ENVIRONMENTAL CHECKLIST
Purpose of Checklist:
The State Environmental Policy Act (SEPA), Chapter 43.21C RCW,, requires all governmental
agencies to consider the environmental impacts of a proposal before making decisions. An
environmental impact statement (EIS) must be prepared for all proposals with probable
significant adverse impacts on the quality of the environment. The purpose of this checklist is
to provide information to help you and the agency identify impacts from your proposal (and to
reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide
whether an EIS is required.
Instructions for Applicants:
This environmental checklist asks you to describe some basic information- about our proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of
your proposal are significant, requiring preparation of an EIS. Answer the questions briefly,
with the most precise information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most
cases, you should be able to answer the questions from your own observations.or project plans
without the need to hire experts. If you really do .not know the answer, or if a question does
not apply to your proposal, write "do not know" or "does not apply." complete answers to the
questions now may avoid unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and, landmark
designations. Answer these questions if you can. If you have problems, the governmental
agencies can assist you.
The checklist questions apply to all parts of your proposal, even if you plan to do them over a
period of time or on different parcels of land. Attach any additional information that will help
describe your proposal or its environmental effects. The agency to which you submit this
checklist may ask you to explain your answers or provide additional information reasonably
related to determining if there may be significant adverse impact.

Complete this checklist for non -project proposals, even though questions may be answered "does

A. BACKGROUND:
The proposed action is to construct two one story wood frame
buildings totalling 5,000 square feet for use as garages (twenty
five individual garage units) on a 3.04 acre parcel developed with
three apartment buildings. SEPA review is required because the
proposal is greater than 4,000 square feet in area. Analysis of
the proposal is based on the submitted drawings, hydrology report
revised 6/19/89 for the parent apartment development, Level One
Downstream analysis dated 3/25/94 and environmental checklist.
B. ENVIRONMENTAL ELEMENTS:
1. Earth: The site is presently developed as a three building
apartment complex. The 1973 USDA Soil Conservation Service's
(SCS) 'Soil Survey for the King County Area' classifies the
soils as Alderwood gravelly sandy loam (AgC). The erosion
hazard is slight to moderate.

Surface Water: As with all paved, developed areas, the site

A Level 1 Downstream Analysis dated 3/25/94, was prepared for
the site by AHR and reviewed by the Public Works Department.
Storm drainage facilities are required to be designed in
accordance with all applicable Core and special Requirements
outlined in the 1992 King County Surface Water Design Manual
(KCSWDM), as well as the recommendations of the Hylebos Creek
and Lower Puget Sound Basin Plan.
The site is located in the West Branch Hylebos Creek Sub -
Basin, as identified in the Hylebos Creek and Lower Puget
sound Basin Plan. The plan recommends storm drainage
enhancements to adequately mitigate the effects of development
on water quality, flooding, and downstream erosion.
Specifically, basin wide recommendation BW-2 calls for the use
of the 7-day storm event in sizing the required detention
facilities for the development, as o

Based on the above policies, plans, and recommendations, the
following mitigation measure should be required to minimize
identified potential adverse impacts on the environment:
A. Surface water detention facilities on the site
shall be designed in accordance with the 1992 Ring
County Surface Water Design Manual (RCSWDM), except
that a 7-day storm event shall be used in sizing
the required detention facilities for the
development, as opposed to the standard 24 hour
event used in the RCSWDM. Additionally, a 30
percent safety factor is not required in sizing the
facilities.
4. Plants: Concur with checklist. A landscape plan, prepared to
FWCC requirements, is required as part of the Site Plan
application.
5. Animals: Concur with checklist.
6. Energy and Natural Resources: Energy provisions for the
development will conform to applicable local, state and
federal regulations as part of the site plan review
application.
7. Environmental Health: Noise levels will increase on a short
term basis during construction activity. These will be
controlled by required conformance with local noise ordinances
that regulate hours of construction. An increase in noise
levels due to traffic generated by the development is expected
on a long term basis. Required landscaping along all site
perimeters will buffer these noise levels. No further
mitigation is required.
8. Land and Shoreline Use: The site is zoned RM2400. The city
Comprehensive Plan designation is High Density Residential.
The development proposal will be compatible with adopted city
regulations through review of the Site Plan application.
Relevant FWCC building setback requirements will be insured
during the Site Plan review. A Lot Line Elimination is not
required, all building setbacks will be met.
9. Housing: Concur with checklist.
10. Aesthetics: Concur with checklist.
11. Light and Glare: Concur with checklist.

