However, the State law only authorizes the position of Chief Administrative Officer ("CAO'�. In those cities with a CAO, their codes do establish minunal qualifications and authority/duties. The discussion points for the January 5, 2010, Special Meeting are: (1) City Council powers ancl related matters; (2) the Mayor's authority, whether City Council desires to confirm appointments of certain positions, and related matters and (3) the CAO position and related matters. It is well established that entities, such as the City, which are created by State law cannot expand nor reduce statutory powers/authority. Additionally, a basic tenet in drafting legislation is to use broader language instead of specific language. Othenvise, an issue mayl arise that is not addressed in the specific language. Lastly, the City's formatting in the Federal Way Revised Code incorporates State law by reference wherever possible in an effort to be consistent, to remain updated when State 1aw changes, to avoid redundanry, and to avoid misinterpretarions. CITY COUNCIL The City Council's statutory powers are attached in the list entitled "City Council Statutory Powers". Also, attached is a table comparing code provisions in cities in the Puget Sound area with populations of 50,000 or more plus Auburn. Lasdy, are copies of Kent's and Renton's code provisions addressing council matters? Also, attached is a clraft, proposed ordinance for Council discussion and direction. It is anticipated that an ordinance regarding Council will be presented for First Reading at the January 19, 2010, City Council meeting. 1 The Mayox's salary will be addressed on January 19, 2010 when Council will discuss the process. 2 Kent's and Renton's codes follow the City's format of referencing State law when applicable. MAYOR The Mayor's statutory authority and duties are attached in the list entitled "Mayor's Statutory Authority Duties". Also attached is a table comparing code provisions in cities in the Puget Sound area with populations of 50,000 or more plus Auburn. Lasdy, are copies of Kent's and Renton's code provisions addressing the mayor and related matters. It might be helpful to review the statutory authority of the city manager in the current form of government to illustrate how FWRC did not address every duty, and a chart to compare the authority of elected mayor and city manger. To that end attached is a list entided "Ciry Manger Statutory Authority and Duties" and table enutled "Comparison of Statutory Authority and Duties". The following are discussion points that Council may want to address: 1. Confirmation of Mayoral A��ointments. Renton is the only city surveyed that confirms mayoral appointments. The code provision under the Mayor sets forth a process and timeline for council confirmation, and references those positions via another secuon of their code. 2. Mayor's hours. Four of the five cities on the table establish the mayor's hours. Auburn adds that the office hours are to be in city hall. A proposed ordinance regarding the Mayor is not attached because of the identified discussion points and because the discussion concerning the process for the Mayor's salary will be before Council on January 19, 2010. As a result, the timing for the presentation of a proposed ordinance regarding the Mayor will occur in the future depending upon Council decisions and direction. CHIEF ADMINISTRATIVE OFFICER Under the Mayor-Council form of government, State law authorizes the position of a Chief Administrative Officer ("CAO'� or an assistant administrative officer if set out in an ordinance. Of the five cities used for comparison above, only Auburn does not have a CAO. The salary of the CAO among the four cities ranges from $116,616 to $163,248 per year. Attached is a table that addresses the salary ranges and the code provisions setting forth the qualifications and duties in each city. Also attached are the copies of Kent's and Renton's codes. Even though the codes set forth the qualifications and duties, all of the cities (except Everett regarding qualifications) have more detailed job descriptions. The attached two-page table shows the detail applied in the positions descriptions. Lasdy, to assist Council attached is a sample position description for illustrative purposes that Human Resources created. The threshold yuestion for Council to address is whether to authorize the position of Chief Administrative Officer. If Council does authorize the position, then Council may want to address: (1) the qualificarions; and (2) the duries to be set out in the FWRC. If directed by Council, Staff will then prepare a proposed ordinance for First Reading at the following City Council meeting. Meeting location_ The regular and other meetings of the city council shall be held in the council chambers at the Gity Hall unless atherwise designated by majority of the city council at a regular or special meeting. B. Regular meeting date and time. The regular meetings shall be held on the first and third Tuesday of each month, except that during the month of December of each year, there shall be only one (1) regular council meeting to be held on the second Tuesday of said month. The City of Renton is a noncharter code city under the laws and statutes of the State, and its City Council shall consist af seven (7) members who sha{I be elected at large. B. The President or majority of inembers of the City Council may hold executive sessions during a regular or special meeting: 1. To consider matters affecting national security; 2. To consider the selection of a site or the acquisition of real estate by lease or purchase when public knowledge regarding such consideration could cause a likelihood of increased price; 3. To consider the minimum price at which real estate will be offered for sale or iease when public knowledge regarding such consideration would cause a likelihood of decreased price. However, final action selling or leasing public praperty shall be taken in a meeting open to the public; 4. To review negotiations on the performance of publicly bid contracts v�rhen public knowledge regarding such consideration would cause a likelihood of increased costs, 5. To consider, in the case of an export trading company, financial and commercial information supplied by private persons ta the export trading company; 6. To receive and evaluate complaints or charges brought against a public officer or $mployee. However, upon the request of such o�cer or employee, a public hearing or a meeting open to the public shall be conducted upon such complaint or charge; 7. To evaluate the qualifications of an applicant for public employment or to review the performance of a public employee. However, subject to RCW 42.30.1.40(4), discussion by a governing body of salaries, wages and other conditions of employment to be generally applied within the agency shall occur in a meetir�g open to the public, and when a governing body elects to take final action hiring, setting the salary of an individual employee or class of employees, or discharging or disciplining