''American Association of University Women Day"
WHEREAS, the future of our nation's productivity and competitiveness
in the global workplace depends on the success of boys and girls, men and women;
and
WHEREAS, the American Association of University Women opens
doors for women and girls and influences public debate on critical social issues such
as education, civil rights, and workplace equity; and
WHEREAS, the American Association of University Women promotes
excellence in academia for women through the improvement. of schools,
communities, and fields of work for the benefit of all; and
WHEREAS, the American Association of University Women is one of the
oldest existing organizations dedicated to promoting education and equity for
women and girls; and
.
WHEREAS, the American Association of University Women celebrates its
12Stb anniversary in 2006; and
WHEREAS, the AAUW of Washington State has advanced its legacy of
leadership on behalf of women and girls in Washington for 104 years;.

1. CALL MEETING TO ORDER
Mayor Park called the special meeting to order at 5:35. Deputy Mayor Ferrell and
Councilmember Dovey were excused. .
Council then divided into two groups to interview the Diversity Commission applicants and
the Planning Commission applicants.
Councilmembers Burbidge and Kochmar, along with Chair Ron Walker, Vice-chair
Jacqueline Piel, ~d City Manager Neal Beets interviewed Diversity Commission
applicants Joyce Cook, Harvajane Brown and Lou Dodson.

Councilmembers McColgan, Faison .and Mayor Park, interviewed Planning Commission
applicants Kevin King, Dini Duclos, Pam Duncan-Pierce, Wayne Carlson, Caleb Allen,
Danny Altzier and Hope Elder.
III. DISCUSSION/DELIBERA TIONS
After interviewing all applicants, Council reconvened as a group to discuss the applicants.
Appointments to the two Commissions will be made at the Regular City Council meeting
immediately following.

Mayor Park called the meeting to order at 6:02 PM. Councilmembers Burbidge, Dovey, Faison,

III. 2007-2008 BIENNIAL BUDGET

Management Services Director Iwen Wang reviewed the overall proposed budget including key
revenue projections which identify sales tax, property tax, criminal justice sales tax, and gambling
taxes and reviewed expenditure projections.

Director Kathy McClung presented the Community Development budget in detail.
. Public Works
Director Cary Roe presented the Public Works budget in detail including anticipated projects,
reviewed the City Manager recommended changes/additions and reviewed 2007/2008 Capital

III. 2007-2008 BIENNIAL BUDGET
Department Presentations (Order Revised)
. Parks & Recreation Department - Director Donna Hansen presented the
Parks and Recreation Depa.rt:nlent Budget reviewing key projects completed
in 2005/2006 and anticipated projects for 2007/2008.
. Public Safety ~ Interim Police Chief Brian Wilson presented the Public
Safety Department Budget reviewing department achievements and future
initiatives. Mr. Wilson also reviewed 2007/2008 Budget requests, and
highlighted the additions in service should Proposition 1 pass.
. Law - City Attorney Pat Richardson presented the Law Divisions proposed
budget reviewing near-term challenges, cost reductions and service
enhancements should Proposition 1 pass.
. Municipal Court - Judge Morgan presented the Municipal Court budget
reviewing 2005/2006 key projects; 2007/2008 anticipated projects and the
proposed budget and proposed serviGe enhancements should Proposition 1
pass.

Matthew Jarvis - spoke regarding the budget and the CounCil's goal of public safety. He asked why Pablic .

Lana Bostic - Chair of the Federal Way Arts Commission - spoke to Council about additional funding for the

William Murphv - requested Council table the decision to approve the Lakota Crest Final Plat Approval. He
stated the recent rains have raised concerns about run-off.

