CALL TO ORDER Committee Chair Kochmar called the meeting to order at 5:30 PM. All members were present. 2. APPROVAL OF MINUTES The June 16,2008 LUTC meeting minutes were approved. Moved: Duclos Seconded: Ferrell Passed: Unanimously, 3-0 3. PUBLIC COMMENT The following public comment was received: Nancy Combs, 30441 21" Ave SW, Federal Way - Ms. Combs commented on the needfor afour-way stop at 21s, Ave SW and SW 304,h St. Bob Kellogg, Federal Way Kiwanis - Mr. Kellogg has recently put out signs for the Kiwanis Salmon Bake. He now realizes that staff has not removed these signs; rather, the signs have been stolen. Of the 50 signs put up, only 10 remain. Mr. Kellogg wants to know if there is a provision in place that protects groups that put out signs as a service to the community. How does the City deal with sign theft? ACM Roe will follow up with Mr. Kellogg and give assistance. Committee Chair Kochmar recommended and Committee Member Duclos supported that a letter to the editor be published concerning the legality of taking signs. Mayor Dovey asked if all signs that appear to be in the right of way are removed. ACM Roe explained that staff removes only those signs that are without a doubt, in the public right of way. Any signs that are questionable are left. Janet Holmes, Federal Way- Ms. Holmes wanted to voice her opinion about the needfor afour-way stop at 21" Ave SW and SW 304,h Street. Ms. Holmes primary concern is for the safety of the children of that neighborhood, walking to andfrom school. Tom Heunisch, S 293rd St, Federal Way - Mr. Heunisch would like the City to take over the maintenance of private storm systems. On a separate note, Mr. Heunisch has noticed that signs have been dumped down the slope off of 1" Ave Sand SW 292"'" Street. 4. BUSINESS ITEMS A. Kim Short Plat Ken Miller provided background information on this item. Committee Member Ferrell asked about the status of installing colored slats in the chain-link fence and if Mr. Madison had been informed of the progress. What, if any, was his response? Mr. Miller answered that although he hasn't spoken to Mr. Madison directly, Mr. Madison has been informed and is satisfied with the outcome. The detention pond is complete with the exception of the slats. ACM Roe confmned Mr. Madison's knowledge of the detention pond completion and the black slats to be installed in the fencing. Sign Code Greg Fewins provided background information on this item. Committee Member Ferrell asked for confIrmation on the following: Signs placed in advance of 30 days prior to or 5 days after a public event would be illegal? Do people need permission from private property owners to place signs? Mr. Fewins answered "yes" to both questions. Committee Member Ferrell felt it would be a hardship to those needing to get permission from private property owners. Committee Member Duclos asked if staked signs would be prohibited in the public right of way. Mr. Fewins answered, "yes". Committee Chair Kochmar suggested organizing a stakeholder group. Although Mayor Dovey would prefer to really look into the sign code issue and understand everything before the Council acts upon it, Committee Member Duclos feels that we should make administrative changes now. Committee Member Ferrell said the bottom line to this issue is really placing signs in the public right of way, and the right of way indirectly belongs to the people of the City. Committee Member Ferrell feels that signage should be allowed in the public right of way, based on reasonable limitations; to do otherwise would infringe on people's freedom of speech. Committee Member Duclos commented that a precedent has been established to put signs in the right of way and feels an obligation to answer the public. Councilmember Burbidge is in favor of banners over the public right of way and also feels an obligation to fmd a solution acceptable to the public. Committee Member Ferrell wants to really examine what other cities do for signage in the right of way. A few minutes was spent looking over an exhibit of the agenda item (provided by Sam Pace) titled "Regulation of Residential (Single-Family) Real Estate Signs". Committee Member Ferrell inquired as to why staked signs would not be allowed in the public right of way. Both Mr. Fewins and ACM Roe commented that there is irrigation along the right of way and stake signs can puncture the irrigation lines. Mr. Fewins added that A-frame signs are being considered for placement in the public right of way, while stake signs would be allowable on private property. Public Comment: Nancy Combs, 30441 21" Ave SW, Federal Way - Ms. Combs commented that she does not like the clutter of signs. Also, what about garage sale signs? Mr. Fewins answered that garage sale signs must also abide by the sign code or they risk being removed Marilyn Gates, 31604 7,h PI SW, Federal Way - Ms. Gates re-read her suggestions, previously presented at both Council and LUTC meetings. Sam Pace, 29839 154,h Ave SE, Kent - Mr. Pace stated his opinion that signs should be allowed in the public right of way and supported his opinion by referencing case law. Mr. Pace also noted some other points: · Realtors are allowed up to ten open house signs; however, through restrictions, most of these signs are taken away. · The City should not require a sign permit for signage in the right of way. Mr. Pace claims that no other city in King Co. requires a permit. · Mr. Pace is in favor of signage in the right of way between sunrise and sunset, because that is when an open house would be occurring anyway. · The City could be liable if they were to remove signs from private property. Mr. Fewins continued by presenting staffs recommendations. Mr. Fewins also asked for clarification from the Committee to make sure staff was proceeding with this item as directed. After much conversation surrounding the many possible routes to take, it was decided to make administrative changes now and draft a sign code amendment allowing for signage in the public right of way, following reasonable guidelines and/or restrictions. Committee Chair Kochmar suggested a public stakeholder group might include representation from the Federal Way Chamber of Commerce, service club members (ie. Kiwanis), South King Co. Realtors, etc. Mr. Fewins asked what should be the priority of drafting a sign code amendment as this will impact the 2008 work plan of the Planning Commission. The Committee directed Mr. Fewins to mover the sign code amendment to the top of the priority list of the Planning Commission's 2008 Work Plan. Forward the "LUTe Administrative Changes" as presented by staff and further explore general access to the general right of way with reasonable restrictions to the August 5, 2008 Council Business Agenda for approval. 2. Direct staff to prepare a code amendment to allow A-frame signage in the public right of way as presented by staff in the "Summary of Performance Standards" to the August 5, 2008 Council Business Agenda for approval. Steel Lake Maintenance North Parking Lot Paving Proiect Award Ken Miller provided background information on this item. There was no discussion. Department of Ecology Interlocal Agreement for Sea Lettuce Removal in Dumas Bay Ken Miller provided background information on this item. Committee Member Duclos inquired as to how the sea lettuce is removed. Mr. Miller responded that this is a pilot project. There are a couple of methods for collecting. The sea lettuce will be removed and studied for possible other uses, such as fuel. Athough a collection method has not been fmalized, the methods being considered will have the least impact to the environment as possible. Mr. Miller added that staff is monitoring Dumas Bay on a regularly scheduled basis for increasing amounts of sea lettuce as well as odor. Council Member Burbidge thanked staff for their efforts in securing funding for this project and asked that Council be kept updated as this project continues. Private Storm Drainage Improvemetns and Maintenance Responsibility Ken Miller provided background information on this item. Mr. Miller stated that there is not much information available on private residential stormwater systems. Committee Chair Kochmar asked if private systems could be dedicated to the City as a way to be maintained by the City. Committee Member Ferrell voiced that the liability and exposure of this idea could be a concern. Public Comment: Tom Heunisch,S 293rd St, Federal Way - Mr. Heunisch asked if the