12. Recreation: Concur with checklist.
13. Historic and Cultural Presentation: Concur with checklist.
14. Transportation: The site abuts SW 356th Street. Primary
access is provided via 23rd Avenue Southwest, a private access
road located on the easterly of two lots composing the
development. No right-of-way improvements are necessary with
the site plan application. No transportation impacts are
anticipated.
15. Public Services: No increase in public services is necessary
for the development proposal provided all applicable City and
affected agency design requirements, including King County
Fire District #39, are met. The project will comply with
relevant fire protection and emergency access requirements
with the Site Plan application. No further mitigation is
necessary.
16. Utilities: A Developer Extension Agreement may be necessary
if water service extensions are required with the Site Plan
application. No further mitigation is necessary.
C. CONCLUSION:
The proposal can be found to not have a probable significant
adverse impact on the environment, provided that the following
condition is properly implemented pursuant to a Mitigated
Determination of Nonsignificance (MDNS).
Conditions of the MDNS are based upon impacts identified within the
environmental checklist, attachments, and the above 'Final Staff
Evaluation for Environmental Checklist Application #SEP94-0008, and
are supported by plans, policies and regulations formally adopted
by the City for the exercise of substantive authority under SEPA to
approve, condition, or deny proposed actions.
The City reserves the right to review any future revisions or
alterations to the site or the proposal in order to determine the
environmental significance or non -significance of the project at
that point in time.

In response to your letter of May 19th (copy attached) regarding
waiver of the level 1 downstream analysis and water quality
requirements for your project, we have the following comments to
offer:
1. Since your project proposes to increase the existing
impervious area of the overall site by more than 5000 square
feet, the 7 core and 12 special requirements of the King
County Surface Water Design Manual need to be addressed. Your
engineer has already provided us with a written narrative on
these requirements along with a level 1 downstream analysis.
2. The existing storm drainage system serving the site does not
conform to current treatment standards for water quality
control and must be retrofitted accordingly. Copies of the
appropriate City Code Sections (22-330, 22-1196 & 22-1198)
are attached for your information. As indicated in the
Planning Department's letter of October 18, 1993, the use of
Best Management Practices (biofiltration swales or filter
strips) was specified as a means to address the water quality
issue.

THE GARAGES MORE THAN ONCE A DAY EACH WAY. AVERAGE
DISTANCE TRAVELLED WOULD BE APPROXIMATELY SIXTY-
FIVE FEET.
4. THERE WOULD BE NO ADDITIONAL OIL DRIPPINGS ADDED TO
THE STORM SYSTEM. DRIPPINGS WOULD ACTUALLY BE
DECREASED BECAUSE TWENTY FIVE CARS WOULD NO LONGER
BE PARKING IN THE UNCOVERED AREAS.
5. THE COSTS OF PROVIDING THE DRAINAGE SYSTEM YOU HAVE
REQUESTED ON TOP OF OTHER CHANGES SUCH AS THE BUILDING
OFFSETS AND MOVING A FIRE HYDRANT MAKES THE ECONOMICS
OF PROVIDING GARAGES FOR LOW TO MODERATE INCOME
TENANTS DIFFICULT TO PROVIDE.

The city Is Development Review Committee examined your site plan application to construct two
garage buildings totalling 5,000 square feet for use by Waverly Apartments tenants. The
committee includes representatives from the Federal Way Water and Sewer, Fire Department,
and staff from the city's land use, public works, and building departments.
The following issues from the committee must be resolved before we can complete the review
of your site plan application. Please provide me your written response to the issues and five sets
of any revised drawings to allow the Committee to complete the review of your application.
Zoning Requirements:
The following issues are from the Land Use Division. Any questions should be directed to me
at 661-4110.
1. Please revise the landscape plan. Landscaping is not allowed in the ten foot wide sewer
easement on the north property line.
2. A swale is proposed on the west side of the westerly garage. Is it to collect roof runoff? If
so, could the runoff be tightlined via roof drains and four inch PVC pipe to the proposed
drainage system, therefore providing sufficient room for required landscaping?
3. Your request to reduce the west property line landscape requirement is approved with the
following conditions:
a. A seven foot wide landscape area planted with Type III landscaping shall be provided
between the proposed garage and west property line and along the north and east
property lines.

