ORD 10-650ORDINANCE NO. 10-650 AN ORDINANCE of the City of Federal Way, Washington, relating to Campaign Contributions; creating a new Chapter 2.07. WHEREAS, campaign finance reform measures taking the form of mandatory candidate contribution limits have been adopted by the cities of Seattle, Kirkland, Issaquah, and similar restrictions have been in place at King County, State and Federal levels for some time; and WHEREAS, it is the best interest of the citizens that political campaign contributions and expenditures be fully disclosed and secrecy avoided; and WHEREAS, the public confidence in municipal government is essential and must be promoted by all possible means; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. Title 2 of the Federal Way Revised Code is hereby amended to add a new section 2.07 to read as follows: 2.07.010 Declaration of policv. It is declared to be the public policy of the citv: (1) That political campai�n contributions and expenditures are to be fullv disclosed to the public and that secrecv is to be avoided. (2) That the people have the ri t to expect from their elected representatives at all levels of government the utmost inte�ritv, honesty and fairness in their dealin�s. (3) That the people shall be assured that the private financial and other dealings of their public officials, and of candidates for those offices, present no conflict of interests Ordinance No.10-650 Page 1 of 5 between the public trust and private interests. (4) That our representative form of �overnment is founded on a belief that those entrusted with the offices of �overnment have nothin� to fear from full public disclosure of their financial and business holdingL, activities and dealings, provided those officials deal honestly and fairlV with the �eople. (5) That public confidence in municipal �overnment can best be sustained bv assuring the people of the impartiality and honestv of the officials in all public transactions and decisions. (6) The provisions of this section shall be liberallv construed to promote complete disclosure of all information respectin� the financin� of p_olitical campaigns so as to assure continuing public confidence of fairness of elections, so as to assure that the public interest will be fullYprotected. 2.07.020 Definitions. For purposes of this chapter definitions found in RCW 42.17.020 as currently enacted or as hereafter amended are herebv adopted bv reference. In adoptin� these definitions bv reference the citv also adopts the interpretation of these definitions published in Chapter 390-05 WAC or otherwise issued bv the Washington State Public Disclosure Commission through declaratory orders, policy statements and commission interpretations. 2.07.030 Application. These limits shall applv to candidates in an�primary, general or special election for the Federal Way citv council and the ma�r. Ordinance No.10-650 Page 2 of 5 2.07.040 Contribution limits. (1) No candidate for citv council or mayor shall acce_pt or receive during the election cvcle campai�n contributions totalin� more than the contribution limit established bv the Public Disclosure Commission for countv office candidates in King Count� the aggregate from any person. (2) The per-election contribution limit established bv the Public Disclosure Commission for county office candidates in King County shall be the election-cvcle contribution limit on candidates for the Federal Wav city council and mavor. (3) The limitations in this section shall not applY to: (a) A candidate's contributions of his/her own resources to his/her own campaig� (b) The value of volunteer services; (c) Any publicly donated funds under provisions authorizin�public funding of local campaigns; and (d) Surplus funds as defined in RCW 42.17.020(481, from a candidate's prior campaign contributions received bYa candidate in connection with a current campai�i onlv to the extent that such funds are derived from contributions that were within the dollar limitations imposed by this chapter. If such funds are from a campaign not covered by this chapter, a candidate mav use onl ��so much of each contribution previously received as would have been allowable as a contribution under this chapter if it had a�plied to that campaign. The source of the candidate's surplus funds shall be determined to be derived Ordinance No.10-650 Page 3 of 5 from the most recent contributions received by such candidate or that candidate's political committee which in total equal the amount of the surplus funds. (4) The limitations imposed by this section shall a�plv to all other contributions. 2.07.050 Adiustment of dollar amounts in chanter — Adherence to Public Disclosure Commission established limits and schedule. (1) The amount of the contribution limit is adiusted to reflect periodic adjustrnents made bv the Public Disclosure Commission for countYoffice candidates in King County. The timin� of the limitation changes shall take place as published bv the Public Disclosure Commission and shall from that time forward form a new limit on contributions. Section 2. Severabilitv. Should any section, subsection, paragraph, sentence, clause, or phrase of this chapter, or its application to any person or situation, be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this chapter or its application to any other person or situation. The City Council of the City of Federal Way hereby declares that it would have adopted this chapter and each section, subsection, sentence, clauses, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions be declared invalid or unconstitutional. Section 3. Corrections. The City Clerk and the codifiers of this ordinance are authorized to make necessary corrections to this ordinance including, but not limited to, the conection of scrivenerlclerical errors, references, ordinance numbering, section/subsection numbers and any references thereto. Ordinance No.10-650 Page 4 of 5 Section 4. Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. Section 5. Effective Date This ordinance shall take effect and be in force January 1, 201 l, as provided by law. PASSED by the City Council of the City of Federal Way this 16�' day of March, 2010.