City would consider taking over private stormwater systems if they met certain criteria. Mr. Heunisch also feels there is argument for this from a taxpayer's standpoint as well. In the case of his particular stormwater system, the system has been recently serviced and paid for by the property owners. If the City took over maintenance, the cost for annual upkeep would be minimal. Committee Member Ferrell asked for specifics on cost. Mr. Heunisch said they paid between $2K and $3K to recently have the system serviced. Future maintenance would be between $600- $700 annually. Committee Kochmar asked staff about having residents contract with the City for private system maintenance. Mr. Miller responded that the City contracts out itself for services as the City does not have its own equipment. Mr. Miller will follow up with Mr. Heunisch and get contact information for contractors providing stormwater maintenance services to him. Committee Members Ferrell and Kochmar asked staff to work with Mr. Heunisch to help resolve his problem. Committee Member Duclos recused herself. Any finding deemed to be a conclusion, and any conclusion deemed to be a finding, shall be treated as such. 2. Based on, inter alia, the analysis and conclusions m the Staff Report and Hearing Examiner's recommendation, and conditions of approval as established therein, the proposed subdivision makes appropriate provisions for the public health, safety, and general welfare, and for such open spaces, drainage ways, streets or roads, alleys, other public ways, transit stops, potable water supplies, sanitary waste, parks and recreation, play grounds, schools and schools grounds, and all other relevant facts as are required by City code and state law, and provides for sidewalks and other planning features to assure safe walking conditions for students who walk to and from school. 3. The public use and interest will be served by the preliminary plat approval granted herein. Section 2. Application Approval. Based upon the recommendation of the Federal Way Hearing Examiner and findings and conclusions contained therein as adopted by the City Council immediately above, Eagle Manor preliminary plat, Federal Way File No. 06-106512-00 SU, is hereby approved, subject to conditions as contained in the July 14,2008, Report and Recommendation of the Federal Way Hearing Examiner (Exhibit A). Doc. 1.0. Section 3. Conditions of Approval Integral. The conditions of approval of the preliminary plat are all integral to each other with respect to the City Council finding that the public use and interest will be served by the platting or subdivision of the subject property. Should any court having jurisdiction over the subject matter declare any of the conditions invalid, then, in said event, the proposed preliminary plat approval granted in this resolution shall be deemed void, and the preliminary plat shall be remanded to the City of Federal Way Hearing Examiner to review the impacts of the invalidation of any condition or conditions and conduct such additional proceedings as are necessary to assure that the proposed plat makes appropriate provisions for the public health, safety, and general welfare and other factors as required by RCW Chapter 58.17 and applicable City ordinances, rules, and regulations, and forward such recommendation to the City Council for further action. Section 4. Severability. If any section, sentence, clause, or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause, or phrase of this resolution. Section 5. Corrections. The City Clerk and the codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the correction of scrivener/clerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. Eagle Creek Land and Development, LLC FINDINGS OF FACT, CONCLUSIONS OF LA WAND RECOl\1fMENDA TION RE: 08-106512-00-5 U INTRODUCTION The Applicant requests approval of a preliminary plat to subdivide 3_11 acres into 12 single- family residential lots. The Hearing Examiner recommends approval subject to conditions recommended by staff ORAL TESTIMONY Associate Planner, David Lee, summarized the staff report, including the application and staff recommendation, for the benefit of the public attending the hearing. Ron Hawkins, whose property borders the south side of the project site, testified that the elimination of existing natural boundaries between the two properties will cause an influx of transients and wild animals onto his property. He added that a fence barrier between the properties is needed to keep his children and dogs from wondering into and exploring the subject site. Melinda Diamond, who lives to the west of the project site, expressed her concerns with the timing of the project given the conditions of the housing market She cited examples of projects nearby that clear the land only to allow it to sit barren without any development but for a model home that becomes a target for vandals. Staff explained that the city cannot require fencing under current code, and that would be a private matter between the parties. He added that any clearing of the property at the preliminary plat stage would be limited to minimum needed to add the necessary improvements. Applicant testified that a fence barrier would be incompatible with the silt fencing required; however, eventually perimeter fencing would most likely be installed_ EXHIBITS See list of exhibits on p. (PA070066J.DOC; 1113041900000I1 Preliminary Plat Recommendation Findings, Conclusions and Recommendation Page I of 8 FINDINGS OF FACT Procedural: I. Applicant. Eagle Creek Land and Development, LLC. 2. Hearing. The Hearing Examiner conducted a hearing on the application at 2:00 p.m. at Federal Way City Hall on June 26, 2008. Substantive: 3. SitelProposal Description. Applicant proposes to subdivide 3.11 acres of currently undeveloped land into 12 residential single-family lots, each a minimum of 7,200 square feet. Street improvements, water, sewer, utilities, storm drainage control improvements, and other related infrastructure improvements will be installed to service the plat. The subject property is located on the southwest comer of 21st Avenue SW & SW 344th Street. The site is currently partially wooded with thick shrubbery. A mixture of conifer and deciduous trees are present on the property. There are a total of 36 significant trees on the subject property. The Applicant has proposed to remove 18 of these trees from the interior of the site for infrastructure. City policy and FWCC Section 20-179 state that existing mature vegetation shall be retained to the maximum extent possible. There are no wetlands on site or within 200 feet of the subject property. No wetlands or surface waters are known to exist on or around the property, and no wetlands or streams are identified on the City's environmentally sensitive areas maps. No wildlife species recognized as priority species are known to inhabit the site or the nearby vicinity. With the exception of lots 7 and 8, all of the proposed lots are of rectangular shape. The subdivision is accessed through 22nd Place SW, which connects to SW 344th Street. All lots ace then accessed directly by SW 344th Court. All building setback Jines (BSBL) are depicted on the preliminary plat map, and each lot contains an adequate building area. A 20- foot-wide storm drainage easement runs east to west along the northern property line. The buildable areas are outside of the easement and should not impact the easement. 4. Characteristics of the Area. The land to the east is a developed single-family subdivision called Danville Station with a zoning of RS 7.2. The properties directly north, west, and south are also single-family zoned (RS 7.2) with sparsely developed larger properties. 