This decision is based on two facts. First, you stated the proposed five foot building
setback would be increased to seven feet. Second, Federal Way City Code WWCC)
Section 22-1570(e), allows landscape buffers to be averaged provided at least 50 percent
pf the required buffer is provided. The revised building setbacks, after relocation, will
be seven and eleven feet. Required setbacks are only five feet. Seven feet is above the
50 percent. -allowance.
4. The proposed north and east property line landscaping is above that required by the FWCC
and may be reduced. Specifically, the north and east property lines may be planted with a
mix of six foot tall evergreen and 1.5 inch diameter deciduous trees interspersed with 24
inch tall shrubs and groundcover. Tree and shrub spacing shall be appropriate for the
species type and provide partial visual separation between land uses. Groundcover shall be
spaced to provide total coverage in three years.
The proposed landscape plan includes a ten foot wide solid Type I evergreen screen (trees
at 7.6 feet on center) with groundcover along the north and east lines.
Public Works'
The following requirements are from the city's Public Works Department. Questions should be
directed to Skip Tullock, Engineering Plans Reviewer, at 661-4132.
1. Please have your engineer address, in the drainage calculations, the Hylebos Creek and
Lower Puget Sound Basin Plan requirements with regard to stormwater flows.
2. The improvement plans must be amended to include curbing around all new pavement
edges.
3. An oil/water separation structure must be installed ahead of the swale and shown on the
plans (in accordance with core requirement 4 of the King County Surface Water Design
Manual) because a biofiltration swale is being provided in lieu of a filter strip.
4. The elevations on the plans must be adjusted to conform to KCAS or NGVD-29 datum.
5. The plans must be amended to include a roof drain along the west side of the westerly set
of garages.
King Count Fire De artment:
King County Fire provided the attached memo addressing emergency access and fire hydrant
requirements. Specifically, the proposed emergency vehicle turn -around must be revised to meet

Mr. Don Vandenheuvel, owner of Waverly Apartments, filed a Site
Plan application to construct two one story wood frame building
totalling 5,000 square feet for use as garages (twenty five
individual garage units) on a 3.04 acre parcel developed with three
apartment buildings.
Issues for the Site Plan application are listed below. I have no
SEPA comments.
1. The site plan shows a ten foot wide sanitary sewer easement
along the north line. If so, landscaping is not allowed in
the easement.
2. Roof gutters and a swale are proposed on the west side of the
garages. Is the swale necessary, can the runoff be tightlined
via a four inch PVC pipe to the drainage system? This area is
needed for required landscaping.
3. Landscaping: Specific landscaping is required by FWCC Section
22-1566 (ic) (3) . Ten feet of type 3 landscaping (partial
visual separation via trees shrubs and groundcover) is
required between the proposed garages and west property line
and the north and east property lines.
The proposed landscape plan shown a ten foot wide type 1 solid
evergreen screen (trees at 6.25 feet on center) between the
garage and property line and a solid type 1 evergreen screen
(trees at 7.6 feet on center) with groundcover along the north
and east lines.
Mr. Vandenheuvel filed a administrative modification to
decrease the ten foot width requirement to five feet between
the garage and west property line and plant it with
groundcover (pygmy barberry plants) at two feet on center)
because of the swale takes up five of the required teen feet,
be a fire hazard as the required trees would be tight against
the building and be an attractive nuisance for kids. Mr.
Vandenheuvel also proposed moving the garage two feet further
from the west property line for a setback of seven and 11
feet.
Recommendation: FWCC requires 10 feet of Type 3 landscaping
(mix of evergreen and deciduous trees, large shrubs and
groundcover) to provide partial visual screening between
properties. There is no existing landscaping to augment the
proposed landscaping.
I recommend:
a. seven foot wide landscape area be provided between the
garage and property line. This recommendation is based
on FWCC 22-1570(e) which allows a buffer to be averaged
provided at least 50% is provided. Proposed building
setbacks will be seven and it feet and building setbacks
are only five feet). Seven feet is above the 50 %
allowance.
This area should be planted with a mix of six foot tall
evergreen or 1.5 inch diameter deciduous trees at 20 feet
on center, 24 inch tall shrubs at a suitable spacing and
groundcover to provide 100 percent coverage in three
years. This type 3 screen is less than that proposed by
the applicant.

