Res 05-461 -.- RESOLUTION NO. 05-461 A RESOLlJTION OF THE CITY COUNCIL OF THE CITY O:F FEDERAL WAY, WASHINGTON, ACCEPTING A SHORELINE MASTER PROGRAM GRANT FROM THE WASHINGTON STATE DEPARTMENT OF ECOLOGY IN THE AMOUNT OF $153,000 AND GIVING AUTHORITY TO THE CITY MANAGER TO CONTRACT WITH A QUALIFIED CONSUL T ANT TO ASSIST THE CITY IN UPDATING THE SHORELINE MASTER PROGRAM AS REQUIRED BY STATE LAW. WHEREAS, at the time of incorporation in 1990, the city adopted the King County Shoreline Master Programs (SMP) and in 1998 adopted its own SMP as a component ofthe comprehensive plan and in 1999 adopted associated development regulations; and WHEREAS, the Federal Way City Council adopted its comprehensive plan with land use map (the "Plan") on November 21, 1995, and adopted development regulations and a zoning map implementing the Plan on July 2, 1996; and subsequently amended the comprehensive plan, land use map, and zoning map on December 23,1998, September 14,2000, November 1,2001, March 27, 2003, July 20,2004 and June 16,2005; ill1d WHEREAS, RCW 90.58.080 requires cities in King County to update their SMP by December 1, 2009; and WHEREAS, the Washington State Department of Ecology (DOE) has offered grant awards to jurisdictions that voluntarily agree to update their shoreline master programs by June 30, 2007; and WHEREAS, the city applied for an early adoption grant from DOE in the amount of $153,000.00; and WHEREAS, the city received a grant award from DOE in the amount of $153,000.00; and Res. #05-46 I Page I ---.-- . . WHEREAS, by accepting the grant award, the city agrees to complete the update to the SMP by June 30,2007; and WHEREAS, stafT has determined that due to the technical nature ofthe project, thc services of a qualified consultant are necessary to complete the update; and WHEREAS, the City Council of the City of Federal Way, Washington, has detcrmincd that it is in the best interest and general welfare of the City of Federal Way; and the city's Potential Annexation Area to update the city's SMP; and Now THEREFORE, TIm CITY COUNCIL OF TIlE CITY Of FEDERAL WAY HEREBY RESOLVES AS FOLLOWS: Scction 1. Public Interest. The bcst interests and general welfare of the City of Federal Way and the city's PAA would be served by accepting the SMP update grant in the amount of $153,000.00 and completing an update of the SMP by June 30, 2007. Additionally, the best interests and general welfare of the city and the city's P AA would be served by contracting with a qualified consultant, f(}[ an mnount not to exceed the total grant amount of $153,000.00, to assist the city in updating the SMP. Section 2. Acceptm1ce of Grant. The City Council hereby accepts the SMP update grant in the amount or $153,000.00. Said grant money is to be used to hire a consultant and pay other costs associated with completing an update to the city's SMP by June 30, 2007. Section 3. Authorization to I-lire Consultant. The City Manager is hereby authorized to enter into an agreement with a qualified consulting lirm to assist the city in updating the SMP by June 30, 2007. Section 4. Severability. If any section, sentence, clause, or phrase or this resolution should he held to be invalid or lmconstitutional by a court or competent jurisdiction, such Res. #05-461 Page 2 -. . invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause, or phrase of this resolution. Section 5. Ratification. Any act consistent with the authority, and prior to the effcctive date, of the resolution is hereby ratified m1d affirmed. Scction 6. Effective Date.