d. . Proposed Purchase and Sale Agreement for Cratsenbergl AMC Theater Site
Assistant City Manager Derek Matheson briefed the Council on the proposed purchase and sale agreement for .
the CratsenberglAMC Theater Site stating that the property acquisition is an important part of the City's
downtown redevelopment efforts, and the property would be purchased with the $5 million the City set aside
for public-private partnerships. Mr. Matheson stated the purchase price is $4.1 million and the City will secure
a short-term loan to make the purchase while they decide on a developer. The City will then sell the property
. to the Developer.
Councilmember Dovey was unable to attend the meeting but issued a statement in support of the purchase.
MOTION: Councilmember Faison moved to authorize the City Manager to execute the necessary documents
as approved by the City Attorney, for the purchase of the Cratsenbergl AMC Theater site located at 31600 20th
Ave S. for $4.1 Million Dollars. Councilmember Burbidge second. The motion carried 6-0.
8. CITY COUNCIL REPORTS
Councilmember Kochmar attended an EMS Levy meeting - the levy proposition is scheduled to go before the
voters in 2007. She also reported the next Finance, Human Services, and Regional Affairs Committee meeting
is scheduled for November 28,2006 at 5:30 PM.
Councilmember Burbidge stated the next Parks, Recreation, Public Safety Committee Meeting is scheduled
for November 14, 2006 at 5 :30 PM. She also updated Council on several upcoming transportation meetings
including the State Tran~ortation Improvement Board Meeting hosted by the City at the Aquatics Center on .
November 16th and 17 . Councilmember Burbidge also recognized Ted Enticknap for his Lifetime
Stewardship Award from the Friends of the Hylebos.
Councilmember Faison stated the next Economic Development Committee Meeting is scheduled for
November 21, 2006 at 5 :30 PM. He also reported on the Sister Cities Trip and stated he is hopeful that these
relationships result in some economic development opportunities.
Councilmember McColgan reported on the importance of serving on regional committees and stated that, with
regards to transportation issues, federal'funding for regional transportation projects effects us all even ifthe
money is allocated to another area ofthe region. He also stated that as one of the larger cities in the tri-county
area, Federal Way has an important role in regional issues.
Deputy Mayor Ferrell encouraged citizens to attend the budget meetings and provide their input. He also
thanked the Department Heads for their detailed budget presentations.
Mayor Park also reported on the Sister City Tour and reiterated the importance of these relationships. He also
updated Council on several- upcoming meetings.
9. CITY MANAGER REPORT
City Manager Beets reported that Federal Way had very few incidents during the recent flooding and .
heavy rains; in part due to geography and in part due to our Public Works Staff who were on 24-hour
shifts to make sure storm drains, etc. were functioning.

SUBJECT: Department of Homeland Security Buffer Zone Grant for Wild Waves & Enchanted
Village - approximately $48,000 additional grant
Background
The Fiscal Year 2005 Homeland Security Appropriations Act provided protection action funding
up to $50,000 to protect and secure the critical infi:astructures and key resource sites in Federal
Way. In 2006 Homeland Security made an additional approximately $48,000 available on the
Buffer Zone Grant. Department of Homeland Security has identified Wild Waves & Enchanted
Village as meeting the cIiteria to coordinate a Buffer Zone Protection Plan.
The Buffer Zone Protection Program is designed to reduce vulnerabilities of critical
infrastructure sites by extending the protected area around a site into the surrounding community
and supporting the prevention and preparedness efforts of local first responders.

The additional grant funds would allow the Department to purchase emergency equipment that
will significantly enhance the ability of the Federal Way Police Department to respond to
potential-Chemical, Biological, Radiological, Nuclear, and Explosive (CBRNE) incident(s) at the
Wild Waves and Enchanted Park as well as other critical infrastructures within our city and to .
include other neighboring Puget Sound communities should emergencies arise. The Federal Way
BDU/CBRN Team is part of a regional team, which has the capability of responding to regional
critical incidents.
This is a one time funding and there are no matching funds required to accept this grant.
The Purchasing Plan specifies the emergency equipment that will be purchased with the above
Grant money. Staff is requesting authorization to purchase the equipment as outlined in the
attached Purchasing Plan.

1. Hardware
. Operating at Wild Waves Park presents several difficult issues. The park uses
gravity to power the majority of its rides, thus making most operations occurring
above ground. All bomb and CBRN operations must be able to occur in a high
angel environment. To operate if a safe and efficient manor the additional ofthe '>J'
following items would greatly help. a) Multipod system tri-pod, for fixing high
point for lowering and lifting operations. b) Edge roller system, to protect rope.
c) Rigging plates, ability to attach multiple systems. d) Swivel, reduce rope strain
do to twisting.
2. Rope'Software
Several of the rides at Wild Waves would take a 600' rope to operate on, do to the
height of the ride above ground. For safety reasons all rope systems require two
ropes. Federal Way only has 300' rope at the present time.
3. SCBA.CBRN
Our present SCBA's were purchased on 1992 and are only usable for another year .
(15 year life span). Also they don't meet the new NIOSH CBRN standards.
4. Tools. Remote Openine: Handline:
With the addition of a new Hook and line kit, we will have the ability to remotely
move and clear objects/hazardous devices with out having to endanger anyone.
. 5. Tools. Bomb Disabline:
Our bomb team needs to have the ability to disrupt multiple item(s) at the same
time, to safety the devise. ~
6. Equipment. Victim Evacuation
We could have large amounts victims at Wild Waves. Some of them needing "
rescue from several of the rides that are above ground level. We will need to have
additional stretchers designed for high angle rescues to handle the increased
volume.

