Lot Line Elimination LLE 94-0008 Dear Ms. Venn, As you are well aware Mr. Bill Kingman, Associate Planner, with the City of Federal Way required our Client Mr. Don Vandenheuvel, the Owner of the Waverly Apartment project to file a Lot Line Elimination as a condition of -PRE 93-0057. Please see Item No. 3 under Planning Issues in his letter dated November 19, 1993. Our firm filed an Application for Lot Line Elimination, The Lot Line Elimination Record of Survey, and a check in the amount of $100.00 for the required filing fee on June 1, 1994 at 12:18 PM (RECEIPT NO. 02-23877). On September 8, 1994 you telephoned Mr. Don Vandenheuvel and stated that you felt the "Legal" descriptions shown on the Lot Line Elimination Plat (Record of Survey) were not correct. Our firm has reviewed the Short Plat Certificate No. 299573 dated March 24, 1994, prepared by Chicago Title Company and found that the legal descriptions for Original Parcel "A" and Original Parcel "B" as shown on the Lot Line Elimination Plat (Record of Survey) due in fact conform exactly to those contained in Short Plat Certificate No. 299573. Our Chief Surveyor, Mr. Lawrence T. Howe, PLS 12460, reviewed the metes and bounds legal description for Revised Parcel "A" and found that it correctly described the perimeter of both original Parcel "A" and Original Parcel "B". Our office then contacted Mr. Mike Harris, Title Officer and Senior Title Examiner for Chicago Title Company in Seattle. He researched the deeds for Original Parcel "A" and Original Parcel "B" and found that they conformed to the Lot Line Adjustment Application LLA 485148 filed by Frank Richter and approved by the King County Building And Land Development Division on May 29, 1985 and recorded under Auditor's file number 8912260187 on December 26, 1989 in the Office of the Pierce County Auditor. FAX (206) 922-0356 On Friday September 16, 1994 our office submitted copies of the Title Report, Lot Line Adjustment Application LLA 485148 and Short Plat No. 978016 to your office to assist you in completing your plan check of Mr. Vandenheuvel's Lot Line Elimination LLE 94-0008. When I spoke to you on the telephone on Thursday, September 29, 1994 you informed me that you felt the legal descriptions were in error. I asked you upon what record information you were basing this statement and you informed me that the King County Assessor's Map showed what appears to be a two foot wide strip of land which extends from the east line of Lot 1 of the Short Plat to the west line of 21st Avenue S.W. I informed you at that time that the King County Assessor's Map was not accurately drawn and was in fact in error. The original legal description for the exterior boundary of King County Short Plat No. 978016 excepts that portion of Government Lot 1 from the Original subdivision (see page 2 of 6) as follows: And except that portion of Government Lot 1, in Section 25, T21 N, R3E, WM. in King County, Washington, described as follows: The north 30 feet of the South 840 feet of the east 437 feet of that portion of Government Lot 1 lying westerly of 21 st Avenue Southwest and north of Southwest 356th Street. It is apparent from the original deeds and the recorded Short Plat No. 978016 that no property lying easterly of the east line of Lot 1 of said Short Plat No. 978016 was to be included in the boundary of the Short Plat. Consequently, we can not incorporate any property in this Lot Line Elimination lying easterly of the east line of Revised Parcel "A". If you are still not certain about this after further examining the attached documents please do not hesitate to contact me as soon as possible.