WATER SUPPLIES FOR FIRE PROTECTION
When any portion of the facility or building protected is in excess of 150 feet from
a water supply on a public street, as measured by an approved route around the
exterior of the facility or building, on site fire hydrants and mains capable of
supplying the required fire flow shall be provided. [UFC 10.4011
When exposed to vehicular damage, fire hydrants shall be suitably protected. [UFC
10.105d]
Hydrants shall not be obstructed by any structure or vegetation, nor shall the
visibility of the hydrant be impaired for a distance of 50 feet in the direction of
vehicular approach to the fire hydrant. [Administrative Policy 10.0041
Fire hydrant locations are subject to the approval of the Fire Marshal or his/her

Existing fire hydrants on public streets are allowed to be considered as available for
the project. Existing fire hydrants on adjacent properties shall not be considered

Plans for fire apparatus access roads shall be submitted to the fire department for
review and approval prior to construction.

During construction, an all-weather fire department access roadway is required
when any portion of an exterior wall of any facility, building or portion of a building
is more than 150 feet from a fire department access roadway. [UFC 10.2031
EXCEPTION: provisions for a sprinklered building.
All fire department access roadways shall be constructed of an all-weather surface
capable of supporting a 25 ton vehicle; the maximum roadway grade shall not

All fire department access roadways shall have (1) a clear and unobstructed width
of not less than 20 feet, (2) an overhead clearance of not less than 13 feet six
inches, (3) all turns or bends shall be designed at not less than a 32 foot inside and

All fire department access roadways which have dead ends exceeding 150 feet
shall be provided with a cul-de-sac at the dead end. All such cul-de-sacs shall be

Designated fire lanes may be required for emergency access. This may be done
during the plans check or after the facility is in operation.

When required, approved signs or other approved notices shall be provided and
maintained for fire apparatus access roads to identify such roads and prohibit the

PROBLEMS WITH KIDS AND UNDESIRABLES.
I REQUEST THE CITY ALLOW US TO ELIMINATE THE RETAINING WALL MOVE
THE BUILDINGS TWO FEET EAST (SEVEN FEET FROM THE PROPERTY LINE) AND
LANDSCAPE AND STABILIZE THE SLOPE WITH TWO GALLON SIZE PYGMY
BARBERRY PLANTS PLANTED ON TWO FOOT CENTERS. THIS SLOPE VARIES IN
HEIGHT BETWEEN THREE AND FIVE FEET. THERE IS A FIVE FOOT FENCE ON
THE PROPERTY LINE AT THE TOP OF THE SLOPE.
USING THE TYPE OF PLANT INDICATED WOULD SUBSTANTIALLY ELIMINATE THE
PROBLEMS INDICATED ABOVE. THE SLOPE WITH NO VEGETATION APPEARS TO
BE VERY STABLE. THE GARAGES WILL HAVE THE PITCH OF THE ROOF REDUCED
SO THE OVERALL HEIGHT WILL BE APPROXIMATELY TEN FEET. THIS WILL
MAKE THE ROOF RIDGE ELEVATION ABOUT THE SAME AS THE FENCE SO THAT
THE BUILDINGS SHOULD BE REASONABLY UNOBTRUSIVE TO THE PROPERTY ON
THE WEST SIDE OF OUR PROPERTY.