SUMMARYIBACKGROUND: On October 3, 2006 the City Manager presented the proposed budget and
related documents at the Council Meeting. Copies of the proposed budget are. available for public review on the
City's website at www.citvoffederalwav.com and on the second floor of City Hall at both the City Manager and
Permit Center lobbies.
The City's Management Team has worked diligently to provide 'a fiscally-sound budget for 2007 and 2008. The
City will conduct three to four budget study sessions on November l, 2, 14 & 16 (if needed) and two public
hearings on November 7 and Zl. Citizen input will be accepted at all special meetings, budget study sessions and

On October 17, 2006, during the public hearing, Council directed the City Manager to direct Staff (1) research whether the
right-of-way vacation could occur if all abutting property owners disagreed; (2) the potential cost to the individuals; (3)
research pedestrian access with the gate and the proposed fence around the entire neighborhood; (4) begin drafting a
maintenance agreement to maintain the infrastructure, and (5) begin drafting criteria for the gate.
The attached document entitled "Campus Estates Right-of-Way Vacation" indicates that all abutting property owners in
Campus Estates must agree to the right-of-way (ROW) vacation. Based upon .the testimony at the public hearing the City
Manager sent a letter to all abutting property owners asking those property owners disagreeing with the prOposed ROW
vacation to respond. To date the City is aware of three property owners who disagree with the ROW Vacation. .

CAMPUS ESTATES RIGHT -OF-WAX V ACA nON
The only means for the City to transfer its right-of-way ("ROW") is through the statutory
method set forth in Title 35.79 of the Revised Code of Washington ("RCW"). The limitation of
the ROW vacation is significant because the vacated portions of the ROW can be traIlsferred only
to the abutting property owners. Consequently, organizations, neighbors or other individuals
generally can not have any legal affect on the vacation unless parcels become landlocked.
Under state statute the vacation can specify or create an easement "for the construction, repair
and maintenance ofpubJic utilities and services." Public utilities are defined to include water,
sewer, and telephone. Cable television is not considered a public utility.
The vacation of the ROW creates an individual property interest for the abutting property
owner. Because the City owns the land in fee, the abutting property owners would need to have
the property surveyed to establish the new legal description for each deed. As with all private .
property, the owner may deny access. Additionally, as mentioned previously, the vacation ofthe
ROW is most likely invalid ifthe result landlocks a parcel ofland. Consequently, in Campus
Estates all abutting property owners need to agree to accept the land from the vacation of the
ROWand also agree to execute a ''travel easement" because there are no alternative ways of
access.
Lastly, state statute gives Council discretion for compensation of the vacated ROW because
the language states the ordinance vacating the ROW "may provide that it shall not become
effective until the owners of the property abutting upon the street.... compensate [the] city . . .
which does not exceed one-half the appraised value of the area vacated." The ROW vacation
ordinance should state the amount of compensation or a formula by which the value will be
calculated.

SUMMARYIBACKGROUND:
Previously, the City Council authorized staff to acquire right-of-way for the South 356th Street at SR 99 Intersection
Improvements Project for fair market value. Staff is currently contacting the property owners to negotiate the
purchases. In anticipation that some or all of the property owners will refuse to'sell because they dislike some aspect
of the project, or because they want more money for their property, staff is requesting that the Council adopt the
attached condenmation ordinance. The ordinance authorizes the City Attorney to commence legal proceedings to . .
acquire the necessary properties by condenmation if the negotiation process fails after a reasonable amount oftirne and
contacts, in order to allow the project to proceed.
Options Considered:
1. Approve to send the condemnation ordinance for South 356th Street at SR 99 Intersection Improvements Project
to the City Council meeting on December 5th, 2006 for second reading.

THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,

DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Public Necessity. The public health, safety, necessity and
convenience demand that right-of-way improvements be constructed and maintained within the
City of Federal Way within the vicinity of South 356th Street and SR99, and that certain real
. property and/or easements upon property be condemned; appropriated, taken and/or damaged .
for the construction of said improvements as provided by this ordinance. .
Section 2. Public Use. The improvements demanded by public health, safety,
convenience and necessity consist of those improvements shown on the Right of Way Plans
dated August 3, 2006, by HDR Engineering, Inc. and on' file with the City of Federal Way, to

after reviewing the planned improvements, hereby declares that the property and/or easements
located within the City of Federal Way, legally described and depicted in Exhibit "A" attached
hereto and incorporated herein by this reference ("Property"), shall be and hereby are
condemned, appropriated, taken and/or damaged for the public use and purpose in installing
right-of-way improvements described in Section 2 above. The condemnation, appropriation,
taking and/or damaging of the Property includes the right to make all necessary slopes for cuts
and fills upon adjacent lands in the reasonable original grading and maintenance ofthe right-of-
. way facilities, as well as. temporary easements to enable construction of said improvements.
Further, the condemnation, appropriation, taking and/or damaging of the Property shall be
subject. to the making of paying of just compensation to the owners thereof in the manner
provided by law.
Section 4. Condemnation Legal Action. The' City Attorney or other attorney
selected by the City Manager is hereby authorized and directed to file all necessary actions and
proceedings provided by law to condemn, take and appropriate the Property in order to carry out
the provisions of this ordinance, and is further authorized in conducting said condemnation
proceedings. and for the purpose of minimizing. damages, to stipulate as to. the use of the
Property and as to the reservation of any right of use to the PropertY owner(s), provided that
.
such reservation does not interfere with the use of the Property by the City as provided in this
ordinance. The City Attorney is further authorized to adjust the location and/or width of any of
the Property and/or easements condemned or taken therein in order' to minimize damages,
provided that said adjustments do not interfere with the use of the Property by the City as
provided in this ordinance.
Section 5. Severability. The provisions of this ordinance are declared separate
and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion
of this ordinance or the invalidity of the application thereof to any person or circumstance, shall
not affect the validity of the remainder of the ordinance, or the validity of its application to other
persons or circumstances.
Section 6. Ratification. Any act consistent with the authority and prior to the
effective date of this ordinance is hereby ratified and affirmed.
Section 7. Effective Date. This ordinance shall take effect and be in force five
(5) days from and after its passage, approval, and publication, as provided by law.

SUMMARY /BACKGROUND: The City Council held public hearings on November 7 and November 21 on the proposed
2007/08 budget and 2007 proposed Property Tax Levy. The 2007 proposed Property Tax Levy is based on the 1%
increase plus new construction and would result in a decrease in the tax rate from $1.22 to approximately $1.14 per
$1,000 of assessed valuation.
. STAFF RECOMMENDATION: Staff reconunends Council approve the attached draft 2007 Property Tax Levy

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
FEDERAL W AY, WASHINGTON, FIXING THE PROPERTY
TAX AMOUNT FOR THE YEAR 2007.
WHEREAS, the City Council ofthe City of Federal Way has met and reviewed all revenue
sources and examined all anticipated expenses and other obligations fotthe 2007/08 biennium; and
WHEREAS, the City Council, in the course of considering the biennium budget, has
conducted public hearings on the proposed property tax levy for 2007, and proposed revenue, and
expenditures for the biennium; and
WHEREAS, the City Council, after hearing and duly considering allrelevaI)t evidence 'and
testiQ10ny presented, determined that it is necessary and advisable to a~thorize an increase in regular
property tax levy consistent with the limit factor prescribed by RCW 84.55.0101 to discharge. the
expected expense and obligations ofthe City.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. LeVY. There shall be and there is hereby levied against the property in the City of
Federal Way, Washington, a municipal regular property ~x for the year 2007 for the purposes of
paying expenses and discharge obligations of the City in the amount of Nine Million, One Hundred
Dollars ($9,100,000).
The levy amount includes (1) an increase in property tax revenue from the previous year of
Eighty-Seven Thousand, Five Hundred and Seven Dollars ($87,507) at one percent (1%), (2) new

construction and improvements to property, (3) any increase in the value of state assessed property,
and amounts authorized by iaw as a result of any annexations that have occurred, as well as
applicable refunds already made.
Section 2. Severability. The provisions of this ordinance are declared separate and severable.
The invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance
or the invalidity of the application thereof to any person or circumstance, shall not affect the validity
ofthe remainder of the ordinance, or the validity of its application to other perSons or circumstances.
Section 3. Ratification. Any act consistent with the authority and prior to the effective date
of this ordinance is hereby ratified and affirmed.
Seotion 4. Effective Date. This ordinance shall take effect and be in force five (5) days from
the time of its final passage, as provided by law.