5. Adverse Impacts. The project has undergone a SEPA review and was issued a DNS. No significant adverse impacts were identified in the record or during public hearing that are not adequately addressed in the recommended conditions to approval, including landscaping, tree retention plan, and other services and improvements identified below. The subject site, however, will not be clear-cut and rendered barren at this stage of development. Tree cutting at the preliminary plat stage is limited to the minimum necessary to permit construction of required improvements. The neighbors certainly expressed some legitimate concerns about impacts, but they can't be addressed through this permitting process. Their issues raise mixed questions of law and fact, (PA0700663.DOC; 1/13041900000/) Preliminary Plat Recommendation Findings, Conclusions and Recommendation Page 2 of 8 but will be addressed in this factual finding for ease of reference. As noted previously, Mr. Hawkins would like the Applicant to construct a fence in order to protect his home from the surrounding area and to keep his children and dogs on site. [n essence. Me. Hawkins assel1s that the Applicant is responsible for the'-'llctions of vandals, and his dogs and children. Constitutionally, the City can only make developers mitigate the adverse impacts they create. Mr. Hawkins is requesting that the Applicant construct a fence to mitigate for the actions of third pal1ies. The City does not have the legal authority to do this. Cel1ain types of construction activities can serve as an attractiv:e nuisance or danger to the public and thereby justify fencing requirements. Deep excavations, for example, adjacent to sidewalks would typically trigger a fence requirement. There is nothing in the record to suggest that the Applicant is proposing any construction activities that would create such a hazard. Ms. Diamond raises a very interesting point about developments going fallow in these difficult economic times. Ms. Diamond's anecdotal comments do suggest that uncompleted subdivisions can create aesthetic blight and attract vandalism. However, in order to consider these impacts on a case by case basis, the economic viability of each project would have to be considered. The City could cel1ainly not condition or deny a project on the basis of lack of marketability if a developer could prove otherwise. Such an analysis is too speculative for permit review. There is cel1ainly insufficient evidence in this record to establish that this Applicant will construct subdivision improvements and then abandon them or delay fUl1her development for several years. Given that developers usually do not have much incentive to make subdivision improvements for lots they cannot sell, it is unlikely that uncompleted subdivisions would be a widespread problem for any significant period of time. If this is or does become a widespread problem, it should be addressed legislatively where economic feasibility can be addressed in a more general, city-wide basis as opposed to project level feasibility. 6. Adequacy of Infrastructure and Public Services. As mitigated by staff, adequate infrastructure will serve development as follows: · Pedestrian System: A sidewalk will be provided along the length of SW 344th Street, 22nd Place SW, and SW 344th COUI1. Specifically, half street improvements include a four-foot wide planter strip, five-foot wide sidewalk, and three-foot-wide utility strip. The Federal Way School District reviewed the plans and had no comments at this time regarding school access paths or configuration. · Subdivision Access and Roadway System: The subdivision is accessed through 22nd Place SW, which connects to SW 344th Street (minor collector). All lots are then accessed directly by SW 344th COUI1. The subdivision does front 21st Avenue SW (al1erial street), but is not directly accessed from 21st Avenue SW. · Street Improvements: With the exception of lots 7 and 8, all of the proposed lots are of rectangular shape. The subdivision is accessed through 22nd Place SW, which connects to SW 344th Street. All lots are then accessed directly by SW 344th Court. The City's Traffic Engineer has reviewed the project and concluded that the proposed {P A0700663.DOC; III 304190000011 Preliminary Plat Recommendation Findings, Conclusions and Recommendation Page 3 of 8 " street layout of the Eagle Manor subdivision is consistent with the adopted codes and comprehensive plan in place at the time of the complete application. Recommendation of approval jssonditioned upon street improvements to meet the code. · Open Space: To provide adequate recreational opportunities commensurate with new residential development, FWCC Chapter 20, "Subdivisions," requires setting aside land on site for open space, or a fee-in-lieu payment The Applicant has proposed the fee-in-lieu option rather than providing on-site open space. The fee-in-lieu of open space shall be calculated on 15 percent of the assessed value of the property based on a current King County assessment at the time of final plat approval. · Fire Protection: Certificate of Water Availability from the Lakehaven Utility District indicates that water will be available to the sitt; in sufficient quantity to satisfy fire flow standards for the proposed development South King County Fire and Rescue requires that a fire hydrant be located within 350 feet of each lot The exact number and location of fire hydrants wiII be reviewed and approved by South King Fire and Rescue. · Schools: As part of the City's initial review of the proposal, the preliminary plat application was referred to the Federal Way School District for comments. Comments from the school district indicate Sherwood Forest Elementary, lIIahee If. High School, and Todd Beamer Senior High School will serve the proposed subdivision. There is school bus transportation to all three schools. The proposed sidewalk from the development should provide safe access to bus stops. The Applicant provided on June 10, 2008, a School Access Analysis (Exhibit 10). The School Access Analysis identifies a safe path of travel for students walking to and from school. Final location and design of the school access path must be approved by the Federal Way School District and the Federal Way Public Works Department prior to issuance of construction permits for infrastructure improvements. School service areas are reviewed annually and may be adjusted to accommodate enrollment growth and new development School impact fees, as authorized by City ordinance and collected at the time of building permit issuance, are currently $4,077.00 per single- family housing unit School impact fees are determined on the basis of the District's Capital Facilities Plan and are subject to annual adjustment and update. · Sewage Disposal: The Applicant proposes to serve the proposed plat by a public sewer system managed by Lakehaven Utility District. A December 29, 2006, signed Certificate of Sewer Availability indicates the District's capacity to serve the proposed development through a Developer Extension Agreement (DEA) between the Applicant and the District. · Water Supply: The Applicant proposes to serve the subdivision with a public water supply and distribution system managed by the Lakehaven Utility District. A {PA0700663.00c; 1/13041.900000I1 Preliminary Plat Recommendation Findings, Conclusions and Recommendation Page 4 of 8 December 29, 2006, signed Certificate of Water Availability (Exhibit 12) indicates Lakehaven's capacity to serve the proposed development. · Drainage Facilities: Developfu~nt of the site will create additional runoff from new impervious surfaces such as streets, driveways, and rooftops. Storm drainage facilities must be designed in accordance with the 1998 King County Surface Water Design Manual (KCSWDM) and the City's amendments to the manual. Detention will be provided by an existing detention pond that serves the adjacent plat to the west, Virginia Hills. This pond will be modified and enlarged so that it can adequately serve both plats. It is located within a City-owned and maintained tract. The Applicant will be dedicating additional property to the City to enlarge the tract. Detention will meet Level I flow control reqUIrements. In addition, due to a downstream conveyance system nuisance flooding problem, the pond will be sized to provide further storage to avoid aggravating the problem. Water quality treatment meeting the Resource Stream Protection menu in the 1998 KCSWDM is also required. The developer proposes a Stormfilter cartridge system to meet this requirement. The system will be sized to meet treatment requirements for both the proposed plat and the plat of Virginia Hills, so it can replace the water quality function of the original pond that will be lost due to the proposed modifications. A landscape tract along the west and south sides of the new stormwater tract will be dedicated to the homeowners' association. The maintenance agreement for the private landscape tract shall be included on the face of the plat and the language shall be approved by the City. Final review of the stormwater quality and detention pond will occur in conjunction with the plat improvement engineering plans. CONCLUSIONS OF LA \V Procedural: I. Authority of Hearing Examiner: Examiner with the authority to conduct Council on preliminary plat applications. FWCC 20-110 (4) and (5) provide the Hearing a hearing and make a recommendation to the City Substantive: 2. Zoning Designation: RS 7.2. 