Subject: A Statement of Design Intent
Dear Mr. Kingman:
It is the owners intent to develope the northerly 35,200 S.F. of his
property known as the Waverly Apartments. He Plans to build two
separate buildings used for private garages. Building "A" along the
west property line will consist of 15 individual, 10 foot wide units,
1-story in height and be 3,000 S.F. in area. Building "B" further to
the east, will consist of 10 individual, 10 foot wide units, 1-story in
height and be 2,000 S.F. in area.
Both buildings will be wood framed constructions, type V-N, non
sprinklered and out of similar materials and colors to match the
existing adjacent apartments on the site, (i.e. composition shingle
roofing @ 6/12 slope, and vertical. siding). All work to comply with
the 1991 Uniform Building Code and all Local Ordinances.
Between the building and the asphalt maneuvering areas we will be
covering approximately 61% of the site with impervious materials. We
will also be adding landscaping along the west and north property
lines.

It has became apparent through our recent conversations with Mr. Tullock that the City's new
drainage standards will make the proposed garages economically infeasible. Skip has
suggested we write you a letter outlining our client's dilemma and proposing a solution that
would meet as many criteria as possible, both the City's and our client's.
For your background information, the existing onsite detention system for the Waverly
Apartments site was designed and approved in 1986. King County criteria at that time called
for a 10-year storm with a 10-year release rate, using the Rational Method for calculating flows
and the Y & M Method for calculating detention volumes. However, the allowable outflow rate
was reduced from 2.3 cfs to 1 cfs to protect a 12" storm line downstream in 356th Street. In
effect, this resulted in a 10-year storm with a 2-year release rate under the old methods.
The calculated storage volume was 2,940 cubic feet, which was installed in Phases 1 and 2 of
the Waverly Apartments project. Even though Phase 3 was not built (the northernmost
planned building and parking lot), all the required detention was installed in Phase 2 because
the detention was to be provided under the access road, which had to be completed in its
entirety as a condition of approval for Phase 2. It was completed in 1988.
Based on relative areas, about 745 cubic feet of the 2,940 cubic feet of storage provided was
intended for Phase 3.
As mentioned above, Phase 3 was never built. The current proposal for 25 garage units has
2,800 square feet less impervious area (or about 11%) than the previously approved Phase 3.
Under the new drainage regulations, detention would have to be provided for a 100-year 7-day
storm, or about 4,000 to 5,000 cubic feet of storage. The only place left to put all this
detention is under the road, since the site is long and narrow and slopes naturally to the road.
Unfortunately the road has already been built to current standards and is located over the
existing detention system, which was designed, approved and built to satisfy the requirements
of a previous master plan. We feel it would be an unfair burden on our client to require that
the existing road and detention system be removed and replaced as necessary to provide the
volume. In the interest of fairness and economic feasibility, we would like to propose the
following drainage improvements for the garages:

1. Provide oil/water separation facilities upstream from the biofiltration swale as required
by City standards (this would consist of a Type 2 manhole with a tee, and would be
followed downstream by another tee in the control structure to be built for a new
storage pond, and another tee in the existing control manhole near the south end of the
site).
2. Provide a shorter biofiltration swale than the one shown on the current plans, but which
would have at least 7 minutes of residence time. Coupled with the wet pond (#5
below) this should meet City standards for treatment.
3. Provide detention for a 10-year storm with a 2-year release rate for the garages and
their aisles, using SBUH methods.
4. Allow a credit of 745 cubic feet of required detention for the volume already provided
for the area in the existing detention system.
5. Make up the difference in storage volume (about 1,750 cubic feet) in a single -cell wet
pond/detention pond to be built at the downstream end of the currently proposed
biofiltration swale. The pond would have Kelley -Block walls to provide maximum
storage volume in the space available.
6. Provide a standard control manhole downstream from the wet pond/detention pond to
control the flow prior to release to the existing detention system.
in our opinion these measures will provide more than adequate stormwater treatment and will
provide an equitable amount of additional detention. We ask that you consider our proposal
as a reasonable and practical alternative to strict compliance with the code, which is unfeasible
for this small project. If you have any questions or need additional information, or if you would
like to suggest modifications to our proposal, please give us a call.