.FEDERAL WAY, WASHINGTON, EXTENDING AND
INCREASING THE UTILITY TAX RATE TO 7.75% FROM
6% FOR PROVIDING ENHANCED POLICE AND
COMMUNITY SERVICES. (AMENDING ORDINANCE
NOS. 95-257, 96~262, 69-276, AND 02-431).
WHEREAS, RCW 35.21.870 permits cities to levy a tax on the privilege of conducting utili~
businesses such as electrical energy, natural gas, or telephone business; and
WHEREAS, the City's current levy of 6% utility taXes are necessary for the construction of

the community center, for the overlay program, for the ongoing maintenance of the community
center, Knutzen Family Theatre, Celebration Park, continuation of existing city services; and
WHEREAS, at the November 7, 2006 election, the voters of the City of Federal Way .
authorized the City to levy a 1.75% utility tax upon the privilege of conducting an electrical energy,
natural gas, storm drainage, garbage, cable television, cellular and other telephone and wireless'
communication services businesses for the purpose of financing enhanced police and community
safety.
NOW, THEREFORE, THE CITY COUNCIL. OF THE CITY OF FEDERAL WAY,
WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Utility Tax. Chapter 14, Article V, Section 14-173 ofthe Federal Way City Code
is hereby amended to read as follows:

14-173 Occupations subject to tax - Amount.
There are levied upon, and shall be collected from everyone, including the city, on account of
. certain business activities engaged in or carried on in the city, occupation taxes in the amounts to be
determined by the application of rates given against gross income as follows:
(1) Upon everyone engaged in and carrying on a telegraph business, a tax equal to €r.fJ-7.75
percent of the total gross income from such business in the city during the period for which the tax .is
due;
(2) Upon everyone engaged in or carrying on a competitive telecommunication service or
network telecommunication service, a tax equal to €r.fJ-7.75 percent of the total gross income from
such business in the city during the period for which the tax is due. In determining gross income
from such business, including intrastate toll service, the taxpayer shall include 100 percent of the
gross income received from such business in the city;
(3) Upon everyone engaged in or carrying on the business of cellular telephone service, a tax
..1 equal to €r.fJ-7. 7 5 percent of the total gross income from such business in the city during the period
for which the tax is due;
. (4) Upon everyone engaged in or carrying on the business of selling, brokering or furnishing
natural gas for domestic, business or industrial consumption, a tax equal to €r.fJ-7. 7 5 percent of the
total gross income from such business in the city during the period for which the tax is due;
(5) Upon the city in respect to the conduct, maintenance, and operation of its municipal storm

percent ofthe total gross income from the dty during the period for which the tax is due, less income.

channel charges; it does not include leased channel revenue, advertising revenue, or any other

Section 2. Severability. The provisions ofthis ordinance are declared-separate and severable.

SUMMARY !BACKGROUND: The City Manager submitted the City's proposed 200712008 budget to the City Council for
consideration on October 3, 2006. The Council held study sessions on November 1,2 and 14 to review and deliberate on
the proposed budget. Public hearings were held on November 7 and November 21 to allow for citizen comment on the
. City Manager Proposed Budget. In addition, voters of Federal Way approved Proposition One. on November 7 to
increase the utility tax for additional police and community safety services. The attached budget ordinance incorporates
Council changes to the Proposed Budget and Proposition One services

FEDERAL WAY, WASHINGTON, RELATING TO BUDGETS
AND FINANCE,' ADOPTING THE 2007-08 BIENNIAL
BUDGET.
WHEREAS, the tax estimates and budget for the City of Federal Way; Washington, for the
2007-08 fiscal biennium have been prepared and filed on October 3, 2006 as provided by Titles
35A.34 and 84.55 of the Revised Code of Washington; and
WHEREAS, the budget was prInted for distribution and notice published in the official paper
of the City of Federal Way setting the time and place for hearing on the budget and said no.tice
stating copies of the budget can be obtained on-line and at the Office of the City Clerk; and
WHEREAS, the City Council of the City of Federal Way having held publjc hearings on
November 7, and November 21; 2006, and having considered the public testimony presented;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS:

Section 1. 2007-08 Biennial Budget. That the budget for the 2007-08 biennium is hereby
adopted in the amounts and for the purposes as shown on the attached Exhibit A ("2007 and 2008
Adopted Budgets").
Section 2. Administration. The City Manager shall administer the Biennial Budget and in
doing so may authorize adjustments to the extent that they are consistent with the budget approved
herein.
