DNS and SEPA Checklist40k C4TY OF i Federal Way DETERMINATION OF NONSIGNIFICANCE (DNS) 2018 Shoreline Master Program Periodic Review (Non -Project Action) Files: 19-101677-SE & 17-105423-UP Description: The City of Federal Way is undertaking a periodic review of its Shoreline Master Program (SMP), as required by the Washington State Shoreline Management Act (SMA) (RCW 90.58), which requires local jurisdictions to review such regulations every eight years. The city adopted its current SMP in 2011. Federal Way's SMP guides construction and development along the shorelines of Puget Sound, Steel Lake, North Lake, and the northwestern portion of Lake Killarney. The city has predesignated shorelines along Star Lake, Five Mile Lake, Lake Geneva, Lake Dolloff, and the remaining portion of Lake Killarney. The focus of this periodic review is on consistency with changes to state law made since its adoption in 2011. The review also will address consistency with the city's comprehensive plan and development regulations. The goal is to adopt the updated SMP by June 30, 2019. The city's periodic review proposes to: • Revise or add several definitions. • Incorporate an updated Environmentally Critical Areas Ordinance, repealing the reference to FWRC 15.10 and referencing FWRC 19.145. • Update language consistent with recent changes in state laws and rules. • Add a section on shoreline setback vegetation conservation standards. • Ensure consistency with other city plans and regulations. This decision was made after review of a completed environmental checklist and other information on file with the city. These changes are outlined in the Washington State Department of Ecology SMP Periodic Update checklist. • Updating the SMP to ensure consistency with regulations adopted by the City of Federal Way that affect environmentally sensitive areas and flood hazard areas. • Adding vegetation conservation standards within the SMP to provide clarity for applicants. • Changing bulkhead standards to be the minimum necessary to afford relief from the existing requirement to be a maximum height of one foot above the elevation of mean higher high water on tidal waters. This includes the waters and all land within 200 feet landward of the ordinary high-water mark (OHWM) of the Puget Sound, Steel Lake, North Lake, and the northwest portion of Lake Killarney within city limits, as well as Star Lake, Lake Dolloff, Lake Geneva, Five Mile Lake, and the remaining portion of Lake Killarney within the city's Potential Annexation Area and associated wetlands of all of the waterbody's listed above. Refer to Exhibits A, B, and C for SMP jurisdiction. 12. Location of the proposal. Give sufficient information for a person to understand the precise location of your proposed project, including a street address, if any, and section, township, and range, if known. If a proposal would occur over a range of area, provide the range or boundaries of the site(s). Provide a legal description, site plan, vicinity map, and topographic map, if reasonably available. There is a variety of terrain located within the SMP jurisdiction, but the steepest slope is estimated in excess of 40 percent along portions of the Puget Sound shoreline. c. If you know the classification of agricultural soils, specify them and note any agricultural land of long-term commercial significance and whether the proposal results in removing any of these soils.