an employee, that action shall be taken in a meeting open to the public; 8. To evaluate the qualifications of a candidate for appointment to elective office. Executive sessions, ta the extent permitted by law, shaU be limited to members of the City Council unless the presence of nonmembers is requested by a majority of City Council members. B. Except as otherwise provided for herein, all regular ar speciai Council meetings shall be open to the public as set forth in RCW 42.30.010 et seq. No official action shall be taken at any executive session, as herein specified; provided, however, that nothing herein shall be deemed to prevent the taking of an informal vote on any matter under discussions. C. In the event of any executive session as hereinabove specified, no member of the City Council, employee of the City, or any other person present during executive session of the City Council, shalf disclose to any person the content or substance of any discussion or action which took place during said executive session, unless a majority of the City Council shall authorize such disclosure. D. Before convening in executive session, the presiding officer of a goveming body shall publicly announce the purpose for excluding the public from the meeting place, and the time when the executive session will be concluded. The executive session may be extended to a stated later time by announcement of the presiding o�cer. (Ord. 4136, 3-7- 88) 1-5-3 CONFLICT OF INTEREST, DISQUALfFICATION, EXEMPTtONS; VOTING REQUIREAAENTS: A. No member af the City Council shall be beneficially interested, directly or indirectly, in any contract which may be made by, through or under the supervision or direction of the City Council, in �nrhole or in substantial part, and as otherwise provided for in Chapter 6 of Title 1(Administrative) of Ordinance No. 4260 entitled "Code of General Ordinances of the City of Renton" (generally referred to as the City's "Code of Ethics" ordinance), or as otherwise regulated by any other law, rule or regulation pertaining to Municipal officers. B. In the event of any private interest by such Councilman, he shall be required to make the disclosures as set forth in Section 1-6-7 af said Code of Ethics Qrdinance. Upon disclosure of such private or personai interest the Councilman so disqualified shall promptly leave his seat during the debate or discussion and vote on such matter and leave the Council chambers until the total subject matter in which he has such personal or private interest has been disposed of. A Councilman stating such disqualification shall not be counted as a part of a quorum and shall be considered absent for the purpose of determining the outcame of any vote on such matter. {Ord. 2897, 12-16-74) 1-5-4 EXEMPT[ON FROM OPEN'PUBUC MEETINGS ACT: The provisions of the Open Public Meetings Act shall not apply to any meeting attended by less than a majority of the members of the City Council in which no final action is taken or commitment made. All preliminary decisions or recammendations made by any such committee consisting of less than a majority of the City Council members shall be submitted in due course to the City Council at a regular ar special meeting far final action. Notwithstanding the foregoing, the chairman of any such subcommittee consisting of less than a majority of all the Councilmen elected, shal! have discretion to allow members of the public to attend and/or participate in any such committee meeting. AN ORDINANCE of the City of Federal Way, Washington, re}ating to the Powers of the City Council; Adding A New Chapter 2.08 to the Federal Way Revised Code. WHEREAS, the City of Federal Way, Washington was formed in February 1991 as a noncharter code city under Chapter 35A.13 RCW, Council-Manager form of government; and WHEREAS, a petition sufficient in form and signatures was previously filed with the City Clerk of the City of Federal Way petitioning that the City of Federal Way abandon its Chapter 35A.13 RCW noncharter code city Council-Manager ("Council-Manager") form of government and reorganize as a Chapter 35A.12 RCW noncharter code city Mayor-Council ("Mayor-Council") form of government; and WHEREAS, pursuant to Resolution No. 09-554, the issue of reorganization was submitted to the registered voters of the City of Federal Way in a general election held on November 3, 2009; and WHEREAS, the King County Elections Office has certified the November 3, 2009, election results to the City of Federal Way showing that a majority of the votes casted were in favor of reorganization of the City of Federal Way as a Mayor-Council form of government; and WHEREAS, pursuant to said election results the City of Federal Way shall abandon its current Council-Manager form of government and reorganize as a Mayor-Council form of government as provided in RCW 35A.06.060; and WHEREAS, the reorganization of the City of Federal Way as a Mayor-Council form of government shall not take effect until the election, qualification and assumption of office under RCW 35A.020.050 of the Mayor under the Mayor-Council form of government, and Ordinance No. 09- Page 1 of 4 Rev 7/09 WHEREAS, RCW 35A.12 provides statutory construction regarding the organization ofthe City of Federal Way and the powers and/or duties of certain officials that may be set forth in the Federal Way Revised Code. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Chapter 2.08 is hereby created in the Federal Way Revised Code to add the following new sections as follows: Chapter 2.08 CITY COUNCIL 2.08.010 Number of Council Members. (11 The City of Federal Way is a noncharter code citv under the laws of the State, and its City Council shall consist of seven f 7} members who shall be elected at large. 2.08.020 Powers and Duties of Covncil Members. (1) The�owers and duties of the Council Members shall be those prescribed in RCW 35A.12.010 et seq., and as otherwise provided bYlaw. 2.08.030 Salaries. 1) The salaries of the Council members shall be set bv the Independent Salary Commission. Section 2. Severabilitv. Should any section, subsection, paragraph, sentence, clause, or phrase of this chapter, or its application to any person or situation, be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this chapter or its application to any other person or situation. The City Council of the City of Federal Way hereby declares that it would have adopted this chapter and each section, subsection, sentence, clauses, phrase, or portion thereof, irrespective of the fact that any one or more Ordinance No. 09- Page 2 of 4 Rev 7/09 sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. Section 3. Corrections. The City Clerk and the codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the correction of scrivener/clerical enors, references, ordinance numbering, section/subsection numbers and any references thereto. Section 4. Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. Section 5. Effective Date. This ordinance shall take effect when the elected mayor assumes o�ce pursuant to RCW 35A.02.050 as provided by law.