3. Review Criteria and Application. FWCC 20-126(c) governs the criteria for preliminary plat approval. Those criteria are quoted in italics below and applied to the application under corresponding Conclusions of Law. FWCC 20-126(c): Decisional Criteria. The application is subject to the adopted 2003 Federal Way Comprehensive Plan (FWCP), which designates the property as Single Family - High Density. The proposed land use, Single-Family Residential plat, wiih__7,200 square-foot minimum lot size (RS-7.2), is consistent with density allowances and policies applicable to this land use as established in the FWCP. The application is consistent with the following Comprehensi ve Plan Policies: (I) LUPI4: Maintain and protect the character of existing and future single-family neighborhoods through strict enforcement of the City's land use regulations; and (2) LUP 17: Encourage the development of transportation routes and facilities to serve single family neighborhoods. Special attention should be given to pedestrian circulation. FWCC 20-126(c)(2): It is consistent with all applicable provisions of the Chapter, including those adopted by reference from the comprehensive plan: 5. The preliminary plat application is required to comply with the provisions of the FWCC Chapter 18, "Environmental Policy"; Chapter 20, "Subdivisions"; Chapter 22, "Zoning"; and all other applicable codes and regulations. Future development of the residential subdivision will be required to comply with all applicable development codes and regulations. As proposed, and with conditions as recommended by staff, the preliminary plat complies with all provisions of the chapter. FWCC 20-126(c)(3): It is consistent with public health, safety, and welfare. 6. The proposed preliminary plat would permit development of the site consistent with the current Single Family - High Density land use classification of the FWCP and map. Proposed access and fire hydrant locations must meet aJl requirements of South King Fire and Rescue. Sidewalks are proposed to provide safe access to schools and school bus stops. Future development of the plat in accordance with applicable codes and regulations should ensure protection of the public health, safety, and welfare. FWCC 20-126(c)(4): It is consistent with the design criteria listed in FWCC 20-2: FWCC 20-2: This chapter is adopted in furtherance of the comprehensive plan of the City. It is hereby declared that the regulations contained in this chapter are necessary to: ( 1 ) Promote the health, safety and general welfare in accordance with the standards established by the state and the city; 7. As noted in the Washington State Growth Management Act, the Washington State Legislature has found it to be in the public interest to prevent urban sprawl and to promote the efficient use of infrastructure. The development proposed by the Applicant at urban densities meets these objectives. Also, as previously discussed, the project, as mitigated, creates no material or significant adverse impacts and there is adequate infrastructure to meet the needs of the new development. For these reasons, the project promotes the health, safety, and general welfare in accordance with the standards established by the state and the city. As previously noted, the project constitutes development in an area that is already characterized and developed by residential development. Also as previously discussed, the project is served (or as conditioned will be served) by adequate infrastructure. For these reasons, the above criterion is satisfied. FWCC 20-2(4): Provide for adequate light and air. 9. The density of the project meets the density requirements for the RS 7.2 zoning. The Applicant will have to comply with the dimensional requirements of the zoning code for any structures it builds in order to get through building permit review. The dimensional standards of the City's Zoning Code set the standard for adequacy of light and air and for these reasons the above criterion is satisfied. FWCC 20-2(5): Provide for water, sewage, drainage, parks and recreational areas, sites for schools and school grounds and other public requirements: to. As noted in the Findings of Fact, the project is served by adequate infrastructure. FWCC 20-2(6): Provide for proper ingress and egress: 11. According to staff, as conditioned, access to all lots wiJl comply with City design standards. FWCC 20-2(7): Provide for housing and commercial needs of the community: J 2. The project constitutes a development at urban densities and therefore satisfies the above criteria. FWCC 20-2(8): Require uniform monumenting of land divisions and conveyance of accurate legal descriptions: 13. FWCC 20-III(b) requires that the survey of the proposed subdivision must be made by or under the supervision of a registered land surveyor who shall certify that it is a true and correct representation of the land surveyed. This and other requirements like it help ensure that the objective of unifonn monumenting of land divisions and accurate legal descriptions are satisfied. CONSULTED DEPARTMENTS AND AGENCIES The following departments, agencies, and individuals were advised of this application. A. Community Development Review Committee (CDRC), consisting of the Federal Way Community Development Services Planning and Building Divisions; Public Works Engineering and Traffic Divisions; Parks, Recreation, and Cultural Resources Department; South King Fire and Rescue; Lakehaven Utility District; City of Tacoma; and Federal Way Public Schools. CDRC comments have been incorporated into this report where applicable. B. All property owners and occupants within 300 feet of the site were mailed notices of the complete preliminary plat application (Exhibit 4). The site was also posted and notice published in the newspaper and on the City's official notice boards. C. In accordance with the State Environmental Policy Act (SEP A) and FWCC Chapter l8, "Environmental Protection," all property owners and occupants within 300 feet ofthe site, and all affected agencies, were notified of the proposed action and the City's environmental decision. In addition, the site was posted and notice placed in the newspaper and on the City's official notice boards. III. STATE ENVIRONMENTAL POLICY ACT An Environmental Determination of Nons ign ificance (DNS) was issued by the City of Federal Way for the proposed action on September 15,2007 (Exhibit 5). This determination was based on review of information in the project file, including the environmental checklist (Exhibit 6), and staff evaluation of the environmental checklist for the Eagle Manor Subdivision (Exhibit 7), resulting in the conclusion that the proposal would not result in probable significant adverse impacts on the environment. No comments or appeals on the SEPA decision were submitted to the City. IV. NATURAL ENVIRONMENT A. Soils _ The 1973 King County soils survey map lists the soils type as AIderwood Gravelly Sandy Loam (AgB). Alderwood soils are characterized as moderately well drained soils that have a weakly consolidated to strongly consolidated substratum at a depth of24 - 40 inches. AgB soils are described as capable for urban development, runoff is slow, and erosion hazard is slight. Typical soils excavation will occur with the street construction, at the site of the proposed on-site water quality/flow control treatment facility, and for utility installation. The preliminary clearing and grading plan depicts clearing limits for construction of the following facilities: street right-of- way, surface water pond, demolition of existing structures, and utility development. B. Topography - Baima & Homberg, Inc., has prepared a conceptual storm drainage analysis for the project (January 10,2008, Exhibit 8). The soils characteristics are described in detail in the report. C. Vegetation _ The site is currently partially wooded with thick shrubbery. A mixture of conifer and deciduous trees reside on the property. A tree survey (Exhibit 1) was submitted with the application as part of the required landscape plan. There are a total of36 significant trees on the subject property. The applicant has proposed to remove 18 of these trees from the interior of the site for infrastructure. Pursuant to FWCC Section 22-1568, no tree replacement is required. City policy and FWCC Section 20-179 state that existing mature vegetation shall be retained to the maximum extent possible. Retained significant trees outside of open space areas would be regulated under FWCC Section 22-1568, "Significant Trees," at the time of individual home construction. D. Wetlands - There are no wetlands on site or within 200 feet of the subject property. No wetlands or surface waters are known to exist on or around the property, and no wetlands or streams are identified on the City's environmentally sensitive areas maps. E. Wildlife and Habitat - No wildlife species recognized as priority species are known to inhabit the site or the nearby vicinity. V. NEIGHBORHOOD CHARACTERISTICS Vicinity _ The property is situated in the southwestern portion of the City, in a single-family residential area with RS 7.2 zoning encompassing the subject property. The site is currently undeveloped. The land to the east is a developed single-family subdivision called Danville Station with a zoning ofRS 7.2. The properties directly north, west, and south are also single-family zoned (RS 7.2) and sparsely developed larger properties. VI. GENERAL DESIGN A. Density and Lot Size - Pursuant to FWCC Section 20-153, all lots in conventional subdivisions shall meet the density and minimum lot size requirements-in this instance, 7,200 square feet per lot. The proposed 12 lots each meet this minimum size. B. Lot Layout _ With the exception oflots 7 & 8, all ofthe proposed lots are of rectangular shape. The subdivision is accessed through 220dPlace SW, which connects to SW 344thStreet. All lots are then accessed directly by SW 344th Court. All building setback lines (BSBL) are depicted on the preliminary plat map, and each lot contains an adequate building area. A 20-foot-wide storm drainage easement runs east to west along the northern property line; however, the properties' (abutting the northern property line) buildable areas are outside of the easement and should not impact the easement. C. Open Space _ To provide adequate recreational opportunities commensurate with new residential development, FWCC Chapter 20, "Subdivisions," requires setting aside land on site for open space, or a fee in lieu payment. The applicant has proposed the fee in lieu option rather than providing on-site open space. Section VII of this report provides a detailed description ofthe proposed roadway system and improvements. E. A Type III landscape buffer 10' in width (Tract "A"/Exhibit 13) is provided for along the length of21 51 Avenue SW (east property line) in accordance to FWCC Section 20-178(a). VII. TRANSPORTATION A. Street Improvements - With the exception of lots 7 & 8, all of the proposed lots are of rectangular shape. The subdivision is accessed through nnd Place SW, which connects to SW 344th Street. All lots are then accessed directly by SW 344th Court. The City's Traffic Engineer has reviewed the project and concluded that the proposed street layout of the Eagle Manor subdivision is consistent with the adopted codes and comprehensive plan in place at the time of the complete application. 22nd Place SW, which connects to SW 3441h Street and SW 344th Court, shall be constructed to City Standard roadway section "W" as follows: a 28-foot paved roadway with curb and gutter, a four-foot planter strip with street trees, five-foot sidewalk, and a three-foot utility strip with streetlights, along all margins (52-foot right-of-way). The existing right-of-way width and pavement width appear to meet current standards; therefore, the applicant will be required to construct the planter strip, sidewalk, street trees, streetlights, and utility strip as a condition of this plat. Street frontage improvements along SW 3441h Street shall be constructed to a City standard Type "S" street section, consisting of a 36-foot paved roadway with four-foot planter strip with street trees, five-foot sidewalks, and three-foot utility strip with streetlights. Street lighting is required on all streets, pursuant to FWCC Section 22-1522. The Public Works Department and South King Fire and Rescue have approved preliminary roadway design and curve radii as proposed. Off-Site Traffic Mitigation - This proposal has been reviewed under the State Environmental Policy Act (SEPA). No mitigation for traffic impacts was identified in the SEPA review of the proposal. The complete application of this project predates city concurrency requirements. VIII. PUBLIC SERVICES A. Schools - As part of the City's initial review of the proposal, the preliminary plat application was referred to the Federal Way School District for comments. Comments from the school district indicate Sherwood Forest Elementary, IIlahee Jr. High School, and Todd Beamer Senior High School will serve the proposed subdivision. There is school bus transportation to all three schools. The proposed sidewalk from the development will provide safe access to bus stops. Bus stops are at: SW 344th Street and 24th Place SW (Sherwood Forest); 2ih Avenue SW and SW 344th Street (IIlahee); and 27th Avenue SW and SW 34Sth Court (Todd Beamer). B. The applicant provided on June 10, 2008, a School Access Analysis (Exhibit 10). The school access analysis identifies a safe path of travel for students walking to and from school. In summary, a safe route of school-related pedestrian travel will be provided by new pedestrian' pathways, of on average, five-foot asphalt walking path next to the driving surface. A full detailed analysis of each pedestrian pathway to the schools is provided for within the School Access Analysis. It should be noted, however; due to the distance created by the location ofthe new subdivision and the existing schools, it is highly unlikely that pedestrian travel will occur with any frequency. Final location and design of the school access path shall be approved by the Federal Way School District and the Federal Way Public Works Department prior to issuance of construction permits for infrastructure improvements. School service areas are reviewed annually and may be adjusted to accommodate enrollment growth and new development. School impact fees, as authorized by City ordinance and collected at the time of building permit issuance, are currently $4,077.00 per single-family housing unit. School impact fees are determined on the basis of the district's Capital Facilities Plan and are subject to annual adjustment and update. C. Parks & Open Space - The applicant has chosen to satisfy the open space requirement of FWCC Section 20-155 via a fee in lieu payment, which is recommended to be approved by the City of Federal Way Parks Director. The fee in lieu of open space payment shall be calculated on IS percent ofthe most recent assessed or appraised value of the property. D. Fire Protection - The Certificate of Water Availability from the Lakehaven Utility District indicates that water will be available to the site in sufficient quantity to satisfy fire flow standards for the proposed development. South King Fire and Rescue requires that a fire hydrant be located within 3S0 feet of each lot. The exact number and location of fire hydrants will be reviewed and approved by South King Fire and Rescue. IX. UTILITIES A. Sewage Disposal- The applicant proposes to serve the proposed plat by a public sewer system managed by Lakehaven Utility District. A December 29, 2006, signed Certificate of Sewer Availability (Exhibit 11) indicates the district's capacity to serve the proposed development through a Developer Extension Agreement (DEA) between the applicant and the district. Water Supply - The applicant proposes to serve the subdivision with a public water supply and distribution system managed by the Lakehaven Utility District. A December 29, 2006, signed Certificate of Water Availability (Exhibit 12) indicates Lakehaven's capacity to serve the proposed development. If additional hydrants or other fire protection systems are indicated, a Development Extension Agreement may be required. C. Drainage Facilities - Development of the site will create additional runoff from new impervious surfaces such as streets, driveways, and rooftops. Stonn drainage facilities are being designed in accordance with the 1998 King County Surface Water Design Manual (KCSWDM) and the City's amendments to the manual. The applicant's resubmitted January 10,2008, preliminary Conceptual Stonn Drainage Analysis (Exhibit 13) by Baima & Holmberg, Inc., was reviewed by the City's Public Works Department. Detention will be provided by an existing detention pond that serves the adjacent plat to the west, Virginia Hills. This pond will be modified and enlarged so that it can adequately serve both plats. It is located within a City-owned and maintained tract. The applicant will be dedicating additional property to the City to enlarge the tract. Detention will meet Level 1 flow control requirements. In addition, due to a downstream conveyance system nuisance flooding problem, the pond will be sized to provide further storage to avoid aggravating the problem. Water quality treatment meeting the Resource Stream Protection menu in the 1998 KCSWDM is required. The developer proposes a Stonnfilter cartridge system to meet this requirement. The system will be sized to meet treatment requirements for both the proposed plat and the plat of Virginia Hills, to replace the water quality function of the original pond that will be lost due to the proposed modifications. A landscape tract along the west and south sides of the new stormwater tract will be dedicated to the homeowners' association. The maintenance agreement for the private landscape tract shall be included on the face of the plat and the language shall be approved by the City. Final review of the stonnwater quality and detention pond will occur in conjunction with the plat improvement engineering plans. X. ANALYSIS OF DECISIONAL CRITERIA The FWCC establishes review procedures and decisional criteria for deciding upon various types of land use applications. Pursuant to FWCC Chapter 20, "Subdivisions," Section 20-110, preliminary plat applications are submitted to the Hearing Examiner for public hearing. The preliminary plat application and the recommendation of the Hearing Examiner are submitted to the City Council for approval or disapproval. Hearing Examiner Preliminary Plat Decisional Criteria - Pursuant to FWCC Section 20-126(c), the Hearing Examiner may recommend approval of the proposed preliminary plat only if the following decisional criteria are met. Decisional criteria and staff responses are provided below. 1. The project is consistent with the comprehensive plan. Staff Comment: The application is subject to the adopted 2003 Federal Way Comprehensive Plan (FWCP), which designates the property as Single Family - High Density. The proposed land use, Single-Family Residential plat, with 7,200 square-foot minimum lot size (RS-7.2), is consistent with density allowances and policies applicable to this land use as established in the FWCP. LUPI4: Maintain and protect the character of existing and future single-family neighborhoods through strict enforcement of the City's land use regulations. b. LUPI7: Encourage the development of transportation routes and facilities to serve single- family neighborhoods. Special attention should be given to pedestrian circulation. 2. The project is consistent with all applicable provisions of the chapter, including those adopted by reference from the comprehensive plan. Staff Comment: The preliminary plat application is required to comply with the provisions ofthe FWCC Chapter 18, "Environmental Policy"; Chapter 20, "Subdivisions"; Chapter 22, "Zoning"; and all other applicable codes and regulations. Future development of the residential subdivision will be required to comply with all applicable development codes and regulations. As proposed, and with conditions as recommended by staff, the preliminary plat will comply with all provisions of the chapter. 3. The project is consistent with the public health, safety, and welfare. Staff Comment: The proposed preliminary plat would permit development of the site consistent with the current Single Family - High Density land use classification of the FWCP and map. Proposed access and fire hydrant locations must meet all requirements of South King Fire and Rescue. Future development of the plat in accordance with applicable codes and regulations will ensure protection of the public health, safety, and welfare. 4. It is consistent with the design criteria listed in Section 20-2. Staff Comment: The proposed preliminary plat would promote the purposes identified in FWCC Section 20-2, and the standards and regulations therein, as identified in the staff report, including effective use ofland, promotion of safe and convenient travel on streets, and provision for the housing needs of the community. As proposed, and with conditions as recommended by City staff, the preliminary plat application complies with all provisions of the chapter. S. It is consistent with the development standards listed in Sections 20-] 51 through 157, and 20-158 through 187. Staff Comment: Development of this site is required to comply with the provisions of FWCC Chapter 18, "Environmental Protection"; Chapter 20, "Subdivisions"; Chapter 22, "Zoning"; and all other applicable local and state development codes and regulations. As proposed, and as recommended by City staff, the preliminary plat application complies with all applicable statutes, codes, and regulations. XI. FINDINGS OF FACT Based on an analysis of the proposed action, environmental record, and related decisional criteria, the Department of Community Development Services finds that: 1. The proposal includes the subdivision of 3.11 acres into 12 residential single-family lots and a private stormwater detention facility. 2. The preliminary plat application is subject to the 2003 FWCP, and the codes and regulations in effect at the time the application was deemed complete, which was January 17,2007. The subject property is designated Single Family -High Density in the 2003 FWCP. 4. An Environmental Determination of Non significance (DNS) was issued for this proposed action on August 22, 2007. No appeals of the SEPA decision were submitted to the City. 5. Zoning for the site is RS-7.2 (minimum lot size 7,200 square feet). Properties to the north, east, south, and west of the subject property are also zoned RS 7.2. The proposed residential subdivision and density is consistent with applicable zoning and subdivision regulations. 6. Pursuant to FWCC Section 20-153, on this 3.1 I-acre parcel, the 12 proposed lots comply with applicable density requirements. 7. As proposed, each lot contains an adequate size and shape building envelope to contain a future single-family residence. Building setback lines (BSBL) are identified on the preliminary plat map. 8. A significant tree survey was submitted with the application. There are a total of 36 significant trees on the subject property. The applicant has proposed to remove l8 of these trees from the interior of the site for infrastructure. Pursuant to FWCC Section 22-1568, no tree replacement is required. City policy and FWCC Section 20-179 state that existing mature vegetation shall be retained to the maximum extent possible. Retained significant trees would be regulated under FWCC Section 22-1568, "Significant Trees," at the time of individual home construction. 9. Development of the site will create additional runoff from new impervious surfaces such as streets, driveways, and rooftops. Storm drainage facilities are being designed in accordance with the 1998 KCSWDM and the City's amendments to the manual. The applicant's preliminary Conceptual Storm Drainage Analysis by Baima & Holmberg (resubmitted January 10, 2008), has been reviewed and has been preliminarily accepted by the City's Public Works Department. Detention will be provided by an existing detention pond that serves the adjacent plat to the west, Virginia Hills. This pond will be modified and enlarged so that it can adequately serve both plats. It is located within a City-owned and maintained tract. The applicant will be dedicating additional property to the City to enlarge the tract. Detention will meet Levell flow control requirements. In addition, due to a downstream conveyance system nuisance flooding problem, the pond will be sized to provide further storage to avoid aggravating the problem. Water quality treatment meeting the Resource Stream Protection menu in the 1998 KCSWDM is required. The developer proposes a Storm filter cartridge system to meet this requirement. The system will be sized to meet treatment requirements for both the proposed plat and the plat of Virginia Hills, to replace the water quality function of the original pond that will be lost due to the proposed modifications. The City's Traffic Engineer has reviewed the project and concluded that the proposed street layout ofthe Eagle Manor subdivision is consistent with the adopted codes and comprehensive plan in place at the time of the complete application. 21st Avenue SW is considered an arterial street. 11. Water and sewer facilities are available from the Lakehaven Utility District and are adequate to serve the proposed development. It is the applicant's responsibility to secure all necessary water and sewer services from the utility provider. ] 3. The applicant has chosen to satisfy the open space requirement of FWCC Section 20-155 via a fee in lieu payment, which has been recommended for approval by the City of Federal Way Parks Director. The fee in lieu of open space payment shall be calculated on IS percent of the most recent assessed or appraised value of the property at the time of final plat approval. ] 4. The proposed preliminary plat is permitted by FWCC Chapter 20, "Subdivisions," and Chapter 22, "Zoning." 15. The proposed subdivision and all attachments have been reviewed for compliance with the FWCP; FWCC Chapter 18, "Environmental Protection"; Chapter 20, "Subdivisions"; Chapter 22, "Zoning"; and all other applicable codes and regulations. As proposed, and recommended by staff, the preliminary plat is consistent with the FWCP and all applicable codes and regulations. 16. Prior to final plat approval and recording, all required and approved improvements will be constructed, or the improvements appropriately bonded, per City code requirements. XII. RECOMMENDATION Based on review of this application, environmental record, and pertinent decisional criteria, the Department of Community Development Services recommends approval of the preliminary plat subject to the following conditions: 1. Final plat approval shall require full compliance with drainage provisions set forth in the FWCC. Compliance may result in reducing the number and/or location of lots as shown on the preliminary approved plat. Final storm drainage engineering plans shall comply with the following: A. Drainage plans and analysis shall comply with the 1998 KCSWDM and amendments adopted by the City of Federal Way. City of Federal Way approval of the drainage and roadway plans is required prior to any construction. B. Level 3 flow control may be provided, or the engineer may instead meet the requirements for a Levell flow control "Type] Conveyance System Nuisance Problem" as outlined in Table 1.2.3.A in the 1998 KCSWDM. 2. The proposed subdivision shall comply with the current City of Federal Way Public Works Development standards for this project, including the following requirements: A. Road A (22nd Place SW) and Road B (SW 344lh Court) shall be constructed to City Standard roadway section "W" as follows: a 28-foot paved roadway with curb and gutter along all margins, a four-foot planter strip with street trees, five-foot sidewalk, and a three-foot utility strip with streetlights, all within a 52-foot right-of-way. Street lighting is required on all streets, pursuant to FWCC Section 22-1522. 3. Clearing for the construction of the plat improvements (roads, pond, and utilities) shall be generally consistent with the clearing limits depicted on the Preliminary Road Grading, Storm Drainage, and Utility Plan, which was prepared by the applicant for the preliminary plat process. The clearing limits referenced above are the approximate clearing limits necessary for road, utility, pond, and necessary lot grading, and may be modified with the approval of the Community Development and Public Works Departments during final engineering plan review as required to reflect changes in road and utility designs, if any. 4. The City requested Level 3 Flow Control for this project, upgrade the conveyance system in question to provide adequate conveyance capacity, or provide additional analysis that demonstrated that there was not a conveyance problem Hydraulics consultant, Ed McCarthy, was contracted to review the existing analysis of the system to see if there was a problem. Ed McCarthy principally reviewed a hydraulic study referenced and contained in the Saghalie Firs Technical Information Report (July 2006). The analysis was prepared by Taylor Engineering Consultants (July 1998) using the City's SWMM hydraulic model of the conveyance system. Ed McCarthy talked to Lorna Taylor in some detail about the modeling for the conveyance system downstream from Eagle Manor. She did the SWMM modeling for the downstream system for the Courtyard Village project. She based the Courtyard Village model on the City's SWMM model that was used to develop their comprehensive drainage plan. She also developed the City's SWMM model while she worked for KCM, prior to Taylor Engineering. Having worked on the City's comprehensive drainage plan, she was familiar with the basin. She says that the conveyance system near the Fred Meyers has flooded in the past, that the flooding is not just a model prediction. Levell Downstream Drainage Analysis Runoff from the site drains east to the adjacent stormwater pond (B) or into the west gutter of 21 st Avenue SW (A). A 42" pipe/CD storm system along the west side of 21 st Avenue SW picks up these flows and conveys them about 505' north though a flat- gradient 42" pipe (at 0.6% to 0.8%) where the pipe becomes 36" with a steeper gradient (1.5% to 2.8%)(C). This 36" pipe continues another 1315' north where it becomes a 48" pipe (0.5% to 1.2%)(D). This 48" pipe continues north 230' where it turns east (E), crossing 21st Avenue SW, then continues east through the Fred Meyer packing lot (F), well beyond ~ mile downstream from the site. This conveyance system apparently continues east approximately 600' through the Fred Meyer parking lot, tuning north (G), then about another 600' north to SW Campus Drive (H), then downhill to the east and southeast, possibly along SW Campus Drive (I) about 1 mile to Panther Lake and the regional stormwater facility-approximately 1.75 miles downstream from the site (J). According to the SWM Engineer with the City, there are apparently no drainage problems along this downstream drainageway, except for a possible surchrarging problem to the east of Fred Meyer, not within the downstream conveyance path, but possibly caused by surcharging in the main storm line in the area of (G). SECTION 4 FLOW CONTROL AND WATER QUALITY FACILITY ANALYSIS AND DESIGN .. ~;~':'~O~k I~ Additional Evaluation of Reported Downstream Problems After the initial Level 1 downstream analysis was conducted, Baima & Holmberg, Inc. was alerted by City staff to possible drainage conveyance problems of the storm drain system immediately downstream of the confluence of the 21st Ave SW system and the 19th Ave SW system (downstream of Fred Meyer), approximately 3/8 ofa mile downstream from the site. The City requested Level 3 Flow Control for this project, upgrade the conveyance system in question to provide adequate conveyance capacity, or provide additional analysis that demonstrated that there was not a conveyance problem Hydraulics consultant, Ed McCarthy, was contracted to review the existing analysis of the system to see if there was a problem. Ed McCarthy principally reviewed a hydraulic study referenced and contained in the Saghalie Firs Technical Information Report (July 2006). The analysis was prepared by Taylor Engineering Consultants (July 1998) using the City's SWMM hydraulic model of the conveyance system. Ed McCarthy talked to Lorna Taylor in some detail about the modeling for the conveyance system downstream from Eagle Manor. She did the SWMM modeling for the downstream system for the Courtyard Village project. She based the Courtyard Village model on the City's SWMM model that was used to develop their comprehensive drainage plan. She also developed the City's SWMM model while she worked for KCM, prior to Taylor Engineering. Having worked on the City's comprehensive drainage plan, she was familiar with the basin. She says that the conveyance system near the Fred Meyers has flooded in the past, that the flooding is not just a model prediction. In conclusion, the developer has agreed to provide Level 3 Flow Control for the Eagle Manor project. The City reserves the right to reject the maintenance firm if it is deemed not qualified for this type of maintenance activity. A sample maintenance agreement can be obtained from the City. 2. Use of the StormFilters will only be permitted on private, commercial sites. Use in residential facilities, private or public, will not be allowed unless directed by the City. 3. The applicant must further allow the manufacturer and/or the City access to the device for water quality testing if deemed necessary by either. Test results will not be used to support a case for requiring removal and replacement of the device by the developer or subsequent. If appropriate, test results may be used to encourage expansion or modification in accordance with the manufacturer's recommendations for better treatment results. 4. The design for Resource Stream Protection will utilize a pre-settling device such as a StormCeptor, StormGate Separator, or other acceptable alternative in advance of the StonnFilter and must be capable of bypassing high flows around the treatment system. To accommodate this flow rate, CONTECH Stormwater Solutions recommends using an 8'x16' Storm Filter with 17 cartridges (see attached detail). The estimated cost of this system is $46.000, complete and delivered to the job site. This estimate assumes that the vault is 6 feet deep. The final system cost will depend on the actual depth of the units and whether extras like doors rather than castings are specified. The contractor is responsible for setting the Storm Filter and all external plumbing. Typically the precast Storm Filters have internal bypass capacities of 1.8 cfs. If the peak discharge off the site is expected to exceed this rate, we recommend placing a high-flow bypass upstream of the StormFilter system. BACKGROUND At the beginning of each calendar year, the Planning Commission's Work Program for that year is approved by the City Council. The Planning Commission Work Program consists of both zoning code amendments (modifying existing codes or adopting new ones) and amending the comprehensive plan. The City Council adopted the 2008 Planning Commission Work Program on January 15,2008. At that time the Work Program consisted of the following. A. ITEMS STARTED IN 2007 AND CARRIED OVER INTO 2008 1. Significant Trees, Vegetation Retention, Clearing, and Grading - This involves a review of and amendment to the current City of Federal Way zoning and subdivision code requirements related to the preservation of significant trees, vegetation retention, and site grading. 2, South 35(/h Subarea Plan - This is a study to determine whether the Single-Family Residential (RS) 15,0 designated parcels located south of SW 356th Street and west of 151 Avenue South should be considered for higher density, B. NEW ZONING CODE AMENDMENTS 1. Increase the building height in all commercial zones. 2. Delete the 120-foot maximum fa~ade length requirement of the Community Design Guidelines. As buildings become taller, there is a need for them to be longer and wider in order to retain appropriate bulk and scale. 3. Reduce how open space requirements are met in the City Center-Core (CC-C) and City Center-Frame (CC-F) zones. The present open space requirement for residential development precludes efficient use of a site. This has become evident with the recent Symphony development. 4. Delete the maximum allowable density for senior housing in the Community Business (BC) zone. There is no maximum density requirement in other commercial zones (CC-C and CC- F) which allow senior housing. In addition, other development standards, such as maximum height, required parking, landscaping, and water detention requirements are sufficient to cap density, 5. Amend Federal Way City Code (FWCC) Chapter 20, "Subdivisions," and Chapter 22, "Zoning," to incorporate Low Impact Development (LID) techniques, The City has recently received technical assistance from the Puget Sound Partnership, which will be in the form of reviewing our codes and proposing code amendments to implement LID techniques. 6. Allow home occupation day cares in an existing nonconforming residential dwelling in commercial zones. This amendment is required to comply with state law. Also, re-examine the home occupation provisions for clarity and applicability in more unique situations, such as adult family homes. 7. Allow the Director of Community Development Services the flexibility to determine the allowable hours of construction on a case-by-case basis. Presently, work is not allowed under any circumstance before 9:00 a,rn, and after 8:00 p.rn, on Sundays and holidays. However, there is sometimes a reason to grant permission to work at these times; for example, the Department of Transportation may need to engage in construction around the clock, 8. Adopt regulations allowing storage containers (cargo containers) in non-residential and/or residential zones. The code is silent on allowing this use and there has been inquires about the use of containers, more commonly on commercial property and to a lesser extent on residential property. 9, Allow churches in all zones. Currently, churches are allowed in all residential zones and the BC, CC-C, and CC-F zones, but not in the Neighborhood Business (BN), Professional Office (PO), Commercial Enterprise (CE), or Office Park (OP) zones. 10. Allow off site signs, such as banners and kiosks, in order to better publicize major events in our city, such as the Federal Way Symphony concerts; Festival Days events; Red, White, and Blue Festival; Centerstage plays; Han Woo Ri; etc. 11. Remove the notice requirements for Social Service Transitional Housing. Presently this use is subject to a Process III review, which requires pubic notice in the paper; posting the site and public notice boards (City Hall and public libraries); and notifying all property owners within 300 feet ofthe site. Request from Ms. Trinh Nguyen to change the comprehensive plan designation and zoning of two lots totaling 0.3 acres located at the southwest corner of the intersection of South 288th Street and 18th Avenue South, from Multi-Family and Multifamily Residential (RM 3600 - one unit per 3,600 square feet) to Community Business and BC zoning. There are also housekeeping amendments that will be made to chapters of the comprehensive plan. In addition, we have recently been notified by the City of Des Moines (Exhibit A) that the City of Federal Way is required to change the comprehensive plan designation and zoning of property located east of 15th Avenue South (Exhibit B) per a settlement agreement between Granville Southern Corporation, Donald and Marie Tavis, and the Cities of Des Moines and Federal Way entered into in August 2000. II. STATUS OF THE WORK PROGRAM After beginning work on the code amendments, it appeared to be more efficient to combine certain of them. In addition, work items not previously approved as part of the Planning Commission Work Program have arisen. The following table describes how items are proposed to be combined and it also lists the new work items. In order to settle the litigation, The Cities of Des Moines and Federal Way, along with Granville Southern entered into a settlement agreement. The project remained dormant until 2006 when the City of Des Moines was contacted by the new owners of the property and project, Pacific West LLC, to discuss the steps needed to complete the Pacific Place project, which was later renamed Pacific Heights. In March of 2008, the Des Moines . City Council approved the preliminary plat for Pacific Heights, However, approval of the preliminary plat did not fulfill all of the terms of the settlement agreement between the Cities of Des Moines and Federal Way and Granville Southern, As part of the agreement the Cities agreed to change the zoning classification of the property to RA-360Q pursuant to Item 1. The City of Des Moines conducted the required public hearing for the zone recHissification for. the portion of the site within Des Moines on June 26, 2008 and the City Council approved Ordinance Number 1431 (enclosed) amending the official zoning map changing the zoning classification from RS-7200 to RA-3600 for that portion of the Granville site within the City of Des Moines. The zoning classification for the portion of the site within City of Federal Way must also be changed in accordance with the settlement agreement. During the public hearing for the zoning reclassification, the Des Moines City Council asked staff to confirm that Federal Way is also proceeding with the required zoning reclassification. Please provide the approximate date by which the zoning reclassification will be presented to the Federal Way City Council so we can keep our City Council informed.