Dear Mr. Vandenheuvel:
In response to your letter of May 19th (copy attached) regarding
waiver of the level 1 downstream analysis and water quality
requirements for your project, we have the following comments to
offer:
1. Since your project proposes to increase the existing
impervious area of the overall site by more than 5000 square
feet, the 7 core and 12 special requirements of the King
County Surface Water Design Manual need to be addressed. Your
engineer has already provided us with a written narrative on
these requirements along with a level 1 downstream analysis.
2. The existing storm drainage system serving the site does not
conform to current treatment standards for water quality
control and must be retrofitted accordingly. Copies of the
appropriate City Code Sections (22-330, 22-1196 & 22-1198)
are attached for your information. As indicated in the
Planning Department's letter of October 18, 1993, the use of
Best Management Practices (biofiltration swales or filter
strips) was specified as a nteans to address the water quality
issue.

The city's Development Review Committee examined your site plan application to construct two
garage buildings totalling 5,000 square feet for use by Waverly Apartments tenants. The
committee includes representatives from the Federal Way Water and Sewer, Fire Department,
and staff from the city's land use, public works, and building departments.
The following issues from the committee must be resolved before we can complete the review
of your site plan application. Please provide me your written response to the issues and five sets
of any revised drawings to allow the Committee to complete the review of your application.
Zon ig Requirements:
The following issues are from the Land Use Division. Any questions should be directed to me
at 661-4110.
1. Please revise the landscape plan. Landscaping is not allowed in the ten foot wide sewer
easement on the north property line.
2. A Swale is proposed on the west side of the westerly garage. Is it to collect roof runoff? If
so, could the runoff be tightlined via roof drains and four inch PVC pipe to the proposed
drainage system, therefore providing sufficient room for required landscaping?
3. Your request to reduce the west property line landscape requirement is approved with the
following conditions:
a. A seven foot wide landscape area planted with Type III landscaping shall be provided
between the proposed garage and west property line and along the north and east
property lines.

This decision is based on two facts. First, you stated the proposed five foot building
setback would be increased to seven feet. Second, Federal Way City Code (FWCC)
Section 22-1570(e), allows landscape buffers to be averaged provided at least 50 percent
of the requjzed buffer is provided. The revised building setbacks, after relocation, will
be seven a� elegy ipet.r Nuired setbacks are only five feet. Seven feet is above the
50 percent allow ,
4. The proposed north and east property line landscaping is above that required by the FWCC
and may be reduced. Specifically, the north and east property lines may be planted with a
mix of six foot tall evergreen and 1.5 inch diameter deciduous trees interspersed with 24
inch tall shrubs and groundcover. Tree and shrub spacing shall be appropriate for the
species type and provide partial visual separation between land uses. Groundcover shall be
spaced to provide total coverage in three years.
The proposed landscape plan includes a ten foot wide solid Type I evergreen screen (trees
at 7.6 feet on center) with groundcover along the north and east lines.
Public Works.'
The following requirements are from the city's Public Works Department. Questions should be
directed to Skip Tullock, Engineering Plans Reviewer, at 661-4132.
1. Please have your engineer address, in the drainage calculations, the Hylebos Creek and
Lower Puget Sound Basin Plan requirements with regard to stormwater flows.
2. The improvement plans must be amended to include curbing around all new pavement
edges.
3. An oil/water separation structure must be installed ahead of the swale and shown on the
plans (in accordance with core requirement 4 of the King County Surface Water Design
Manual) because a biofiltration swale is being provided in lieu of a filter strip.
4. The elevations on the plans must be adjusted to conform to KCAS or NGVD-29 datum.
5. The plans must be amended to include a roof drain along the west side of the westerly set
of garages.
King County Fire De artment:
King County Fire provided the attached memo addressing emergency access and fire hydrant
requirements. Specifically, the proposed emergency vehicle turn -around must be revised to meet

access design requirements and an existing fire hydrant at the northeast corner of the property
must be relocated because it is too far from the curb. Questions should be directed to Chris

Federal Way Water an Sewer:
Federal Way Water and Sewer requests you file a Developer Extension Agreement for the fire
hydrant extension. Questions should be directed to Rick Gillmore, Supervisor of Technical

Summary:
