CALL MEETING TO ORDER Mayor Park called the meeting to order at 7:04 PM. Councilmembers Burbidge, Dovey, Faison, Kochmar, Deputy Mayor Ferrell and Mayor Park present. Councilmember McColgan was excused. MOTION: Councilmember Faison moved to amend the Agenda to add Property Acquisition for Executive Session pursuant to RCW 42.30.110(1)(b). Councilmember Dovey second. The motion carried 6-0. 2. PLEDGE OF ALLEGIANCE Councilmember Burbidge led the flag salute which was followed by the National Anthem. performed by the FederalW ay Chorale. 3. PRESENTATIONS a. Proclamation - Don Barrows - Federal Way Chorale Councilmember Burbidge presented Don Barrows, Director ofthe Federal Way Chorale, with a proclamation which proclaimed May 20,2006 as Don Barrows Day in the City of Federal Way. Mr. Barrows thanked the Council and the Chorale. b. Proclamation - Public Works Week Councilmember Dovey presented the Public Works Department with a proclamation which proclaimed May 21-27,2006 as Public Works Week in the City of Federal Way. Public Works Director Cary Roe thanked the Council and gave a brief presentation detailing the services provided by the department. c. Presentation - Parks and Recreation Commission Certificates of Appointment Councilmember Burbidge presented Certificates of Appointment to the Parks and Recreation Commission to the following: Charles Purdom, David Talcott, Helen Stanwell (Alternate) and Carol Otto (Alternate). Both Ms. Stanwell and Ms. Otto were present to accept their certificates. d. Presentation - Ceremonial Swearing-in of Officer Justin Wilson City Clerk Laura Hathaway presided over the swearing-in of Officer Justin Wilson. e. Presentation - King Co. DOT - Executive's Proposal for Transit Now! King County Department of Transportation General Manager Kevin Desmond presented the Executive's Proposal for Transit Now, stating that this initiative will increase the transit sales tax by one-tenth of one percent and allow Metro to keep pace with growth. Mr. Desmond entertained Council questions. Councilmember Kochmar stated the City needs collector bus service to take people from their neighborhoods to the transit center. Councilmember Burbidge agreed with Councilmember Kochmar and also asked about the potential of connecting Rapid Ride Rapid Transit with Pierce County. Councilmember Dovey asked for more information on how the partnership program will work. Mr. Desmond stated the Transit Now proposal goes to the King County Council in June and he will then have more information regarding the partnership formula; however, it is their assumption that the partnership program will go into effect in the third or fourth year of the program to allow cities to include it in their budgets. Councilmember Faison asked about the allocation formula and how it relates to the partnership program. Mr. Desmond responded that the allocation formula is currently 40/40/20, meaning for every new service hour added, 40% goes to the East Sub-area, 40% goes to the South Sub-area and 20% goes to the West Sub-area. He stated that the partnership program will not be allocated to this program. L'i Mr. Desmond will take Council's comments back to the King County Council. f. City Manager -Emerging Issues: . 21 st Avenue SW Neighborhood Traffic Safety Update Traffic Engineer Rick Perez provided a chronological outline showing when traffic calming measures were first discussed with area residents and stated that the speed study suggests the speed tables have been effective. 4. CITIZEN COMMENT Jeff Ouinnell- spoke in support ofthe traffic calming measures on 21 st Avenue SW and said they have been effective. He disagrees with citizen comments regarding traffic safety in the neighborhood made at the previous Council meeting. Joey Kaye - voiced her concerns over an in-home daycare and the resulting parking problem in her neighborhood. She submitted photographs to illustrate the parking issue. Kevin Morris - spoke in support of making French Lake Park a permanent off-leash dog park and asked that the proposed dangerous dog ordinance address punishing the dog owners vs. the dogs. Harrell Hursy- spoke in support of making French Lake Park a permanent off-leash dog park and reviewed several improvements made to the off-leash section of the park including gates and signs which post the rules, etc. Nancy Combs - stated her opposition to the traffic safety improvements on 21 st and stated they are not working. Evelyn Castellar - spoke regarding property rights, referred to the Hearing Examiner's decision regarding her land use case, and submitted a list of city staff members. Craig Woods - thanked supporters of the French Lake off-leash dog park and asked the Council to make it a permanent off-leash park. Gayla Hardison - spoke in regards to panhandling and tent cities. She inquired about the City's liability should anything happen on the site of a tent city. Also asked what recourse the City has if the King County 320th Library is moved against the City's wishes. Frosty Hardison - concurred with Mrs. Hardison. Elizabeth Hardison - spoke in regards to panhandling in the City. H. David Kaplan - spoke in support of volunteers and fundraising efforts regarding parks and supports the off-leash dog park at French Lake Park. Jill Payne (Comments read into the record by City Clerk) - voiced concerns regarding graffiti throughout the City and an unlicensed day-care and the resulting parking . problem in her neighborhood. . , Councilmember Kochmar asked for an internal report on the Castellar issue, the unlicensed daycare/parking issue, the graffiti issue and the tent city. Interim City Manager Matheson stated he would report back to the Council on these issues. Councilmember Dovey invited Ms. Castellar to a future Land Use/Transportation Meeting in order to engage in a better dialogue by allowing for 10-15 minutes on the agenda. Councilmember Dovey stressed that this would be dialogue on the property issue only. 5. CONSENT AGENDA a. Parks Maintenance Contract - Approved MOTION: Councilmember Dovey moved approval of the Consent Agenda as presented. Deputy Mayor Ferrell second. Motion carried 6-0. 6. INTRODUCTION ORDINANCE a. Council Bill #405 - Transportation Concurrency Ordinance AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, CREATING CHAPTER 19, ARTICLE N, "TRANSPORTATION I CONCURRENCY MANAGEMENT." I City Clerk Laura Hathaway read the Ordinance Title into the record. I, MOTION: Councilmember Dovey moved the Ordinance to second reading/enactment on the june9,'2006 Council Agenda. Councilmember Burbidge second.~The motlon.carried 6-0. I . 7. COUNCIL BUSINESS I a. Selection of V oting Delegates for A WC Annual Business Meeting MOTION: Mayor Park moved to select Councilmembers Faison, Kochmar and himself as voting members to the A WC Annual Business Meeting. Councilmember Dovey second. The motion carried 6-0. 8. CITY COUNCIL REPORTS Councilmember Dovey reported the next Land Use/Transportation Committee Meeting is scheduled for June 5, 2006. Councilmember Burbidge reported on the Advancing Leadership Youth Program Graduation, upcoming theatre events, and the Consejo Counseling Services ground breaking ceremony that will take place at City Hall on May 24, 2006. Councilmember Kochmar thanked staff for their efforts on the Volunteer Dinner, reported on the Suburban Cities Policy Issues Committee and stated that on June 28, 2006 Council and staff attending the A WC Annual Conference will meet with our legislators at the networking dinner. Councilmember Kochmar also reported that the Farmer's Market is now open each Saturday and the next Finance/Human ServicesIRegional Affairs Committee meeting is scheduled for May 23, 2006 at 5:00 followed by a Council Study Session on the budget at 6:00 PM. Deputy Mayor Ferrell also thanked staff for their efforts with the Volunteer Dinner and stated that at the ParksIRecreation/Public Safety Committee two important issues were discussed that will soon come before the City Council: domestic violence and dangerous dog legislation. ------------ - ---_._~._-_._-~- Mayor Park also thanked staff for putting together the Volunteer Dinner and thanked the many volunteers that serve the City. Mayor Park reported that Council met in Executive Session with Waters-Oldani Recruiting to review 12-14 applications for City Manager. Council has scheduled another Executive Session on June 7, 2006 to further narrow the applicant pool to 5-6 candidates and those candidates. Those candidates will be invited to the Special Meeting/Public Forum on June 16 &17, 2006. 9. CITY MANAGER REPORT Interim City Manager Matheson reported that on June 1,2006 at 3:00 PM there will be a press conference to thank our Federal Legislators for their efforts in obtaining over $100 million toward funding the Triangle Project. By construction that amount will be closer to $160 million. U.S. Senator Patty Murray, U.S. Representative Adam Smith and U.S. Representative Dave Reichert have all confirmed their attendance. Mr. Matheson also reported that on May 20,200632 City staff members will participate in Relay for Life. Thus far they have raised over $3,000 in the fight against cancer. Lastly, he reported that the Executive Session is expected to last approximately one hour with no action. Council adjourned to Executive Session at 9:05 PM. 10. EXECUTIVE SESSION a.
