18 budget through a Small Public Works Contract process. The applicant is paying permitting fees for State Environmental Policy Act ("SEPA") review and the development agreement. Backp_round Information In 2005, Kitts Corner's (southwest corner of Pacific Highway S and S 336th Street) comprehensive plan designation and zoning was changed to BC (Community Business) via a Process VI Comprehensive Plan Amendment and Process V Rezone, under Ordinance 05-490. This approval contained many conditions regulating specific development of the site. Subsequently, the City has approved multiple modifications to the approval conditions and associated master plan. The current Conditions of approval will be addressed as part of the Process VI. In 2023, the City was approached by Grand Peaks Properties, Inc. to initiate a Comprehensive Plan Amendment, rezone and Development Agreement for Kitts Corner. According to the developer, Kitts Corner represented an opportunity to provide market -rate rental housing within an urban village concept where the broader community can gather and connect on a neighborhood scale. Grand Peaks was proposing a new mixed -use development with 400+ market -rate multifamily housing units centered around a pedestrian friendly retail corridor. The City Council agreed to negotiating a development with Grand Peaks. Earlier this year, Grand Peaks allowed the property to fall out of contract and Christian Faith Center has placed the property under contract. On 25 April 2024, the City received a request from Christian Faith Center to enter into a development agreement for the Kitts Corner properties. CFC has indicated they believe Sound Transit will purchase their current property and they will be forced to relocate. Desiring to remain in Federal Way, the Kitts Corner property is large enough to accommodate CFC's plans for redevelopment. The proposal would include the development of a 100,000 sf church, associated parking, and potentially other uses for the property. - Over the last 15+ years Kitts Corner has undergone various zoning modifications associated with a big -box masterplan that failed to move forward due to economic conditions and antiquated planning concepts that do not support the urban village concept. The site is now burdened by past ordinances that historically have made it challenging to develop market -rate housing and retail. Removal of these conditions will create a clean slate for the property to be developed. Rev. 6/2020 May 6, 2024 Land Use and Transportation Committee Kitts Corner DA Page 2 It is staff s belief there is an opportunity to work with the applicant to promote development of the site, and also achieve comparable community benefits to those contained in the original zoning conditions. If approved by the City Council, the City would separately initiate a proposal [Comprehensive Plan Amendment (2025) and rezone] to remove the currently existing conditions on the property, so long as the City and the applicant can negotiate a satisfactory development agreement for the property that is supported by Council. Under FWRC, only the City Council or Council Committee may initiate preparation and negotiation of a development agreement. The current action before the Council is to approve negotiation of a development agreement; this is not an action to approve or deny a specific development agreement proposal. Any approval or denial of the ultimate development agreement amendment would come before Council for decision at a later time. The City's separate proposal to remove the currently existing conditions on the property is contingent upon Council ultimately approving a development agreement for the property. In other words, staff does not support removal of the currently existing conditions of development unless a new development agreement can be entered with the applicant to the satisfaction of Council. As such, they will need to relocate their campus. CFC has entered into a purchase and sale agreement for the property commonly known as the Kitt's Corner Property comprised of approximately 22 acres at the intersection of Pacific Highway South and South 336th Street. Similar to previous development proposals for the site, the current land use conditions placed on the site via previous ordinances do not support the development of a 100,000 SF Church facility and associated parking. CFC is seeking to undertake a development agreement, in conjunction with a contract rezone and comprehensive plan amendment in order to revise the land use conditions and allow for the future development of the overall site. As the site is large to accommodate both the church facility and other potential uses, the development agreement process will allow for those uses to be further defined for the overall site. Background Information: Staff will present the monthly progress update on the Sound Transit projects in the City of Federal Way. Updates for this month include: Federal Way Link Extension: • Northbound only travel continues for 23`d Ave S. • Work for the new concrete roadway, curb, and sidewalk for S 317d' St is scheduled to switch to north side at the end of April/early May. • Sewer work along S 320"' St has paused to allow for a revised removal plan but is expected to resume early May along with the final curb, gutter, and sidewalk. • Landscaping, final ballast, and final rail destressing is taking place. ■ Installation of permanent storm ponds and vaults is beginning. • Roadway work for the new 22"d Ave S, S 319th St, and S 318d' St adjacent to the new transit station continues. • Final work for TPSS06 and TPSS07 is ongoing. • Exterior cladding and artwork for the garage extension is being installed. ■ Federal Way Transit Center Station work continues with ceiling and wall panel installation, escalator and elevator installation and testing, and electrical, plumbing, and mechanical work. • Interior work for the End of Line Facility and Bus Driver Relief Building is ongoing.
